The Central Govt. hereby makes the following rules further to amend the Designs Rules, 2001, These rules may be called the Designs (Amendment) Rules, 2014.

सा.का.नि. ९२५(अ).— डिजाइन अधिनियम, २००० (२००० का १६) की धारा ४७ की उपधारा (३) के अधीन यथापेक्षित कतिपय प्रारूप नियम अर्थात् डिजाइन (संशोधन) नियम, २०१३, भारत सरकार के वाणिज्य और उद्योग मंत्रालय (औद्योगिक नीति और संवर्धन विभाग) की अधिसूचना संख्यांक सा०का०नि० ७२०(अ), तारीख ३१ अक्तूबर, २०१३ द्वारा भारत के राजपत्र, असाधारण, भाग II, खंड ३, उपखंड (i), तारीख ३१ अक्तूबर, २०१३ में प्रकाशित किए गए थे और उन सभी व्यक्तियों से, जिनका उससे प्रभावित होने की संभावना थी, उस तारीख से, जिसको उक्त अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव आमंत्रित किए गए थे;

और उक्त अधिसूचना वाले राजपत्र की प्रतियां ३१ अक्तूबर, २०१३ को जनता को उपलब्ध करा दी गई थी;

और उक्त प्रारूप नियमों पर जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा विचार कर लिया गया है;

अत:, अब, केंद्रीय सरकार, डिजाइन अधिनियम, २००० (२००० का १६) की धारा ४७ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, डिजाइन नियम, २००१ का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्् :--

१. (१) इन नियमों का संक्षिप्त नाम डिजाइन (संशोधन) नियम, २०१४ है ।

(२) ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

२. डिजाइन नियम, २००१ (जिसे इसमें इसके पश्चात् मूल नियम कहा गया है) के नियम २ में,--

(i) खंड (ग) के पश्चात् निम्नलिखित खंड अंत:स्थापित किया जाएगा, अर्थात्् :--

'(गक) "प्रकृत व्यक्ति से भिन्न कोई अन्य व्यक्ति" के अंतर्गत "लघु अस्तित्व" होगा";';

(ii) खंड (ङ) के पश्चात् निम्नलिखित खंड अंत:स्थापित किया जाएगा, अर्थात्् :--

'(ङक) "लघु अस्तित्व" से अभिप्रेत है,-

5177 GI/2014 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (i) माल के विनिर्माण या उत्पादन में लगे किसी उद्यम की दशा में कोई उद्यम, जहां संयंत्र या मशीनरी में विनिधान सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, २००६ (२००६ का २७) की धारा ७ की उपधारा (१) के खंड (क) के अधीन किसी मध्यम उद्यम के लिए विनिर्दिष्ट सीमा से अधिक नहीं है ; और

(ii) सेवाएं उपलब्ध कराने या देने में लगे किसी उद्यम की दशा में कोई उद्यम, जहां उपस्कर में विनिधान सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, २००६ (२००६ का २७) की धारा ७ की उपधारा (१) के खंड (ख) के अधीन मध्यम उद्यम के लिए विनिर्दिष्ट सीमा से अधिक नहीं है ।

स्पष्टीकरण १- इस खंड के प्रयोजनों के लिए, "उद्यम" से ऐसा कोई औद्योगिक उपक्रम या कारबार समुत्थान या कोई स्थापन, चाहे जिस भी नाम से हो, अभिप्रेत है, जो किसी भी रीति में औद्योगिक (विकास और विनियमन) अधिनियम, १९५१ (१९५१ का ६५) की प्रथम अनुसूची में विनिर्दिष्ट किसी उद्योग से संबंधित माल के विनिर्माण या उत्पादन में लगा हो या ऐसे किसी उद्योग में कोई सेवा या सेवाएं उपलब्ध कराने या देने में लगा हो।

स्पष्टीकरण २- संयंत्र और मशीनरी में विनिधान की संगणना करते समय प्रदूषण नियंत्रण, अनुसंधान और विकास, औद्योगिक सुरक्षा युक्तियों और ऐसी अन्य चीजों की लागत को, जो सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, २००६ (२००६ का २७) के अधीन अधिसूचना द्वारा विनिर्दिष्ट की जाएं, अपवर्जित किया जाएगा ।

स्पष्टीकरण ३- भारतीय रिजर्व बैंक की विदेशी करेंसी की निर्देश दरें अभिभावी होंगी ।'।

३. मूल नियमों के नियम ५ के उपनियम (२) में खंड (घ) के पश्चात् निम्नलिखित खंड अंत:स्थापित किए जाएंगे, अर्थात्् :--

