का.आ. 3237(अ).—(cid:19)न(cid:13)न(cid:20)ल(cid:21)खत (cid:24)ा(cid:26)प अ(cid:29)धसूचना, िजसे के &'(cid:8)य सरकार, पया)वरण (संर-ण) अ(cid:29)ध(cid:19)नयम, 1986 (1986 का 29) क3 धारा 3 क3 उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ प(cid:4)ठत उपधारा (1) 9वारा (cid:24)द:त शि<तय= का (cid:24)योग करते हुए, जार(cid:8) करने का (cid:24)Cताव करती है, पया)वरण (संर-ण) (cid:19)नयम, 1986 के (cid:19)नयम 5 के उप(cid:19)नयम (3) क3 अपे-ानुसार, जनसाधारण क3 जानकार(cid:8) के (cid:20)लए (cid:24)का(cid:20)शत क3 जाती है, िजनके उससे (cid:24)भाGवत होने क3 संभावना है; और यह सूचना द(cid:8) जाती है Hक उ<त (cid:24)ा(cid:26)प अ(cid:29)धसूचना पर, उस तार(cid:8)ख से, िजसको इस अ(cid:29)धसूचना वाले भारत के राजपJ क3 (cid:24)(cid:19)तयां जनसाधारण को उपलKध करा द(cid:8) जाती हL, साठ (cid:4)दन क3 अव(cid:29)ध क3 समािMत पर या उसके पNचात ् Gवचार Hकया जाएगा ;

अतः, अब, के &'(cid:8)य सरकार, पया)वरण (संर-ण) (cid:19)नयम, 1986 के (cid:19)नयम 5 के उप(cid:19)नयम (3) और पया)वरण (संर-ण) अ(cid:29)ध(cid:19)नयम, 1986 (1986 का 29) क3 धारा 3 क3 उपधारा (2) के खंड (v) और खंड (xiv) के साथ प(cid:4)ठत और उप धारा (1) 9वारा (cid:24)द:त शि<तय= का (cid:24)योग करते हुए, म(cid:21)णपुर रा]य मS बं(cid:19)नंग व&यजीव अभयार\य क3 सीमा से शू&य Hक. मी. से 9.5 Hक.मी. तक के पYरवत)नीय GवCताYरत -ेJ को बं(cid:19)नंग व&यजीव अभयार\य पाYरिCथ(cid:19)तक3य संवेद(cid:8) जोन (िजसे इसमS इसके पNचात ् पाYरिCथ(cid:19)तक संवेद(cid:8) जोन कहा गया है) के (cid:26)प मS अ(cid:29)धसू(cid:29)चत करती है, िजसका Gववरण (cid:19)न(cid:13)नानुसार है, अथा)त ् :--
1. पा(cid:15)रि&थ(तक संवेद+ जोन का -व&तार और उसक/ सीमाएं--(1) पाYरिCथ(cid:19)तक संवेद(cid:8) जोन का GवCतार बं(cid:19)नंग व&यजीव अभयार\य क3 सीमा से शू&य Hक.मी. से 9.5 Hक.मी. तक पYरवत)नीय GवCताYरत होगा । बं(cid:19)नंग व&यजीव अभयार\य के उ:तर मS पाYरिCथ(cid:19)तक संवेद(cid:8) जोन शू&य Hक.मी. तक GवCताYरत होगा िजसक3 सीमा नागालLड रा]य के साथ सि(cid:13)म(cid:20)लत होगी । पाYरिCथ(cid:19)तक संवेद(cid:8) जोन का -ेJ 233.5 वग) Hक.मी. है |
(2) पाYरिCथ(cid:19)तक संवेद(cid:8) जोन क3 सीमा का वण)न मान(cid:29)चJ मS उपाबंध I के (cid:26)प मS (cid:4)दया गया है |
(3) पाYरिCथ(cid:19)तक संवेद(cid:8) जोन क3 सीमा का मान(cid:29)चJ उनके अ-ांश और देशा&तर स(cid:4)हत उपाबंध II के mप मS उपाबX है ।
(4) पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS आने वाले nाम= क3 सूची (cid:24)मुख dब&दुओं के सम&वय के साथ उपाबंध III के mप मS उपाबX है |
2. पा(cid:15)रि&थ(तक संवेद+ जोन के 3लए आंच3लक महायोजना – (1) रा]य सरकार, पाYरिCथ(cid:19)तक संवेद(cid:8) जोन के (cid:24)योजन= के (cid:20)लए राजपJ मS इस अ(cid:29)धसूचना के अं(cid:19)तम (cid:24)काशन क3 तार(cid:8)ख से दो वष) क3 अव(cid:29)ध के भीतर, Cथानीय Rयि<तय= के परामश) से, और इस अ(cid:29)धसूचना मS (cid:4)दए गए अनुबंध= का पालन करते हुए आंच(cid:20)लक महायोजना तैयार करेगी ।
