dk-vk- 229-¼v½-&यतः केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय (सड़क स्कन्ध) की निम्नलिखित संख्यांक अधिसूचना द्वारा निम्नलिखित भूखण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात्‌ "प्राधिकरण" संदर्भित किया गया है) को सौंपे हैं;

और यतः, प्राधिकरण ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 14 के प्रावधान के अनुसरण में, प्रचालन, अनुरक्षण और हस्तांतरण (ओएमटी) आधार पर गुवाहाटी बाइपास से रारा-37,36 एवं 54/54इ के गुवाहाटी बाइपास-नगांव-दबोका-उडौली सेक्षन और 163.90 कि.मी. से 262.725 कि.मी. (रारा-37), 0.000 कि.मी. से 15.943 कि.मी. (रारा-37) 5.500 कि.मी. से 35.862 कि.मी. (रारा-36), 0.000 कि.मी. से 40.000 कि.मी. (54/54इ) (जिसे इसमें इसके पश्चात्‌ "उक्त सेक्षन" संदर्भित किया गया है) के प्रचालन और अनुरक्षण हेतु 22.05.2014 को प्रस्तुत की गई बोलियों के लिए मैसर्स नार्थ ईस्ट टोलवेज प्राइवेट लिमिटेड, जिसका पंजीकृत कार्यालय 101, श्री अम्बा शान्ति चेम्बर्स, होटल लीला के सामने, अंधेरी-कुर्ला रोड, अंधेरी ईस्ट, मुम्बई-400059 में है (जिसे इसमें इसके पश्चात्‌ "रियायतग्राही" संदर्भित किया गया है) के साथ 17 अक्तूबर, 2014 को करार किया था (जिसे इसमें इसके पश्चात्‌ "उक्त करार" संदर्भित किया गया है);

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार न, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008, जिसे सा.का.नि. 838(अ), तारीख 5 दिसम्बर, 2008 द्वारा प्रकाषित किया गया था (जिसे इसमें इसके पश्चात्‌ "उक्त नियम" संदर्भित किया गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) की धारा 8क और बोली प्रस्तुत करने की तारीख तक इसके संषोधन द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त खण्ड के अनुरक्षण, प्रबंध और प्रचालन पर हुए व्यय, निवेषित पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम यातायात का दबाव और प्राधिकरण तथा रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए, एतद्‌द्वारा यह अधिसूचित करती है कि सड़क खण्ड की निवल लम्बाई 166.059 कि.मी. (1.237 कि.मी. की संरचना को छोड़कर जिसकी लम्बाई 60 मीटर से अधिक है और समकक्ष लम्बाई 12.37 कि.मी. है) हेतु चार या अधिक लेन के उपयोग हेतु सारणी-1 में विनिर्दिष्ट यांत्रिक वाहनों पर नीेचे सारणी 1 के स्तम्भ (1) में विनिर्दिष्ट दर पर (जिसे इसमें इसके पश्चात्‌ "आधार दर" संदर्भित किया गया है) और बाइपासों, जिनकी कुल लम्बाई 37.866 कि.मी. है, जिसकी प्रत्येक बाइपास की लागत दस करोड़ या अधिक है, के उपयोग हेतु शुल्क उद्‌ग्रहीत एवं संग्रहीत किया जाएगा और उक्त खण्ड के उपयोग के लिए उक्त रियायतग्राही को प्राधिकरण द्वारा घोषित वाणिज्यिक प्रचालन की तारीख को और उस तारीख से अथवा इस अधिसूचना के राजपत्र में प्रकाषन पर, इनमें से जो भी बाद में हो, करार में यथा-विनिर्दिष्ट समापन की तारीख तक, शुल्क संग्रहीत एवं प्रतिधारित करने हेतु प्राधिकृत करती है;

