ंकि वायुयान नियम, 1937 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप सासासासा....काकाकाका....िनिनिनिन.... 32323232((((अअअअ)))).—चू
वायुयान अिधिनयम, 1934 (1934 का XXII) की धारा 14 की अपेक्षानुसार भारत सरकार, नागर विमानन मंत्रालय की तारीख 12 नवंबर, 2014 की अधिसूचना सं. सा.का.िन. 794(अ) के द्वारा प्रकाशित किए गए, जिसे ऐसे )यक्तियों जिनके उनसे प्रभावित होने की संभावना है, से राजपत्र में इस अधिसूचना के प्रकाशित होने के तीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव आमंत्रित करते 4ए भारत के राजपत्र की प्रतियां सार्वजनिक रूप से उपलब्ध कराई गई;
और चू ंकि उक्त अधिसूचना की प्रतियां 12 नवंबर, 2014 को सार्वजनिक रूप से उपलब्ध करा दी गई थी;
और चू ंकि उक्त अधिसूचना में विनि6दष्ट अवधि के अंदर प्रारूप नियमों के संबंध में किसी )यक्ति से कोई आक्षेप या सुझाव प्राप्त नह: 4ए हैं;
अत:, अब, कें <ीय सरकार, उक्त वायुयान अधिनियम की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते 4ए वायुयान िनयम 1937 में और आगे संशोधन करने के लिए निम्निलिखत िनयम बनाती है, अर्थात्:—
1. (1) इन नियमों का संक्षिप्त नाम वायुयान (संशोधन) िनयम, 2015 है।
(2) ये सरकारी राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

(क) िनयम 39ग में, तालिका में, स्तंभ (3) में प्रविष्टि (i) के सामने ''दो वर्ष'' शब्दों के स्थान पर ''पांच वर्ष'' शब्दों को प्रतिस्थापित किया जाए;
(ख) िनयम 42 में-
(i) उप-िनयम (1) में, दूसरे परन्तुक के पश्चात, निम्नलिखित परन्तुक अंत:स्थापित किया जाए, अर्थात्:—
''परन्तु यह और भी कि उस दशा में जहां कालावधि समाप्त भारतीय वाणिज्यिक अनुJप्ति धारक किसी संिवदाकारी राज्य द्वारा जारी विधिमान्य समतुल्य वाणिज्यिक अनुJप्ति पर उड़ान कर रहा है और भारतीय अनुJप्ति के नवीकरण के लिए वह उड़ान अनुभव की अपेक्षाओं को पूरा करता है, उसकी भारतीय अनुJप्ति यदि दो वर्ष पहले समाप्त हो गई है तो उसकी अर्हक जांच और परीक्षण िजसे महािनदेशक आवश्यक समझें, के पश्चात नवीकृ त की जा सके गी'';
(ii) मौजूदा तीसरे परन्तुक में,''परन्तु यह और कि'' शब्द के स्थान पर ''परन्तु यह और भी कि'' शब्दों को प्रतिस्थापित किया जाए;
(ग) िनयम 133क के पश्चात, भाग XII-ख के शीर्ष में,''नार्मल'' शब्द के स्थान पर ''मैनुअल'' शब्द प्रतिस्थापित किया जाए;
(घ) िनयम 133ख में,-
(i) उप-िनयम (1) में, खंड (क) में, उप-खंड (v) में, मौजूदा पाठ के स्थान पर निम्निलिखत उप-खंड प्रतिस्थापित किया जाए, अर्थात:—
''(v) सभी विमानन विषयों के लिए प्रशिक्षण स्कू ल'';
(ii) उप-िनयम (3क) में, ''एक वर्ष'' शब्द जहां वे दोनों स्थान पर आए हैं, शब्दों के स्थान पर ''पांच वर्ष'' शब्दों को प्रतिस्थापित किया जाए;
(iii) उप-िनयम (4) में, खंड (ख) में,''नागर िवमानन िवभाग'' शब्दों के स्थान पर ''नागर िवमानन महािनदेशालय'' शब्दों को प्रतिस्थापित किया जाए;
(iv) उप-िनयम (9) में और उप-िनयम (10) के खंड (क) में, ''नागर उड़नयोग्यता अपेक्षाओं'' शब्दों के स्थान पर ''नागर विमानन अपेक्षाओं'' शब्दों को प्रतिस्थापित किया जाए;
(ङ) अनुसूची ।। में, अनुभाग 'ण' और 'त' में, खंड (2) में,—
(i) उप-खंड (क) में, ''रेPटग जारी करना'' शब्दों के स्थान पर Qमश: ''उपकरण रेPटग परीक्षण का समाधानप्रद रूप में पूरा करना'' शब्दों को प्रतिस्थापित किया जाए;
(ii) उप-खंड (ख) में ''नवीकरण के लिए आवेदन प्रस्तुत किया गया है'' शब्दों के स्थान पर ''Qमश:
उपकरण रेPटग परीक्षण किया गया है'' शब्दों को प्रतिस्थापित किया जाए;
(iii) उप-खंड (ग) में ''रेPटग का नवीकरण'' शब्दों के स्थान पर Qमश: ''उपकरण रेPटग परीक्षण'' शब्दों को प्रतिस्थापित किया जाए;
