dk-vk- 50¼v½.—यतः, केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1035 (अ), तारीख 07.05.2010 द्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग संख्या 8क के 0.000 कि.मी. से 71.400 कि.मी. (कांडला मुंद्रा पोर्ट सेक्षन) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात्‌ 'प्राधिकरण' संदर्भित किया गया है) को सौंपा है;

और यतः, प्राधिकरण ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 14 के प्रावधान के अनुसरण में, राष्ट्रीय राजमार्ग विकास परियोजना चरण III के अधीन डिजाइन, निर्माण, वित, प्रचालन और हस्तांतरण (डीबीएफओटी) आधार पर राष्ट्रीय राजमार्ग 8क के 0.000 कि.मी. से 71.400 कि.मी. (लगभग लम्बाई 71.400 कि.मी.) तक गांधीधाम (कांडला)-मुंद्रा पोर्ट सेक्षन (जिसे इसमें इसके पश्चात्‌ "उक्त खण्ड" संदर्भित किया गया है) को विकसित करके चार/छह लेन का बनाए जाने तथा उक्त खण्ड के प्रचालन और अनुरक्षण हेतु 03.12.2009 को प्रस्तुत की गई बोली के लिए मैसर्स केएम टोल रोड प्राइवेट लिमिटेड, जिसका पंजीकृत कार्यालय एच ब्लॉक, प्रथम तल, धीरू भाई अंबानी नॉलेज सिटी, नवी मुम्बई-400710 में हैै (जिसे इसमें इसके पश्चात्‌ "रियायतग्राही" संदर्भित किया गया है) के साथ 10.03.2010 को करार किया है (जिसे इसमें इसके पश्चात्‌ "उक्त करार" संदर्भित किया गया है)।

अतः अब, केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त राष्ट्रीय राजमार्ग के उक्त खण्ड के निर्माण, अनुरक्षण, प्रबंध और प्रचालन पर हुए व्यय, निवेषित पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम, यातायात का दबाव तथा प्राधिकरण और रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए, एतद्‌द्वारा यह अधिसूचित करती है कि सड़क खण्ड की निवल लम्बाई 62.670 कि.मी. हेतु चार या अधिक लेन के खण्डों के उपयोग के लिए यांत्रिक वाहनों पर सारणी 1 के स्तम्भ (2) में विनिर्दिष्ट दर पर (जिसे इसमें इसके पश्चात्‌ "आधार दर" संदर्भित किया गया है) तथा स्थायी पुल/बाइपास/संरचनाओं के उपयोग के लिए, जिनकी लागत दस करोड़ रु. या उससे अधिक है नीचे सारणी 1 और 2 में विनिर्दिष्ट प्रकार के वाहनों पर सारणी 2 में विनिर्दिष्ट आधार दरों पर शुल्क उद्‌ग्रहीत एवं संग्रहीत किया जाएगा और उक्त रियायतग्राही को प्राधिकरण द्वारा घोषित वाणिज्यिक प्रचालन की तारीख को और उस तारीख से और प्राधिकरण से पूर्णतः प्रमाणपत्र अथवा अनंतिम प्रमाणपत्र प्राप्त करने पर, जैसी भी स्थिति हो, अथवा इस अधिसूचना के राजपत्र में प्रकाषन पर, जो भी बाद में हो, उक्त नियमों एवं पूर्वोक्त करार के प्रावधानों के अध्यधीन और उनके अनुसार, शुल्क को संग्रहीत एवं प्रतिधारित करने के लिए प्राधिकृत करती है;

(1) नीचे उद्‌ग्रहीत एवं संग्रहीत शुल्क, निम्नलिखित टोल प्लाजा पर, ऐसे प्रत्येक टोल प्लाजा (प्लाजाओं) के लिए विनिर्दिष्ट दूरी हेतु शोध्य और संदेय होगाः

