संसंसंसं.... 3333----16161616////विनि(cid:25)दष्टविनि(cid:25)दष्टविनि(cid:25)दष्टविनि(cid:25)दष्ट खाद्य खाद्य खाद्य खाद्य////अिधसूचना अिधसूचना अिधसूचना अिधसूचना ((((खाद्य सहयोज्यखाद्य सहयोज्यखाद्य सहयोज्यखाद्य सहयोज्य))))////एफएसएसएआईएफएसएसएआईएफएसएसएआईएफएसएसएआई----2014 2014 2014 2014 :::: खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) िविनयम, ²⁰¹¹ का और संशोधन करने के िलए कितपय विनियमों का िनम्निलिखत प्रारूप, जो भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, कें !ीय सरकार के पूर्व अनुमोदन से खाद्य सुरक्षा और मानक अिधिनयम, 2006 (2006 का 34) की धारा 16 की उपधारा (2) के खंड (ख) के साथ पठित धारा 92 की उपधारा (2) के खंड (ड.) द्वारा प्रदत्त शक्तियों का प्रयोग करते -ए, बनाने का प्रस्ताव करता है, उक्त उपधारा (2) द्वारा यथापेक्षित उन सभी 2क्तियों की जानकारी के िलए, िजनका उससे प्रभावित होना संभा2 है, प्रकाशित करता है और यह सूचना दी जाती है कि उक्त प्रारूप िवनियमों पर उस तारीख से, िजसको इस अिधसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध कराई जाती हैं, से साठ दिन की अविध की समाप्ति के Ik"pkत् िवचार किया जाएगा ;

आक्षेप और सुझाव, यदि कोई हों, मुख्य कार्यपालक अिधकारी, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, खाद्य और औषिध प्रशासन भवन, कोटला रोड, नई दिल्ली-110002 को भेजे जा सकें गे ;

ऐसे आक्षेपों और सुझावों पर, जो इस प्रकार विनि=दष्ट अविध की समाप्ति से पूर्व उक्त प्रारूप विनियमों की बाबत किसी 2क्ति से प्राप्त हों, खाद्य प्राधिकरण द्वारा िवचार किया जाएगा ।

प्राप्राप्राप्रारूपरूपरूपरूप िविनयमिविनयमिविनयमिविनयम

1. (1) इन विनिमयों का संक्षिप्त नाम खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) (संशोधन) िविनयम, 2015 है ।

(2) ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) िविनयम, 2011 में, िविनयम 2.13 के पश्चात् निम्निलिखत िविनयम अंत:स्थापित किए जाएंगे, अर्थात् :--

''''''''2.142.142.142.14 ग्लूग्लूग्लूग्लूटेन मुक्तटेन मुक्तटेन मुक्तटेन मुक्त खाद्य खाद्य खाद्य खाद्य---- (1) इन खाद्यों में एक या अधिक ऐसे संघटक हैं या ये ऐसे संघटकों से बने -ए हैं, जिसमें, जहां अंतKनहित ग्लूटेन को कम कर दिया गया है और ग्लूटेन स्तर कु ल िमलाकर 20 मिNा/किNा. से अधिक नहO है, वहां चावल, राई, जौ, जई और ज्वार या रागी, दालें और फली हो सकती हैं जो उपभोक्ता को यथाविSीत या यथा वितरित खाद्य पर आधारित है ।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (2) उत्पाद में, गेTं या उसका कोई संघटक नहO होता है और इसमें खाद्य सुरक्षा और मानक (पैकें जिग और लेबलिग) िविनयम, 2011 के उप िविनयम 2.4.5 (52) में यथा उपबंधित लेबल घोषणा होगी ।

(3) ऐसा खाद्य, जिनकी प्रकृ ति, ग्लूटेन मुक्त आहार के रूप में प्रयोग किए जाने के लिए उपयुक्त है को ''िवशेष आहार'' , ''िवशेष

आहारिकी'' या किसी अन्य समतुल्य पद के रूप में नामित नहO किया जाएगा । तथापि, ऐसे खाद्य के लेबल पर यह कथन हो सके गा कि

''यह खाद्य ग्लूटेन मुक्त प्रकृ ति का है'' :

