सासासासा....काकाकाका....िनिनिनिन.... 930930930930((((अअअअ).).).).————िवदेशी मु(cid:6)ा प्रबंध अिधिनयम, 1999 (1999 का 42) की धारा 7 की उप-धारा (1) के खंड (ए), उप-धारा (3) और धारा 47 की उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:24)ए एवं 3 मई, 2000 की अिधसूचना सं. फे मा. 23/2000-आरबी में आंिशक संशोधन करते (cid:24)ए, भारतीय रिज़र्व बैंक, समय-समय पर यथा संशोिधत, िवदेशी मु(cid:6)ा प्रबंध (माल और सेवाओं का निर्यात) िविनयमावली, 2000 में िनम्निलिखत संशोधन करता है, अर्थात्:
1.1.1.1. संक्षिप्तसंक्षिप्तसंक्षिप्तसंक्षिप्त नामनामनामनाम औरऔरऔरऔर प्रारंप्रारंप्रारंप्रारंभभभभ
(i) ये िविनयम िवदेशी मु(cid:6)ा प्रबंध (माल और सेवाओं का निर्यात) (चौथा संशोधन) िविनयमावली, 2014 कहलाएंगे।
(ii) वे 8 नवंबर 2013 से लागू समझे जाएंगे।@

िवदेशी मु(cid:6)ा प्रबंध (माल और सेवाओं का निर्यात) िविनयमावली, 2000 में,—
5195 GI/2014 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] एएएए.... िविनयम 3 में, उप-िविनयम (3) के बाद, िनम्निलिखत जोड़ा जाएगा, अर्थात्:
"(4) माल/सॉ)टवेयर के निर्यात के संबंध में निर्यात आगम-रािश की वसूली तीसरे पक्ष (Third party) से होने के बारे में निर्यातक द्वारा उचित घोषणा फॉर्म में िविधवत घोषणा की जानी चािहए।"
बीबीबीबी.... िविनयम 16 में, उप-िविनयम (1) में, "जहां निर्यातक भारत से बाहर के खरीदार से (ब्याज के साथ या बिना ब्याज)
अ5िम भुगतान प्राप्त करता है, निर्यातक यह सुनि:ित करने के िलए दायित्व के अधीन होगा कि" शब्दों को "जहां
निर्यातक भारत से बाहर के खरीदार/निर्यातक द्वारा निर्यात घोषणा पत्र में बताए गए तीसरे पक्ष (Third party)
से (ब्याज के साथ या बिना ब्याज) अ5िम भुगतान प्राप्त करता है, निर्यातक यह सुनि:ित करने के दायित्व के अधीन
होगा कि" शब्दों से प्रतिस्थापित किया जाएगा।

(1) @ यह स्पष्ट किया जाता है कि इन विनियमों को पूर्व प्रभावी किए जाने से किसी भी Dक्ति पर कोई प्रतिकू ल प्रभाव
नहF पड़ेगा।
(2) मूल िविनयमावली 8 मई, 2000 के सा.का.िन. 409(अ), के जरिये सरकारी राजपत्र के भाग II, खंड 3, उप-खंड (i)

Foreign Exchange Management (Export of Goods & Services) (Fourth Amendment) Regulations, 2014
G.S.R. 930(E).—In exercise of the powers conferred by clause (a) of sub-section (1), sub-section (3) of Section 7 and sub-section (2) of Section 47 of the Foreign Exchange Management Act, 1999 (42 of 1999) and in partial modification of its Notification No. FEMA.23/2000-RB dated May 3, 2000, Reserve Bank of India makes the following amendment in the Foreign Exchange Management (Export of Goods and Services) Regulations, 2000, as amended from time to time, namely :
1. Short title and commencement
(i) These Regulations may be called the Foreign Exchange Management (Export of Goods and Services) (Fourth Amendment) Regulations, 2014.
(ii) They shall be deemed to have come into force from November 08, 2013.@
2. Amendment to the Regulations
In the Foreign Exchange Management (Export of Goods and Services) Regulations, 2000, following changes may be made:
a) in Regulation 3, after sub-regulation (3), following shall be added, namely:—
"(4) Realization of export proceeds in respect of export of goods/software from third party should be duly declared by the exporter in the appropriate declaration form."
b) In Regulation 16, in sub-regulation (1) for the words,—
"Where an exporter receives advance payment (with or without interest), from a buyer outside India, the exporter shall be under an obligation to ensure that-" the words, "Where an exporter receives advance payment (with or without interest), from a buyer/third party named in the export declaration made by the exporter, outside India, the exporter shall be under an obligation to ensure that -" shall be substituted.

