काकाकाका....आआआआ.... 3254325432543254((((अअअअ).).).).———— के न्(cid:13)ीय सरकार, आवश्यक वस्तु अिधिनयम, 1955 (1955 का 10) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते "ए, उर्वरक (नियंत्रण) आदेश, 1985 का और संशोधन करने के लिए निम्निलिखत आदेश करती है, अर्थात: - 1. (1) इस आदेश का संक्षिप्त नाम उर्वरक (नियंत्रण) पांचवां संशोधन आदेश, 2014 है ।

(2) यह राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगा ।

2. उर्वरक (नियंत्रण) आदेश, 1985 (जिसे इसमें इसके पश्चात् मूल आदेश कहा गया है) में-

(i) खंड 14 के उपखंड (2) में, पैरा (ख) में, शब्द और अक्षर ''फार्म ड.'', के स्थान पर ''फार्म घ'' शब्द और अक्षर रखा जाएगा;

(ii) खंड 15 के उपखंड (2) में, शब्द और अक्षर ''फार्म छ'', के स्थान पर ''फार्म च'' शब्द और अक्षर रखा जाएगा;

(iii) खंड 28 के उपखंड 1 में –

(क) पैरा (ख क) के पश्चात् निम्निलिखत अंत:स्थापित किया जाएगा अर्थात् :-

''परन्तु यह कि निरीक्षक फार्म ञ में दो प्रतियों में नमूना ब्यौरे तैयार करेंगे और इसकी प्रति उस डीलर या उसके प्रतिनिधि को देगा जिससे नमूना िलया गया है'';

(ख) पैरा (ख ख) के पश्चात् निम्निलिखत अंत:स्थापित किया जाएगा, अर्थात:-

'' परन्तु यह कि निरीक्षक फार्म ञ में दो प्रतियों में नमूना ब्यौरे तैयार करेंगे और इसकी प्रति उस डीलर या उसके प्रतिनिधि को देगा िजससे नमूना िलया गया है'';

(ग) पैरा (ख ग) के पश्चात् निम्निलिखत अंत:स्थापित किया जाएगा, अर्थात:-

''परन्तु यह कि निरीक्षक फार्म ञ में दो प्रतियों में नमूना ब्यौरे तैयार करेंगे और इसकी प्रति उस डीलर या उसके प्रतिनिधि को देगा जिससे नमूना िलया गया है'';

(iv) खंड 30 के उपखंड (1) में, शब्द, अक्षर और अंक ''फार्म ट1'' के स्थान पर शब्द और अक्षर ''फार्म ट'' रखा जाएगा;

5) मैं अलग से ससूचना Sापन दाखिल करूं गा, जहां भंडारण के न्(cid:13) अधिसूचित प्राधिकारी की अधिकारिता से बाहर हैं, जहां विCय डिपो अवस्थित हैं ।

6) मैं प्रत्येक स्थान के लिए अलग से सूचना Sापन दाखिल करूं गा जब उर्वरक बेचने का कारोबार एक से अधिक स्थानों पर चलाने के िलए आिशयत है ।

7) यदि मैं खुदरा और थोक दोनों Dयवहारियों के रूप में उर्वरकों का कारोबार करता Nं तो मैं अलग से सूचना Sापन फाइल करूं गा ।

8) मैं पुष्टि करता Nं कि मेरा रजिस्ट्रीकरण अथवा प्राधिकार का पूर्व प्रमाणपत्र निलंबित या रद्द करने के अधीन है या उर्वरकों के बेचने से वि\वजत किया गया है ।

6) किसी अन्य विनिर्माण प्रमाण-पत्र का पूरा ब्यौरा, यदि कोई हो, जिसे किसी अन्य रजिस्ट्रीकरण प्राधिकारी द्वारा जारी किया गया हो;

7) आवेदक कितने दिनों से उर्वरकों/ कार्बनिक उर्वरक/जैव उर्वरक/सूcम पोषक तत्व वाले उर्वरकों के मि'ण के भौितक और दानेदार/विशेष मि'ण तैयार करने के कारोबार में लगा "आ है ?

8) आवेदन की तारीख को मेरे/हमारे पास उर्वरकों/ कार्बनिक उर्वरकों/जैव उर्वरकों/ भौितक/दानेदार/विशेष मि'ण/ सूcम पोषक तत्व वाले उर्वरकों के प्रत्येक की मात्रा तथा प्रत्येक के सामने नोट किए गए विभिन्न पते;

9) (i) यदि आवेदक उर्वरकों के भौतिक/दानेदार /विशेष मि'णों/ सूcम पोषक तत्व युक्त उर्वरकों/ कार्बनिक उर्वरकों/जैव उर्वरकों के मि'ण बनाने का कारोबार कर रहा है तो प्रहस्तित ऐसे मि'णों की अवधि और स्थान जहां उर्वरकों को मि'ित किया गया था, के सभी विवरण दें;

(ii) पिछले कै लेंडर वर्ष के दौरान प्रहस्तित किए गए भौतिक /दानेदार उर्वरक /विशेष मि'ण/कार्बनिक उर्वरक /जैव उर्वरक की मात्रा भी बताएं,