(2) आचं(cid:20)लक महायोजना रा]य सरकार मS स-म (cid:24)ा(cid:29)धकार(cid:8) 9वारा अनुमो(cid:4)दत होगी |
(3) पाYरिCथ(cid:19)तक3य संवेद(cid:8) जोन के (cid:20)लए आंच(cid:20)लक महायोजना इस अ(cid:29)धसूचना मS Gव(cid:19)न(cid:4)द)Tट mप मS ऐसी र(cid:8)(cid:19)त मS रा]य सरकार तथा सुसंगत के &'(cid:8)य और रा]य Gव(cid:29)धय= के सामंजCय मS भी तथा के &'(cid:8)य सरकार 9वारा जार(cid:8) माग)(cid:19)नदeश, य(cid:4)द कोई हो, 9वारा तैयार होगी |
(4) आंच(cid:20)लक महायोजना, इसमS पया)वरणीय और पाYरिCथ(cid:19)तक3य Gवचार= को समाक(cid:20)लत करने के (cid:20)लए (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत सभी संबX रा]य सरकार के Gवभाग= के परामश) से तैयार होगी, अथा)त ्:--
(i) पया)वरण ;
(ii) वन ;
(iii) शहर(cid:8) Gवकास ;
(iv) पय)टन ;
(v) नगरपा(cid:20)लक ;
(vi) राजCव ;
(vii) कृ Gष ; और
(viii) म(cid:21)णपुर रा]य (cid:24)दूषण (cid:19)नयंJण बोड), ह=गे ।
[भाग II—खण्ड 3(ii)] भारत का राजपत्रा : असाधरण 3(5) आंच(cid:20)लक महायोजना अनुमो(cid:4)दत Gव9यमान भू-उपयोग, अवसंरचना:मक और Hpयाकलाप= पर कोई (cid:19)नबqधन अ(cid:29)धरोGपत नह(cid:8)ं करेगी जब तक Hक इस अ(cid:29)धसूचना मS और आंच(cid:20)लक महायोजना मS सभी अवसंरचना और अ(cid:29)धक (cid:24)भावी और पाYर िCथ (cid:19)तक3य अनुकू ल Hpयाकलाप कारक इस (cid:24)कार Gव(cid:19)न(cid:4)द)Tट न हो ।
(6) आंच(cid:20)लक महायोजना मS अनाrछा(cid:4)दत -ेJ= के जीणtXार, Gव9यमान जल (cid:19)नकाय= के संर-ण, आवाह -ेJ= के (cid:24)बंधन, जल-संभर= के (cid:24)बंधन, भूतल जल के (cid:24)बंधन, मृदा और नमी संर-ण, Cथानीय समुदाय= क3 आवNयकताओं तथा पाYरिCथ(cid:19)तक3 और पया)वरण से संबं(cid:29)धत ऐसे अ&य पहलुओं, िजन पर uयान देना आवNयक है, के (cid:20)लए उपबंध ह=गे ।
(7) आंच(cid:20)लक महायोजना सभी Gव9यमान पूजा Cथल=, nाम= और नगर(cid:8)य बंदोबCत=, वन= के (cid:24)कार और HकCम=, कृ Gष -ेJ=, ऊपजाऊ भू(cid:20)म, हYरत -ेJ जैसे उ9यान और उसी (cid:24)कार के Cथान, उ9यान कृ Gष -ेJ, आHक) ड=, झील= और अ&य जल (cid:19)नकाय= का अwयकं न करेगी ।
(8) आंच(cid:20)लक महायोजना पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS Gवकास को पाYर िCथ (cid:19)तक अनुकू ल Gवकास और Cथानीय समुदाय= क3 जीवकोपाज)न को सु(cid:19)निNचत करते हुए Gव(cid:19)नय(cid:20)मत होगी ।
3. रा6य सरकार 7वारा 8कए जाने वाले उपाय-- रा]य सरकार इस अ(cid:29)धसूचना के उपबंध= को (cid:24)भावी करने के (cid:20)लए (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत उपाय करेगी, अथा)त ् :-
