का.आ. 3233(अ).— (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत (cid:24)ा(cid:26)प अ(cid:29)धसूचना, िजसे के &'(cid:8)य सरकार, पया)वरण (संर-ण) अ(cid:29)ध(cid:19)नयम, 1986 (1986 का 29) क2 धारा 3 क2 उपधारा (2) के खंड (v) और खंड (xiv) के साथ प(cid:4)ठत उपधारा (1) 9वारा (cid:24)द:त शि<तय= का (cid:24)योग करते हुए, जार(cid:8) करने का (cid:24)Cताव करती है, पया)वरण (संर-ण) (cid:19)नयम, 1986 के (cid:19)नयम 5 के उप(cid:19)नयम (3) क2 अपे-ानुसार, जनसाधारण क2 जानकार(cid:8) के (cid:20)लए (cid:24)का(cid:20)शत क2 जाती है; िजनके उससे (cid:24)भाGवत होने क2 संभावना है ; और यह सूचना द(cid:8) जाती है Hक उ<त (cid:24)ा(cid:26)प अ(cid:29)धसूचना पर, उस तार(cid:8)ख से, िजसको इस अ(cid:29)धसूचना वाले भारत के राजपJ क2 (cid:24)(cid:19)तयां जनसाधारण को उपलKध करा द(cid:8) जाती हL, साठ (cid:4)दन क2 अव(cid:29)ध क2 समािMत पर या उसके पNचात ् Gवचार Hकया जाएगा ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और इस -ेJ का पXरर-ण और संर-ण करना है तथा िजसक2 सीमाओं को इस अ(cid:29)धसूचना के पैरा 1 मR पाXरिCथ(cid:19)तक और पया)वरण क2 dिSट से (cid:20)लMपा-असरंग व&यजीव अभयार[य संरe-त -ेJ के चार= ओर पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के (cid:26)प मR Gव(cid:19)न(cid:4)द)Sट Hकया गया है और उ<त पाXरिCथ(cid:19)तक जोन मR उ9योग या उ9योग= के वगf को तथा उनक2 संHgयाओं और (cid:24)Hgयाओं को (cid:24)(cid:19)तGषW करना आवNयक है ;

अतः, अब, के &'(cid:8)य सरकार, पया)वरण (संर-ण) (cid:19)नयम, 1986 के (cid:19)नयम 5 के उप(cid:19)नयम (3) और पया)वरण (संर-ण) अ(cid:29)ध(cid:19)नयम, 1986 (1986 का 29) क2 धारा 3 क2 उपधारा (2) के खंड (v) और खंड (xiv) के साथ प(cid:4)ठत उपधारा (1) 9वारा (cid:24)द:त शि<तय= का (cid:24)योग करते हुए, (cid:20)लMपा-असरंग व&यजीव अभयार[य पाXरिCथ(cid:19)तक संवेद(cid:8) जोन (िजसे इसमR इसके पNचात ् पाXरिCथ(cid:19)तक2य संवेद(cid:8) जोन कहा या है) के (cid:26)प मR (cid:4)हमाचल (cid:24)देश रा\य मR (cid:20)लMपा-असरंग व&यजीव अभयार[य क2 सीमा से 14 Hकलोमीटर तक क2 सीमा के -ेJ के GवCतार को अ(cid:29)धसू(cid:29)चत करती है, िजसका Gववरण (cid:19)न(cid:13)नानुसार है, अथा)त ् :-

1. पा(cid:15)रि%थ'तक संवेद* जोन का ,व%तार और उसक. सीमाएं--(1) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन का GवCतार (cid:20)लMपा- असरंग व&यजीव अभयार[य क2 सीमा से उ:तर-पूवa (जो Gपन घाट(cid:8) राSm(cid:8)य पाक) के साथ), उ:तर(cid:8) और उ:तर(cid:8)-पिNचमी पर 14 Hकलोमीटर तक फै ला हुआ है । पाXरिCथ(cid:19)तक संवेद(cid:8) जोन का GवCतार व&यजीव अभयार[य के पूवa, दe-णी और दe-णी-पिNचमी पर शू&य Hकलोमीटर तक है । पाXरिCथ(cid:19)तक संवेद(cid:8) जोन का -ेJ 254 वग) Hकलोमीटर है ।

