सा पा(cid:7407)ठत उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, कना(cid:6981)टक रा(cid:6996)य म(cid:7286) (cid:7081)(cid:7404)नगरी र्(cid:7008)य ीिर् अभयार(cid:7003)य क(cid:7409) सीमा से 100 मीटर से 12 (cid:7408)कलोमीटर क(cid:7409) सीमा तक के (cid:6979)े(cid:7074) को (cid:7081)(cid:7404)नगरीर् (cid:7008)यर् ीि अभयार(cid:7003)य पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन

अभयार(cid:7003)य है का र्न(cid:7021)तार 100 मी. से 12 (cid:7408)क.मी. तक है । नसिक(cid:7409) सीमा(cid:7312) कार् ण(cid:6981)न उपाबंध I म(cid:7286) (cid:7408)दया गया है ।

(2) पा(cid:7407)रन(cid:7021)नतक(cid:7409) र्संेदी ोिन नसिम(cid:7286) कना(cid:6981)टक के कोडागु नलिे के र्नरापिेट तालुक के 14 (cid:7061)ाम ह(cid:7289) और 73.094 र्ग(cid:6981) (cid:7408)कलोमीटर के (cid:6979)े(cid:7074) म(cid:7286) ै ला (cid:7263)आ है ।

(3) अ(cid:6979)ां और देांतर रेखा के सा-सा पा(cid:7407)रन(cid:7021)नतक(cid:7409) र्संेदी ोिन क(cid:7409) सीमा का माननच(cid:7074) उपाबंध II म(cid:7286) (cid:7272)प म(cid:7286) संल(cid:6991)न है ।

(4) पा(cid:7407)रन(cid:7021)नतक(cid:7409) र्संेदी ोिन म(cid:7286) आनेर् ाले र्गां(cid:7298) क(cid:7409) सूची उपाबंध III म(cid:7286) है ।

2. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आंचनलक महायोनिा--(1) रा(cid:6996)य सरकार, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के (cid:7079)योनि के नलए रापि(cid:7074) म(cid:7286) अंनतम अनधसूचना के (cid:7079)कान क(cid:7409) तारीख से दोर् ष(cid:6981) क(cid:7409) र्अनध के भीतर (cid:7021)ानीय लोग(cid:7298) से पराम(cid:6981) करके और इस अनधसूचना म(cid:7286) (cid:7408)दए गए अनुबंध(cid:7298) का पालन करते (cid:7263)ए एक ोिनल मा(cid:7021)टर (cid:7009)लान तैयार करेगी ।

(2) उ(cid:6989)त योनिा का रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा अनुमो(cid:7408)दत क(cid:7409) ािएगी ।

(3) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का आंचनलक महायोनिा रा(cid:6996)य सरकार (cid:7367)ारा ऐसी रीनत से ोि इस अनधसूचना म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट (cid:7408)कया ािए और सुसंगत के (cid:7008)(cid:7076)ीय और रा(cid:6996)य र्ननधय(cid:7298) के और के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा ािरी माग(cid:6981)द(cid:7278) नस(cid:7373)ांत(cid:7298) के अनु(cid:7272)प तैयार (cid:7408)कया ािएगा ।

(7) उ(cid:7334) योनिा म(cid:7286) सभी र्न(cid:7378)मान पूाि (cid:7021)ल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोब(cid:7021)त(cid:7298),र् न(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021)म(cid:7298), निाितीय (cid:6979)े(cid:7074)(cid:7298) कृ नष (cid:6979)े(cid:7074)(cid:7298), ऊपािऊ भूनम, ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021)ान, उ(cid:7378)ान कृ नष (cid:6979)े(cid:7074), लो(cid:7378)ान, झील(cid:7298) और अ(cid:7008)य लि ननकाय(cid:7298) का सीमाकं न करेगी ।