10) यदि आवेदन नवीनीकरण के लिए है, तो संक्षिप्त में बताएं कि मूल प्रमाण-पत्र की वैधता की अवधि के अंदर ही पालन क्यों नहH किया जा सका ।

11) उर्वरकों के विशेष मि'ण की दशा में उर्वरकों के विशेष मि'ण की अपेक्षा Dयक्तियों का नाम व पता;

क) मैं विहित रजिस्ट्रीकरण प्रमाण-पत्र फीस/नवीकरण फीस जमा करा चुका Nं ।

ख) मैं/हम घोषणा करता Nं/करते हैं कि ऊपर दी गई सूचना मेरी/हमारी जानकारी और विश्वास के अनुसार सत्य और सही है, और इसका कोई भी भाग मिथ्या नहH है ।

ग) मैंने /हमने उर्वरक (नियंत्रण) आदेश,1985 के परिशिष्ट के प्रारूप 'च' में दिए गए विनिर्माण प्रमाण-पत्र के निबंधन और शतe को ध्यान पूर्वक पढ़ा है और मैं/हम उनका पालन करने के लिए सहमत Nं/हैं ।

घ) मैं/हम घोषणा करता Nं/करते हैं कि भौतिक /दानेदार/विशेष मि'ण उर्वरक/कार्बनिक उर्वरक /जैव उर्वरक जिनके लिए विनिर्माण प्रमाण-पत्र का आवेदन किया गया है । मेरे/हमारे अथवा उस Dयक्ति द्वारा जिनके पास राज्य सरकार द्वारा समय समय पर विहित की गई अर्हताएं हैं अथवा मेरे /हमारे िनदेश, पर्यवेक्षण ओर नियंत्रण के अधीन किसी अन्य Dयक्ति द्वारा या Dयक्ति जो उbच अर्हताएं रखता है द्वारा तैयार किया जाएगा ।

ड.) मैं/हम घोषणा/ करता Nं/करते हैं कि इस आदेश के अधीन, नियंत्रक द्वारा विनिhदष्ट अपेक्षित प्रयोगशाला सुविधा मेरे/हमारे कब्जाधीन है।

1. इस प्रमाण-पत्र का धारक उस प्रधान परिसर के एक भाग में, जिसमें भौतिक/दानेदार/विशेष मि'ण उर्वरक/ कार्बनिक उर्वरक/जैव उर्वरक बनाने का कारबार किया जाता है, जो जनता के लिए किसी खुले सहजदृश्य स्थान पर, मूल प्रमाण-पत्र प्रद\शत करेगा और उसी रीति से ऐसे प्रमाणपत्र की एक प्रति प्रत्येक अन्य परिसर में भी, जहां वह कारबार चलाया जाता है प्रद\शत करेगा । प्रमाणपत्र की प्रतियों की अपेक्षित संख्या, उनकी फीस के संदाय करने पर प्राप्त की जाएगी ।

2. इस प्रमाण-पत्र का धारक इसे उस परिसर में नहH रखेगा, जहां वह भौितक/दानेदार/विशेष मि'ण उर्वरक/जैव उर्वरकों/कार्बनिक उर्वरक के बनाने का कारबार चलाता है, जिसके संबंध में उर्वरक (नियंत्रण) आदेश, 1985 के अधीन रजिस्ट्रीकरण प्रमाण-पत्र अभिप्राप्त नहH किया गया है ।

3. इस प्रमाण-पत्र का धारक उर्वरक (नियंत्रण) आदेश, 1985 और तत्समय प्रवृत उसके अधीन जारी की गई अधिसूचना आदेश और निदेश के उपबंधों का अनुपालन करेगा ।

4. प्रमाण-पत्र का धारक रजिस्ट्रीकरण प्राधिकारी को प्रमाण-पत्र में विनिhदष्ट परिसर में या किसी नए परिसर में जिसमें वह भौितक/दानेदार/विशेष मि'ण/ कार्बनिक उर्वरक/जैव उर्वरक बनाने का कारबार चलाता है कोई परिवर्तन होने पर तत्काल रिपार्ट करेगा और प्राधिकारी के सामने मूल प्रमाण-पत्र और उसकी प्रतियां प्रस्तुत करेगा ताकि उस प्राधिकारी द्वारा आवश्यक संशोधन किए जा सके ।

5. इस प्रमाण-पत्र का धारक यह सुनिश्चित करेगा कि भौतिक/दानेदार/विशेष मि'ण उर्वरक/ कार्बनिक उर्वरक/जैव उर्वरक, िजनके संबंध में रजिस्ट्रीकरण का प्रमाण-पत्र अभिप्राप्त किया गया है, उसके द्वारा अथवा इस प्रकार की योग्यताएं जैसी कि समय-समय पर राज्य सरकार द्वारा विहित की जाएं रखने वाले Dयक्ति द्वारा अथवा धारक के निदेशन, पर्यवेक्षण और नियंत्रण के अधीन अथवा उक्त अर्हताएं रखने वाले Dयक्ति द्वारा तैयार किया जाता है ।