(i) @It is clarified that no person will be adversely affected as a result of the retrospective effect being given to these Regulations.

सासासासा....काकाकाका....िनिनिनिन.... 931931931931((((अअअअ).).).).————िवदेशी मु(cid:6)ा प्रबंध अिधिनयम, 1999 (1999 का 42) की उप-धारा 6 के खंड (i), धारा 47 की उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:24)ए तथा 3 मई, 2000 की अिधसूचना सं. फे मा.14/2000-आरबी में आंशिक संशोधन करते (cid:24)ए, भारतीय रिज़र्व बैंक एतद्द्वारा समय-समय पर यथा संशोिधत िवदेशी मु(cid:6)ा प्रबंध (प्राप्ति और भुगतान का तरीका) िविनयमावली, 2000 में िनम्निलिखत संशोधन करता है, अर्थात्:-

(i) ये िविनयम िवदेशी मु(cid:6)ा प्रबंध (प्राप्ति और भुगतान का तरीका) ((((दूसरा संशोधन) िविनयमावली, 2014 कहलाएंगे।
(बी) वे 8 नवंबर, 2013 से लागू समझे जाएंगे@।
2.2.2.2. िविनयिविनयिविनयिविनयमों मों मों मों में संशोधनमें संशोधनमें संशोधनमें संशोधन
1. िविनयम 3 में, उप-िविनयम (3) के बाद, िनम्निलिखत उप-िविनयम जोड़ा जाएगा, अर्थात्:
"(4) प्राधिकृ त Dापारी @ेणी-I बैंकों को यह अनुमति दी गई है कि वे माल/सॉ)टवेयर के निर्यात के िलए तीसरे पक्ष (third party) (खरीदार से भिन्न पक्ष) से भुगतान प्राप्त करने की अनुमित प्रदान करें, बशतL तीसरे पक्ष जिसके माध्यम से निर्यात आगम-रािश वसूली जाएगी, उसके संबंध में निर्यातक ने निर्यात संबंधी उचित घोषणा फार्म में िविधवत घोषणा की हो और भारतीय रिजर्व बैंक द्वारा विनिNदष्ट कतिपय अन्य शतP का पालन किया गया हो।" 2. िविनयम 5 में, उप-िविनयम (2) के बाद, िनम्नलिखित उप-िविनयम जोड़ा जाएगा, अर्थात्:
"(3) प्राधिकृ त Dापारी @ेणी-I बैंकों को यह अनुमति दी गई है कि वे माल/ सॉ)टवेयर के आयात के िलए तीसरे पक्ष (third party) (आपूTतकर्ता से भिन्न पक्ष) को भुगतान करने की अनुमित प्रदान करें, बशतL भारतीय रिजर्व बैंक द्वारा िविनNदष्ट शतP का पालन किया गया हो।"

Foreign Exchange Management (Manner of Receipt & Payment) (Second Amendment) Regulations, 2014
G.S.R. 931(E).—In exercise of the powers conferred by clause (i) of sub-section 6, sub-section (2) of Section 47 of the Foreign Exchange Management Act, 1999 (42 of 1999) and in partial modification of its Notification No.FEMA.14/2000-RB dated May 3, 2000, Reserve Bank of India makes the following amendment in the Foreign Exchange Management (Manner of Receipt & Payment) Regulations, 2000, as amended from time to time, namely:
1. Short title and commencement
(i) These Regulations may be called the Foreign Exchange Management (Manner of Receipt & Payment) (Second Amendment) Regulations, 2014
(ii) They shall be deemed to have come into force from November 08, 2013.@
2. Amendments to the Regulations
1. In Regulation 3, after sub regulation (3), the following should be added, namely:
"(4) Authorized Dealer Category- l (AD Category-l) banks have been permitted to allow payments for export of goods/ software to be received from a Third party (a party other than the buyer) provided, the details of the Third party through which the export proceeds are being realized, have been duly declared by the exporter in the appropriate export declaration form and certain other conditions as stipulated by Reserve Bank of India."
2. In Regulation 5, after sub regulation (2), the following should be added, namely:
"(3) Authorized Dealer Category- l (AD Category-l) banks have been permitted to allow payments to be made for import of goods/software to a Third party (a party other than the supplier) subject to conditions as stipulated by Reserve Bank of India."