नोटः सेक्षन के पूरा होने पर इसे रियायतग्राही को सौंप देने के बाद अपूर्ण सेक्षन साइट का हिस्सा बन जाएगा तथा ऐसे खण्ड के पूरा होने और उसे रियायतग्राही को सौंपने के बाद यह शुल्क के उद्‌ग्रहण और संग्रहण के लिए उपलब्ध रहेगा।

(2) उपर्युक्त के अतिरिक्त, निम्नलिखित बाइपास (बाइपासों), जिनकी लागत 10 करोड़ रुपए या अधिक है, के उपयोग के लिए निम्नलिखित टोल प्लाजाओं पर, ऐसे टोल प्लाजाओं के लिए विनिर्दिष्ट लम्बाई हेतु, आधार दर के डेढ़ गुना की दर से निम्नलिखित शुल्क भी शोध्य और संदेय होगा।

* सेक्षन के पूरा होने पर इसे रियायतग्राही को सौंप देने के बाद अपूर्ण सेक्षन साइट का हिस्सा बन जाएगा तथा ऐसे खण्ड के पूरा होने और उसे रियायतग्राही को सौंपने के बाद यह शुल्क के उद्‌ग्रहण और संग्रहण के लिए उपलब्ध रहेगा।

3. उपर्युक्त के अतिरिक्त, निम्नलिखित संरचनाओं, जिनकी लम्बाई 60 मीटर से अधिक है, के उपयोग के लिए भी संरचनाओं की लम्बाई को समकरण गुणक 10 से गुणा करके राजमार्ग की समकक्ष लम्बाई में परिवर्तित करते हुए निम्नलिखित टोल प्लाजा (प्लाजाओं) पर निम्नलिखित शुल्क भी शोध्य और संदेय होगाः

* 60 मीटर से अधिक की लम्बाई वाली संरचनाओं का ब्यौरा निम्न प्रकार हैः

** सेक्षन के पूरा होने पर इसे रियायतग्राही को सौंप देने के बाद अपूर्ण सेक्षन साइट का हिस्सा बन जाएगा तथा ऐसे खण्ड के पूरा होने और उसे रियायतग्राही को सौंपने के बाद यह शुल्क के उद्‌ग्रहण और संग्रहण के लिए उपलब्ध रहेगा।

4. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजी—त हुआ हो और वह टोल प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके लिए वर्ष 2014-15 के लिए मासिक पास की दर 225.00 रूपए (दो सौ पच्चीस रूपए मात्र) होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा।

5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्‌ः

6 जिस जिले में टोल प्लाजा पड़ता है उस जिले में पंजी—त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।

7.. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक या मालिक या प्रभारी व्यक्ति को अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग पर प्रवेष कराने के लिए शुल्क संग्रहण एजेंसी को यांत्रिक वाहनों की ऐसी श्रेणी के लिए लागू शुल्क के दस गुना के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।

8. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं उक्त नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।

9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।

10. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और छूट की गणना प्राधिकरण द्वारा की जाएगी। उसे प्राधिकरण द्वारा रियायतग्राही के माध्यम से अंग्रजी तथा स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाषित करवाया जाएगा और तत्पष्चात्‌ उक्त नियमों के नियम 5 तथा रियायत करार के प्रावधानों के अनुसार उसमें वार्षिक तौर पर संषोधन किया जाएगा तथा प्रकाषित किया जाएगा, परन्तु शर्त यह है कि शुल्क में पिछली बार किए गए संषोधन की तारीख से 6 (छह) महीने तक ऐसा कोई संषोधन नहीं किया जाएगा।