परंतु इसमें ऊपर यथावKणत ग्लूटेन मुक्त के लिए आवश्यक सहयोजन उपबंधों का अनुपालन किया जाता है और ऐसे किसी कथन से उपभोक्ता Yमित नहO होता है ।

New Delhi, the 28th, January, 2015

No. 3-16/Specified Foods/Notification(Food Additive)/FSSAI-2014.—The following draft of certain regulations further to amend the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, which the Food Safety and Standards Authority of India proposes to make with the previous approval of the Central Government, in exercise of the powers conferred by clause (e) of sub-section (2) of section 92 read with clause (b) of sub-section (2) of section 16 of the Food Safety and Standards Act, 2006 (34 of 2006), is hereby published as required by the said sub section (2), for information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of a period of sixty days from the date on which copies of the Official Gazette in which this notification is published, are made available to the public;

Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, FDA Bhawan, Kotla Road, New Delhi – 110 002;

The Objections and suggestions which may be received from any person with respect to the said draft regulations, before the expiry of the period specified above, shall be considered by the Food Authority.

Draft Regulations 1. (1) These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives) (Amendment) Regulations, 2015.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, after regulation 2.13, the following regulations shall be inserted, namely:—

"2.14 Gluten-free foods.- (1) These foods consist of or are made from one or more ingredients which may contain rice, rye, barley, oats and millets or ragi, pulses and legumes, where the inherent gluten has been reduced and the gluten level does not exceed 20 mg/kg in total, based on the food as sold or distributed to the consumer.

(2) The product does not contain wheat or any of its ingredients and shall bear the label declaration as provided in the sub-regulation 2.4.5 (52) of Food Safety and Standards (Packaging and Labelling) Regulations, 2011.

(3) A food which, by its nature, is suitable for use as part of a gluten-free diet shall not be named as "special dietary", "special dietetic" or any other equivalent term. However, such a food may bear a statement on the label that "this food is by its nature gluten-free".

Provided that it complies with the essential composition provisions for gluten-free as described above and such a statement does not mislead the consumer.

2.15. Foods specially processed to reduce gluten content to a level above 20 up to 100mg/kg.- These foods consist of one or more ingredients from rice, rye, barley, oats, millets or ragi, pulses and legumes which have been specially processed to reduce the inherent gluten present in them to a level above 20 up to 100 mg/kg in total, based on the food as sold or distributed to the consumer and shall bear the label declaration as provided in the sub-regulation 2.4.5 (53) of Food Safety and Standards (Packaging and Labelling) Regulation, 2011.

2. खाद्य सुरक्षा और मानक (पैके जिग और लेबलिग) िविनयम, 2011 में, िविनयम 2.4 के उप िविनयम 2.4.5 में उपखंड (51) पश्चात् निम्निलिखत उपखंड अंत:स्थापित किए जाएंगे, अर्थात् :--

''(52) खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) िविनयम, 2011 के िविनयम 2.14 में वKणत उत्पादों की दशा में उत्पाद के नाम के ठीक समीप्य में ''ग्लूटेन मुक्त'' शब्द मु!ित होंगे, अर्थात् :--

''ग्लूटेन मुक्त''

(53) खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) िविनयम, 2011 के िविनयम 2.15 में वKणत उत्पादों की दशा में उत्पाद के नाम के ठीक समीप्य में ''न्यून ग्लूटेन'' मु!ित होंगे, अर्थात् :--

''न्यून ग्लूटेन''

Draft Regulations 1. (1) These regulations may be called the Food Safety and Standards (Packaging and Labelling) (Amendment) Regulations, 2015. (2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, in regulation 2.4, in sub regulation 2.4.5, after sub-clause (51), the following sub- clauses shall be inserted, namely: — "(52) The term "Gluten-free" shall be printed in the immediate proximity of the name of the product in the case of products described in regulation 2.14 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, namely: —

"Gluten-Free"

(53) The term "Low-Gluten" shall be printed in the immediate proximity of the name of the product in the case of products described in regulation 2.15 of the Food Safety and Standards(Food Products Standards and Food Additives) Regulations, 2011, namely:-

"Low-Gluten"