(8) उ(cid:7334) योनिा म(cid:7286) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) र्नकास को र्नननयनमत करेगी नसिसे पा(cid:7407)रन(cid:7021)नतक(cid:7409) अनुकू ल र्नकास (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409)र् ीिकोपा(िcid:6981)न सुर(cid:6979)ा के नलए सुननन(cid:7019)चत (cid:7408)कया ाि सके ।

3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए ािने र्ाले उपाय-- रा(cid:6996)य सरकार इस अनधसूचना के उपबंध(cid:7298) को (cid:7079)र्भाी करने के नलए नन(cid:7388)नलनखत उपाय करेगी, अा(cid:6981)त् :--

(1) भू-उपयोग - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286)र् न(cid:7298), उ(cid:7378)ान-कृ नष (cid:6979)े(cid:7074)(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योनि के नलए नचन(cid:7008)हत (cid:7408)कए गए पाक(cid:7300) और खुले (cid:7021)ान(cid:7298) कार् ानणन(cid:6996)यक और औ(cid:7378)ोनगक संब(cid:7373) र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए उपयोग या संप(cid:7407)र्रत(cid:6981)न नह(cid:7277) होगा :

परंतु पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर कृ नष भूनम का संप(cid:7407)र्रत(cid:6981)न, अर्नुी(cid:6979)ण सनमनत क(cid:7409) नसा(cid:7407)र पर और रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन से, (cid:7021)ानीय नर्नानसय(cid:7298) क(cid:7409) र्आासीय (िcid:7272)रत(cid:7298) को पूरा करने के नलए और पैरा 4 क(cid:7409) सारणी के (cid:7021)तंभ (2) के अधीन मद सं0 10,16,22, 28 और सं. 31 के सामने सूचीब(cid:7373) (cid:7408)(cid:7059)याकलाप(cid:7298) को पूरा करने के नलए अनु(cid:6980)ात ह(cid:7298)गे, अा(cid:6981)त् :-

(i) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए, पय(cid:6981)टक(cid:7298) के अ(cid:7021)ायी अनधभोग के नलए पा(cid:7407)रन(cid:7021)नतक अनुकू ल कटीर ैिसे टे(cid:7008)ट, का(cid:7020)ट गृह;

(ii) र्न(cid:7378)मान सक(cid:7298) को चौा करना ता उनका सदृढीकरण और नई सक(cid:7298) का संननमा(cid:6981)ण ;

(iii) (cid:7079)दूषण उ(cid:7004)प(cid:7382) न करनेर् ाले लघु उ(cid:7378)ोग,

(iv) र्षा(cid:6981) लि संचय, और ;

(v) कु टीर उ(cid:7378)ोग, नसिके अंतग(cid:6981)त (cid:7061)ामीण उ(cid:7378)ोग भी ह(cid:7289) :

परंतु यह और (cid:7408)क रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन और संर्नधान के अनु(cid:6994)छेद 244 या त(cid:7004)समय (cid:7079र्)ृ(cid:7275) र्ननध के उपबंध(cid:7298) के अनुपालन के नबना, नसिके अंतग(cid:6981)त अनुसूनचत निािनत और अ(cid:7008)य परंपरागत र्न नर्नासी र्(न अनधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अनधननयम, 2006 (2007 का 2) भी है,र् ानणन(cid:6996)यक या उ(cid:7378)ोग र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए निाितीय भूनम का उपयोग अनु(cid:6980)ात नह(cid:7277) होगा :

परंतु यह भी (cid:7408)क पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर भू-अनभलेख(cid:7298) म(cid:7286) (cid:7079)तीत होनेर् ाली कोई (cid:7074)ु(cid:7407)ट, अर्नुी(cid:6979)ण सनमनत के र्नचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)येक मामले म(cid:7286) के र्ल एक बार ठीक क(cid:7409) ािएगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के ठीक करने क(cid:7409) के (cid:7008)(cid:7076)ीय सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय को सूचना देनी होगी ।

