ºÉÉ.BÉEÉ.ÉÊxÉ. 911(अअअअ).—राष्ट्रपति, संविधान के अनुच्छेद ३०९ के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पूर्वोत्तर पुलिस अकादमी, बारापानी समूह 'क' और 'ख' पद भर्ती नियम, २०१४ का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्् :—
१. (१) इन नियमों का संक्षिप्त नाम पूर्वोत्तर पुलिस अकादमी, बारापानी, समूह 'क' और समूह 'ख' पद भर्ती नियम, २०१४ है ।
(२) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पूर्वोत्तर पुलिस अकादमी, बारापानी समूह 'क' और 'ख' पद भर्ती नियम, २०१४, की अनुसूची में,—
(क) सहायक निदेशक (विधि) पद से संबंधित क्रम संख्यांक 2 के सामने,—
(i) स्तम्भ (11) के अधीन, उप-शीर्ष "प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है)" के अधीन मद (क) की उप-मद (ii) मे अंत में, आने वाले "और" शब्द के स्थान पर, "या" शब्द रखा जाएगा;
(ii) स्तम्भ (12) के अधीन, प्रविष्टि (1), प्रविष्टि (2) और प्रविष्टि (3), के स्थान पर, निम्नलिखित प्रविष्टियाँ रखी जाएंगी, अर्थात्:—
(1) अध्यक्ष/सदस्य, संघ लोक सेवा आयोग - अध्यक्ष
(2) निदेशक, पूर्वोत्तर पुलिस अकादमी, शिलॉँग - सदस्य
(3) संयुक्त निदेशक, पूर्वोत्तर पुलिस अकादमी, शिलांॅँग - सदस्य
(ख) सहायक निदेशक (प्राध्यापक) के पद से संबंधित क्रम संख्यांक 4 के सामने, स्तम्भ 10 के अधीन, मद (i) के स्थान पर, निम्नलिखित मद रखी जाएंगी, अर्थात् :-
"50 प्रतिशत प्रोन्नति या प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) द्वारा";

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ग) उप सहायक निदेशक (आउटडोर) पद से संबंधित क्रम संख्यांक 8 के स्तम्भ (11) के अधीन,—
(i) उप-शीर्ष "प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है)" के अधीन, मद संख्या (अ) (i) के स्थान पर, निम्नलिखित मद रखी जाएंगी, अर्थात् :-
"(क) (i) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं;
(ii) जिन्होंने मूल काडर या विभाग में वेतन बैंड-2, 9300-34800+ग्रेड वेतन 4200 रु. या समतुल्य में नियमित आधार पर नियुक्ति के पश्चात् पांच वर्ष की सेवा की है; और
(iii) उप शीर्ष "प्रतिनियुक्ति या पुनर्नियोजन (भूतपूर्व सैनिकों के लिए) में;"
(क) उपरोक्त उप-शीर्ष के स्थान पर निम्नलिखित उपशीर्ष रखा जाएगा, अर्थात्ः-
"सशस्त्र बल के कार्मिकों या भूतपूर्व सैनिकों की प्रतिनियुक्ति या पुनर्नियोजन";
(ख) कनिष्ठ कमीशन अधिकारियों के स्तर तक के ऐसे "सशस्त्र बल के ऐसे कार्मिक" से आरंभ होने वाले, और "उनकी नियुक्ति पुनर्नियोजन के आधार पर की जाएगी" पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित शब्द रखे जाएंगे, अर्थात्ः-
"सशस्त्र बलों के या सेना, नौसेना या वायुसेना के समतुल्य स्तर के ऐसे जूनियर कमीशंड आफिसर जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं उन पर भी विचार किया जाएगा और ऐेसे अधिकारियों का यदि चयन होता है, तो उन्हें उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से नियुक्त किया जाना है, तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है, परंतु पद के लिए वास्तविक चयन किए जाने के पहले यदि ऐसे अधिकारियों को सेवानिवृत्त या रिजर्व में स्थानांतरित किया जाता है, तब उनकी नियुक्ति पुनर्नियोजन के आधार पर की जाएगी।"।
(घ) अधीक्षक (प्रशिक्षण) के पद से संबंधित क्रम संख्यांक 9 के सामने,-
(i) स्तम्भ (10) के अधीन, प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि को रखा जाएगा, अर्थात्ः-
"सशस्त्र बल के कार्मिकों की प्रतिनियुक्ति या पुनर्नियोजन";
(ii) स्तम्भ (11) के अधीन,—
(क) उप-शीर्ष "प्रतिनियुक्ति" के अधीन, उप-मद (ii) में, अंत में आने वाले शब्द "या" के स्थान पर "और" शब्द रखा जाएगा;
(ख) उप-शीर्ष "सशस्त्र बल के कार्मिकों की प्रतिनियुुक्ति या पुनर्नियोजन" के अधीनः-
(i) "कार्मिक" शब्द के स्थान पर "कार्मिक या भूतपूर्व सैनिक" शब्दों को रखा जाएगा;
(ii) (ख) कनिष्ठ कमीशन अधिकारियों के स्तर तक के "सशस्त्र बल के कार्मिकों" से आरंभ होने वाले शब्द और "उनकी नियुक्ति पुनर्नियोजन के आधार पर की जाएगी" पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित शब्द रखे जाएंगे, अर्थात् :—

