सासासासा....काकाकाका....िनिनिनिन.... 52(52(52(52(अअअअ))))————के न्(cid:9)ीय मोटर यान िनयम, 1989 का प्रा(cid:13)प मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 212 की उप-धारा (1) की अपेक्षानुसार, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में, भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अिधसूचना सं. सा.का.िन. 629(अ), तारीख 1 िसतंबर, 2014 के अधीन प्रकाशित किया गया था, जिसमें उन सभी #क्तियों से, िजनके उससे प्रभावित होने की संभावना थी, उस तारीख से, िजसको भारत के राजपत्र में प्रकाशित उक्त अिधसूचना की प्रतियां जनता को उपलब्ध करा दी गई थ+, प,चीस दिन की समाप्ति के पूर्व आक्षेप और सुझाव मांगे गए थे ;
और उक्त अिधसूचना की प्रतियां तारीख 1 िसतंबर, 2014 को जनता को उपलब्ध करा दी गई थीं ;
और कें (cid:9)ीय सरकार के विचार के लिए उक्त प्रा(cid:13)प िनयमों के संबंध में जनता से अब तक कोई आक्षेप और सुझाव प्राप्त नह+ 7ए हैं ;
अतः, अब, कें (cid:9)ीय सरकार, मोटर यान अिधिनयम, 1988 की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते 7ए, के न्(cid:9)ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए निम्नलिखित िनयम बनाती है, अर्थात् :--
1. (1) इन नियमों का संक्षिप्त नाम के न्(cid:9)ीय मोटर यान (दूसरा संशोधन) िनयम, 2015 है ।
(2) ये राजपत्र में इस अधिसूचना के प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. के न्(cid:9)ीय मोटर यान िनयम, 1989 के िनयम 96 के उप-िनयम (9) के खंड (iii) के पश्चात् निम्निलिखत खंड अंतःस्थापित किया जाएगा, अर्थात् :--
"(iv). खंड (ii) और खंड (iii) में विनिDदष्ट तारीख के पूर्व विनिFमत यानों के निम्निलिखत प्रवगG में भा.मा. : 11852 : 2003 (भाग 9) के अनुरूप प्रति एंटी लॉक ब्रेJकग प्रणाली लगानी होगी -- THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2 (क) परिसंकटमय मालों और (cid:9)वीकृ त पेट्रोलियम गैस वहन करने के िलए बनाए गए 1 अक्तू बर, 2006 को या उसके Ik"pkr् विनिFमत ट्रैक्टर - ट्रैलर संयोजन से भिन्न यानों के एन 3 प्रवर्ग ;
- अक्तू बर, ↩
- प्रवर्ग, जो दो मंजलीय परिवहन यान हैं ; (ग) 1 अक्तू बर, 2007 को या उसके पश्चात् विनिFमत यानों के एन3 प्रवर्ग, जो ट्रैक्टर - ट्रैलर संयोजन के रूप में उपयोग होते हैं ; (घ) 1 अक्तू बर, 2007 को या उसके पश्चात् विनिFमत बसों के एम3 प्रवर्ग, जो अिखल भारतीय परिवहन परिमट पर चलते हैं ; [फा. सं. आरटी-11028/20/2006-एमवीएल] संजय बंदोपाध्याय, संयुक्त सिचव टिप्पणटिप्पणटिप्पणटिप्पण :::: मूल िनयम सा.का.िन. 590(अ), तारीख 2 जून, 1989 द्वारा प्रकाशित किए गए थे और अंितम संशोधन सं. सा.का.िन. 27(अ), तारीख 13.01.2015 द्वारा किया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 23rd January, 2015 G.S.R. 52(E).—Whereas the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, was published as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988) vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 629(E), dated the 1st September, 2014, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of twenty five days from the date on which copies of the Official Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 1st September, 2014; And whereas, so far no objections and suggestions have been received from the public in respect of the said draft rules for consideration by the Central Government; Now, therefore, in exercise of the powers conferred by Section 110 of the Motor Vehicles Act, 1988, the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:— 1. (1) These rules may be called as the Central Motor Vehicles (2nd Amendment) Rules, 2015. (2) They shall come into force on the date of publication of this notification in Official Gazette. 2. In the Central Motor Vehicle Rules, 1989, in rule 96, in sub- rule (9), after clause (iii), the following clause shall be inserted, namely:— “(iv) the following categories of vehicles manufactured prior to the dates specified in clauses (ii) and (iii) shall be fitted with Anti-lock Braking System conforming to IS: 11852:2003 (Part 9)— (a) N3 categories of vehicles other than tractor-trailer combination manufactured on and after the 1st day of October, 2006 meant for carrying hazardous goods and liquid petroleum gas; (b) N3 categories of vehicles manufactured on and after the 1st day of October, 2007, that are double decked transport vehicles; (c) N3 categories of vehicles manufactured on and after the 1st day of October, 2007, that are used as tractor-trailer combinations; (d) M3 categories of buses that ply on All India Tourist Permit, manufactured on and after the 1st day of October, 2007.”.