"(ङ) जब किसी प्रकृत व्यक्ति द्वारा प्रक्रियागत कोई आवेदन, प्रकृत व्यक्ति से भिन्न किसी व्यक्ति को पूर्णत: या भागत: अंतरित हो जाता है तो प्रकृत व्यक्ति से प्रभारित फीस/फीसों और प्रकृत व्यक्ति से भिन्न व्यक्ति से प्रभार्य फीस/फीसों में फीस/फीसों के मापमान का अंतर, यदि कोई हो, नए आवेदक द्वारा ऐसे अंतरण के लिए किए गए अनुरोध के साथ उसी मामले में संदत्त किया जाएगा ।

(च) जब किसी लघु अस्तित्व द्वारा प्रक्रियागत कोई आवेदन, प्रकृत व्यक्ति से भिन्न (लघु अस्तित्व के सिवाए) किसी व्यक्ति को पूर्णत: या भागत: अंतरित हो जाता है तो लघु अस्तित्व से प्रभारित फीस/फीसों और प्रकृत व्यक्ति से भिन्न (लघु अस्तित्व के सिवाए) व्यक्ति से प्रभार्य फीस/फीसों में फीस/फीसों के मापमान का अंतर, यदि कोई हो, नए आवेदक द्वारा ऐसे अंतरण के लिए किए गए अनुरोध के साथ उसी मामले में संदत्त किया जाएगा ।"।

४. मूल नियमों के नियम ६ में, उपनियम (१) के स्थान पर निम्नलिखित परंतुक अंत:स्थापित किया जाएगा, अर्थात्् :--

"परंतु लघु अस्तित्व की दशा में, ऐसे प्रत्येक दस्तावेज के साथ, जिसके लिए कोई फीस विनिर्दिष्ट की गई है, प्ररूप-२४ लगाया जाएगा ।"।

५. मूल नियमों में, प्रथम अनुसूची के स्थान पर निम्नलिखित अनुसूची रखी जाएगी, अर्थात्् :--

"प्रथम अनुसूची (नियम ५ देखिए) फीस

६. मूल नियमों की द्वितीय अनुसूची में,-

(i) प्ररुपों की सूची में" प्ररुप संख्या २३ के पश्चात् निम्नलिखित प्रविष्टि अंत:स्थापित की जाएगी, अर्थात्

अनुसूची देखिए" शब्द रखे जाएंगे ;

(iii) प्ररूप २, प्ररूप ५, प्ररूप ६, प्ररूप ९, प्ररूप १४, प्ररूप १५, प्ररूप १६, प्ररूप १७ और प्ररूप २० में, "फीस ५०० रुपए" शब्दों और अंकों के स्थान पर क्रमश: "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(iv) प्ररूप ३ में, "फीस २००० रुपए" शब्दों और अंकों के स्थान पर "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(v) प्ररूप ८ में, "फीस १५०० रुपए" शब्दों और अंकों के स्थान पर "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(vi) प्ररूप १९ में, "फीस १०० रुपए" शब्दों और अंकों के स्थान पर "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(vii) प्ररूप २२ और प्ररूप २३ में, "फीस २०० रुपए" शब्दों और अंकों के स्थान पर क्रमश: "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(viii) प्ररूप १०, प्ररूप ११ और प्ररूप १२ में,

(क) "फीस **" शब्दों और तारक चिहनों के स्थान पर "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(ख) "** एक डिजाइन के संबंध में ५०० रुपये । प्रत्येक अतिरिक्त डिजाइन के लिए २०० रुपये" तारक चिहनों, शब्दों और अंकोे का लोप किया जाएगा ;

(ix) प्ररूप १३ में,-

(क) "फीस *" शब्द और तारक चिहन के स्थान पर "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(ख) "टिप्पण फीस - ** एक डिजाइन के संबंध में ५०० रुपये । प्रत्येक अतिरिक्त डिजाइन के लिए २०० रुपये" शब्दों, तारक चिहना और अंकोे का लोप किया जाएगा ;

(x) प्ररूप १८ में,-

(क)"फीस *" शब्द और तारक चिहन के स्थान पर "फीस के लिए प्रथम अनुसूची देखिए" शब्द रखे जाएंगे ;

(ख) "*२०० रुपये प्रतिमास" तारक चिहन, अंकोे और शब्दों का लोप किया जाएगा ;

(xi) प्ररुप सं. २३ के पश्चात् निम्नलिखित प्ररुप अंत:स्थापित किया जाएगा, अर्थात् :--