(1) भू-उपयोग - पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS वन=, उ9यान-कृ Gष -ेJ=, कृ Gष -ेJ=, आमोद-(cid:24)मोद के (cid:24)योजन के (cid:20)लए (cid:29)चि&हत Hकए गए पाकi और खुले Cथान= का वा(cid:21)णि]यक और औ9यो(cid:29)गक संबX Gवकास Hpयाकलाप= के (cid:20)लए उपयोग या संपYरवत)न नह(cid:8)ं होगा :
परंतु पाYरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर कृ Gष भू(cid:20)म का संपYरवत)न, मानीटर(cid:8) स(cid:20)म(cid:19)त क3 (cid:20)सफाYरश पर और रा]य सरकार के पूव) अनुमोदन से, Cथानीय (cid:19)नवा(cid:20)सय= क3 आवासीय ज(cid:26)रत= को पूरा करने के (cid:20)लए और पैरा 4 क3 सारणी के Cतंभ (2) के अधीन मद सं. 26, 30, 32 और 37 के सामने सूचीबX Hpयाकलाप= को पूरा करने के (cid:20)लए अनुxात ह=गे, अथा)त ् :-
(i) (cid:24)दूषण उ:प&न न करने वाले लघु उ9योग;
(ii) पाYरिCथ(cid:19)तक3य अनुकू ल पय)टन Hpयाकलाप= के (cid:20)लए पय)टक= के अCथायी आवासन के (cid:20)लए पाYरिCथ(cid:19)तक3य अनुकू ल आरामगाह जैसे टSट, लकड़ी के मकान आ(cid:4)द ;
(iii) वषा) जल संचय; और
(iv) कु ट(cid:8)र उ9योग, िजसके अंतग)त nामीण (cid:20)श(cid:6)पकार भी हL :
परंतु यह और Hक रा]य सरकार के पूव) अनुमोदन और संGवधान के अनुrछे द 244 तथा त:समय (cid:24)वृत्त Gव(cid:29)ध के उपबंध= के अनुपालन के dबना, िजसके अंतग)त अनुसू(cid:29)चत जनजा(cid:19)त और अ&य परंपरागत वन (cid:19)नवासी (वन अ(cid:29)धकार= क3 मा&यता) अ(cid:29)ध(cid:19)नयम, 2006 (2007 का 2) भी है, वा(cid:21)णि]यक या उ9योग Gवकास Hpयाकलाप= के (cid:20)लए जनजातीय भू(cid:20)म का उपयोग अनुxात नह(cid:8)ं होगा :
परंतु यह और भी Hक पाYरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर भू-अ(cid:20)भलेख= मS उपसंजात कोई Jु(cid:4)ट मानीटर(cid:8) स(cid:20)म(cid:19)त के Gवचार (cid:24)ाMत करने के पNचात ् रा]य सरकार 9वारा (cid:24):येक मामले मS एक बार संशो(cid:29)धत होगी और उ<त Jु(cid:4)ट के संशोधन क3 भारत सरकार के पया)वरण, वन और जलवायु पYरवत)न मंJालय को सूचना देनी होगी ।
परंतु यह और भी Hक उपयु )<त Jु(cid:4)ट का संशोधन इस उप पैरा के अधीन यथा उपबं(cid:29)धत के (cid:20)सवाय Hकसी भी दशा मS भू-उपयोग का पYरवत)न सि(cid:13)म(cid:20)लत नह(cid:8)ं होगा ।
परंतु यह और भी Hक िजससे हYरत -ेJ मS जैसे वन -ेJ, कृ Gष -ेJ आ(cid:4)द मS कोई पाYरणा(cid:20)मक कटौती नह(cid:8)ं होगी और अन(cid:24)यु<त या अनु:पादक कृ Gष -ेJ= मS पुन: वनीकरण करने के (cid:24)यास Hकए जाएंगे ।
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)](2) #ाकृ (तक =ोत> -- आचं(cid:20)लक महायोजना मS सभी (cid:24)ाकृ (cid:19)तक {ोत= क3 पहचान क3 जाएगी और उनके संर-ण और पुनन)वीकरण के (cid:20)लए योजना सि(cid:13)म(cid:20)लत होगी और रा]य सरकार 9वारा ऐसे -ेJ= पर या उनके (cid:19)नकट Gवकास Hpयाकलाप (cid:24)(cid:19)तGषX करने के (cid:20)लए ऐसी र(cid:8)(cid:19)त से माग)(cid:19)नदeश तैयार Hकए जाएंगे ।
