यह आदेश कोचीन पत्तन न्यास (सीओपीटी) के वतर्मान दरमान की वैधता अवधि में बढ़ोत्तरी से संबंिधत है।
2. सीओपीटी के वतर्मान दरमान इस प्राधिकरण द्वारा पिछली बार आदेश सं. टीएएमपी/49/2011- सीओपीटी दिनांक 1 अप्रैल, 2013 के अंतर्गत अनुमोदित किये गये थे जिन्हें भारत के राजपत्र में 10 जून, 2013 को अधिसूचित किया गया था। इस आदेश में दरमानों की वैधता 31 मार्च 2015 तक निर्धारित की गई थी। इस प्राधिकरण द्वारा सीओपीटी के वतर्मान दरमानों की वैधता की तिथि दिनांक 28 अप्रैल, 2015 के आदेशानुसार 30 िसतंबर, 2015 तक बढ़ायी गई थी।
3. सीओपीटी द्वारा, वतर्मान दरमानों में संशोधनों के लिए 2005 के प्रशुल्क दिशानिद=शों के अंतर्गत दिनांक 03 नवंबर, 2014 के पत्र के द्वारा अपना प्रस्ताव, पेश किया गया । इस प्रस्ताव पर संबंधित पणधारियों के साथ िवचार विमर्श किया गया।
4.1. इस दौरान पोत परिवहन मंत्रालय द्वारा उनके पत्र सं. 8(1)/2014-टीएएमपी दिनांक 13 जनवरी, 2015 के अंतर्गत नई 'महापत्तन न्यासों के लिए प्रशुल्क निर्धारण नीति-2015' जारी कर दी गई िजसे
5118 GI/2015 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] इस प्राधिकरण द्वारा भारत के राजपत्र सं 30 पर दिनांक 27 जनवरी, 2015 को अधिसूचित किया गया। यह नई 'महापत्तन न्यासों के लिए प्रशुल्क निर्धारण नीति-2015', 13 जनवरी,2015 से प्रभावी हो गई है।
4.2. पोत परिवहन मंत्रालय की नई 'महापत्तन न्यासों के लिए प्रशुल्क निर्धारण नीति-2015' में उल्लिखित प्रशुल्क निर्धारण प्रBिया, 2005 के प्रशुल्क दिशानिद=शों में निधारित प्रशुल्क निर्धारण पCति से ब(cid:27)त भिन्न है अत:, सीओपीटी द्वारा प्रस्तुत प्रस्ताव पर 2005 के दिशानिद=शों के अनुसार कार्रवाई नहD की जा सकी है। इस परिप्रेEय में इस प्राधिकरण द्वारा जारी 13 फरवरी, 2015 के आदेश के अंतर्गत सीओपीटी के दरमानों के सामान्य परिशोधन के प्रस्ताव को बंद कर दिया गया था । सीओपीटी को पोत परिवहन मंत्रालय की घोषित नई प्रशुल्क नीित-2015 के अंतर्गत नया परिशोधित प्रस्ताव प्रस्तुत करने का परामर्श दे दिया गया था।
5. प्रशुल्क नीित 2015 के खंड 1.5 के अनुसार इस प्राधिकरण द्वारा प्रशुल्क नीित 2015 के कार्यान्वयन के लिए महापत्तन न्यासों के परामर्श से भारत के राजपत्र में, 04 जून 2015 को राजपत्र सं 207 के अंतर्गत कार्यकारी दिशानिद=श जारी किए गए हैं।
6.1. अब सीओपीटी द्वारा उनके पत्र सं. एफडी/कॉस्टिग /रिवीज़न ऑफ एसओआर-2015-18/2015 दिनांक 27 जुलाई,2015 के माध्यम से नई महापत्तन न्यासों के लिए प्रशुल्क नीित 2015 के अनुसार इन दरमानों में परिवर्तन का प्रस्ताव पेश किया गया है। दरमानों में परिशोधन के लिए सीओपीटी का दिनांक 27 जुलाई 2015 का यह प्रस्ताव परामर्शाधीन है। 27 अक्तूबर, 2015 को संयुक्त सुनवाई की गई थी। कु छ मुद्दों पर सीओपीटी से अतिरिक्त सूचना/स्पष्टीकरण मांगा गया है। सीओपीटी का उत्तर अभी तक प्राप्त नहD (cid:27)आ है।
6.2. सीओपीटी से जानकारी/स्पष्टीकरण प्राप्त हो जाने के पश्चात, प्रस्ताव पर आगे की कार्रवाई अपेक्षित होगी और इस मामले पर प्राधिकरण द्वारा निर्णय लेने में कु छ समय लगेगा।
6.3. क्योंकि सीओपीटी के मौजूदा दरमानों की बढ़ी (cid:27)ई वैधता 30 िसतंबर, 2015 को समाप्त हो गई है और इसको ध्यान में रखते (cid:27)ए प्राधिकरण को मामले में कार्रवाई पूरा करने में कु छ समय लगेगा। इस प्राधिकरण द्वारा सीओपीटी के वतर्मान दरमानों की वैधता की अंतिम तिथि समाप्त होने से 31 दिसम्बर 2015 तक या नई प्रशुल्क नीति के अंतर्गत संशोधित दरमानों के कार्यान्वित होने की प्रभावी तिथि तक जो भी पहले हो बढ़ायी जाती है।
6.4. 01 अप्रैल, 2013 के बाद सीओपीटी के किसी अन्य मामले का निस्तारण नई 'महापत्तन न्यासों के िलए प्रशुल्क नीित-2015' के अनुसार किया जाएगा ।