6. प्रमाण-पत्र और उसकी कोई प्रतियां, यदि कोई हो, मशीन द्वारा नंबर दिया जाएगा और उसे उसके धारक अथवा प्रमाण-पत्र की कार्बन प्रति पर उनके अभिकर्ता के हस्ताक्षर पर परिदान किया जाएगा, जो प्रत्येक 'रजिस्ट्रीकरण प्राधिकारी' द्वारा 'प्रमाणपत्र पुस्तिका' में अविकल बांधा "आ, रखा जाएगा ।

(v) फार्म घ का लोप किया जाएगा ;

(vi) फार्म ज के लिए निम्नलिखित फार्म रखा जाएगा, अर्थात:—

New Delhi, the 23rd December, 2014

S.O. 3254(E).— In exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following Order further to amend the Fertiliser (Control) Order, 1985, namely:—

1. (1) This Order may be called the Fertiliser (Control) Fifth Amendment Order, 2014.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. In the Fertiliser (Control) Order, 1985, (hereinafter referred as the principal Order),Ñ

(i) in sub-clause (2) of clause 14, in paragraph (b), for the word and letter " Form E", the word and letter " Form D" shall be substituted;

(ii) in sub-clause (2) of clause 15, for the word and letter "Form G", the word and letter "Form F" shall be substituted;

(iii) in sub-clause 1 of clause 28,Ñ

(a) after paragraph (ba); the following shall be inserted, namely,Ñ

"Provided that the inspector shall prepare the sampling details in duplicate in Form J and hand over one copy of the same to the dealer or his representative from whom the sample has been drawn;";

(b) after paragraph (bb); the following shall be inserted, namely,Ñ

"Provided that the inspector shall prepare the sampling details in duplicate in Form J and hand over one copy of the same to the dealer or his representative from whom the sample has been drawn;";

(c) after paragraph (bc); the following shall be inserted namely,Ñ10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] "Provided that the inspector shall prepare the sampling details in duplicate in Form J and hand over one copy of the same to the dealer or his representative from whom the sample has been drawn;";

(iv) in sub-clause (1) of clause 30, for the word, letter and figure "Form K1", the word and letter "Form K" shall be substituted.

(6) I shall file a separate Memorandum of Intimation for each place when the business of selling fertilisers is intended to be carried on at more than one place.

(7) I shall file separate Memorandum of Intimation if I carry on the business of fertilisers both as retail and wholesale dealer.

(8) I confirm that my previous certificate of Registration or Authorisation is not under Suspension or Cancellation or debarred from selling of fertilisers.

(6) Full particulars of any other certificate of manufacture, if any, issued by any other Registering Authority; (7) How long has the applicant been carrying on the business of preparing physical/granulated/special mixture of fertilisers/organic fertiliser/iofertiliser/mixture of micronutrient fertilisers?

(8) Quantities of each physical /granulated/special mixture of fertilisers/ mixture of micronutrient fertilisers/ organic fertilisers/bio fertilisers (in tonnes) in my/our possession on the date of the application and held at different addresses noted against each;

(9) (i) If the applicant has been carrying on the business of preparing physical/granulated/special mixtures of fertilisers/mixture of micronutrient fertilisers/organic fertiliser/biofertiliser, give all particulars of such mixtures handled, the period and the place (s) at which the mixing of fertilisers was done;

(ii) Also give the quantities of physical/granulated/special mixture of fertiliser/organic fertiliser/ biofertiliser handled during the past calendar year;

(10) If the application is for renewal, indicate briefly why the original certificate could not be acted on within the period of its validity.

(1) The holder of this certificate shall display the original thereof in a conspicuous place open to the public in a part of the principal's premises in which business of making the physical/ granulated /special mixture of fertilizers/organic fertilizer/biofertiliser is carried on and also a copy of such certificate in similar manner in every other premises in which that business is carried on. The required number of copies of the certificate shall be obtained on payment of the fee thereof.

(2) The holder of this certificate shall not keep in the premises in which he carried on the business of making physical/ granulated/special mixture of fertilizers/organic fertilizer/biofertiliser in respect of which a certificate of registration has not been obtained under the Fertiliser (Control) Order, 1985.

(3) The holder of the certificate shall comply with the provisions of the Fertiliser (Control) Order, 1985 and the notification order and direction, issued there under for the time being in force.

(4) The holder of the certificate shall report forth with to the Registering authority any change in the premises specified in the certificate or any new premises in which he carried on the business of making physical /granulated/special mixture of fertilizers/organic fertilizer/biofertiliser and shall produce before the authority the original certificate and copies thereof so that necessary correction may be made therein by that authority. (5) The holder of this certificate shall ensure that the physical/granulated/special mixture of fertilizers/organic fertilizer/biofertiliser in respect of which a certificate of registration has been obtained in prepared by him or by a person having such qualifications as may be prescribed by the State Government, from time to time or by any other person under the direction, supervision land control of the holder or the person having the said qualifications.

(6) The certificate and copies thereof, if any, will be machine numbered and delivered against the signature of the holder thereof or his agent on the carbon copy of the certificate which will be kept intact bound in the "Certificate Book" by each Registering Authority.";