(3) पय(cid:4)टन – (क) पाYरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर पय)टन संबंधी Hpयाकलाप, जो आंच(cid:20)लक महायोजना का भाग (cid:26)प मS (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत (cid:26)प मS ह=गे ।
(ख) पय)टन महायोजना पय)टन Gवभाग, म(cid:21)णपुर सरकार 9वारा राजCव और वन Gवभाग, म(cid:21)णपुर सरकार के परामश) से तैयार होगी ।
(ग) पय)टन संबंधी Hpयाकलाप (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत के अधीन Gव(cid:19)नय(cid:20)मत ह=गे, अथा)त ् :-
(i) पाYरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर सभी नए पय)टन Hpयाकलाप= या Gव9यमान पय)टन Hpयाकलाप= का GवCतार राT|(cid:8)य Rया} संर-ण (cid:24)ा(cid:29)धकरण, पया)वरण, वन और जलवायु पYरवत)न मंJालय 9वारा जार(cid:8) (समय- समय पर यथा संशो(cid:29)धत) माग)(cid:19)नदेश= के अनुसार होगा िजसमS पाYरिCथ(cid:19)तक पय)टन, पाYरिCथ(cid:19)तक (cid:20)श-ा और पाYरिCथ(cid:19)तक Gवकास को मह:व (cid:4)दया जाएगा और पाYरिCथ(cid:19)तक संवेद(cid:8) जोन क3 वहन -मता के अuययन पर आधाYरत होगा ;
(ii) पाYरिCथ(cid:19)तक3 अनुकू ल पय)टन Hpयाकलाप= के संबं(cid:29)धत पय)टक= के अCथायी (cid:19)नवास के (cid:20)लए आवासन के (cid:20)सवाय पाYरिCथ(cid:19)तक3 संवेद(cid:8) जोन के भीतर होटल और Yरसाट) के नए सं(cid:19)नमा)ण व&यजीव अभयार\य क3 सीमा के 1 Hकलोमीटर के भीतर अनुxात नह(cid:8)ं ह=गे ।
पर&तु संरh-त -ेJ= क3 सीमा से एक Hकलोमीटर क3 दूर(cid:8) से परे और पाYरिCथ(cid:19)तक संवेद(cid:8) जोन के GवCतार तक नए होटल= और Gव~ामCथल= क3 Cथापना पय)टन महायोजना के अनुसार पाYरिCथ(cid:19)तक पय)टन सुGवधाओं के (cid:20)लए पूव)-पYरभाGषत और अ(cid:20)भ(cid:4)हत -ेJ= मS ह(cid:8) क3 अनुxात ह=गे |
(iii) आंच(cid:20)लक महायोजना का अनुमोदन Hकए जाने तक, पय)टन के (cid:20)लए Gवकास और Gव9यमान पय)टन Hpयाकलाप= के GवCतार को वाCतGवक Cथल Gव(cid:19)न(cid:4)द)Tट संवी-ा तथा मानीटर(cid:8) स(cid:20)म(cid:19)त क3 (cid:20)सफाYरश पर आधाYरत संबं(cid:29)धत Gव(cid:19)नयामक (cid:24)ा(cid:29)धकाYरय= 9वारा अनुxात Hकया होगा ।
(4) नैस(cid:21)ग(cid:4)क -वरासत -- पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS मह:वपूण) नैस(cid:29)ग)क Gवरासत के सभी Cथल= जैसे सभी जीन कोश आरh-त -ेJ, शैल Gवरचनाएं, जल (cid:24)पात=, झरन=, घाट(cid:8) मागi, उपवन=, गुफाएं, Cथल=, (cid:127)मण, अNवरोहण, (cid:24)पातो आ(cid:4)द क3 पहचान क3 जाएगी और उ&हS संरh-त Hकया जाएगा तथा उनक3 सुर-ा और संर-ा के (cid:20)लए इस अ(cid:29)धसूचना के (cid:24)काशन क3 तार(cid:8)ख से छह मास के भीतर, उपयु<त योजना बनाएगी और ऐसी योजना जोनल माCटर Mलान का भाग होगा ।
(5) मानव (न3म(cid:4)त -वरासत &थल> - पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS भवन=, संरचनाओं, (cid:20)श(cid:6)प-त€य, ऐ(cid:19)तहा(cid:20)सक, कला:मक और सांCकृ (cid:19)तक मह:व के -ेJ= क3 पहचान करनी होगी और इस अ(cid:29)धसूचना के (cid:24)काशन क3 तार(cid:8)ख से छह माह के भीतर उनके संर-ण क3 योजनाएं तैयार करनी ह=गी तथा आंच(cid:20)लक महायोजना मS सि(cid:13)म(cid:20)लत क3 जाएंगी ।
