यह प्रकरणकरणकरणकरण कोचीन पत्तन न्यास के पत्तन भूख(cid:16)डों(cid:16)डों(cid:16)डों(cid:16)डों के िलए प#ेदारी किराये की वैधता के विस्तार से संबंधीत है।

2.2. जैसाकि, सीओपीटी के पत्तन भूखंडों के प#ेदारी किरायों की वैधता 30 सितंबर 2015 को समाप्त हो रही थी, सीओपीटी ने दिनांक 30 िसतंबर 2015 के अपने ई-मेल के जरिये सूिचत किया कि मूल्यनिर्धारक ने प्री- 7ा8ट मूल्यनिर्धारण रिपोर्ट प्रस्तुत कर दी है और उस पर िवचार विमर्श चल रहा है। महापत्तनों के िलए भूिम नीित मार्गदर्शी 2014 के प्रासंगिक प्रावधानों का अनुपालन करते (cid:20)ए रिपोर्ट को फाइनलाइज करने में कम से कम एक माह और लगेगा।
2.3. उपरोक्त स्थिति के मद्दे नजर सीओपीटी ने प#ेदारी किरायों के संशोधन हेतु प्रस्ताव प्रस्तुत करने के िलए 15 नवंबर 2015 तक समय-विस्तार के िलए अनुरोध किया है। तथािप, सीओपीटी ने, सीओपीटी के पत्तन भूखंडो की मौजूदा प#ेदारी किराया दरों की वैधता की विस्तार के िलए अनुरोध नही किया है।
3.1. सीओपीटी के पत्तन भूखंडों के वतर्मान प#ेदारी किरायों की वैधता 30 िसतंबर 2015 को समाप्त हो गई है, जब तक कि वैधता िवस्तारित नही कर दी जाती प्रशुल्क >वस्था में एक खालीपन बना रहेगा जो अवांछनीय है। इसिलए, यह प्राधिकरण, सीओपीटी के पत्तन भूखंडों के वतर्मान प#ेदारी किरायों की वैधता को, इनके हाल ही में, समाप्त होने की ितिथ से 31 दिसंबर 2015 तक अथवा सीओपीटी द्वारा दािखल किए जाने वाले प्रशुल्क प्रस्ताव के आधार पर सीओपीटी के पत्तन भूखंडों के संशोिधत प#ेदारी किरायों की अिधसूचना की प्रभावी ितिथ तक, इनमें से जो भी पहले हो, विस्तारित की जाती है।
3.2. मई 2010 में इस प्राधिकरण (cid:12)दारा अनुमोदित प#ेदारी किरायों की अनुसूची में सामान्य नोट 1 एक िवशिष्ट शर्त प्रदान करता है कि प्रदत्त प#ेदारी किराए, सरकार (cid:12)दारा जारी मार्गदBशयों के अनुCप 2% वाBषक की अपने आप वाBषक वृEि के अधीन है। ऐसी स्थिति में, 2% की दर से वाBषक वृEि, सीओपीटी के पत्तन भूखंडों के प#ेदारी किरायों पर विस्तारित वैधता अविध के दौरान लागू की जाती रहेगी। वाBषक वृEि संबंधी धारा, भूिम नीित मार्गदर्शी 2014 के साथ-साथ संशोिधत भूिम नीित मार्गदर्शी 2014 के भी अनुरूप है।
3.3. तथािप, इस िवषय में, यहां यह उल्लेख करना भी प्रासंगिक है कि 2% की वाBषक वृEि के साथ मौजूदा प#ेदारी किरायों का विस्तार वतर्मान परिदृश्य में खालीपन से बचने के िलए के वल एक अनन्तिम >वस्था है। सीओपीटी के पत्तन भूखंडों के िलए निर्धारित किए जाने वाले प#ेदारी किराये, सीओपीटी (cid:12)दारा दािखल किए जाने वाले प्रस्ताव के आधार पर होंगे।
4. परिणाम स्वरूप और ऊपर प्रदत्त कारणों से, यह प्राधिकरण, सीओपीटी के पत्तन भूखंडों के वतर्मान प#ेदारी किरायों की वैधता को 30 िसतंबर 2015 से आगे (और) 31 दिसंबर 2015 तक अथवा सीओपीटी (cid:12)दारा दािखल किए जाने वाले प्रशुल्क प्रस्ताव के आधार पर, 2% वाBषक वृEि के साथ संशोिधत प#ेदारी किरायों की अिधसूचना की प्रभावी ितिथ तक इनमें से जो भी पहले हो, विस्तारित करता है। सीओपीटी को िनदेश दिया जाता है कि वह संशोिधत भूिम नीित मार्गदर्शी 2014 के लागू होने वाले प्रावधानों का अनुपालन करते (cid:20)ए, जैसाकि सीओपीटी ने स्वीकार किया था, सीओपीटी के पत्तन भूखंडों के प#ेदारी किरायों के संशोधन के िलए अपना प्रस्ताव 15 नवंबर 2015 तक हर हाल में प्रस्तुत कर दे।

