सं. ए.12(11)1/2009-चि.-IV.― कर्मचारी राज्य बीमा अधिनियम, 1948 (1948 का 34) की धारा 97 की उप-धारा (2क) तथा उप- धारा (2) के खंड (xxi) के साथ पठित उक्त धारा की उप-धारा (1) अर धारा 17 की उप-धारा (3) द्वारा प्रदत्त शक्तियों का प्रयग करत् हुए तथा कर्मचारी राज्य बीमा निगम (दंत्य शिक्षण संकाय पद) भर्ती विनियम, 2009, दिनांक 17 अप्रैल, 2009 के अधिक्रमण में, ऐसे अधिक्रमण से पहले की गई अथवा किए जाने से छूट गई बातों के अलावा, कर्मचारी राज्य बीमा निगम एतद्द्वारा कर्मचारी राज्य बीमा निगम दंत्य महाविद्यालयों के लिए दंत्य शिक्षण संकाय पदों की भर्ती प्रक्रिया क विनियमित करने हेतु निम्नलिखित विनियम बनाता है, अर्थात् :-
1. संक्षिप्त नाम अर प्रारम्भ : (1) ये विनियम कर्मचारी राज्य बीमा निगम दंत्य शिक्षण संकाय पद भर्ती विनियम, 2014 कहे जाएंगे।
(2) ये शासकीय राजपत्र में इनके प्रकाशन की तिथि से लागू होंगे।
2. अनुप्रयज्यता : ये विनियम इन विनियमों के साथ संलग्न अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों पर लागू होंगे।
3. पदों की संख्या, वर्गीकरण, वेतन बैंड तथा ग्रेड वेतन या वेतनमान : उक्त पदों की संख्या, उनका वर्गीकरण अर उनसे सम्बद्ध वेतन बैंड तथा ग्रेड वेतन या वेतनमान उक्त अनुसूची के स्तंभ 2 से 4 में यथाविनिर्दिष्ट होंगे।
4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि : उक्त पदों से संबंधित भर्ती की पद्धति, आयु-सीमा, अर्हताएं अर अन्य मामले उक्त अनुसूची के स्तंभ 5 से 12 में यथाविनिर्दिष्ट होंगे।
5. चयन बोर्ड का गठन : (1) चयन बोर्ड में निम्नलिखित शामिल होंगे :-
(क) भारत सरकार में सचिव या अपर सचिव स्तर का अंशकालिक अध्यक्ष या जिस व्यक्ति ने भारत सरकार में सचिव या अपर सचिव का पद धारित किया हो जिसे सचिव, श्रम अर रजगार मंत्रालय या महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा अध्यक्ष, कर्मचारी राज्य बीमा निगम के विशिष्ट पूर्व अनुमदन से नियुक्त किया जाएगा।
(ख) की जाने वाली भर्ती की शाखा या विशेषज्ञता क्षेत्र के द दंत्य विश्षज्ञ, जिन्हें महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा इस प्रयजन के लिए अनुरक्षित विश्षज्ञों के पैनल में से, चयन बर्ड के अध्यक्ष द्वारा चुना जाएगा।
(ग) नई दिल्ली में चिकित्सा आयुक्त, कर्मचारी राज्य बीमा निगम विभागीय विश्षज्ञ हगा तथा अन्य राज्यों के मामलों में संबंधित राज्य के वरिष्ठ राज्य चिकित्सा आयुक्त अथवा राज्य चिकित्सा आयुक्त विभागीय प्रतिनिधि होंगे। परंतु किसी कारणवश इन अधिकारियों के उपलब्ध न हने की स्थिति में महानिदेशक विभागीय विश्षज्ञ के रूप में किसी अन्य अधिकारी क नामित कर सकता है।
(2) अंशकालिक अध्यक्ष की पदावधि सामान्यतः चयन बर्ड के गठन की तिथि से एक वर्ष के लिए हगी। तथापि, अध्यक्ष, कर्मचारी राज्य बीमा निगम के विशिष्ट पूर्व अनुमदन से महानिदेशक द्वारा उनकी पदावधि कम की अथवा बढ़ाई जा सकती है।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (3) अंशकालिक अध्यक्ष अर चिकित्सा या दंत्य विश्षज्ञ, केंद्र सरकार द्वारा विहित दरों क ध्यान में रखत् हुए समय-समय पर महानिदेशक द्वारा यथा नियत दरों पर यात्रा भत्ता, बैठक शुल्क आदि के हकदार होंगे।
(6) चयन की प्रक्रिया तथा रीति :
(1) उक्त अनुसूची में शामिल इन पदों पर सीधी भर्ती सामान्यतः चयन बोर्ड द्वारा पात्र उम्मीदवारों के साक्षात्कार के आधार पर की जाएगी।