[भाग II—खण्ड 3 (i)] भारत का राजपत्रा : असाधरण 3(च) अनुसूची XI में,-
(i) ''अनुJा पत्र'' शब्द जहां कह: आता है, वहां ''विमान प्रचालक प्रमाणपत्र'' शब्दों को प्रतिस्थािपत किया जाए;
(ii) पैरा 1 के आरंभ में, ''अनुJा'' शब्द के स्थान पर ''विमान प्रचालक प्रमाणपत्र'' शब्दों को प्रतिस्थापित किया जाए;
(iii) पैरा 5 में, खंड (3) में, ''पRचीस हजार #पए'' शब्दों के स्थान पर ''पचास हजार #पए'' शब्दों को प्रतिस्थापित किया जाए;
(iv) पैरा 5 में, खंड (4) के स्थान पर निम्नलिखित खंड प्रतिस्थापित किया जाए, अर्थात:—
''(4) विमान प्रचालक प्रमाणपत्र जारी करने के लिए बीस लाख रूपए और उसके नवीकरण के लिए दस लाख रूपए की फीस संदेय होगी'';
(v) पैरा 8 में, खंड (2) में, उप-खंड (vii)का लोप किया जाए;
(vi) पैरा 10 के स्थान पर, निम्नलिखित पैरा प्रतिस्थापित किया जाए, अर्थात:—
''10 विमान प्रचालक प्रमाणपत्र में ऐसी सूचना जो महानिदेशक द्वारा विहित की जाए, िनिहत होगी'';
(vii) पैरा 13, 14, 17 और 19 का लोप किया जाए;
(viii) पैरा 20 में, उप-खंड (1) में, ''नागर िवमानन िवभाग'' शब्दों के स्थान पर, ''नागर िवमानन महािनदेशालय'' शब्दों को प्रतिस्थापित किया जाए;
(ix) पैरा 21 के स्थान पर निम्नलिखित पैरा प्रतिस्थापित किया जाए, अर्थात्:—
''21 विमान प्रचालक प्रमाणपत्र का धारक, डाक या कोई अन्य वस्तुओं को प4ंचाने के लिए ऐसी सेवाएं जो महानिदेशक द्वारा विनि6दष्ट की जाएं, निष्पादित करेगा।''

टिप्पटिप्पटिप्पटिप्पणणणण ::::---- मूल िनयम तारीख 23 मार्च, 1937 की अधिसूचना संख्या वी-26 के द्वारा भारत के राजपत्र में प्रकाशित किए गए थे और अंतिम संशोधन तारीख 10 अप्रैल, 2013 को भारत के राजपत्र, असाधारण, भाग-II, खंड 3, उप-खंड (1) में प्रकाशित सा.का.िन. सं. 213(अ), द्वारा किए गए।

NOTIFICATION
New Delhi, the 13th January, 2015
G.S.R. 32(E).─Whereas the draft of certain rules further to amend the Aircraft Rules, 1937, was published, as required by Section 14 of the Aircraft Act, 1934 (XXII of 1934), vide notification of the Government of India in the Ministry of Civil Aviation, published in the Gazette of India, Extraordinary Part- II, Section 3, sub-section (i), vide number G.S.R. 794(E), dated 12th November, 2014, for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in which the said notification was published, were made available to public;
And whereas copies of the Gazette in which the said notification was published were made available to the public on the 12th November, 2014;
And whereas no objections or suggestions have been received from the public in respect of the draft rules within the period specified in the said notification;
Now, therefore, in exercise of the powers conferred by Section 5 of the said Aircraft Act, the Central Government hereby makes the following rules further to amend the Aircraft Rules, 1937, namely: ─
1. (1) These rules may be called the Aircraft (Amendment) Rules, 2015.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules, 1937,—
(a) in rule 39C, in the table against entry (i) in column (3), for the words "Two years" the words, "Five years" shall be substituted;
(b) in rule 42,─
(i) in sub-rule (1), after second proviso, the following proviso shall be inserted, namely.─