11. वाणिज्यिक प्रचालन की तारीख से परियोजना की वसूल की जाने वाली पूंजीगत लागत 2413.65 करोड़ रुपए (दो हजार चार सौ तेरह करोड़ पैंसठ लाख रुपए मात्र) है। वाणिज्यिक प्रचालन की तारीख से, टोल का संग्रहण रियायतग्राही द्वारा राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008, के अधीन की गई व्यवस्था के अनुसार लागू दरों पर तथा बोली की नियत तारीख तक उसमें किए गए संषोधन तक किया जाएगा। पूंजीगत लागत की वसूली रियायत शुल्क के माध्यम से वाणिज्यिक प्रचालन की तारीख को एनपीवी निकालने हेतु 12% प्रतिवर्ष की दर से छूट देते हुए की जाएगी। जिस दिन पूंजीगत लागत की वसूली हो जाएगी टोल दरों को घटाकर 40% कर दिया जाएगा। रियायत शुल्क को भी घटाकर देय राषि का 40% कर दिया जाएगा और खण्ड 2.1.1.1 के अनुसार 10% की वार्षिक वृद्धि भी लागू होगी।

12. यदि किसी कारण से वाणिज्यिक प्रचालन की तारीख को पहले कर दिया जाता है। स्थगित कर दिया जाता है तो वसूल की जाने वाली पूंजीगत लागत का फिर से हिसाब लगाया जाएगा और इसके बारे में इंजीनियर/स्वतंत्र इंजीनियरों द्वारा वाणिज्यिक प्रचालन की वास्तविक तारीख के बाद 30 दिनों के अन्दर रियायतग्राही को सूचित किया जाएगा।

Transport ( Roads Wing), following numbers

issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch (above) to the National Highways Authority of India (hereinafter referred to as the Authority) ;

And Whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said agreement) on 17th October, 2014 with M/s Northeast Tollways Private Limited having its registered office at 101, Shree Amba Shanti Chambers, Opp. Hotel Leela, Andheri-Kurla Road, Andheri East, Mumbai-400059 (hereinafter referred to as the "Concessionaire"), for bids submitted on 22.05.2014 for the Operation and Maintenance of Guwahati Bypass-Nagaon-Daboka-Udauli Section of NH-37, 36 & 54/54E from Guwahati Bypass and from Km. 163.90 to 262.725 (NH-37), from Km. 0.000 to Km. 15.943 (NH-37), from Km. 5.500 to Km. 35.862 (NH-36), from Km. 0.000 to Km. 40.000 (NH-54/54E) (hereinafter referred to as the "said section") on Operation, Maintenance & Transfer (OMT) basis;

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and its amendment till bid submission date (hereinafter referred to as the "Rules"), the Central Government, having regard to the expenditure involved in maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of said section at the rates specified in column (2) of Table 1 for net road section length of 166.059 km (excluding 1.237 Km of structure having length more than 60 m with equivalent length of 12.37 Km) for use of the four & more lane sections(hereinafter referred to as "base rate") and one and half times of base rate for bypasses having an aggregate length of 37.866 Km costing each Bypass Rupees Ten Crore or more on the type of vehicles specified in column(1) of Table 1 below and authorizes the said Concessionaire to collect and retain the fee for the use of the said section on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

2. In addition to above, the following fee shall also be due and payable for the use of the following bypass(es) costing Rs 10 crore or more at the following Toll Plazas at one and half times the base rate for the length of bypasses specified for such Toll Plazas:

3. In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

available for levying and collecting fee after completion of such stretch and handing over to Concessionaire.

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two Hundred and Twenty- five only) for the year 2014-15, which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.

9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.

10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from preceding revision of fee.

11. The Present Value of Capital Cost of the project to be recovered from the date of COD is Rs. 2413.65 Crore (Rupees Two Thousand Four Hundred Thirteen Crore and Sixty-five Lac Only). From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and further amendments till bid due date. The Capital Cost shall be recovered through Concession Fee by discounting @ 12% per annum to arrive at NPV as on the date of commercial operation (COD). After the day on which the Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of the rate being charged. The Concession Fee shall also be reduced to 40% of the amount payable and annual increment of 10% as per Clause 21.1.1 shall be applicable.

12. In case, due to any reason, COD is advanced/postponed, the capital Cost to be recovered shall be reworked and intimated to the concessionaire within 30 days after actual COD, by the Engineer/Independent Engineers.