परंतु यदि भर्ती हेतु भिन्न रीति अंगीकृत करनी आवश्यक ह जाती है त अध्यक्ष, कर्मचारी राज्य बीमा निगम का विशिष्ट पूर्व अनुमदन प्राप्त करने के पश्चात महानिदेशक इसे अंगीकृत कर सकेंगे और तथापि, भर्ती की रीति विज्ञापन में अधिसूचित कर दी जाने के पश्चात कई परिवर्तन नहीं किया जा सकेगा।
(2) आयु, अर्हता, अनुभव आदि की विहित अपेक्षाएं पूरा करने मात्र से ही आवेदक क साक्षात्कार हेतु आमंत्रित किए जाने अथवा विज्ञापित पद पर किसी प्रकार के दावे का कोई अधिकार प्राप्त नहीं ह जाएगा।
(3) आवेदनों के संबंध में विज्ञापन जारी करने तथा अध्यक्ष, चयन बर्ड क प्रस्तुत करने के लिए आवेदनों के प्रक्रमण संबंधी समस्त कार्य महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा किया जाएगा।
(4) चयन बर्ड क आवश्यक सचिवीय सहायता, महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा उपलब्ध कराई जाएगी।
7. निरर्हता : ऐसा कई व्यक्ति :-
(क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसका विवाहिती जीवित है; अथवा (ख) जिसने अपने विवाहिती के जीवित रहत् हुए किसी व्यक्ति से विवाह किया है या विवाह करने का करार किया है, उक्त पद पर नियुक्ति का पात्र नहीं हगा :
परन्तु यदि महानिदेशक इस बात से संतुष्ट हैैं कि ऐसा विवाह ऐसे व्यक्ति अर विवाह के अन्य पक्षकार पर लागू स्वीय विधि के अन्तर्गत अनुमेय है अर ऐसा करने के अन्य आधार हैं त वे किसी व्यक्ति क इस विनियम प्रवर्तन से छूट दे सकत् हैं।
8. शिथिल करने की शक्ति : जहाँ कर्मचारी राज्य बीमा निगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा समीचीन है त वे तत्संबंधी कारणों क लेखबद्ध करके तथा केन्द्र सरकार के परामर्श से किसी श्रेणी अथवा वर्ग के व्यक्तियों के संबंध में इन विनियमों के किसी भी उपबंध में आदेश द्वारा शिथिलता दे सकत् हैं।
9. अपवाद : इन विनियमों की कई बात आरक्षणों, आयु-सीमा में शिथिलता अर अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिकों अर व्यक्तियों के अन्य विश्ष वर्गों के लिए उपबंध कराना अपेक्षित है।
10. व्याख्या : यदि इन विनियमों की व्याख्या से संबंधित कोई प्रश्न आता है तो केन्द्र सरकार के परामर्श से उसका निर्णय कर्मचारी राज्य बीमा निगम द्वारा किया जाएगा।

NOTIFICATION
New Delhi, the 23rd December, 2014
No. A.12 (11)/1/2009-Med.-IV—In exercise of the powers conferred by sub-section (1) of Section 97, read with clause (xxi) of sub-section (2) and sub-section (2A) of the said Section and sub-section (3) of Section 17 of the Employees' State Insurance Act, 1948 (34 of 1948) and in supersession of the Employees State Insurance Corporation (Dental Teaching Faculty posts) Recruitment Regulations, 2009 dated the 17th April , 2009, except as respects things done or omitted to be done before such supersession, the Employees' State Insurance Corporation hereby makes the following regulations regulating the method of recruitment to the Dental Teaching Faculty posts in the Employees' State Insurance Corporation Dental Colleges, namely: –
1. Short title and commencement.–(1) These regulations may be called the Employees' State Insurance Corporation Dental Teaching Faculty posts, Recruitment Regulations, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.–These regulations shall apply to the posts specified in column 1 of the Schedule annexed to these regulations.