Tariff Authority for Major Ports
NOTIFICATION
Mumbai, the 23rd November, 2015
No. TAMP/33/2007-COPT.—In exercise of the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing lease rentals for port lands of Cochin Port Trust as in the Order appended hereto.

This case relates to extension of the validity of lease rentals for port lands of the Cochin Port Trust (COPT).
2.1. The lease rentals for port lands of COPT was revised by the Authority vide Order No.TAMP/33/2007-COPT dated 4 May 2010. The said Order was notified in the Gazette of India on 11 June 2010 vide Gazette No.160. The lease rentals for the port lands of COPT revised by the Authority were valid for five years, i.e. upto 11 July 2015. This Authority has extended the validity of the lease rentals for port lands of COPT till 30 September 2015 vide Order dated 17 August 2015.
2.2. As the validity of the lease rentals for port lands of COPT was to expire on 30 September 2015, the COPT vide its email dated 30 September 2015 has stated that the valuer has submitted the pre-draft valuation report and the discussions on the same are in progress. It may take atleast one more month to finalize the report complying with the relevant provisions of the Land Policy Guidelines for Major Ports, 2014.
2.3. In view of the above position, the COPT has requested for extension of time upto 15 November 2015 for the submission of the proposal for revision of the Lease Rentals. However, the COPT has not requested for extension of the validity of the existing lease rentals rate for port lands of COPT.
3.1. The validity of the existing lease rentals for port lands of COPT expired on 30 September 2015. Unless the validity is extended there will be a vacuum in the tariff arrangement, which is not desirable. This Authority, therefore, extends the validity of the existing lease rentals for port lands of COPT from the date of its expiry till 31 December 2015 or till the date of effect of notification of the revised lease rentals of port lands of COPT based on the tariff proposal to be filed by the COPT, whichever is earlier.
3.2. The General Note 1 in the Schedule of lease rent approved by this Authority in May 2010 prescribes a specific condition that the lease rent prescribed is subject to automatic annual escalation @ 2% in line with the guidelines issued by the Government. That being so, the annual escalation @ 2% will continue to apply during the extended validity period of the lease rentals for port lands of COPT. The annual escalation clause is also in line with the Land Policy Guidelines, 2014 as well as in its revised Land Policy Guidelines, 2014.
3.3. However, in this regard, it is relevant here to mention that the extension of the existing lease rentals with an annual escalation of 2% is only a provisional arrangement to avoid a vacuum in the current scenario. The lease rentals to be fixed for the port lands of COPT will be based on a proposal to be filed by the COPT.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]4. In the result, and for the reasons given above, this Authority extends the validity of the existing lease rentals for port lands of COPT, beyond 30 September 2015 upto 31 December 2015 or date of effect of notification of the revised lease rentals based on the tariff proposal to be filed by the COPT, whichever is earlier, with an annual escalation of 2%. The COPT is directed to file its proposal for revision of lease rents for port lands of COPT positively by 15 November 2015 as agreed by the COPT following the applicable revised Land Policy Guidelines, 2014.