(2) उपर्युक्त के अतिरिक्त, निम्नलिखित बाइपास (बाइपासों), के उपयेाग के लिए जिनकी लागत नीचे विनिर्दिष्ट की गई है, सारणी सं. 2 में विनिर्दिष्ट आधार दरों पर निम्नलिखित टोल प्लाजा (प्लाजाओंं) पर, निम्नलिखित शुल्क भी शोध्य और संदेय होगा।

3. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजी—त हुआ हो और वह टोल प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके लिए वर्ष 2014-15 के लिए मासिक पास की दर 225.00 रूपए (दो सौ पच्चीस रूपए मात्र) होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के प्रावधानों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जाएगा । 4. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्‌ः

5. जो यांत्रिक वाहन अपने श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक या मालिक या प्रभारी व्यक्ति को अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग पर प्रवेष कराने के लिए शुल्क संग्रहण एजेंसी को ऐसी श्रेणी के यांत्रिक वाहन के लिए लागू शुल्क के दस गुना के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक कि ऐसे यांत्रिक वाहन से अतिरिक्त भार को हटा न दिया जाए।

6. यांत्रिक वाहनों के श्रेणी, उनके लिए अनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी । 7. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा । 8.. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और छूट की गणना राजमार्ग परियोजना का लम्बाई को पूरे कर लिए गए खण्ड के आधार पर प्राधिकरण द्वारा की जाएगी। प्राधिकरण द्वारा रियायतग्राही के माध्यम से उसे अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाषित करवाया जाएगा और तत्पष्चात्‌ उक्त नियमों के नियम 5 के अनुसार उसमें वार्षिक तौर पर संषोधन किया जाएगा तथा प्रकाषित किया जाएगा, परन्तु शर्त यह है कि शुल्क में पिछली बार के संषोधन की तारीख से 6 (छह) महीने की अवधि में कोई संषोधन नहीं किया जाएगा।

NOTIFICATION

New Delhi, the 6th January, 2015

S.O. 50(E).— Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1035 (E), dated 07.05.2010, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 0.000 to km 71.400 (Kandla- Mudra Port Section) of National Highway No. 8A in the State of Gujarat to the National Highways Authority of India (hereinafter referred to as the "Authority");

And whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement on 10.03.2010 (hereinafter referred to as said agreement) with M/s KM Toll Road Private Limited having its registered office at H Block, 1st Floor, Dhirubhai Ambani Knowledge City, Navi Mumbai-400710 (hereinafter referred to as the "Concessionaire"), for the bid submitted on 03.12.2009 for the development of Gandhidham (Kandla) – Mundra Port Section from km 0.000 to km 71.400 (approx. length 71.400 km) on National Highway No. 8A (hereinafter referred to as the "said section") to four/six laning and operation and maintenance of the said section under NHDP Phase-III on Design, Build, Finance, Operate and Transfer (DBFOT) Toll Basis.

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles at the rate specified in column (2) of the Table 1 for net road section length 62.670 km for use of the four and more lane sections (hereinafter referred to as "base rate") and at the base rates specified in the Table No. 2 for permanent bridge/bypass/structures costing Rupees Ten Crore or more on the Type of Vehicles specified in Table 1 and 2 below and authorizes the said Concessionaire to collect and retain the fee on and from the date of Commercial Operation (COD) declared by the Authority and on getting the Completion Certificate or the Provisional Certificate, as the case may be, from the Authority or publication of this Notification in the Official Gazette, whichever is later, subject to and in accordance with the said rules and the provisions of the aforesaid agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for the distance specified for such Toll Plaza(s):

2. In addition to above, the following fee shall also be due and payable for the use of the following bypass(es) at the base rates specified in Table no. 2, cost of which is specified hereunder, at the following Toll Plaza(s):

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five only) for the year 2014-15 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely;

The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

6. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.

7. The Fee rates shall be displayed for information of the users in accordance with rule 12 of the said Rules. 8. Based on the Base rate of Fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of completed portion of the length of the Project Highway. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised and published annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within a period of 6 (six) months from the date of the preceding revision of Fee.