NOTIFICATION
New Delhi, the 23rd December, 2014
G.S.R. 911(E).—In exercise of the powers conferred by the provisio to article 309 of the Constitution, the President hereby makes the following rules to amend the North Eastern Police Academy, Barapani, Group 'A' and 'B' posts Recruitment Rules, 2014, namely:—
1. (1) These rules may be called the North Eastern Police Academy, Barapani, Group 'A' and 'B' posts Recruitment (Amendment) Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the schedule to the North Eastern Police Academy, Barapani, Group 'A' and 'B' posts Recruitment Rules, 2014,—
(a) against serial number 2, relating to the post of Assistant Director (Law),—
(i) under column (11), under the sub-heading "Deputation (including Short Term Contract)", in item (a), in sub-item (ii), for the word 'and' occurring at the end, the word "or" shall be substituted;
(ii) under column (12), for the entries (1), (2) and (3), the following entries shall be substituted, namely:—
(i) Chairman/Member, Union Public Service Commission —Chairman
(ii) Director, North Eastern Police Academy, Shillong —Member
(iii) Joint Director, North Eastern Police Academy, Shillong —Member
(b) against serial number 4, relating to the post of Assistant Director (Lecturer), under column (10), for item (i), the following item shall be substituted, namely:—
"50% by promotion/deputation (including short-term contract)";
(c) against serial number 8, relating to the post of Deputy Assistant Director (outdoor), under column (11),—
(i) under the sub-heading "Deputation (Including short term contract)", for item (a) (i), the following items shall be substituted, namely:—
"(a) (i) holding analogous post on regular basis in the parent cadre or department;
(ii) with five years' service in the grade rendered after appointment thereto on regular basis in the pay band-2, ` 9300-34800 with grade pay of ` 4200 or equivalent in the parent cadre or department; and
(iii) in the sub-heading "Deputation/Re-employment (for ex-servicemen):",—
(A) for the sub-heading, the following sub-heading shall be substituted, namely:—
"Deputaion/re-employment of Armed Forces Personnel/Ex-servicemen";
(B) for the portion beginning with the words "The Armed Forces Personnel", and ending with the words "their appointment will be on re-employment basis", the following words shall be substituted, namely:—
"The Armed Forces Personnel up to the level of Junior Commissioned Officers or equivalent in the Army, Navy or Air Force who are due to retire or who are to be transferred to reserve within a period of one year shall also be considered and such officers, if selected, will be given deputation terms up-to the date on which they are due for release from the Armed Forces; thereafter, they may be continued on re-employment terms, but in case such officers have retired or have been transferred to reserve before the actual selection to the post is made, then, their appointment will be on re-employment basis.".

(i) under column (10), for the entry, the following entry shall be substituted, namely:—
"By deputation/re-employment of Armed Forces Personnel/Ex-servicemen";
(ii) under column (11),—
(A) under the sub-heading "Deputation", in sub-item (ii), for the word "or" occurring at the end, the word "and" shall be substituted;
(B) in the sub-heding "Deputation/re-employment of Armed Forces Personnel:",—
(I) for the word "Personnel", the words "Personnel/Ex-servicemen" shall be substituted;
(II) for the portion beginning with the words "The Armed Forces Personnel", and ending with the words "their appointment will be on re-employment basis", the following words shall be substituted, namely:—
"The Armed Forces Personnel up to the level of Junior Commissioned Officers or equivalent in the Army, Navy or Air Force who are due to retire or who are to be transferred to reserve within a period of one year shall also be considered and such officers, if selected, will be given deputation terms up-to the date on which they are due for release from the Armed Forces; thereafter, they may be continued on re-employment terms, but in case such officers have retired or have been transferred to reserve before the actual selection to the post is made, their appointment will be on re-employment basis.".
