काकाकाका....आआआआ.... 3233 (अ)3233 (अ)3233 (अ)3233 (अ)....--------जबकि, केन्द्रीय सरकार ने, राष्ट्रीय अन्वेषण अभिकरण अधिनियम, 2008 (2008 का 34) (जिसे इसके बाद उक्त अधिनियम के रूप में संदर्भित किया गया है) की धारा 11 की उप-धारा (1) के अंतर्गंत प्रदत्त शक्तियों का प्रयोग करते हुए, अनुसूचित अपराधों के विचारण के लिए उक्त अधिनियम की धारा 11 की उप-धारा (1) के प्रयोजनार्थ वरिष्ठतम अपर जिला एवं सत्र न्यायाधीश, सिलीगुड़ी को 29 अप्रैल, 2011 को भारत के राजपत्र, असाधारण, भाग-II, खण्ड-3, उप-खण्ड (ii) में प्रकाशित 29 अप्रैल, 2011 की अधिसूचना संख्या का. आ. 951(अ) के तहत विशेष न्यायालय के रूप में अधिसूचित किया था, जिसका क्षेत्राधिकार पश्चिम बंगाल के दार्जिलिंग, जलपाईगुड़ी तथा कूच बिहार जिलों की सीमा तक था;
और जबकि, श्रीमती सुब्राता हाजरा (साहा), अपर जिला एवं सत्र न्यायाधीश, फास्ट ट्रैक कोर्ट-2, बसीरहाट, 24 परगना (नॉर्थ), जिन्हें, दिनांक 16 जुलाई, 2012 की अधिसूचना संख्या का.आ. 1589 (अ) के तहत उक्त विशेष न्यायालय की अध्यक्षता करने के लिए न्यायाधीश के रूप में नियुक्त किया गया था, स्थानान्तरण हो गया है;
अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा-11 की उप-धारा (3) के अंतर्गत प्रदत्त की गई शक्तियों का प्रयोग करते हुए तथा दिनांक 16 जुलाई, 2012 की अधिसूचना संख्या 1589 (अ) का अधिक्रमण करते हुए, सिवाय उन कार्यों के जिन्हें ऐसे अधिग्रहण के पूर्व सम्पादित कर लिया गया था अथवा करने के लिए छोड़ दिया गया था, और कोलकाता उच्च न्यायालय की सिफारिशों पर श्रीमती चन्द्राणी मुखर्जी (बनर्जी), अपर जिला तथा सत्र न्यायाधीश, सिलीगुड़ी, दार्जिलिंग को एतद््द्वारा, उक्त विशेष न्यायालय की अध्यक्षता करने के लिए न्यायाधीश के रूप में नियुक्त करती है ।

NOTIFICATION
New Delhi, the 18th December, 2014
S. O. 3233 (E).—Whereas, in exercise of the powers conferred by sub-section (1) of section 11 of the National Investigation Agency Act, 2008 (34 of 2008) (hereinafter referred to as the said Act), the Central Government had, vide notification number S.O. 951 (E), dated the 29th April, 2011, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), dated the 29th April, 2011, notified the Court of the Seniormost Additional District and Sessions Judge at Siliguri as the Special Court for the purpose of sub-section (1) of section 11 of the said Act having Jurisdiction within the Districts of Darjeeling, Jalpaiguri and Cooch Bihar of the State West Bengal for the trial of Scheduled Offences;
And whereas, Smt. Subrata Hazra (Saha), Additional District and Sessions Judge, Fast Tract Court-2, Basirhat, 24-Parganas (North), who was appointed as the Judge to preside over the said Special Court vide notification number S. O. 1589 (E), dated 16th July, 2012, has been transferred;
Now, therefore, in exercise of the powers conferred by sub-section (3) of section 11 of the said Act and in supersession of the notification number S. O. 1589 (E), dated 16th July, 2012, except as respects things done or omitted to be done before such supersession, the Central Government, on the recommendation of the Hon'ble Chief Justice of the High Court of Calcutta, hereby appoints Smt. Chandrani Mukherjee (Banerjee), Additional District and Sessions Judge, Siliguri, Darjeeling as the Judge to preside over the said Special Court.