(6) Aव(न #दूषण -- पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS uव(cid:19)न (cid:24)दूषण के (cid:19)नयंJण के (cid:20)लए रा]य सरकार का पया)वरण Gवभाग वायु ((cid:24)दूषण (cid:19)नवारण और (cid:19)नयंJण) अ(cid:29)ध(cid:19)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:19)नयम= के उपबंध= के अनुसरण मS माग)दश)क (cid:20)सXांत और Gव(cid:19)नयम तैयार करेगा ।
(7) वायु #दूषण -- पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS, वायु (cid:24)दूषण के (cid:19)नयंJण के (cid:20)लए रा]य सरकार का पया)वरण Gवभाग वायु ((cid:24)दूषण (cid:19)नवारण और (cid:19)नयंJण) अ(cid:29)ध(cid:19)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:19)नयम= के उपबंध= के अनुसरण मS माग)दश)क (cid:20)सXांत और Gव(cid:19)नयम तैयार करेगा ।
(8) बCह=ाव का (न&सारण -- पाYरिCथ(cid:19)तक संवेद(cid:8) जोन मS उपचाYरत ब(cid:4)ह{ाव का (cid:19)नCसारण जल ((cid:24)दूषण (cid:19)नवारण तथा (cid:19)नयंJण) अ(cid:29)ध(cid:19)नयम, 1974 (1974 का 6) और उसके अधीन बनाए गए (cid:19)नयम= के उपबंध= के अनुसार होगा ।
[भाग II—खण्ड 3(ii)] भारत का राजपत्रा : असाधरण 5(9) ठोस अप3शFट -- ठोस अप(cid:20)शTट= का (cid:19)नपटान (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत (cid:26)प मS होगा -

NOTIFICATION
New Delhi, the 30th November, 2015
S.O. 3237(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the Public;

Draft Notification
WHEREAS, Bunning Wildlife Sanctuary in the Tamenglong District of Manipur, Covering over an area of 115.8 square kilometres, notified vide the State Government of Manipur notification number 55/14/97 dated the 8th September, 1997, has got unique ecosystem of Alpine grassland and Forest ecosystem at the catchment of four important rivers, natural water fall etc. hosting varied floral and faunal diversity including Barking deer, Sambar, Leopard, Jackal, Pangolin, Wild boar, Tiger, Jungle cat, Martens, Clouded leopard, Golden cat, Slow etc;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Bunning Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 9.5kilometre from the boundary of the Bunning Wildlife Sanctuary in the State of Manipur as the Bunning Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone is varies from zero to9.5 kilometres from the boundary of the Bunning Wildlife Sanctuary. The extents of Eco-sensitive Zone is zero kilometre at North of the Wildlife Sanctuary, which shares boundary with State of Nagaland. The area of Eco- sensitive Zone is 233.5square kilometre.