(2) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन उ:तर क2 ओर (मान(cid:29)चJ मR (cid:19)नदnश oब&दु ई.9 है) 78° 7.695' पू. और अ-ांश 31°52.117' उ., पिNचम क2 ओर (मान(cid:29)चJ मR (cid:19)नदnश oब&दू ई.4 है) देशांतर 78°6.013' पू. और अ-ांश 31°42.410' उ., देशांतर 78°5.545' पू. के दe-णी सीमा oब&दु पर और पूव) क2 ओर (मान(cid:29)चJ मR (cid:19)नदnश oब&दु ई13 है) और अ-ांश 31°49.856' उ. (4) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भूमंडल(cid:8)य िCथ(cid:19)त (cid:24)णाल(cid:8) (जीपीएस) oब&दु उपाबंध II के (cid:26)प मR उपाबW है ।

(5) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के अंतग)त कोई qाम नह(cid:8)ं है ।

2. पा(cid:15)रि%थ'तक संवेद* जोन के 2लए आंच2लक महायोजना – (1) रा\य सरकार, पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के (cid:24)योजन के (cid:20)लए राजपJ मR अ(cid:29)धसूचना के अं(cid:19)तम (cid:24)काशन क2 तार(cid:8)ख से दो वष) क2 अव(cid:29)ध के भीतर, Cथानीय Qयि<तय= के परामश) से, इस अ(cid:29)धसूचना मR संलrन अनुबंध= के सामंजCय से आंच(cid:20)लक महायोजना तैयार करेगी ।

(2) उ<त योजना रा\य सरकार मR स-म (cid:24)ा(cid:29)धकार(cid:8) 9वारा अनुमो(cid:4)दत होगी ।

(3) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के (cid:20)लए आचं(cid:20)लक महायोजना इस अ(cid:29)धसूचना मR Gव(cid:19)न(cid:4)द)Sट (cid:26)प मR ऐसी र(cid:8)(cid:19)त मR रा\य सरकार तथा सुसंगत कR '(cid:8)य और रा\य Gव(cid:29)धय= के सामंजCय मR भी तथा कR '(cid:8)य सरकार 9वारा जार(cid:8) माग)(cid:19)नदnश, य(cid:4)द कोई ह=, 9वारा तैयार होगी ।

(4) आंच(cid:20)लक महायोजना सभी संबW रा\य सरकार के Gवभाग= के परामश) से तैयार होगी, अथा)त ्:--

(i) पया)वरण ;

(ii) वन ;

(iii) नगर Gवकास ;

(iv) पय)टन ;

(v) नगरपा(cid:20)लक ;

(vi) राजCव ;

(vii) कृ Gष ;

(ix) (cid:4)हमाचल (cid:24)देश रा\य (cid:24)दूषण (cid:19)नयंJण बोड) ;

(x) (cid:20)संचाई ; और

(xi) लोक (cid:19)नमा)ण Gवभाग

इसमR पया)वरणीय और पाXरिCथ(cid:19)तक2 Gवचार= को समाक(cid:20)लत करने के (cid:20)लए ह=गे।

(5) महायोजना अनुमो(cid:4)दत Gव9यमान भू-उपयोग, अवसंरचना:मक और Hgयाकलाप= पर कोई (cid:19)नबuधन अ(cid:29)धरोGपत नह(cid:8)ं करेगी जब तक Hक इस अ(cid:29)धसूचना मR Gव(cid:19)न(cid:4)द)Sट न ह= और आचं(cid:20)लक महायोजना मR सभी अवसंरचना Hgयाकलाप= मR द-ता और पाXरिCथ(cid:19)तक2य अनुकू लता का संवध)न करेगी ।

