सासासासा....काकाकाका....िनिनिनिन.... 58585858((((अअअअ)))).—के न्(cid:9)ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए, कितपय नियमों का निम्नलिखित प्रारूप, िजसे के न्(cid:9)ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 110 की उपधारा (1) के खंड (ग) द्वारा प्रदत्त शक्तियों का प्रयोग करते !ए, बनाने का प्रस्ताव करती है, उक्त अिधिनयम की धारा 212 की उपधारा (1) की अपेक्षानुसार उन सभी )क्तियों की जानकारी के िलए, िजनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों को उस तारीख से, िजसको भारत के उस राजपत्र की प्रतियां, जिसमें यह अिधसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अविध की समाप्ति के प3ात् िवचार किया जाएगा ;
इन प्रारूप नियमों पर आक्षेप या सुझाव, यदि कोई हों, संयुक्त सिचव (परिवहन), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, संसद् मार्ग, नई दिल्ली- 110001 को भेजे जा सकें गे ;
के न्(cid:9)ीय सरकार द्वारा उक्त प्रारूप नियमों की बाबत, ऐसे किन्ही आक्षेपों और सुझावों पर, जो किसी )क्ति से पूव;क्त अविध की समाप्ति से पूर्व प्राप्त हों, िवचार किया जाएगा ।
प्रारूपप्रारूपप्रारूपप्रारूप िनयमिनयमिनयमिनयम
1. (1) इन नियमों का संक्षिप्त नाम के न्(cid:9)ीय मोटर यान (संशोधन) िनयम, 2015 है ।
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे।
478 GI/2015 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. के न्(cid:9)ीय मोटर यान िनयम, 1989 (जिसे इसमें इसके पश्चात् मूल िनयम कहा गया है) के िनयम 96ग में, विद्यमान परन्तुक के स्थान पर निम्निलिखत परन्तुक रखा जाएगा, अर्थात् :--
''परंतु 1 फरवरी, 2015 को या उसके पश्चात् विनिCमत प्रत्येक कृ षि ट्रैक्टर और उसके कृ षि ट्रेलर में, हाईLोलिक ब्रेक प्रणाली रखने वाले कृ षि ट्रेलर को सुकर बनाने के लिए नियम 97 के उपिनयम (3) में निPदष्ट एआईएस : 043- 2005 विनिदRश के अनुसार निम्नलिखित अपेक्षाओं को पूरा किया जाएगा, अर्थात् :--
(क) एक हाईLोलिक पंप और वाल्व, जो ट्रैक्टर पर समुचित पाइप से जुड़े हों ;
(ख) ओईएम द्वारा उपसाधन के रूप में दी गई ट्रैक्टर पर एक हाईLोलिक पाइप और दाब लाइन, जो उनके डीलरों द्वारा फिट की जानी है, जो ट्रेलर के लिए हाईLोलिक लाइन की निकासी को सुकर बनाने के लिए ट्रैक्टर के पिछले भाग पर समाप्त होती है ;
(ग) प्रत्येक किस्म और माडल के ट्रैक्टर िविनर्माता द्वारा ट्रैक्टर के पिछले भाग पर एक हाईLोलिक पाइप और दाब लाइन के उपलब्ध रहने को मैनुअल में स्पष्टतया विनिPदष्ट किया जाएगा ;
(घ) ट्रैक्टर में ट्रेलर ब्रेक संचालन के बल या लिक को जोड़ने की न्यूनतम [यवस्था होगी ।''।
3. मूल नियमों के नियम 97 के उपिनयम (3) में निम्निलिखत परंतुक अंत:स्थापित किया जाएगा, अर्थात् :--
''परंतु 1 फरवरी, 2015 को या उसके पश्चात् विनिCमत प्रत्येक कृ षि ट्रेलर में, समय-समय पर यथासंशोिधत एआईएस : 043-2005 विनिदRश के अनुसार कृ षि ट्रेलर ब्रेक प्रणाली की अनुपालना के लिए निम्नलिखित अपेक्षाओं को पूरा किया जाएगा, अर्थात् :--
(क) ट्रेलर पर हाईLोलिक ब्रेक प्रणाली या इनCसया ओवर-रन ब्रेक प्रणाली जैसे, आधार ब्रेक (Lम या डिस्क, आदि) संचालन प्रणाली, जिसके अंतर्गत आनुपातिक या नियंत्रण वाल्व भी है ;
(ख) समय-समय पर यथासंशोिधत एआईएस : 043-2005 के अनुसार कृ षि ट्रेलर ब्रेक प्रणाली का किस्म अनुमोदन ।'' ।

NOTIFICATION
New Delhi, the 27th January, 2015
G.S.R. 58(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by clause (c) of sub-section (1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988) is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which copies of this notification as published in the Official Gazette are made available to the public.
[भाग II—खण्ड 3 (i)] भारत का राजपत्रा : असाधरण 3Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi – 110001;
The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called the Central Motor Vehicles (….Amendment) Rules, 2015.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred to as the principal rules), in rule 96C, for the existing proviso, the following proviso shall be substituted, namely:-
"Provided that every agricultural tractor manufactured on or after 1st January, 2016 and coupled with agricultural trailer, shall meet the following requirements to facilitate agricultural trailer having hydraulic brake system as per AIS:043-2005 specification referred to in sub-rule (3) of rule 97, namely:-
(a) a hydraulic pump and valve with suitable pipe connections on the tractor;
(b) a hydraulic piping and pressure lines on the tractor supplied by the OEM as accessories, to be fitted on the tractor by their dealers which shall be terminated at the rear end of the tractor, to facilitate tapping of hydraulic line for trailer;
(c) the hydraulic line pressure available at the rear end of the tractor shall be clearly specified by the manufacturer for each type and model of the tractor in the owner's manual;
(d) the tractor shall have the minimum provision for connecting the trailer brake actuation cable or linkage.".
3. In the principal rules, in rule 97, in sub-rule (3), the following proviso shall be inserted, namely:-
"Provided that every agricultural trailer manufactured on or after 1st January, 2016 shall meet the following requirements for compliance to agricultural trailer brake system as per AIS:043-2005 specification, as amended from time to time, namely:-
(a) fitment of the hydraulic braking system or inertia over-run braking system such as foundation brake (drum or disc, etc.) actuation systems on the trailer including the proportional or control valve;
(b) type approval of agricultural trailer braking system requirements as per AIS- 043-2005, as amended from time to time.".

Note: The principal rules were notified in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (i) vide notification number G.S.R. 590(E) dated the 2nd June, 1989 and lastly amended vide notification number G.S.R. 27(E) dated the 13.01.2015.
