काकाकाका....आआआआ.... 3262326232623262((((अअअअ))))....—आयकर अिधिनयम, 1961 (1961 का 43) की धारा 10 के खंड (46) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:29)ए, के न् सरकार एतद्‌द्वारा उक्त खंड के प्रयोजनार्थ के रल सरकार द्वारा गठित आयोग ^के रल स्टेट इलेक्ट्रिसिटी रेगुलेटरी कमीशन' को उक्त आयोग को होने वाली निम्नलिखित विनि/दष्ट आय के संबंध में अिधसूिचत करती है, अर्थात:-

(क) के रल सरकार से अनुदानों और ऋणों के रूप में प्राप्त रािश;

(ख) याचिका शुल्क;

(ग) लाइसेंस शुल्क;

(घ) निवेश से अ=जत ब्याज ।

2. यह अधिसूचना वित्त वर्ष 2012-13 से 2016-17 तक लागू होगी ।

3. यह अधिसूचना निम्नलिखित शतA के अधीन होगी कि के रल स्टेट इलेक्ट्रिसिटी रेगुलेटरी कमीशन:

(क) किसी वाणिज्यिक गतिवििध में शामिल नहC होगी;

(ख) इसकी गितिविधयां और िवनि/दष्ट आय की प्रकृ ति पूरे वित्त वर्ष में अपरिव=तत रहती है; और5071 GI/2014 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ग) यह उक्त अधिनियम की धारा 139 की उप-धारा (4ग) के खंड (छ) के उपबंधों के अनुसार आय की विवरणी दािखल करती है। [अिधसूचना सं. . . . 85/2014/फा.सं.196/09/2014-आकिन-I]

NOTIFICATION

New Delhi, the 23rd December, 2014

S.O. 3262(E).—In exercise of the powers conferred by clause (46) of Section 10 of the Income-tax Act, 1961 (43 of 1961), the Central Government hereby notifies for the purposes of the said clause, "Kerala State Electricity Regulatory Commission, a Commission constituted by the Government of Kerala in respect of the following specified income arising to that Commission, namely:-

(a) amount received in the form of grants and loans from the Government of Kerala;

(b) petition fees;

(c) licence fees;

(d) Interest earned from investment.

2. This notification shall be applicable for the financial years 2012-2013 to 2016-2017.

3. The notification shall be subject to the conditions that the Kerala State Electricity Regulatory Commission:-

(a) shall not engage in any commercial activity;

(b) its activities and the nature of the specified income remain unchanged throughout the financial year; and (c) it files return of income in accordance with the provision of clause (g) of sub-section (4C) Section 139 of the said Act.