(6) आंच(cid:20)लक महायोजना मR अनाvछा(cid:4)दत -ेJ= के जीणxWार, Gव9यमान जल (cid:19)नकाय= के संर-ण, आवाह -ेJ= के (cid:24)बंधन, जल-संभर= के (cid:24)बंधन, भूतल जल के (cid:24)बंधन, मृदा और नमी संर-ण, Cथानीय समुदाय= क2 आवNयकताओं तथा पाXरिCथ(cid:19)तक2 और पया)वरण से संबं(cid:29)धत ऐसे अ&य पहलुओं, िजन पर yयान देना आवNयक है, के (cid:20)लए उपबंध ह=गे ।

(7) आंच(cid:20)लक महायोजना सभी Gव9यमान पूजा Cथल=, qाम= और नगर(cid:8)य बंदोबCत=, वन= के (cid:24)कार और HकCम=, जनजातीय -ेJ=, कृ Gष -ेJ=, ऊपजाऊ भू(cid:20)म, हXरत -ेJ जैसे उ9यान और उसी (cid:24)कार के Cथान, उ9यान कृ Gष -ेJ, आHक) ड=, झील= और अ&य जल (cid:19)नकाय= का अ{यकं न करेगी ।

(8) आंच(cid:20)लक महायोजना पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR Gवकास को पाXरिCथ(cid:19)तक अनुकू ल Gवकास और Cथानीय समुदाय= क2 जीवकोपाज)न को सु(cid:19)निNचत करते हुए Gव(cid:19)नय(cid:20)मत होगी ।

(9) (cid:4)हमाचल (cid:24)देश रा\य सरकार अपनी अ(cid:29)धकाXरता के अधीन -ेJ के (cid:20)लए पृथक आंच(cid:20)लक महायोजना तैयार करेगी ।

3. रा5य सरकार 6वारा 7कए जाने वाले उपाय-- रा\य सरकार इस अ(cid:29)धसूचना के उपबंध= को (cid:24)भावी करने के (cid:20)लए (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत उपाय करेगी, अथा)त ् :--

(1) भू-उपयोग - पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR आमोद-(cid:24)मोद के (cid:24)योजन के (cid:20)लए (cid:29)चि&हत Hकए गए वन=, उ9यान-कृ Gष -ेJ=, कृ Gष -ेJ=, पाकf और खुले Cथान= का वा(cid:21)णि\यक और औ9यो(cid:29)गक संबW Gवकास Hgयाकलाप= के (cid:20)लए उपयोग या संपXरवत)न नह(cid:8)ं होगा :

परंतु पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर कृ Gष भू(cid:20)म का संपXरवत)न मानीटर(cid:8) स(cid:20)म(cid:19)त क2 (cid:20)सफाXरश पर और रा\य सरकार के पूव) अनुमोदन से, Cथानीय (cid:19)नवा(cid:20)सय= क2 आवासीय ज(cid:26)रत= को पूरा करने के (cid:20)लए और पैरा 4 क2 सारणी के Cतंभ (2) के अधीन gम सं. 33, 35, 37, और 41 के सामने सूचीबW Hgयाकलाप= को पूरा करने के (cid:20)लए अनु|ात ह=गे, अथा)त ् :-

(i) (cid:24)दूषण उ:प&न न करने वाले लघु उ9योग,

(ii) पाXरिCथ(cid:19)तक अनुकू ल पय)टन Hgयाकलाप= से संबं(cid:29)धत पय)टक= के अCथायी अ(cid:29)धभोग के (cid:20)लए पाXरिCथ(cid:19)तक अनुकू ल कु ट(cid:8)र जैसे टLट, लकड़ी के मकान आ(cid:4)द ।

(iii) वषा) जल संचय, और

(iv) कु ट(cid:8)र उ9योग= मR qाम उ9योग, भंडारण क2 सुGवधा और Cथानीय सुख-सुGवधाएं सि(cid:13)म(cid:20)लत हL :