"Provided also that, in case where the holder of expired Indian commercial licence is flying on a valid equivalent commercial licence issued by a Contracting State and satisfies the requirement of flying experience for renewal of Indian licence, his Indian licence, if expired beyond two years, shall be renewed after his qualifying the examinations and tests as the Director-General may consider necessary:";
(ii) in the existing third proviso, for the words "Provided further that", the words "Provided also that" shall be substituted;
(c) after rule 133A, in the heading for PART XII-B, for the word, "NORMAL" the word "MANUAL" shall be substituted;
(d) in rule 133B,—
(i) in sub-rule (1), in clause (a), in sub-clause (v), after the existing texts the following sub-clause shall be substituted, namely:─
"(v) training schools for all aviation subjects;".
(ii) in sub-rule (3A), for the words "one year" at both places where they occur, the words "five years" shall be substituted;
(iii) in sub-rule (4), in clause (b), for the words, " Civil Aviation Department," the words "Directorate General of Civil Aviation" shall be substituted;
(iv) in sub-rule (9), and in clause (a) of sub-rule (10), for the words "Civil Airworthiness Requirements" the words, "Civil Aviation Requirements" shall be substituted;
(e) in Schedule II, in sections 'O' and 'P', in clause (2),─
(i) in sub-clause (a), for the words, "issue of the rating" the words, "the satisfactory completion of the instrument rating test" shall respectively be substituted;
[भाग II—खण्ड 3 (i)] भारत का राजपत्रा : असाधरण 5(ii) in sub-clause (b) for the words, "application for renewal has been submitted" the words "test for instrument rating has been conducted" shall respectively be substituted;
(iii) in sub-clause (c) for the words, " renewal of rating" the words, "the instrument rating test" shall respectively be substituted;
(f) in Schedule XI,─
(i) the word "permit" wherever it occurs, the words, "Air Operator Certificate" shall be substituted;
(ii) In paragraph 1, in the beginning, for the word "Permission" the words "Air Operator Certificate" shall be substituted;
(iii) in paragraph 5, in clause (3), for the words, "rupees twenty five thousand" words, "fifty thousand rupees" shall be substituted;
(iv) in paragraph 5, for clause (4), the following clause shall be substituted, namely:-
"(4) A fee of rupees twenty lakhs shall be payable for the issuance of an Air Operator Certificate and rupees ten lakhs shall be payable for renewal thereof;".
(v) in paragraph 8, in clause (2), sub clause (vii) shall be omitted;
(vi) for paragraph 10, the following paragraph shall be substituted, namely:─
"10. The Air Operator certificate shall contain such information as prescribed by the Director General;".
(vii) paragraphs 13, 14, 17 and 19 shall be omitted;
(viii) in paragraph 20, in sub-clause (1) for the words, "Civil Aviation Department," the words, "Directorate General of Civil Aviation" shall be substituted;
(ix) for paragraph 21, the following paragraph shall be substituted, namely:─
"21. The holder of an Air Operator Certificate shall perform such services for conveyance of mail or any other items as specified by the Director General.".