Mumbai, the 24th November 2015
No. TAMP/49/2011-COPT.—In exercise of the powers conferred by Sections 48, 49 and 50 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates of Cochin Port Trust (COPT), as in the Order appended hereto.

This Order relates to the extension of the validity of the existing Scale of Rates of the Cochin Port Trust (COPT).

The existing SOR of the COPT was last approved by this Authority vide Order No. TAMP/49/2011-COPT dated 1 April 2013 which was notified in the Gazette of India on 10 June 2013, with a validity till 31 March 2015. This Authority has extended the validity of SOR of COPT till 30 September 2015 vide Order dated 28 April 2015.
3. The COPT had filed its proposal for revision of its SOR under 2005 guidelines vide its letter dated 3 November 2014. The proposal was taken up for consultation with the relevant stakeholders.
4.1 In the meantime, the Ministry of Shipping (MOS), vide its letter No. 8(1)/2014-TAMP dated 13 January 2015 has issued the new "Policy for determination of Tariff for Major Port Trusts, 2015" which was notified in the Gazette of India vide Gazette No. 30 dated 27 January 2015 by this Authority. The new "Policy for determination of Tariff for Major Port Trusts, 2015" has come into effect from 13 January 2015.
4.2. The tariff fixation process envisaged in the new Tariff Policy of 2015 for Major Port Trust by MOS, is significantly different from the tariff fixation method stipulated in the Tariff Guidelines of 2005. Hence, the proposal filed by COPT could not be processed under 2005 guidelines. In view of this, this Authority vide its Order dated 13 February 2015 had closed the COPT proposal dated 3 November 2014 filed under 2005 guidelines for general revision of its Scale of Rates. The COPT was advised to file a revised proposal in accordance with the new Tariff policy of 2015 announced by the MOS. 5. As per Clause 1.5 of Tariff Policy, 2015, this Authority has notified working guidelines to operationalise the Tariff Policy, 2015 in consultation with all Major Port Trusts in the Gazette of India on 4 June 2015 vide Gazette No.207.
6.1. Now, the COPT vide its letter No.FD/Costing/Revision of SOR-2015-18/2015 dated 27 July 2015 has filed its proposal for revision of its SOR under new Tariff Policy for Major Port Trusts, 2015. The proposal dated 27 July 2015 filed by the COPT for revision of SOR has already been taken on consultation. Joint hearing was held on 27 October 2015. Additional information / clarification on a few points has been sought from the COPT. Reply of the COPT is awaited.
6.2. On receipt of the information / clarification by the COPT, the proposal requires to be processed further which will take some time for the case to mature for consideration of this Authority.
6.3. Since the extended validity of the existing SOR of COPT has expired on 30 September 2015 and recognising that it will take some time for the case to mature for consideration of this Authority, this Authority extends the validity of the existing SOR of COPT from the date of its expiry till 31 December 2015 or till the effective date of implementation of the revised Scale of Rates under new Tariff Policy, 2015, whichever is earlier.
6.4. The treatment of additional surplus, if any, accruing to COPT for the period beyond 1 April 2015 will be governed by the new Tariff Policy for Major Port Trusts, 2015.
