काकाकाका....आआआआ.... 380((((अअअअ).).).).————के (cid:8)ीय सरकार, पर्यावरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उप-धारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:29)ए और भारत सरकार के पर्यावरण और वन मंत्रालय की अिधसूचना संख्यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 (िजसे इसमें इसके प$ात् उक्त राजपत्र अिधसूचना कहा गया है) के अनुसरण में राज्य स्तर समाघात निर्धारण प्राधिकरण (एस.ई.आई.ए.ए.), छत्तीसगढ़ (िजसे इसमें इसके प$ात् प्राधिकरण, छत्तीसगढ़) कहा गया है, गठित करती है जिसमें निम्नलिखित सदस्य होंगे, अर्थात् :-

2. प्राधिकरण, छत्तीसगढ़ के अध्यक्ष और सदस्य राजपत्र में इस अिधसूचना के प्रकाशन की तारीख से तीन वर्ष की अविध के िलए पद धारण करेंगे ।

3. प्राधिकरण, छत्तीसगढ़ ऐसी शक्तियों का प्रयोग करेगा और उक्त राजपत्र अिधसूचना में यथािविनHदष्ट प्रJिया का पालन करेगा ।

4. प्राधिकरण, छत्तीसगढ़, छत्तीसगढ़ राज्य के िलए पैरा-5 के अधीन गठित राज्य स्तर विशेषA मूल्यांकन सिमित (एस.ई.ए.सी.) की सिफारिशों पर उसका िविनश्चय आधारित होगा ।

5. कें (cid:8)ीय सरकार, प्राधिकरण, छत्तीसगढ़ की सहायता करने के िलए प्रयोजन के लिए छत्तीसगढ़ राज्य सरकार के परामर्श से राज्य स्तर विशेषA मूल्यांकन सिमित, छत्तीसगढ़ (िजसे इसमें इसके प$ात् एस.ई.ए.सी. छत्तीसगढ़ कहा गया है) गठित करती है, जिसमें निम्नलिखित सदस्य समाविष्ट होंगे अर्थात् :--

पदधारण करेंगे ।

7. एस.ई.ए.सी., छत्तीसगढ़ की शक्तियों का प्रयोग करेगी और उक्त राजपत्र अिधसूचना में यथािविनHदष्ट प्रJिया का पालन करेगा ।

8. एस.ई.ए.सी., छत्तीसगढ़, सामूिहक उत्तरदाियत्व के िसXांत पर कार्य करेगी और अध्यक्ष प्रत्येक मामले में सर्वसम्मित पर प(cid:29)ंचने का

प्रयास करेगा और यदि सर्वसम्मित पर नहZ प(cid:29)ंचा जा सकता है तो ब(cid:29)मत की दृष्टि से अिभभावी होगा ।

9. छत्तीसगढ़ राज्य सरकार, प्राधिकरण, छत्तीसगढ़ और एस.ई.ए.सी. के िलए सिचवालय के रूप में कार्य करने को किसी अिभकरण को

अिधसूिचत करेगी और सभी िवत्तीय और संभार तंत्र समर्थन िजसके अंतर्गत स्थान, परिवहन और इसके सभी कानूनी कृ त्यों के संबंध में

ऐसी अन्य सुिवधाएं उपलब्ध कराएगी ।

10. प्राधिकरण, छत्तीसगढ़ के अध्यक्ष और सदस्यों तथा एस.ई.ए.सी, छत्तीसगढ़ के अध्यक्ष और सदस्यों को बैठक के िलए फीस, यात्रा

भत्ता और मंहगाई भत्ता छत्तीसगढ़ राज्य सरकार के संबX नियमों के अनुसरण में संदेय होंगे ।

New Delhi, the 4th February, 2015

S.O. 380(E).—In exercise of the powers conferred by sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said Gazette Notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority (SEIAA), Chhattisgarh (hereinafter referred to as the Authority, Chhattisgarh) comprising of the following Members, namely :—

2. The Chairman and Members of the Authority, Chhattisgarh shall hold office for a term of three years from the date of publication of this notification in the Official Gazette. 3. The Authority, Chhattisgarh shall exercise the powers and follow the procedures as specified in the said Gazette notification. 4. The Authority, Chhattisgarh shall base its decision on the recommendations of the State level Expert Appraisal Committee (SEAC) constituted under paragraph 5 for the State of Chhattisgarh. 5. For the purpose of assisting the Authority, Chhattisgarh, the Central Government, in consultation with the State Government of Chhattisgarh, hereby constitutes the State level Expert Appraisal Committee, Chhattisgarh (hereinafter referred to as SEAC, Chhattisgarh) comprising of the following Members, namely :-

6. The Chairman and Members of SEAC, Chhattisgarh shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

7. The SEAC, Chhattisgarh shall exercise the powers and follow the procedures as specified in the said Gazette notification. 8. The SEAC, Chhattisgarh shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail. 9. The State Government of Chhattisgarh shall notify an agency to act as Secretariat for the Authority, Chhattisgarh and SEAC, Chhattisgarh and shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all its statutory functions. 10. The sitting fee, travelling allowance and dearness allowance to the Chairman and Member of the Authority, Chhattisgarh and the Chairman and Members of SEAC, Chhattisgarh shall be paid in accordance with the concerned rules of the State Government of Chhattisgarh.
