सड़क परिवहन और राजमार्ग मंत्रालयसड़क परिवहन और राजमार्ग मंत्रालयसड़क परिवहन और राजमार्ग मंत्रालयसड़क परिवहन और राजमार्ग मंत्रालय अधिसूचनाअधिसूचनाअधिसूचनाअधिसूचना नई दिल्ली, 22 दिसम्बर, 2014 काकाकाका....आआआआ.... 3253(अ)3253(अ)3253(अ)3253(अ)....----यतः राष्ट्रीय राजमार्ग (राष्ट्रीय राजमार्गों के खण्ड/राष्ट्रीय राजमार्गों पर स्थायी पुलों/अस्थायी पुलों के उपयोग हेतु किसी व्यक्ति द्वारा शुल्क का संग्रहण) नियम, 1997 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, का.आ. सं. 1515 (अ), तारीख 18.06.2009, जिसे का.आ. सं. 2227 (अ), तारीख 22.07.2013 द्वारा संशोधित किया गया था, द्वारा निर्माण, प्रचालन और हस्तांतरण (बीओटी) आधार पर उत्तर प्रदेश और राजस्थान राज्यों में राष्ट्रीय राजमार्ग संख्या 11 के 18.000 कि.मी. से 63.000 कि.मी. (आगरा - भरतपुर सेक्शन) तक विद्यमान दो लेन की सड़क चार लेन में विकास, प्रचालन और अनुरक्षण हेतु मैसर्स ओरिएन्टल पाथवेज (आगरा) प्राइवेट लिमिटेड को शुल्क को संग्रहीत एवं प्रतिधारित करने के लिए प्राधिकृत किया गया था।
अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए का.आ. सं. 1515, तारीख 18.06.2009 द्वारा प्रकाशित अधिसूचना में एतद्द्वारा निम्नलिखित संशोधन करती हैः
शुल्क अधिसूचना के पृष्ठ संख्या 8 पर टिप्पणियों के पैरा 4 को प्रतिस्थापित किया जाएगा।

जब उसी वाहन को दिन में एक से अधिक बार उक्त खण्ड को पार करना हो तो प्रयोक्ता के पास यह विकल्प होगा कि वह पहले ही चक्कर में टोल प्लाजा को पार करते समय उपर्युक्त सारणी के स्तम्भ (3) में विनिर्दिष्ट दर के डेढ़ गुना के हिसाब से बहु-यात्राओं के लिए शुल्क का भुगतान करे, अथवा जहां किसी वाहन को पूरे महीने में उक्त खण्ड का बार-बार और लगातार उपयोग करना हो वहां प्रयोक्ता इस प्रकार विनिर्दिष्ट दर के तीस गुना के बराबर की दर पर मासिक पास प्राप्त कर ले।
इस रूप में प्रतिस्थापित किया जाएगा जब उसी वाहन को 24 घंटे के अन्दर आने और जाने के लिए उक्त खण्ड को पार करना पड़े तो प्रयोक्ता के पास यह विकल्प होगा कि वह पहले ही चक्कर में टोल प्लाजा को पार करते समय एकतरफा यात्रा के लिए अधिसूचित दर के डेढ़ गुना के हिसाब से शुल्क का भुगतान करे। यदि वाहन को बार-बार इस सुविधा का उपयोग करना हो तो वाहन में व्यक्ति अथवा वाहन का प्रयोक्ता एकतरफा यात्रा के लिए अधिसूचित दर के 30 गुना के बराबर प्रभार का भुगतान करके मासिक पास प्राप्त कर ले।

NOTIFICATION

S.O. 3253(E).—Whereas, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways (Collection of Fees by any person for the use of Section of National Highways/Permanent Bridge/Temporary Bridge on National Highways) Rules, 1997, M/s Oriental Pathways (Agra) Private Limited was authorized to collect and retain the fee for the development, operation and maintenance of the existing two lane road into four lane road from km 18.000 to km 63.000 (Agra-Bharatpur section) of National Highway No. 11 in the States of Uttar Pradesh and Rajasthan on Build, Operate and Transfer (BOT) basis vide S.O. No. 1515(E) dated 18.06.2009 and amended vide S.O. No. 2227(E) dated 22.07.2013.
Now, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government hereby makes following amendments in the notification published vide S.O. No. 1515(E) dated 18.06.2009:

When the same vehicle has to cross the said section more than once in a day, the user shall have the option to pay fee for multiple trips at the rate one and half times the rate specified in column (3) of above table while crossing the toll plaza in the first trip itself, or where such vehicle has to use the said section continuously and frequently for the entire month, the user may have a monthly pass at the rate thirty times the rate so specified.
As
When the same vehicle has to cross the said stretch for a round trip within a span of 24 hours, the user shall have the option to pay one and half time of the notified rate for one way trip while crossing the toll plaza in the first trip itself. If the vehicle has to use the facility frequently, the vehicle occupier or user can have a monthly pass on the payment of charges equal to 30 times of the notified rate for one way trip.