परंतु यह और भी Hक रा\य सरकार के पूव) अनुमोदन तथा संGवधान के अनुvछे द 244 और त:समय (cid:24)वृ:त Gव(cid:29)ध के उपबंध= के अनुपालन के oबना, िजसके अंतग)त अनुसू(cid:29)चत जनजा(cid:19)त और अ&य परंपरागत वन (cid:19)नवासी (वन अ(cid:29)धकार= क2 मा&यता) अ(cid:29)ध(cid:19)नयम, 2006 (2007 का 2) भी है, वा(cid:21)णि\यक या उ9योग Gवकास Hgयाकलाप= के (cid:20)लए जनजातीय भू(cid:20)म का उपयोग अनु|ात नह(cid:8)ं होगा :

परंतु यह और भी Hक पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर भू-अ(cid:20)भलेख= मR उपसंजात कोई Jु(cid:4)ट मानीटर(cid:8) स(cid:20)म(cid:19)त के Gवचार (cid:24)ाMत करने के पNचात ् रा\य सरकार 9वारा (cid:24):येक मामले मR संशो(cid:29)धत होगी और उ<त Jु(cid:4)ट के संशोधन क2 के &'(cid:8)य सरकार के पया)वरण, वन और जलवायु पXरवत)न मंJालय को सूचना देनी होगी ।

परंतु यह और भी Hक उपयु )<त Jु(cid:4)ट का संशोधन मR इस उप पैरा के अधीन यथा उपबं(cid:29)धत के (cid:20)सवाय Hकसी भी दशा मR भू-उपयोग का पXरवत)न सि(cid:13)म(cid:20)लत नह(cid:8)ं होगा :

परंतु यह और भी Hक िजससे हXरत -ेJ मR जैसे वन -ेJ, कृ Gष -ेJ मR कोई पाXरणा(cid:20)मक कटौती नह(cid:8)ं होगी और अन(cid:24)यु<त या अनु:पादक कृ Gष -ेJ= मR पुन: वनीकरण करने के (cid:24)यास Hकए जाएंगे ।

(2) "ाकृ 'तक जल <ोत -- आचं(cid:20)लक महायोजना मR सभी (cid:24)ाकृ (cid:19)तक जल ~ोत= क2 पहचान क2 जाएगी और उनके संर-ण और पुनन)वीकरण के (cid:20)लए योजना को सि(cid:13)म(cid:20)लत Hकया जाएगा और रा\य सरकार 9वारा ऐसी र(cid:8)(cid:19)त से माग)दश)क (cid:20)सWांत बनाए जाएंगे िजससे Hक उन -ेJ= मR या इसके समीप Gवकास Hgयाकलाप को रोका जा सके जो ऐसे -ेJ के (cid:20)लए हा(cid:19)नकारक हL ।

(3) पय(cid:4)टन – (क) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर पय)टन संबंधी Hgयाकलाप, जो पय)टन महायोजना के अनुसार ह=गे, आंच(cid:20)लक महायोजना का भाग (cid:26)प मR ह=गे ।

(ख) पय)टन महायोजना पय)टन Gवभाग, 9वारा (cid:4)हमाचल (cid:24)देश रा\य सरकार के वन और पया)वरण Gवभाग के परामश) से तैयार होगी ।

(ग) पय)टन संबंधी Hgयाकलाप (cid:19)न(cid:13)न(cid:20)ल(cid:21)खत के अधीन Gव(cid:19)नय(cid:20)मत ह=गे, अथा)त ् :-

(i) पाXरिCथ(cid:19)तक संवेद(cid:8) जोन के भीतर सभी नए पय)टन Hgयाकलाप= या Gव9यमान पय)टन Hgयाकलाप= का GवCतार राSm(cid:8)य Qया(cid:127) संर-ण (cid:24)ा(cid:29)धकरण, के &'(cid:8)य सरकार पया)वरण, वन और जलवायु पXरवत)न मंJालय 9वारा जार(cid:8) (समय-समय पर यथा संशो(cid:29)धत) माग)(cid:19)नदेश= के अनुसार होगा िजसमR पाXरिCथ(cid:19)तक पय)टन, पाXरिCथ(cid:19)तक (cid:20)श-ा और पाXरिCथ(cid:19)तक Gवकास को मह:व (cid:4)दया जाएगा और पाXरिCथ(cid:19)तक संवेद(cid:8) जोन क2 वहन -मता के अyययन पर आधाXरत होगा ;

