ºÉÉ.BÉEÉ.ÉÊxÉ. 920(+É).—केंद्रीय सरकार, विदेशी मुद्रा प्रबंध अधिनियम, १९९९ (१९९९ का ४२) की धारा ४६ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विदेशी मुद्रा अपील अधिकरण (अध्यक्ष और सदस्य भर्ती, वेतन और भत्ते तथा अन्य सेवा शर्तें) नियम, २००० का संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्् :-
१. (१) इन नियमों का संक्षिप्त नाम विदेशी मुद्रा अपील अधिकरण (अध्यक्ष और सदस्य भर्ती, वेतन और भत्ते तथा अन्य सेवा शर्तें) संशोधन नियम, २०१४ है ।
(२) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
२. विदेशी मुद्रा अपील अधिकरण (अध्यक्ष और सदस्य भर्ती, वेतन और भत्ते तथा अन्य सेवा शर्तें) नियम, २००० (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम ५ के परंतुकों का लोप किया जाएगा ।
३. उक्त नियम के नियम ७ के स्थान पर, निम्नलिखित नियम रखा जाएगा, अर्थात्् :—
"७. ´ÉäiÉxÉ +ÉÉè® £ÉkÉä.—(१) अध्यक्ष, ८०,०००/- रुपए प्रतिमास (नियत) के शीर्ष वेतनमान में होगा और सदस्य ६७,०००/- रुपए से ७९,०००/- रुपए के उच्चतर प्रशासनिक ग्रेड में होंगे :
परंतु जहां उच्च न्यायालय के किसी आसीन न्यायाधीश को अध्यक्ष के रूप में नियुक्त किया जाता है, वहां वह उसी दर पर मासिक वेतन का हकदार होगा जो उसे उच्च न्यायालय के न्यायाधीश के रूप में अनुज्ञेय है :
परंतु यह और कि जहां किसी सेवानिवृत्त व्यक्ति को अध्यक्ष या सदस्य के रूप में नियुक्त किया जाता है, वहां उसके मासिक वेतन में से पेंशन की सकल रकम को या अभिदायी भविष्य निधि में के नियोजक के अभिदाय को या सेवानिवृत्ति के ऐसे किसी अन्य प्रकार के फायदे को, यदि कोई हो, जो उसने लिया है या उसके द्वारा लिया जाए, कम कर दिया जाएगा ।
5141 GI/2014 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (२) उपनियम (१) में विनिर्दिष्ट वेतन के अतिरिक्त, केंद्रीय सरकार द्वारा समय-समय पर जारी किए गए ऐसे नियमों और आदेशों के अनुसार, जो ऐसे भत्तों और फायदों के अनुदत्त किए जाने के संबंध में लागू होते हैं,--
(क) अध्यक्ष, ऐसे अन्य भत्तों और फायदों का हकदार होगा, जो भारत सरकार के सचिव को अनुज्ञेय हैं ;
(ख) सदस्य, ऐसे भत्तों और अन्य फायदों के हकदार होंगे, जो भारत सरकार के अपर सचिव को अनुज्ञेय हैं :
परंतु अध्यक्ष के रूप में नियुक्त उच्च न्यायालय का कोई आसीन या सेवानिवृत्त न्यायाधीश, ऐसे अन्य भत्तों और फायदों का हकदार होगा जो दिल्ली उच्च न्यायालय के आसीन न्यायाधीश को अनुज्ञेय हैं ।" ।
४. उक्त नियम के नियम ११ का लोप किया जाएगा ।
५. उक्त नियम के नियम १२ के पश्चात्, निम्नलिखित नियम अंत:स्थापित किया जाएगा, अर्थात्् :-
"१२क. अध्यक्ष या अन्य सदस्य के पद पर न रहने पर वह अपील अधिकरण के समक्ष हाजिर होने, कार्य करने या अभिवचन करने का हकदार नहीं होगा ।" ।

NOTIFICATION
New Delhi, the 29th December, 2014
G.S.R. 920(E).—In exercise of the powers conferred by Section 46 of the Foreign Exchange Management Act, 1999 (42 of 1999), the Central Government hereby makes the following rules to amend the Appellate Tribunal for Foreign Exchange (Recruitment, Salary and Allowances and Other Conditions of Service of Chairperson and Members) Rules, 2000, namely :—
1. (1) These rules may be called the Appellate Tribunal for Foreign Exchange (Recruitment, Salary and Allowances and Other Conditions of Service of Chairperson and Members) Amendment Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Appellate Tribunal for Foreign Exchange (Recruitment, Salary and Allowances and Other Conditions of Service of Chairperson and Members) Rules, 2000 (hereinafter referred to as the said rules), the provisos to rule 5 shall be omitted.
3. In the said rules, for rule 7, the following rule shall be substituted, namely:—
"7. Pay and allowances.—(1) The Chairperson shall be in the Apex Scale of Rs. 80,000 per month (fixed) and the Members shall be in the Higher Administrative Grade of Rs. 67,000 to 79,000 :
Provided that where a sitting Judge of a High Court is appointed as the Chairperson, he shall be entitled to a monthly salary at the same rate as is admissible to a Judge of High Court:
Provided further that where a retired person is appointed as the Chairperson or a Member, his monthly salary shall be reduced by the gross amount of pension or employer's contribution to the Contributory Provident Fund or any other form of retirement benefit, if any, drawn or to be drawn by him.
(2) In addition to the pay specified in sub-rule (1),—
(a) the Chairperson shall be entitled to such other allowances and benefits as are admissible to a Secretary to the Government of India;

in accordance with the rules and orders issued by the Central Government governing the grant of such allowances and benefits, from time to time:
Provided that a sitting or retired Judge of a High Court appointed as the Chairperson shall be entitled to such other allowances and benefits as are admissible to a sitting Judge of the High Court of Delhi." 4. In the said rules, rule 11 shall be omitted.
5. In the said rules, after rule 12, the following rule shall be inserted, namely :—
"12A. On ceasing to hold office, the Chairperson or other Member shall not be entitled to appear, act or plead before the Appellate Tribunal".
