का....आआआआ.... 3317331733173317((((अअअअ))))....————जबकि के न्(cid:14) सरकार ने राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 5 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय, की अधिसूचना सं. का.आ. 275(अ), तारीख 14 फरवरी, 2012 के द्वारा मध्य प्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 7 को मध्य प्रदेश राज्य सरकार को सुपुर्द कर दिया है ।

और जबकि, मध्य प्रदेश राज्य में अवस्थित रीवा से मध्य प्रदेश/उत्तर प्रदेश सीमा तक राष्ट्रीय राजमार्ग सं. 7 के िवकास के िलए 30 सितम्बर, 2009 को के न्(cid:14)ीय सरकार और मध्य प्रदेश राज्य सरकार के बीच एक समझौता ;ापन पर हस्ताक्षर किए गए थे ।

और जबकि, मध्य प्रदेश राज्य सरकार की ओर से कार्यान्वयन प्राधिकरण के रूप में कार्य करने के लिए मध्य प्रदेश राज्य सरकार ने आदेश सं.5593/6502/19/यो./2011 दिनांक 18.10.2011 के तहत मध्य प्रदेश सड़क विकास निगम लि., भोपाल (जो इसके बाद ''प्राधिकरण'' के रूप में उल्लििखत है) को अधिकृ त किया था ।

और जबकि, प्राधिकरण ने मध्य प्रदेश राज्य में डिजाइन, निर्माण, वित्तपोषण, प्रचालन और हस्तांतरण (डीबीएफओटी) आधार पर राष्ट्रीय राजमार्ग सं. 7 के किमी 229/100 से किमी 140/600 [डिजाइन लंबाई किमी 89.23] तक राष्ट्रीय राजमार्ग सं.7 के रीवा से मध्य प्रदेश/उत्तर प्रदेश सीमा खंड (जो इसके आगे ''किथत खंड'' के रूप में उल्लििखत है) के िवकास एवं प्रचालन के लिए दिनांक 02.09.2011 को प्रस्तुत िनिवदा के िलए मै. विन्ध्याचल एक्सप्रैसवे प्रा.िल. जिसका पंजीकृ त कार्यालय ए-104, शपथ-4, कर्णावती क्लब के सामने, एस.जी. रोड, अहमदाबाद, िपन-380051, है (जो इसके आगे ''रियायतEाही'' के रूप में उल्लििखत है) के साथ 25.01.2012 को एक करार (जो इसके आगे ''करार'' के रूप में उल्लििखत है), किया है ।

अत: अब, बोली प्राप्ति की तारीख तक यथा-संशोधित राष्ट्रीय राजमार्ग शुल्क (दरों का निर्धारण और संEहण) िनयम, 2008 के िनयम 3 के साथ पठित (जो इसके आगे ''िनयम'' के रूप में उल्लििखत है) राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते Iए के न्(cid:14) सरकार, कथित खंड के निर्माण, अनुरक्षण, प्रबंधन और प्रचालन में निहित Jयय, निवेशित पू ंजी पर ब्याज, यथोचित प्रतिलाभ, यातायात की मात्रा तथा प्राधिकरण और रियायतEाही के बीच संपन्न करार की अवधि को ध्यान में रखते Iए, एतLारा यह अधिसूचित करती है कि कथित खंड का प्रयोग करने के लिए यांत्रिक वाहन पर 61.33 किमी की लंबाई वाले िनबल सड़क खंड के िलए 4 और अधिक लेन वाले खंडों के प्रयोग हेतु तािलका-1 के कॉलम (2) में विनिMदष्ट दर पर (जिसे इसमें 5181 GI/2014 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] इसके पश्चात् ''आधार दर'' कहा गया है) तथा नीचे तािलका-1 के कॉलम (1) में विनिMदष्ट वाहनों की किस्मों पर 27.90 किमी कु ल िडजाइन लंबाई वाले 6 बाईपासों के लिए आधार दर के डेढ़ गुना दर से शुल्क प्रभारित और संEहीत किया जाएगा, और उक्त रियायतEाही को, प्राधिकरण द्वारा घोषित वाणिज्यिक प्रचालन (सीओडी) की तारीख से और यथा-स्थिति प्राधिकरण से पूर्णता प्रमाणपत्र अथवा अनंतिम प्रमाणपत्र प्राप्त करने पर अथवा सरकारी राजपत्र में इस अधिसूचना के प्रकाशन पर करार में यथा-विनिMदष्ट करार समापन की तारीख तक, इसमें से जो भी बाद में हो, शुल्क का संEहण करने और प्रतिधारित करने के लिए प्राधिकृ त करती है;

करने वाले Jयक्ति के लिए मासिक पास की दर वर्ष 2014-15 के िलए 225.00 U. (दो सौ प\चीस Uपए मात्र) है और यह राष्ट्रीय राजमार्ग फीस (दरों का निर्धारण और संEहण) िनयम, 2008 के उपबंधों के अनुसार प्रत्येक वर्ष संशोधन के अध्यधीन है ।

4. राजमार्ग खंड पर बIल यात्राओं के लिए निम्नलिखित दरों पर पास जारी किए जाएंगे, अर्थात्