(ii) पाXरिCथ(cid:19)तक2य अनुकू ल पय)टक Hgयाकलाप= के संबंध मR अCथायी अ(cid:29)धभोग के (cid:20)लए वास सुGवधा के (cid:20)सवाय (cid:20)लMपा-असरंग व&यजीव अभयार[य क2 सीमा से एक Hकलोमीटर भीतर होटल और Xरसोटf का नया सं(cid:19)नमा)ण अनु|ात नह(cid:8)ं होगा ;

परंतु संरe-त -ेJ= क2 सीमा से एक Hकलोमीटर क2 दूर(cid:8) से परे पाXरिCथ(cid:19)तक2य संवेद(cid:8) जोन क2 सीमा तक नए होटल और Xरसोट) के Cथापन पय)टन महायोजना के अनुसार पाXरिCथ(cid:19)तक2य पय)टन सुGवधा के (cid:20)लए पूव) पXरभाGषत और Gव(cid:19)न(cid:4)द)Sट Cथान मR ह(cid:8) अनु|ात Hकया जाएगा ।

(iii) आंच(cid:20)लक महायोजना का अनुमोदन Hकए जाने तक, पय)टन के (cid:20)लए Gवकास और Gव9यमान पय)टन Hgयाकलाप= के GवCतार को वाCतGवक Cथल Gव(cid:19)न(cid:4)द)Sट संवी-ा तथा मानीटर(cid:8) स(cid:20)म(cid:19)त क2 (cid:20)सफाXरश पर आधाXरत संबं(cid:29)धत Gव(cid:19)नयामक (cid:24)ा(cid:29)धकाXरय= 9वारा अनु|ात Hकया जाएगा ।

(4) नैस(cid:21)ग(cid:4)क ,वरासत -- पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR मह:वपूण) नैस(cid:29)ग)क Gवरासत के सभी Cथल= जैसे सभी जीन कोश आरe-त -ेJ, शैल Gवरचनाएं, जल (cid:24)पात=, झरन=, घाट(cid:8) मागf, उपवन=, गुफाएं, Cथल=, €मण, अNवरोहण, (cid:24)पात= आ(cid:4)द क2 पहचान क2 जाएगी और उ&हR संरe-त Hकया जाएगा तथा उनक2 संर-ा और संर-ा के (cid:20)लए इस अ(cid:29)धसूचना के (cid:24)काशन क2 तार(cid:8)ख से छह मास के भीतर, उपयु<त योजना बनाएगी और ऐसी योजना आंच(cid:20)लक महायोजना का भाग होगा ।

(5) मानव 'न2म(cid:4)त ,वरासत %थल? - पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR भवन=, संरचनाओं, (cid:20)श(cid:6)प-त(cid:129)य, ऐ(cid:19)तहा(cid:20)सक, कला:मक और सांCकृ (cid:19)तक मह:व के -ेJ= क2 पहचान करनी होगी और इस अ(cid:29)धसूचना के (cid:24)काशन क2 तार(cid:8)ख से छह माह के भीतर उनके संर-ण क2 योजनाएं तैयार करनी ह=गी तथा आंच(cid:20)लक महायोजना मR सि(cid:13)म(cid:20)लत क2 जाएगी ।

(6) @व'न "दूषण -- पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR yव(cid:19)न (cid:24)दूषण के (cid:19)नयंJण के (cid:20)लए रा\य सरकार का पया)वरण Gवभाग या राजCथान रा\य (cid:24)दूषण (cid:19)नयंJण बोड), वायु ((cid:24)दूषण (cid:19)नवारण और (cid:19)नयंJण) अ(cid:29)ध(cid:19)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:19)नयम= के उपबंध= के अनुसरण मR माग)दश)क (cid:20)सWांत और Gव(cid:19)नयम तैयार करेगा ।