परंतु यह भी (cid:7408)क उपयु (cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संोधन म(cid:7286) इस उप पैरा के अधीन या उपबंनधत के नर्साय (cid:7408)कसी भी दा म(cid:7286) भू- उपयोग का प(cid:7407)र्रत(cid:6981)न सन(cid:7013)मनलत नह(cid:7277) होगा ।

परंतु अभयार(cid:7003)य क(cid:7409) सीमा से एक (cid:7408)कलोमीटर से परे पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के र्न(cid:7021)तार तक पय(cid:6981)टन महायोनिा के अनुसार पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन सुर्नधा(cid:7312) के नलए के र्ल अनभनहत (cid:6979)े(cid:7074) म(cid:7286) नए होटल(cid:7298) और सैरगाह(cid:7298) का (cid:7021)ापन अनु(cid:6980)ात ह(cid:7298)गे ।

(iii) आंचनलक महायोनिा का अनुमो(cid:7408)दत (cid:7408)कए ािने तक, पय(cid:6981)टन के नलए र्नकास और र्न(cid:7378)मान पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) के र्न(cid:7021)तार को र्ा(cid:7021)तर्नक (cid:7021)ल र्ननन(cid:7416)द(cid:7397) र्संी(cid:6979)ा ता अर्नुी(cid:6979)ण सनमनत क(cid:7409) नसा(cid:7407)र पर आधा(cid:7407)रत संबंनधत र्नननयामक (cid:7079)ानधकरण(cid:7298) (cid:7367)ारा अनु(cid:6980)ात (cid:7408)कया होगा ।

(4) नैस(cid:7414)गक र्नरासत -- पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) मह(cid:7004र्)पूण(cid:6981) नैस(cid:7414)गक र्नरासत के सभी (cid:7021)ल(cid:7298) ैिसे सभी ीिन को आरन(cid:6979)त (cid:6979)े(cid:7074), ैल र्नरचनाएं, लि (cid:7079)पात(cid:7298), झरन(cid:7298), घाटी माग(cid:7300), उर्पन(cid:7298), गुाएं, (cid:7021)ल(cid:7298), (cid:7082)मण, अ(cid:7393)रोहण, (cid:7079)पातो आ(cid:7408)द क(cid:7409) पहचान क(cid:7409) ािएगी और उ(cid:7008)ह(cid:7286) संरन(cid:6979)त (cid:7408)कया ािएगा ता उनक(cid:7409) सुर(cid:6979)ा और संर(cid:6979)ा के नलए इस अनधसूचना के (cid:7079)कान क(cid:7409) तारीख से छह मास के भीतर, उपयु(cid:7334) योनिा बनाएगी और ऐसी योनिा आंचनलक महायोनिा का भाग होगा ।

(7)र् ायु (cid:7079)दूषण -- पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286),र् ायु (cid:7079)दूषण के ननयं(cid:7074)ण के नलए रा(cid:6996)य सरकार का पया(cid:6981र्)रण र्नभाग,र् ायु ((cid:7079)दूषण नर्नारण और ननयं(cid:7074)ण) अनधननयम, 1981 (1981 का 14) और उसके अधीन बनाए गए ननयम(cid:7298) के उपबंध(cid:7298) के अनुसार म(cid:7286) माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत और र्नननयम तैयार करेगा ।

(8) बनह(cid:7090र्)ा का नन(cid:7021)सारण -- पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) उपचा(cid:7407)रत बनह(cid:7090र्)ा का नन(cid:7021)सारण, लि ((cid:7079)दूषण नर्नारण ता ननयं(cid:7074)ण) अनधननयम, 1974 (1974 का 6) और उसके अधीन बनाए गए ननयम(cid:7298) के उपबंध(cid:7298) के अनुसार होगा ।

(9) ठोस अपन(cid:7397) -- ठोस अपन(cid:7397)(cid:7298) का ननपटान नन(cid:7388)नलनखत (cid:7272)प म(cid:7286) होगा -

