सासासासा....काकाकाका....िनिनिनिन. 41((((अअअअ).).).).—के *ि!य सरकार, आवँयक वःतु अिधिनयम, 1955 (1955 का 10) क1 धारा 3 के अधीन ूद3 श45य6 का ूयोग करते हुए (cid:27)करोिसन (उपयोग पर िनब;धन और अिधकतम क1मत िनयतन) आदेश, 1993 का और संशोधन करने के िलए िन<निल=खत आदेश करती है, अथा@त ् :—

1. (1) इन िनयम6 का सं=CD नाम (cid:27)करोिसन (उपयोग पर िनब@धंन और अिधकतम क1मत िनयतन) संशोधन आदेश 2015 है ।

(2) ये राजपऽ मF ूकाशन क1 तार!ख को ूवृ3 ह6गे ।

2. (cid:27)करोिसन (उपयोग पर िनब;धन और अिधकतम क1मत िनयतन) आदेश, 1993 (=जसे इसमF इसके पGात ् मूल आदेश कहा गया है) के खंड 2 मF, -

"(क) उपखंड (छ) के पGात ् , िन<निल=खत उपखंड अंतःःथा4पत (cid:27)कया जाएगा, अथा@त ् :—

'(छक) "गैर पी ड! एस (cid:27)करोिसन" से पी ड! एस (cid:27)करोिसन से िभ*न सभी (cid:27)करोिसन अिभूेत हN ।' (ख) उपखंड (झ) के पGात ्, िन<निल=खत उपखंड अंतःःथा4पत (cid:27)कया जाएगा, अथा@त ् :—

'(झक) "गैर पी ड! एस (cid:27)करोिसन" से साव@=जिनक 4वतरण ूणाली के अधीन 4वतQरत (cid:27)करोिसन अिभूेत है =जसे खंड 8 के अधीन 4विशS Tप से रखा गया है ।'

3. मूल आदेश के खंड 3 के उप-खंड (ग) मF "और आई बी पी कं पनी िलिमटेड" शVद6 और अCर6 को हटा (cid:27)दया जाएगा ।

4. मूल आदेश के खंड 7 मF, -

(क) उपखंड (घ) और उपखंड (च) के ःथान पर िन<निल=खत उपखंडोको रखा जाएगा, अथा@त ् :—

(च) समानांतर 4वपणनकता@ को इस अिधिनयम के उपबंध6, िनयम6 और उसके अधीन बताए गए 4विनयम6 और त\समय ूवृ3 4विधयां =जस ूकार से लागू ह6 के अनुपालन करने पर गैर पी ड! एस (cid:27)करोिसन के पैके ज और 4वबय क1 अनुमित होगी ;।"

(ख) उपखंड 7 (छ) को हटा (cid:27)दया जाएगा ।

5. मूल आदेश मF, खंड 7 क को हटा (cid:27)दया जाएगा ।

6. मूल आदेश मF खंड 11 के पGात ्, िन=<निल=खत परंतुक अंतःःथा4पत (cid:27)कया जाएग, अथा@त ् :-

"परंतु यह (cid:27)क समानांतर 4वपणनकता@ (जो आदेश के उपबंध6 का अनुपालन कर रहF है) और उ`च (cid:27)करोिसन तेल (एस के ओ) के थोक bयापार! (जो सरकार! तेल कं पनी cारा िनयु5 (cid:27)कए गए हN) को गैर पी ड! एस (cid:27)करोिसन क1 आपूित@ (cid:27)बयाकलाप, 4वपणन, bयवसाय या वा=णdय को इस आदेश के उपबंध6 से छू ट होगी ।"

7. मूल आदेश मF, अनुसूची क, अनुसूची ख, अनुसूची ग और अनुसूची घ को हटा (cid:27)दया जाएगा ।

MINISTRY OF PETROLEUM AND NATURAL GAS

ORDER

New Delhi, the 19th January, 2015

G.S.R. 41(E).—In exercise of the powers conferred under section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following order further to amend the Kerosene (Restriction on Use and Fixation of Ceiling Price) Order, 1993, namely:—

1. (1) This Order may be called the Kerosene (Restriction on Use and Fixation of Ceiling Price) Amendment Order, 2015.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. In the Kerosene (Restriction on Use and Fixation of Ceiling Price) Order, 1993 (hereinafter referred to as the principal Order), in clause 2, ---

(a) after sub-clause (g), the following sub-clause shall be inserted, namely:—

'(ga) "Non-PDS Kerosene" means all kerosene other than PDS kerosene;'.

(b) after sub-clause (i), the following sub-clause shall be inserted, namely:—

'(ia) "PDS Kerosene" means the kerosene distributed under the Public Distribution System as distinguishable under clause 8;'.

3. In the principal Order, in clause 3, in sub-clause (c), the words and letters "and IBP Co. Limited" shall be omitted.

4. In the principal Order, in clause 7,—

(a) for sub-clauses (d) and (f), the following sub-clauses shall be substituted, namely:—

"(d) The Indian Oil Corporation Limited, Hindustan Petroleum Corporation limited and Bharat Petroleum Corporation Limited shall ensure that quality checks are carried out so that the kerosene meets the specification under Bureau of Indian Standards specification No. IS-1459 in all respects before the indigenously produced kerosene is sold and in case of imported kerosene, before the imported kerosene is discharged into the storage infrastructure at the Port or sold;"

(f) The Parallel Marketeer shall be allowed to package and sell non-PDS kerosene in compliance with the provisions of the Act, the rules and regulations made thereunder and the laws for the time being in force, as may be applicable;".

(b) sub clause 7 (g) shall be omitted.

5. In the principal Order, clause 7A shall be omitted.

6. In the principal Order, after clause 11, the following proviso shall be inserted, namely:—

"Provided that parallel marketeers' (complying with the provisions of the Order), and Superior Kerosene Oil (SKO) wholesale dealers' (appointed by the Government Oil Company) activities of supply, distribution, trade and commerce of non-PDS Kerosene shall be exempted from the provisions of this Order."

7. In the principal Order, Schedules, A, B, C and D shall be omitted.