(7) वायु "दूषण -- पाXरिCथ(cid:19)तक संवेद(cid:8) जोन मR वायु (cid:24)दूषण के (cid:19)नयंJण के (cid:20)लए रा\य सरकार का पया)वरण Gवभाग या राजCथान रा\य (cid:24)दूषण (cid:19)नयंJण बोड), वायु ((cid:24)दूषण (cid:19)नवारण और (cid:19)नयंJण) अ(cid:29)ध(cid:19)नयम, 1981 (1981 का 14) और उसके अधीन बनाए गए (cid:19)नयम= के उपबंध= के अनुसरण मR माग)दश)क (cid:20)सWांत और Gव(cid:19)नयम तैयार करेगा ।

S.O. 3233(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2), of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986), is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification should be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette of India containing this notification are made available to the public;

Draft Notification

WHEREAS, the Lippa-Asarang Wildlife Sanctuary lies between 31º40' 15" to 31º44′18" North Latitude and 78º13′ and 78º18′ East Longitude in Sangla wildlife range, the Kinnaur District of Himachal Pradesh and spread in an area of 31 square kilometer;

AND WHEREAS, the prominent species available in Sanctuary includes, Ibex, blue sheep, Snow-Leopard, and Ram chokar and vegetation is represented by the alpine shrubs and juniper bushes;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area Lippa-Asarang Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW. THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 14 kilometers from the boundary of the Lippa-Asarang Wildlife Sanctuary, in the State of Himachal Pradesh as the Lippa- Asarang Eco-sensitive zone (hereinafter referred as to the Eco-sensitive zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone- (1) The extent of Eco-sensitive zone is varies upto 14 kilometers on north-east (coincides with Pin Vallley National Park), north and north-west from the boundary of Lippa- Asarang Wildlife Sanctuary. The extent of Eco-sensitive Zone is zero kilometer on east, south and south- west side of the Wildlife Sanctuary. The area of Eco-sensitive Zone is 254 square kilometres.

(2) The Eco-sensitive Zone is bounded by 78° 7.695' E and latitude 31°52.117'N towards north (reference point in map is E09), longitude 78°6.013' E and latitude 31°42.410'N towards west (reference point in map is E04), southern boundary point at longitude 78°5.545' E and latitude 31°49.856'N (reference point in map is E07) 78°19.124' E longitude and 31°46.420' N latitude towards east (reference point on map is E13).

(3) The map of Eco-sensitive Zone along is appended as Annexure I

(4) The Global Positioning System (GPS) points of Eco sensitive zone is appended as Annexure II.

(5) No village falls within Eco-sensitive Zone.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.

(2) The said Plan shall be approved by the competent authority in the State Government.

(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Municipal;

(vi) Revenue;

(vii) Agriculture;

(ix) Himachal Pradesh State Pollution Control Board;

(x) Irrigation; and

(xi) Public Works Department,

for integrating environmental and ecological considerations into it.

(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.

(9) The State Government of Himachal Pradesh shall prepare separate Zonal Master Plans for area under their jurisdiction.

3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use - Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 33, 35, 37, and 41 in column (2) of the Table in paragraph 4, namely:-

(i) Small scale industries not causing pollution,

(ii) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities,

(iii) Rainwater harvesting, and

(iv) Cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forest and Environment of the Himachal Pradesh State Government.

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Lippa-Asarang Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities:

Provided that beyond the distance of one kilometer from the boundary of the Protected Areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Rajasthan State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.

(7) Air pollution.- The Environment Department of the State Government or Rajasthan State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.

(9) Solid wastes. - Disposal of solid wastes shall be as under namely:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone

(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government and the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial units

(a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco- sensitive zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