(i) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) ठोस अपन(cid:7397)(cid:7298) का ननपटान भारत सरकार के त(cid:7004)कालीन पया(cid:6981र्)रण और र्न मं(cid:7074)ालय क(cid:7409) समय-समय पर या संोनधत अनधसूचना सं. का. आ. 908(अ), तारीख 25 नसतंबर, 2000 नगरपानलक ठोस अपन(cid:7397) ((cid:7079)बंध और हालन) ननयम, 2000 के उपबंध(cid:7298) के अनुसार (cid:7408)कया ािएगा ;

(iv) अकाब(cid:6981)ननक साम(cid:7061)ी का ननपटान पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के बाहर पहचान (cid:7408)कए गए (cid:7021)ल पर (cid:7408)कसी पया(cid:6981र्)रणीय (cid:7272)प से (cid:7021र्)ीकाय(cid:6981) रीनत म(cid:7286) होगा और पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) ठोस अपन(cid:7020)ट(cid:7298) को लिाना या भ(cid:7020)मीकरण अनु(cid:6980)ात नह(cid:7277) होगा ।

(10) ैिर् नच(cid:7408)क(cid:7004)सीय अपन(cid:7020)ट - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) ैिर् नच(cid:7408)क(cid:7004)सीय अपन(cid:7397)(cid:7298) का ननपटान भारत सरकार के त(cid:7004)कालीन पया(cid:6981र्)रण औरर् न मं(cid:7074)ालय क(cid:7409) समय-समय पर यासंोनधत अनधसूचना सं.का.आ.630 (अ) तारीख 20 ुिलाई, 1998 (cid:7367)ारा (cid:7079)कानतर् ैि नच(cid:7408)क(cid:7004)सीय अपन(cid:7397) ((cid:7079)बंध और हालन) ननयम, 1998 के उपबंध(cid:7298) के अनुसार (cid:7408)कया ािएगा ।

(11) यानीय प(cid:7407)र्रहन - प(cid:7407)र्रहन क(cid:7409) यानीय गनत र्आास के अनुकू ल रीनत म(cid:7286) र्नननयनमत होगी और इस संबंध म(cid:7286) आंचनलक महायोनिा म(cid:7286) र्नेष उपबंध समार्न(cid:7020)ट (cid:7408)कए ािएंगे और आंचनलक महायोनिा के तैयार होने और रा(cid:6996)य सरकार के स(cid:6979)म (cid:7079)ानधकारी के (cid:7367)ारा अनुमो(cid:7408)दत होने तक, रा(cid:6996)य सरकार पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन अर्नुी(cid:6979)ण सनमनत (cid:7079र्)ृ(cid:7275) ननयम(cid:7298) और र्नननयम(cid:7298) के अनुसार यानीय गनत के अनुपालन को मानीटर करेगी ।

(12) औ(cid:7378)ोनगक इकाइयँ.- (क) (cid:7079)(cid:7021)तार्नत पा(cid:7407)रन(cid:7021)नतक(cid:7409)य र्संेदी ोिन के भीतर नए का(cid:7020)ठ उ(cid:7378)ोग(cid:7298) क(cid:7409) (cid:7021)ापना र्ननध के अनुसार (cid:7021)ानपत र्न(cid:7378)मान का(cid:7020)ठ आधा(cid:7407)रत उ(cid:7378)ोग(cid:7298) के नलए अनु(cid:6980)ात क(cid:7409) ािएगी अ(cid:7008)या नह(cid:7277) ।

(ख) (cid:7079)(cid:7021)तार्नत पा(cid:7407)रन(cid:7021)तक र्संेदी ोिन के भीतर लि, र्ायु, मृदा, (cid:7007र्)नन (cid:7079)दूषण का(cid:7407)रत करने र्ाले (cid:7408)कसी नए उ(cid:7378)ोग को (cid:7021)ानपत करने क(cid:7409) अनु(cid:6980)ा नह(cid:7277) होगी ।

4. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) (cid:7079)नतनष(cid:7373) और र्नननयनमत (cid:7408)कए ािनेर् ाले (cid:7408)(cid:7059)याकलाप(cid:7298) क(cid:7409) सूची - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) सभी (cid:7408)(cid:7059)याकलाप पया(cid:6981र्)रण (संर(cid:6979)ण) अनधननयम, 1986 (1986 का 29) के उपबंध(cid:7298) (cid:7367)ारा ानसत ह(cid:7298)गे और नीचे दी गई तानलका म(cid:7286) र्ननन(cid:7416)द(cid:7397) रीनत म(cid:7286) र्नननयनमत ह(cid:7298)गे, अा(cid:6981)त् :--

6. ननद(cid:7287) का ननबंधन :

S.O.3226(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

Draft Notification

WHEREAS, Brahmagiri Wildlife Sanctuary is situated in Southern side of Coorg district in the State of Karnataka and lies between North latitude 11 55

¢ to 12 19

¢ and East longitude 75 44

¢ to 76 04 ;

AND WHEREAS, the Brahmagiri Wildlife Sanctuary lies in the core of Western Ghats and is characterized by rugged terrain with slopes varying from 1% to more than 35% slope and it is a high rain fall ranging between 2500 mm to 6000 mm per year

AND WHEREAS, the Sanctuary supports rich biodiversity with high rate of endemism and is also home for critically endangered species like Malabar Civet and Lion Tailed Macaque, Slender Loris, Nilgiri Marten, Wild Dog, Asian Elephant, Clawless Otter;

AND WHEREAS, the Sanctuary forms an important corridor for large mammals like Asian Elephant and Tiger to move between Nagarahole National Park and Talacauvery Wildlife Sanctuary in Karnataka and Wayanad and Aralam14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Wildlife Sanctuaries in Kerala state and also forms part of the Mysore Elephant Reserve declared under the Project Elephant;

AND WHEREAS, the sanctuary area has a very high Floral and Faunal diversity, the sanctuary consists of evergreen and semi-evergreen forests interspersed with shola grasslands and the vegetation comprises of very important species like Dipterocarpus indicus, Antiaris toxicaria, Kingiodendron pinnatum, Diospyrous ebenum, Bischofia javanica, Calophyllum apetalum, Cinnamomum zeylanicum, Dalbergia latifolia, Pterocarpus marsupium, Elaeocarpus sp., Myrstica sp., Garcinia sp., Machilus macarantha, Mesua ferrea, Hopea parviflora, Dysoxylum malabaricum, Cannarium strictum, Gnetum ula, etc.

AND WHEREAS the important animals found in the sanctuary are Tiger, Leopard, Wild Dog, Elephant, Gaur, Sambar, Barking deer, Nilgiri Langur, Nilgiri Marten, Clawless Otter, Brown Palm Civet, Leopard cat, Slender loris, Travancore flying squirrel, King cobra, Indian rock python, and Malabar pied hornbill, Malabar grey hornbill, Malabar trogon, Malabar whistling thrush, Wayanad laughing thrush, White-bellied tree-pie, Hill myna etc.;

AND WHEREAS, the sanctuary is catchment for River Cauvery which is an important River of Karnataka and Lakshmanthirtha and Ramathirtha are the tributaries of River Cauvery that originates from Brahmagiri Wildlife Sanctuary and many perennial streams also originate from the sanctuary;

AND WHEREAS, it is necessary to conserve and protect the area to the extent and boundaries of which is specified in paragraph 1 of this notification around the Brahmgiri Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industry and their operations and processes in the said Eco-sensitive Zone ;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub– section (2) and sub-section(3) of section (3) of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 100 meters to 12 kilometers from the boundary of Brahmgiri Wildlife Sanctuary in the State of Karnataka, as the Brahmgiri Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and Boundary of Eco-sensitive Zone.-(1) The Eco-sensitive Zone has an extent varying from 100 meters to 12 kilometers from the boundary of Brahmgiri Wildlife Sanctuary and the description of boundaries is given in Annexure I.

