सा.का.िन. 914(अ).—कें (cid:11)ीय मोटरयान नियम, 1989 का और संशोधन करने के लिए निम्नलिखित प्रारूप िनयम, जिनको कें (cid:11)ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 110 की उपधारा (1) के खंड (ड.) द्वारा प्रदत्त शक्तियों का प्रयोग करते %ए, बनाने का प्रस्ताव करती है, को उक्त अधिनियम की धारा 212 की उपधारा (1) द्वारा यथा अपेक्षित उसके द्वारा संभा-य प्रभावित सभी -यक्तियों की जानकारी के लिए प्रकाशित किया जाता है ; और नोटिस दिया जाता है कि उक्त प्रारूप नियम पर उस तारीख से तीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा, जब राजपत्र में यथा प्रकाशित इस अधिसूचना की प्रतियां जन साधारण को उपलब्ध करवाई जाए ;
इन प्रारूप नियमों के संबंध में, आक्षेप और सुझाव, यदि कोई हो, तो संयुक्त सिचव, (परिवहन), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, पाAलयामेंट स्ट्रीट, नई दिल्ली – 110001 को ऊपर विनिDदष्ट अवधि के भीतर भेजे जा सकें गे ;
उक्त प्रारूप नियमों के संबंध में किसी -यक्ति से इस प्रकार विनिDदष्ट अवधि के भीतर प्राप्त आक्षेप या सुझाव पर कें (cid:11)ीय सरकार द्वारा विचार किया जाएगा ।

1. (1) इन नियमों का संक्षिप्त नाम कें (cid:11)ीय मोटरयान (सत्रहवाँ संशोधन) िनयम 2015 है ।
(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. कें (cid:11)ीय मोटरयान नियम, 1989 में, िनयम 105 में, उपिनयम (1) में,-
(i) खंड (ख) में, मोटर साइकिल शब्दों का लोप किया जाएगा ;
(ii) खंड (ख) के पश्चात् निम्निलिखत खंड अंत:स्थापित किया जाएगा, अर्थात् :--
फ्(खख) 1 अप्रैल, 2016 को या उसके पश्चात् विनिAमत प्रत्येक दोपहिया में एआईएस : 010(भाग 1) (रैव 1)-2010/एआईएस : 010(भाग2)(रेव 1)-2010/एआईएस : 010(भाग 4) (रेव 1)-2010 और एआईएस : 010(भाग 5) (रेव 5)-2010 के अनुसार पालन अपेक्षाओं के अनुरूप एक हेड लैम्प, और एआईएस : 009(रेव 1)-2011 के अनुसार समय-समय पर यथा संशोधित प्रतिष्ठापन अपेक्षाएं होगी, जो तब स्वत: ही स्विच आन होंगी जब इंजन चालू हो:
परंतु यदि दिन के समय जलने वाला लैम्प एआईएस :012(भाग 10)(रेव 1)-2011 और एआईएस : 010(भाग 5)(रेव 1)-2010 के अनुसार पालन अपेक्षाओं के अनुरूप है, और एआईएस :009(रेव 1)-2011 के अनुसार समय-समय पर यथा संशोधित प्रतिष्ठापन अपेक्षाएं किसी दोपहिए में प्रतिष्ठापित है तो वे स्वत: ही स्विच आन हो जाए यदि इंजन चालू है :
परंतु यह और कि दिन के समय जलने वाला लैम्प स्वत: ही स्विच आफ हो जाएगा यदि इंजन चालू है और हेड लैम्प स्विच आन है;।य्

NOTIFICATION
New Delhi, the 26th November, 2015.
G.S.R. 914(E).--The following draft rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by clause (e) of sub-section (1) of Section 110 of the Motor Vehicles Act, 1988 (59 of 1988) are hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration after expiry of a period of thirty days from the date on which the copies of this notification as published in the Official Gazette are made available to the public;
Objections or suggestions, if any, to these draft rules may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, New Delhi-110001, within the period specified above;
The objections or suggestions, which may be received from any person with respect to the said draft rules within the period so specified will be taken into consideration by the Central Government.

1. (1) These rules may be called the Central Motor Vehicles (Seventeenth amendment) Rules, 2015.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989, in rule 105, in sub-rule (1),--
(i) in clause (b), the words "motor cycles," shall be omitted;
(ii) after clause (b), the following clause shall be inserted, namely:-
"(bb) every two wheeler manufactured on or after the 1st April, 2016 shall have a head lamp, conforming to the performance requirements as per AIS: 010 (Part 1) (Rev 1)-2010 / AIS: 010 (Part 2) (Rev 1)-2010/ AIS: 010 (Part 4) (Rev 1)-2010 and AIS: 010 (Part 5) (Rev 1)-2010, and installation requirements as per AIS: 009 (Rev 1)-2011 as amended from time to time, which shall automatically switch on when the engine is running:
Provided that if day time running lamp, conforming to the performance requirements as per AIS: 012 (Part 10) (Rev 1)-2011 and AIS: 010 (Part 5) (Rev 1)-2010, and installation requirements as per AIS: 009(Rev1)-2011 as amended from time to time, is installed in a two wheeler, it shall switch on automatically if the engine is running:
Provided further that the daytime running lamp shall switch off automatically if the engine is running and the head lamp is switched on;".
