काकाकाका. . . . आआआआ.... 282282282282((((अअअअ) ) ) ) –––– जबकि, के न्(cid:14)ीय सरकार ने, राष्ट्रीय अन्वेषण अिभकरण अिधिनयम, 2008 (2008 का 34) (िजसे इसके बाद 'उक्त अिधिनयम' संद(cid:27)भत किया गया है) की धारा 11 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते +ए, अनुसूिचत अपराधों के विचारण के लिए उक्त अधिनियम की धारा-11 की उप-धारा (1) के प्रयोजनार्थ XLIX अपर सिटी सिविल एवं सत्र न्यायाधीश, बंगलौर सिटी के न्यायालय को 07 जनवरी, 2013 के भारत के राजपत्र, असाधारण भाग-।।, ख6ड-3, उप-ख6ड (ii) में प्रकाशित 31 सितम्बर, 2012 की अधिसूचना सं. का. आ. 78 (अ) के तहत विशेष न्यायालय के रूप में अधिसूचित किया था, िजसका क्षेत्राधिकार संपूर्ण कर्नाटक राज्य था;
और जबकि, @ी सोमराजू, XLVIII अपर सिटी सिविल एवं सत्र न्यायाधीश, बंगलौर िसटी, जिन्हें दिनांक 28 अक्तूबर, 2013 की अधिसूचना सं. 3271 (अ) के तहत उक्त विशेष न्यायालय की अध्यक्षता करने के लिए न्यायाधीश के रूप में नियुक्त किया गया था, का स्थानांतरण हो गया है;
अत: अब के न्(cid:14)ीय सरकार, उक्त अधिनियम की धारा 11 की उप-धारा (3) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते +ए तथा दिनांक 28 अक्तूबर, 2013 की अधिसूचना सं. 3271 (अ) का अधिDमण करते +ए, सिवाय उन कायE के जिन्हें ऐसे अधिDमण के पूर्व सम्पादित कर लिया गया था अथवा करने के लिए छोड़ दिया गया था, @ी शिवन्ना, XLVIII अपर िसटी सिविल एवं सत्र न्यायाधीश, बंगलौर सिटी को सर्वानुमति से तथा कर्नाटक उIच न्यायालय, बंगलौर उIच न्यायालय के माननीय मुख्य न्यायाधीश की सिफारिश पर एतMारा, उक्त विशेष न्यायालय की भी अध्यक्षता करने के लिए न्यायाधीश के रूप में नियुक्त करती है।

NOTIFICATION
New Delhi, the 29th January, 2015
S. O. 282 (E). – Whereas, in exercise of the powers conferred by sub-section (1) of section 11 of the National Investigation Agency Act, 2008 (34 of 2008) (hereinafter referred to as the said Act), the Central Government had, vide notification number S. O. 78(E), dated the 31st December, 2012, published in the Gazette of India, Extraordinary, Part- II, Section 3, Sub-section (ii), dated the 7th January, 2013, notified the Court of XLIX Additional City Civil and Sessions Judge, Bangalore City as the Special Court for the purpose of sub-section (1) of section 11 of the said Act having Jurisdiction throughout the State of Karnataka for the trial of Scheduled Offences;
And whereas, Sri Somaraju, XLVIII Additional City Civil and Sessions Judge, Bangalore City, who was appointed as the Judge to preside over the said Special Court vide notification number S. O. 3271(E), dated 28th October, 2013, has been transferred;
Now, therefore, in exercise of the powers conferred by sub-section (3) of section 11 of the said Act and in supersession of the notification number S. O. 3271 (E), dated 28th October, 2013, except as regards to things done or omitted to be done before such supersession, the Central Government, on the recommendation of the Hon'ble Chief Justice of the High Court of Karnataka, Bangalore, hereby appoints concurrently Shri Shivanna, XLVIII Additional City Civil and Sessions Judge, Bengaluru City as the Judge to also preside over the said Special Court.

बाद 'उक्त अिधिनयम' संद(cid:27)भत किया गया है) की धारा 11 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते +ए, अनुसूिचत अपराधों के विचारण के लिए उक्त अधिनियम की धारा-11 की उप-धारा (1) के प्रयोजनार्थ पूनमल्ली, चेन्नई स्थित बम विस्फोट मामलों के संपूर्ण विचारण हेतु सत्र न्यायालय, चेन्नै को 01 सितम्बर, 2010 के भारत के राजपत्र, असाधारण, भाग-।।, ख6ड-3, उप खण्ड (ii) में प्रकाशित 01 सितम्बर, 2010 की अधिसूचना संख्या का. आ. 2163 (अ.) के तहत विशेष न्यायालय के रूप में अधिसूचित किया था, जिसका क्षेत्राधिकार संपूर्ण तमिलनाडु राज्य था;
और जबकि, तिरू एम. मोनी, सत्र न्यायाधीश जिन्हें दिनांक 28 जुलाई, 2014 की अधिसूचना संख्या का. आ. 1914 (अ) के तहत उक्त विशेष न्यायालय की अध्यक्षता करने के लिए न्यायाधीश के रूप में नियुक्त किया गया था, का स्थानांतरण हो गया है;
अत: अब के न्(cid:14)ीय सरकार, उक्त अधिनियम की धारा 11 की उप-धारा (3) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते +ए तथा दिनांक 28 जुलाई, 2014 की अधिसूचना सं.-का.आ.1914 (अ) का अधिDमण करते +ए, सिवाय उन कायE के जिन्हें ऐसे अधिDमण के पूर्व सम्पादित कर लिया गया था अथवा करने के लिए छोड़ दिया गया था, तिरू पी. मुNगन, जिला न्यायाधीश, जो अभी सत्र न्यायाधीश के रूप में तैनात हैं, को म(cid:14)ास-न्यायाधिकार के उIच न्यायालय के माननीय मुख्य न्यायाधीश की सिफारिशों पर एतMारा, उक्त िवशेष न्यायालय की अध्यक्षता करने के लिए न्यायाधीश के रूप में नियुक्त करती है।

S.O.283(E). – Whereas, in exercise of the powers conferred by sub-section (1) of section 11 of the National Investigation Agency Act, 2008 (34 of 2008) (hereinafter referred to as the said Act), the Central Government had, vide notification number S. O. 2163(E), dated the 1st September, 2010, published in the Gazette of India, Extraordinary, Part- II, Section 3, Sub-section (ii), dated the 1st September, 2010, notified the Sessions Court for exclusive trial of bomb Blast cases, Chennai at Poonamallee as the Special Court for the purpose of sub-section (1) of section 11 of the said Act having Jurisdiction throughout the State of Tamil Nadu for the trial of Scheduled Offences;
And whereas, Thiru M. Mony, Sessions Judge, who was appointed as the Judge to preside over the said Special Court vide notification number S. O. 1914 (E), dated 28th July, 2014, has been transferred;
Now, therefore, in exercise of the powers conferred by sub-section (3) of section 11 of the said Act and in supersession of the notification number S. O. 1914 (E), dated 28th July, 2014, except as regards to things done or omitted to be done before such supersession, the Central Government, on the recommendation of the Hon'ble Chief Justice of the High Court of Judicature at Madras, hereby appoints Thiru P. Murugan, District Judge now posted as Sessions Judge as the Judge to preside over the said Special Court.
