संसंसंसं....2/1(21)2/1(21)2/1(21)2/1(21)/2009-केविविआ/2009-केविविआ/2009-केविविआ/2009-केविविआ....—केन्द्रीय विद्युत विनियामक आयोग (जिसे इसके पश्चात् केन्द्रीय आयोग कहा गया है), विद्युत अधिनियम, 2003 (2003 का 36) की धारा 91(3) के साथ पठित धारा 178 (2)(यक) के अधीन प्रदत्त शक्तियों और इस निमित्त सामथ्र्यकारी सभी अन्य शक्तियों का प्रयोग करते हुए, केन्द्रीय विद्युत विनियामक आयोग (आंतरिक और बाह्य चिकित्सा सुविधा) विनियम, 2005 (जिसे इसके पश्चात् 'मूल विनियम' कहा गया है) का संशोधन के लिए, निम्नलिखित विनियम बनाता है, अर्थात्ः- 1. संक्षिप्त नाम तथा प्रारंभः (1) इन विनियमों का संक्षिप्त नाम केन्द्रीय विद्युत विनियामक आयोग (आंतरिक और बाह्य चिकित्सा सुविधा)(प्रथम संशोधन) विनियम, 2015 है।
(2) ये विनियम राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे।
2. मूल विनियम के विनियम 1 के उपखंड 1.3 के स्थान पर, निम्नलिखित रखा जाएगाः "1.3 ये विनियम केन्द्रीय आयोग के कर्मचारियों को लागू होंगे।"
3. मूल विनियम के विनियम 2 के उपखंड 2.3 के स्थान पर, निम्नलिखित रखा जाएगाः "2.3 "कर्मचारी""कर्मचारी""कर्मचारी""कर्मचारी" से केन्द्रीय आयोग द्वारा नियुक्त और उसकी सूची पर ऐसा कोई व्यक्ति अभिप्रेत है जिसे केन्द्रीय आयोग द्वारा इन विनियमों के अंतर्गत लाभ प्राप्त करने की अनुमति है और वे कर्मचारी भी शामिल हैं जिन्होंने आयोग में स्थायी रूप से समाविष्ट होने के बाद, कम से कम 5 वर्षाेंं की सेवा करते हुए, आयोग से अधिवार्षिकी प्राप्त की है।"
4. मूल विनियम के विनियम 2 के उपखंड 2.8 के स्थान पर, निम्नलिखित रखा जाएगाः
"2.8 "वेतन""वेतन""वेतन""वेतन" से छठे केन्द्रीय वेतन आयोग की सिफारिशों के कार्यान्वयन के परिणामस्वरूप, आयोग में विभिन्न पदाें के लिए लागू संशोधित वेतनमान के अनुसार मूल वेतन तथा ग्रेड पे तथा गैर-प्रेक्टिसिंग भत्ता, यदि कोई है, अभिप्रेत है। उन कर्मचारियों के लिए, जिन्होंने अधिवार्षिकी प्राप्त की है और इन विनियमों के अधीन चिकित्सा सुविधाओं के लिए पात्र हैं, वेतन से अधिवार्षिकी से पूर्व आहरित अंतिम वेतन अभिप्रेत है।"

5. मूल विनियम के विनिमय 3 के उपखंड 3.1, 3.2 और 3.7 के स्थान पर, निम्नलिखित रखा जाएगाः-
"3.1 अस्पताल में दाखिल होने की स्थिति में, कमरा सुविधा, अर्थात् सामान्य वार्ड, अर्द्ध प्राईवेट वार्ड, प्राईवेट वार्ड, डे-केयर आदि के लिए, पात्रता वैसी ही होगी जैसी समय-समय पर, केन्द्रीय सरकार स्वास्थ्य योजना (सीजीएचएस) द्वारा यथानिर्धारित की जाएं।"
3.2. सामान्य वार्ड, अर्द्ध प्राईवेट वार्ड, प्राईवेट वार्ड और डे केयर के लिए कमरा किराए के लिए पात्रता, समय-समय पर, यथासंशोधित सीजीएचएस दरों के अनुसार होगी।
3.7. आंतरिक उपचार की अवधि के लिए पैकेज दरें वैसी ही होंगी जैसी समय-समय पर, सीजीएचएस द्वारा यथानिर्धारित की जाएं।"
6. मूल विनियम के विनियम 5 के उपखंड 5.1 के पश्चात् निम्नलिखित उपखंड अंतःस्थापित किया जाएगाः
"5.2 आयोग के अधिवार्षिकी प्राप्त कर्मचारियों के मामले में, बाह्य उपचार पर किए गए व्यय की वार्षिक सीमा सीजीएचएस नियमों के अनुसार, या समतुल्य पद पर सेवा कर रहे कर्मचारी के अधिकतम वेतनमान तथा ग्रेड पे, जो भी कम हो, के अनुसार होगी।"

CENTRAL ELECTRCITY REGULATROY COMMISSION
NOTIFICATION
New Delhi, the 20th Novermber, 2015
No. 2/1 (21)/2009-CERC .— In exercise of powers conferred under Section 178(2)(za) read with Section 91 (3) of the Electricity Act 2003 (36 of 2003) and all powers enabling it in this behalf, the Central Electricity Regulatory Commission (hereinafter called the Central Commission) hereby makes the following Regulations, to amend the Central Electricity Regulatory Commission (Indoor/Outdoor Medical Facilities) Regulations, 2005 (hereinafter referred to as "the Principal Regulations"), namely:-
1. Short Title and Commencement: (1) These Regulations may be called the Central Electricity Regulatory Commission (Indoor/outdoor Medical Facilities) (First Amendment) Regulations, 2015
(2) These regulations shall come into force with effect from the date of their publication in the official Gazette.
2. Sub-clause 1.3 of Regulation 1 of the Principal Regulations shall be substituted as under:
"1.3 They shall apply to the employees of the Central Commission."
3. Sub-clause 2.3 of Regulation 2 of the Principal Regulations shall be substituted as under:
2.3 "Employee" means any person appointed by and on the rolls of the Central Commission, who is allowed to avail the benefit under these regulations by the Central Commission and also includes the employees who have superannuated from the Commission, having rendered service of not less than 5 years, after being permanently absorbed in the Commission."
4. Sub-clause 2.8 of Regulation 2 of the Principal Regulations shall be substituted as under:

"2.8 "Pay" means Basic Pay plus Grade Pay plus Non Practicing Allowance, if any, as per the revised scale of pay applicable to the various posts in the Commission consequent upon implementation of the recommendations of the Sixth Central Pay Commission. For employees who have superannuated and are eligible for medical facilities under these regulations, pay means the last pay drawn before the superannuation."
5. Sub-clauses 3.1, 3.2 and 3.7 of Regulation 3 of the Principal Regulations shall be substituted as under:
"3.1 The entitlement for room facility i.e. General Ward, Semi-Private Ward, Private Ward, Day Care, etc. in case of hospitalization shall be same as may be prescribed by the Central Government Health Scheme (CGHS) from time to time.
3.2 Entitlement for room rent for General Ward, Semi Private Ward, Private Ward and Day Care shall be as per CGHS rates as amended from time to time.
3.7 Package rates for duration of indoor treatment shall be the same as prescribed by the CGHS from time to time."
6. After sub-clause 5.1 of Regulation 5 of the Principal Regulations, the following sub-clause shall be inserted:
"5.2 In the case of superannuated employees of the Commission, the annual ceiling of the expenses incurred on outdoor treatment shall be as per CGHS Rules, or maximum of the pay scale plus grade pay of a serving employee holding equivalent post, whichever is lower."