(2) The boundary description of the Eco-sensitive Zone is appended as Annexure I.
(3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended as Annexure II.
(4) The list of the villages falling within Eco-sensitive Zone along with coordinates of prominent points is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
i. Environment;
ii. Forest;
iii. Urban Development;
iv. Tourism;

vi. Revenue;
vii. Agriculture; and
viii. Manipur State Pollution Control Board,
for integrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use. - Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 26, 30, 32 and 37 in column (2) of the Table in paragraph 4, namely:-
(i) Small scale industries not causing pollution;
(ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities;
(iii) Rainwater harvesting; and
(iv) Cottage industries including village artisans:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Manipur in consultation with Department of Revenue and Forest, Government of Manipur.

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:
Provided that beyond the distance of one kilometre distance from the boundary of the Protected Area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per tourism master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder.
(7) Air pollution.—The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder.
(9) Solid wastes.—Disposal of solid wastes shall be as under.-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material shall be disposed of in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change vide Notification number S.O. 630(E), dated the 20th July, 1998as amended from time to time.
(11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government. The Monitoring Committee shall monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:-

5. Eco-sensitive Zone Monitoring Committee.—(1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(a) The Conservator of Forests / Deputy Conservator of Forests/Park and Sanctuary, Government of Manipur —Chairman
(b) Senior Town Planner of the area — Member;
(c) Senior Environment Engineer, Manipur State Pollution Control Board, Imphal —Member;
(d) A representative of Non-governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Manipur for a term of one year —Member;
(e) One expert in the area of ecology and environment to be nominated by the Government of Manipur —Member;
(f) Divisional Forest Officer / Tamenglong— Member Secretary.
Terms of Reference:
(2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)](3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Conservator of Forests / Park and Sanctuaryshall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per preform appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.

Limits and boundaries of the proposed Eco-sensitive Zone of Bunning Wildlife Sanctuary
North: Starting from Station No.1, the confluence of Agaki stream and Barak River, the line runs easterly direction along Agaki stream, crosses Station No. 2, till it reaches Takou village at Station No. 3.
East: From Station No. 3 (Takou village), the line runs southerly direction along the hill-ridge Inter Village Road (IVR) upto Station No. 4 (Tamah village), then continues along the IVR upto Station No. 6 on Irang river, then follows along the Irang River upto Station No. 7 - confluence of Irang River and Ati Stream/Lok.
South: Starting from Station No. 7, confluence of Irang River and Ati Stream/Lok, the line runs towards west along a small lok starting from Sonpram village crossing Station No. 8, then along the IVR to Sonpram village upto Station No. 9 (Sonpram village where IVR crosses Apa river), then along the PWD road upto Station No. 11 (Tharon village), then along the hill ridge IVR upto Longdi Pabram village (Station No. 12), then continues along the IVR passing Taipram village (Station No. 13) till it reaches Barak River (at Station No. 7 of Jiri-Makru Wildlife sanctuary Eco-sensitive zone).