(2) The Eco-sensitive Zone includes 14 villages in Virajpet taluk of Kodagu District in Karnataka and is spread over an area of 73.094 square kilometers.

(3) The map of Eco-sensitive Zone boundary together with latitudes longitudes is appended as Annexure II;

(2) The list of villages falling within the Eco-sensitive Zone is given at Annexure-III.

2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.

(2) The said Plan shall be approved by the Competent Authority in the State Government.

(3) The said Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(4) The said Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment,

(ii) Forest,

(iii) Urban Development,

(iv) Tourism,

(v) Municipal,

(vi) Revenue,

(vii) Agriculture

(viii) State Pollution Control Board,

(ix) Irrigationभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 15 (x) Public Works Department

for integrating environmental and ecological considerations into it.

(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The said plan shall provide details for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The said Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(8) The said Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development for livelihood security of local communities.

3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 16, 22, 28 and 31 in column (2) of the Table in paragraph 4, namely:-

(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourismactivities,

(ii) Widening and strengthening of existing roads, (iii) Small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government to prohibit development activities at or near these areas in such a manner as which are detrimental to such areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall be form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment, Government of Karnataka.

(c) The activity of tourism shall be regulated as under, namely:-

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Brahamgiri Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:

Provided that, beyond the distance of one kilometer from the boundary of the Protected Areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in designated areas for Eco- tourism facilities as per Tourism Master Plan.

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.

(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(a) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to time;

(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(c) the biodegradable material shall be recycled preferably through composting or vermiculture;

(d) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial Units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law.

(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the Table below, namely:-

5. Monitoring Committee:- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(i) Regional Commissioner, Mysore – Chairman

(ii) Hon'ble Member of Legislative Assembly, Virajpet Constituency, Kodagu District – Member

(Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required)

(iii) Representative of the Department of Environment, Government of Karnataka – Member;

(iv) Representative of the Department of Urban Development, Government of Karnataka –Member;

(v) Representative of Non-governmental Organizations working in the field of nature conservation (including heritage conservation) to be nominated by the Ministry of Environment and Forests, Government of India – Member;

(vi) The Regional Officer, Karnataka State Pollution Control Board, Mysore – Member;

(vii) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Ministry of Environment and Forests, Government of India – M ember.

(viii) Deputy Commissioner or his representative, Kodagu District, Madikeri – Member

(ix) The Deputy Conservator of Forests, Madikeri Wildlife Division, Madikeri – Member Secretary.

Terms of Reference: (2) The Monitoring Committee shall monitor the compliance of the provisions of this Notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV.

(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.

Annexure I

Boundary description of the eco-sensitive zone around Brahmagiri Wildlife Sanctuary.

Boundary Description of the eco-sensitive Zone of the Brahmagiri wildlife sanctuary is as under.

North: The boundary line of Eco-sensitive Zone starts at Soma Male on the "D" line of Kerti reserve forest boundary and runs in South-Eastern direction and all along the northern boundary of Kerti reserve forest till it reaches a point where the "D"-line of Urti reserve forest and Kerti reserve forest meets i.e. common point at Perambadi tank.

The Eco-sensitive Zone boundary line then runs at a width of 100m parallel to the D-Line of Brahmagiri Wildlife Sanctuary passing through the villages of Arji, Nangala, Rudraguppe, Badaga & Forest, Kuttandi, Begur, Hysodlur, Badagarakeri, Parakatakeri, Theralu & Forest, West Nemmale, Kurchi, Manchalli & Forest and reaches a point bearing GPS Co-ordinates N 11.954135 E 76.056282 in the village Kutta.

East – South – West : Then the line runs in South-Western direction and runs all along the common boundary of Brahmagiri Wildlife Sanctuary and interstate boundary till it reaches the common point of Urti reserve forest of Brahmagiri Wildlife Range and Kerti reserve forest of Makutta Range at Kutupuzha Bridge. Then the line traverses all along the boundary of Kerti reserve forest and reaches the starting point at Soma Male.