"प्ररुप - २४ (डिजाइन अधिनियम, २०००) (नियम २ और नियम ५ देखें)

किसी लघु अस्तित्व की प्रास्थिति का दावा करने के लिए प्रस्तुत किया जाना है

डिजाइन आवेदन सं. ......./ रजिस्ट्रीकृत डिजाइन सं. की बाबत यह घोषित किया जाता है कि मैं/हम डिजाइन नियम, २००१ के नियम २(चक) के अनुसार लघु अस्तित्व हैं और सबूत के रुप में निम्नलिखित दस्तावेज प्रस्तुत करते हैं ।

२. दस्तावेजों की विशिष्टियों का

(i) सूक्ष्म लघु और मध्यम उद्यम विकास अधिनियम, २००६ (२००६ का २७) (भारतीय अस्तित्वों की दशा में के अधीन रजिस्ट्रीकरण का साक्ष्य) ।

(ii) आवेदक या प्राधिकृत हस्ताक्षरकर्ता द्वारा डिजाइन नियम, २००१ के नियम ४२ के अनुसार, यह स्पष्ट कथन करते हुए कि अभिसाक्षी (विदेशी अस्तित्वों की दशा में) डिजाइन नियम, २००१ के नियम २(छ) के अधीन यथा परिभाषित लघु अस्तित्व है, अभिसाक्ष्यित शपथ पत्र6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] मैं/हम यह घोषणा करते हैं कि इसमें दी गई सूचना मेरे/हमारे सर्वोतम ज्ञान, जानकारी और विश्वास में सत्य है और यह कि डिजाइन नियम २००१ के नियम २(छ) में यथापरिभाषित लघु अस्तित्व के रुप में मेरी /हमारी प्रास्थिति में किसी परिवर्तन की दशा में मुझे/हमें किसी लघु अस्तित्व के रुप में फायदा नहीं मिलेगा ।

टिप्पण : १. लघु अस्तित्व के रुप में प्रास्थिति की बाबत तथ्यों की गलत सूचना/ दुव्र्यपदेशन के आधार पर फीस में कमी का फायदा लेने का यह अभिप्राय होगा कि नियम ५ (२)(ख) द्वारा यथा आदेशाधीन दस्तावेज के साथ संपूर्ण फीस नहीं है । धारा २४(२) के अनुसार ऐसे मामले में दस्तावेज का फाइल किया जाना तब तक प्रभावी नहीं होगा जब तक फीस का पूर्णतया संदाय नहीं कर दिया गया हो ।

२. लघु अस्तित्व के रुप में प्रास्थिति के बारे में कोई मिथ्या सुझाव या मिथ्या व्यपदेशन करके डिजाइन रजिस्टर में प्रविष्ट रजिस्ट्रीकृत डिजाइन को डिजाइन अधिनियम, २००० की धारा ३१ के उपबंध लागू हो सकेंगे"।

७. मूल नियमों में, चतुर्थ अनुसूची के स्थान पर निम्नलिखित अनुसूची रखी जाएगी, अर्थात्् :--

NOTIFICATION

New Delhi, the 30th December, 2014

G.S.R 925(E).—Whereas certain draft rules, namely the Design (Amendment) Rules, 2013, were published as required under sub-section (3) of Section 47 of the Designs Act, 2000 (16 of 2000) vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) number G.S.R. 720 (E), dated the 31st October, 2013, in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i), dated 31st October, 2013, for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Gazette containing the notification were made available to the public;

And whereas, the copies of the Gazette containing the said notification were made available to the public on the 31st October, 2013;

And whereas, the objections and the suggestions received from the public on the said draft rules have been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by Section 47 of the Designs Act, 2000 (16 of 2000), the Central Government hereby makes the following rules further to amend the Designs Rules, 2001, namely:-

1. (1) These rules may be called the Designs (Amendment) Rules, 2014.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In rule 2 of the Designs Rules, 2001 (hereinafter referred to as the principal rules),—

(i) after clause (c), the following clause shall be inserted, namely:—

'(ca) "person other than a natural person", shall include a "small entity";';

(ii) after clause (e), the following clause shall be inserted, namely:—

'(ea) "small entity" means,—

(i) in case of an enterprise engaged in the manufacture or production of goods, an enterprise where the investment in plant and machinery does not exceed the limit specified for a medium enterprise under clause (a) of sub-section (1) of Section 7 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006); and

(ii) in case of an enterprise engaged in providing or rendering of services, an enterprise where the investment in equipment is not more than the limit specified for medium enterprises under clause (b) of sub-section (1) of Section 7 of the Micro, Small and Medium Enterprises Development Act, 2006.