Union of India in Writ Petitiion (Civil) No.202 of 1995 and order of the Hon'ble Supreme Court dated 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2.	Setting up of saw mills.	No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3.	Setting up of industries causing water or air or soil or noise pollution.	No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
4.	Commercial use of firewood.	Prohibited (except as otherwise provided) as per applicable laws.
5.	Establishment of new major hydroelectric projects and irrigation projects.	Prohibited (except as otherwise provided) as per applicable laws.
6.	Use or production of any hazardous substances.	Prohibited (except as otherwise provided) as per applicable laws.
7.	Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons.	Prohibited (except as otherwise provided) as per applicable laws.
8.	Discharge of effluents and solid waste in natural water bodies or terrestrial area.	Prohibited (except as otherwise provided) as per applicable laws.
9.	Air and vehicular pollution.	Prohibited (except as otherwise provided) as per applicable laws.
10.	Fishing by mechanical means.	Prohibited (except as otherwise provided) as per applicable laws.
B. Regulated Activities
11.	Felling of trees.	(a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the enactments made by the Central Government or State Government and the rules made thereunder.
12.	Establishment of hotels and resorts.	No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco- friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansions of existing activities would in conformity with Zonal Master Plan and National Tiger Conservation Authority guidelines.
13.	Drastic change of agriculture systems.	Regulated under applicable laws.
14.	Commercial use of natural resources including groundwater harvesting.	(a) The extraction of ground water for the bonafide agricultural and domestic consumption of the occupier of land shall be permitted. (b) Extraction of ground water for industrial, commercial use shall require prior written permission, including the amount that can be
		extracted, from the State Ground Water Board, in absence of such Board, the state department having control over it, and the Monitoring Committee. (c) no sale of surface water or ground water shall be permitted except with the prior approval of the Monitoring committee; (d ) the conservation of water and its distribution from existing facilities within Eco-sensitive Zone, other than sanctuary and forest areas, shall be regulate in accordance to the provisions of the forest(conservation) Act, 1980(69 of 1980). (e) steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
15.	Erection of electrical cables.	Promote underground cabling with the permission of the competent authority.
16.	Fencing of existing premises of hotels and lodges.	Regulated under applicable laws.
17.	Use of polythene bags by shopkeepers.	Prohibited (except as otherwise provided) as per applicable laws.
18.	Widening and strengthening of existing roads.	Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
19.	Movement of vehicular traffic at night.	Regulated for commercial purpose, under applicable laws.
20.	Introduction of exotic species.	Regulated under applicable laws.
21.	Protection of hill slopes and river banks.	As per existing master plan or with permission of competent authority.
22.	Commercial Sign boards and hoardings.	Regulated as per Zonal Master plan.
23.	Establishment of domestic stone crushing unit for domestic use.	Regulated under applicable laws.
24.	Water transportation.	Regulated under applicable laws.
25.	Fishing.	Regulated under applicable laws.

32.	Construction activities.	(a) No new construction of any kind shall be permitted within one kilometer from the boundary of sanctuary: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3. (b) Beyond one kilometer upto the extent of the Eco-sensitive Zone construction for bona fide local needs shall be permitted and other commercial construction activities shall be regulated as per zonal master plan.
33.	Small scale industries not causing pollution.	Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
34.	Collection of Forest produce or Non-Timber Forest Produce (NTFP).	Regulated under applicable laws.
35.	Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities.	Regulated under applicable laws.
C. Promoted Activity
36.	Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.	Permitted under applicable laws.
37.	Rain water harvesting.	Shall be actively promoted.
38.	Organic farming.	Shall be actively promoted.
39.	Use of renewable energy sources.	Shall be actively promoted.
40.	Adoption of green technology for all activities.	Shall be actively promoted.

5. Eco-sensitive Zone Monitoring Committee:- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone falling in the State of Himachal Pradesh , which shall comprise of the following namely:-

(a) An eminent person, expert in the area of ecology and environment to be nominated by the Government of Himachal Pradesh - Chairman

(b) The Divisional Forest Officer (Territory) - Member

(d) Representative of Non-Governmental Organisation working in the field of environment to be nominated by the Government of Himachal Pradesh - Member

(e) Representative of the Department of Revenue, Government of Himachal Pradesh -Member

(f) Representative of the Himachal Pradesh Pollution Control Board -Member

(g) Sub–Divisional Magistrate Pooch or representative - Member

(h) The Divisional Forest Officer (Wildlife) - Member Secretary

Terms of Reference:

(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco- sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Chairmen or the convener of the Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure III.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.