3. Number of posts, classification , pay band and grade pay or pay scale.–The number of the said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the said Schedule.
4. Method of recruitment, age-limit, qualifications etc.–The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns 5 to 12 of the said Schedule.
5. Composition of Selection Board.–(1) The Selection Board shall consist of–
(a) a part-time Chairman of the status of Secretary or Additional Secretary to the Government of India or a person who had held the post of the status of Secretary or Additional Secretary to the Government of India, who may be appointed by the Secretary, Ministry of Labour and Employment or the Director General, Employees' State Insurance Corporation, with the specific prior approval of the Chairman, Employees' State Insurance Corporation;
(b) two Dental experts from the discipline or specialised field for which recruitment is to be made, who may be chosen by the Chairman Selection Board from the panel of experts maintained for the purpose by the Director General, Employees' State Insurance Corporation.
(c) the Medical Commissioner, Employees' State Insurance Corporation shall be the departmental expert in New Delhi and in case of other States, the Senior State Medical Commissioner or State Medical Commissioner of the respective States shall be the departmental representative :
Provided that the Director General may nominate some other officer as the departmental expert, in case the said officers are not available due to some reasons.
(2) The term of office of the part-time Chairman shall ordinarily be one year from the date of constitution of the Selection Board and his term may, however, be curtailed or extended by the Director General, with the specific prior approval of the Chairman, Employees' State Insurance Corporation.
(3) The part-time Chairman and the Medical or Dental Experts shall be entitled to travelling allowances, sitting fees, etc. at such rates as may be fixed by the Director General from time to time, keeping in view the rates prescribed by the Central Government.
(6) Procedure and manner of Selection.–
(1) The direct recruitment to the posts included in the said Schedule shall ordinarily be made on the basis of an interview of eligible candidates by the Selection Board:
Provided that in case, it becomes necessary to adopt a different mode of recruitment, the Director General may adopt the same after obtaining specific prior approval of the Chairman, Employees' State Insurance Corporation, and however, once a mode of recruitment is notified in the advertisement, no change shall be made subsequently.
(2) Mere fulfillment of the prescribed requirement of age, qualification, experience, etc. shall not confer any right on the applicant to be called for interview or to any claim over the post advertised.
(3) All work relating to issue of advertisement in respect of applications and processing of applications for submission to the Chairman, Selection Board shall be handled by the office of the Director General, Employees' State Insurance Corporation.
10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4](4) The Selection Board shall be provided necessary secretarial assistance by the office of the Director General, Employees' State Insurance Corporation .
7. Disqualification.–No person.–
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Director General may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.
8. Power to relax.–Where the Director General of the Employees State Insurance Corporation is of the opinion that it is necessary or expedient to do so, he may, by order, for reasons to be recorded in writing and in consultation with the Central Government, relax any of the provisions of these regulations with respect to any class or category of persons.
9. Savings.–Nothing in these regulations shall affect reservations, relaxation of age- limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
10 Interpretation.–If any question relating to the interpretation of these regulations arises, it shall be decided by the Employees State Insurance Corporation in consultation with the Central Government.

Note 1 : The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall not exceed three years. Note 2 : The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation and similarly, deputationist shall not be eligible for consideration for appointment by promotion. Note 3 : The maximum age limit for appointment by deputation or absorption shall be not exceeding 56 years as on the closing date of the receipt of applications.