Explanation 1. – For the purpose of this clause, "enterprise" means an industrial undertaking or a business concern or any other establishment, by whatever name called, engaged in the manufacture of production of goods, in any manner, pertaining to any industry specified in the First Schedule to the Industries (Development and Regulation) Act, 1951 (65 of 1951) or engaged in providing or rendering of any service or services in such an industry.

Explanation 2. – In calculating the investment in plant and machinery, the cost of pollution control, research and development, industrial safety devices and such other things as may be specified by notification under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), shall be excluded.

Explanation 3. – The reference rates of foreign currency of the Reserve Bank of India shall prevail.'.

3. In rule 5 of the principal rules, in sub- rule (2), after clause (d), the following clauses shall be inserted, namely:-

"(e) In case an application processed by a natural person is fully or partly transferred to a person other than a natural person, the difference, if any, in the scale of fees between the fees charged from a natural person and the fees chargeable from the person other than natural person in the same matter shall be paid by the new applicant with the request for transfer.

(f) In case an application processed by a small entity is fully or partly transferred to a person other than a natural person (except a small entity), the difference, if any, in the scale of fees between the fees charged from the small entity and the fees chargeable from the person other than natural person (except a small entity) in the same matter shall be paid by the new applicant with the request made for such transfer.".

4. In rule 6 of the principal rules, after sub-rule (1), the following proviso shall be inserted, namely:-

"Provided that in the case of small entity, every document, for which a fee has been specified, shall be accompanied by Form-24.".

5. In the principal rules, for THE FIRST SCHEDULE, the following SCHEDULE shall be substituted, namely:-

6. In the principal rules, in THE SECOND SCHEDULE,-

(i) in the " LIST OF FORMS", after 'Form No.23, the following entry shall be inserted, namely :-

(ii) in FORMS 1, 4 and 7 for the word, letters and figures "FEE Rs.1000", the words "For fee see First Schedule" shall respectively be substituted;

(iii) in FORMS 2, 5, 6, 9, 14, 15, 16, 17 and 20 for the word, letters and figures "FEE Rs.500", the words "For fee see First Schedule" shall respectively be substituted;

(iv) in FORM 3, for the word, letters and figures "FEE Rs. 2000", the words "For fee see First Schedule" shall be substituted;

(v) in FORM 8, for the word, letters and figures "FEE Rs.1500", the words "For fee see First Schedule" shall be substituted;

(vi) in FORM 19, for the word, letters and figures "FEE Rs.100", the words "For fee see First Schedule" shall be substituted;

(vii) in FORMS 22 and 23, for the word, letters and figures "FEE Rs.200", the words "For fee see First Schedule" shall respectively be substituted;

(viii) in FORMS 10, 11 and 12,-

(a) for the word and asterisks "FEE **", the words "For fee see First Schedule" shall respectively be substituted;

(b) the asterisks, words and figures namely, " **In respect of one Design Rs. 500.00. For each additional Design Rs. 200.00" shall be omitted;

(ix) in FORM 13,-

(a) for the word and asterisks "FEE **", the words "For fee see First Schedule" shall be substituted;

(b) the asterisks, words and figures namely, " Note.- FEE-- ** In respect of one Design Rs. 500.00. For each additional Design Rs. 200.00" shall be omitted;

(x) in FORM 18,-

(a) for the word and asterisk "FEE *", the words "For fee see First Schedule" shall be substituted;

(b) the asterisks, words and figures namely, "*Rs. 200 per month" shall be omitted.

(xi) after Form No. 23, the following Form shall be inserted, namely :-

(ii) An affidavit deposed by the applicant or authorised signatory (on the basis of deponent's own knowledge) in accordance with rule 42 of the Designs Rules, 2001 clearly stating that the deponent is a small entity as defined under rule 2(g) of the Designs Rules, 2001 (in case of foreign entities).

Note:

1. Availing of benefit of reduction in fee on the basis of incorrect information/ misrepresentation of facts with regard to status as a small entity would mean that the entire fee did not accompany the document, as mandated by rule 5(2)(b). In such a case, in accordance with section 24(2), the filing of the document shall be of no effect unless the fee has been fully paid.

2. A registered design entered into the Register of designs by making any false suggestion or false representation as to the status as small entity may attract the provisions of section 31 of the Designs Act, 2000".

7. In the principal rules, for THE FOURTH SCHEDULE, the following SCHEDULE shall be substituted, namely:-
