काकाकाका....आआआआ.... 3285328532853285(अ(अ(अ(अ))))....----केन्द्रीय सरकार ने पेट्रोलियम और खनिज पाइपलाइन्स (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 की उप-धारा (1) के अधीन जारी की गई, भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का. आ. 2997(अ) तारीख 24 नवम्बर, 2014 जिसका प्रकाशन भारत के राजपत्र संख्या 2410 भाग II खण्ड 3 , उपखण्ड (ii) तारिख 27 नवम्बर, 2014 में किया गया है । इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट ओड़िशा राज्य की तहसीलः- सोहेला, जिल्लाः- बरगड, की भूमि में, ओड़िशा राज्य में पारादीप से छाीसगढ़ राज्य में रायपुर एबं झारखण्ड राज्य में राँचि तक पेट्रोलियम उत्पादों के परिवहन के लिए इंडियन ऑयल कॉर्पोरेशन लिमिटेड द्वारा क्रियान्वित किए जा रहे ''पारादीप - सम्बलपुर -रायपुर- राँचि पाइपलाइन परियोजना'' के सम्बंध में पाइपलाइन बिछाई जाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के लिए अपने आशय की घोषणा की थी ;
ओर उक्त राजपत्र अधिसूचना की प्रतियाँ जनता को तारिख 27 नवम्बर,2014 सेे उपलब्ध करा दी गई थी;
ओर, उक्त अधिनियम की धारा 6 की उप-धारा (1) के अनुसरण में सक्षम प्राधिकारी ने केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
ओर, केन्द्रीय सरकार ने, उक्त रिपोर्ट पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइन बिछाने के लिए अपेक्षित है, उसमें उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है ;
अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइन बिछाने के उपयोग का अधिकार अर्जित किया जाए ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उपधारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से केन्द्रीय सरकार में निहित होने के बजाए, सभी बिल्लंगमों से मुक्त हो कर इंडियन ऑयल कॉर्पोरेशन लिमिटेड में निहित होगी।
पेट्रोलियम और खनिज पाइपलाइन अधिनियम, 1962 कि धारा 10 के अधीन किसी भी क्षतिपूर्ति के लिए इंडियन ऑयल कॉर्पोरेशन लिमिटेड पूर्णतया उत्तरदायी होगी और पाइपलाइन से सम्बन्धित किसी भी मामले पर केन्द्रीय सरकार के विरूद्ध कोई वाद या कानूनी कार्यवाही नहीं हो सकेगी।

NOTIFICATION
New Delhi, the 3rd December, 2015
S.O. 3285(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas, published in the Gazette of India no.2410 Part II, section 3, sub-section(ii) dated 27th November 2014 vide S.O. number 2997(E) dated 24th November, 2014 issued under sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said act), the Central Government declared its intention to acquire the right of user in the land situated in Tehsil- Sohela, District- Bargarh, in Odisha State, specified in the schedule appended to that notification for the purpose of laying pipeline for the transportation of Petroleum products from Paradip in the State of Odisha to Raipur in the State of Chhattisgarh & Ranchi in the State of Jharkhand by Indian Oil Corporation Limited for implementing the "Paradip- Sambalpur-Raipur-Ranchi Pipeline Project".
And whereas, copies of the said Gazette notification were made available to the public on 27th November 2014;
And whereas, the Competent Authority has under sub-section (1) of section 6 of the said Act, has submitted his report to the Central Government;
And whereas, the Central Government after considering the said report, and on being satisfied that the said land is required for laying the pipeline, has decided to acquire the right of user therein;
[भाग II—खण्ड 3 (ii)] भारत का राजपत्रा : असाधरण 3Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to pipeline.

और केन्द्रीय सरकार, उक्त अधिनियम की धारा 6 की उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से केन्द्रीय सरकार में निहित होने के बजाए, सभी बिल्लंगमों से मुक्त हो कर इंडियन ऑयल कॉर्पोरेशन लिमिटेड में निहित होगी।
पेट्रोलियम और खनिज पाइपलाइन अधिनियम, 1962 कि धारा 10 के अधीन किसी भी क्षतिपूर्ति के लिए इंडियन ऑयल कॉर्पोरेशन लिमिटेड पूर्णतया उत्तरदायी होगी और पाइपलाइन से सम्बन्धित किसी भी मामले पर केन्द्रीय सरकार के विरूद्ध कोई वाद या कानूनी कार्यवाही नहीं हो सकेगी।