छोड़कर) के लिए फीस उस _ेणी के वाहन हेतु निर्धारित दर की 50% होगी, बशत' कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सbवस रोड या वैकल्पिक सड़क उपलब्ध न हों ।

6. किसी _ेणी विशेष के लिए विनिMदष्ट अनुमत्य भार से अिधक भार वाले यांत्रिक वाहन के चालक अथवा स्वामी अथवा प्रभारी Jयक्ति को राष्ट्रीय राजमार्ग पर अतिभार लदे वाहन के प्रवेश के लिए पथकर संEहण एजेंसी को उस _ेणी के यांत्रिक वाहनों के लिए लागू फीस की 10 गुना के बराबर फीस का भुगतान करना होगा और इस यांत्रिक वाहन से अतिभार को उतारे बिना वह उस राजमार्ग खंड का इस्तेमाल करने का हकदार नहc होगा ।

7. सभी परिभाषाएं, यांत्रिक वाहनों की _ेणी, इनके अनुमत्य भार, छू ट प्राप्त वाहनों की _ेणी, सbवस रोड, वैकल्पिक सड़क इत्यादि कथित नियमों में विनिMदष्ट परिभाषाओं के अनुरूप होंगी ।

8. फीस की दरें कथित िनयमावली के िनयम 12 के अनुसरण में प्रयोक्ताओं के सूचनार्थ प्रदbशत करनी होंगी ।

9. यांत्रिक वाहनों से फीस की वास्तिवक रािश तािलका-1 में यथा-संशोिधत आधार वर्ष 2007-08 के लिए प्रति किमी फीस की आधार दर के आधार पर यांत्रिक वाहन से प्रभारित की जाने वाली वास्तविक राशि और छू ट का आकलन प्राधिकरण द्वारा राजमार्ग परियोजना की लंबाई के पूरे Iए भाग के आधार पर किया जाएगा । प्राधिकरण द्वारा इसे रियायतEाही के माध्यम से प्रत्येक अंEेजी और देशी भाषा में कम से कम एक समाचार पत्र में प्रकाशित कराया जाएगा और तत्पश्चात् कथित नियमों के नियम 5 और रियायत करार के उपबंध के अनुसरण में वाbषक रूप से संशोधित कराया और प्रकाशित कराया जाएगा बशत' कि फीस के पूर्ववर्ती संशोधन की तारीख से 6 महीनों की अवधि के भीतर कोई संशोधन नहc किया जाएगा ।

NOTIFICATION

New Delhi, the 30th December, 2014

S.O. 3317(E).—Whereas, by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways number S.O. 275 (E) dated 14th February, 2012 issued under Section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted National Highway No. 7 in the State of Madhya Pradesh to the State Government of Madhya Pradesh.

And whereas, a Memorandum of Understanding was entered between Central Government and the State Government of Madhya Pradesh on September 30, 2009 for the development of National Highway No. 7 from Rewa to MP/UP Border situated in the State of Madhya Pradesh.

And whereas, the State Government of Madhya Pradesh authorized Madhya Pradesh Road Development Corporation Limited, Bhopal (hereinafter referred to as the "Authority") to act as implementing authority on behalf of the State Government of Madhya Pradesh vide order No. 5593/6502/19/ ;ks./2011 dated 18.10.2011.

And whereas, the Authority has entered into an Agreement on 25.01.2012 (hereinafter referred to as said "Agreement") with M/s. Vindhyachal Expressway Private Limited, having its Registered Office at A-104, Shapath-4, Opp. Karnavati Club, S.G. Road, Ahmedabad 380 051, Gujarat (hereinafter referred to as "Concessionaire"), for the bid submitted on 02.09.2011 for the development & operation of Rewa-MP/UP Border Section of NH-7 from km 229/100 to km 140/600 [Design length 89.23 km] (hereinafter referred to as the "said section") in the State of Madhya Pradesh on Design, Build, Finance, Operate and Transfer (DBFOT) basis;

Now, therefore, in exercise of the powers conferred by Section 8A of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended upto the date of receipt of bid, (herein referred to as the "Rules"), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the Agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in column (2) of the Table 1 for net road section of 61.33 km length for use of the four and more lane sections (hereinafter referred to as "base rate") and at one and half times of the base rate for six number of bypasses having total design length of 27.90 km on the Types of Vehicles specified in column (1) of the Table 1 below, and authorizes the said Concessionaire to collect and retain the fees on and from the date of commercial operation dated (COD) declared by the Authority and on getting the completion certificate or the provisional completion certificate as the case may be from the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the Agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plazas for the distance specified for such Toll Plazas:

2. In addition to the above, the following fee shall also be due and payable for the use of following bypass at the base rate mentioned in the Table below, cost of which is specified hereunder and at the following toll plaza:

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15 and is subject to revision every year as per the provisions of the National Highway fee (determination of Rates and collection) Rules, 2008.

4. For multiple journeys on the highway section, passes shall be issued at the following rates namely:

5. Fee for commercial vehicles (excluding vehicles plying under National Permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

7. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rule.

8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.

9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed portion of the length of the project Highway. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the concessionaire and thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession Agreement and got published, provided that no revision shall be effected with in a period of six months from the date of the preceding revision of fee.
