काकाकाका....आआआआ.... 3323332333233323(अ)(अ)(अ)(अ)....----यतः, केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008, जिन्हें सा.का.नि. 838(अ), तारीख 5 दिसम्बर, 2008 द्वारा प्रकाशित किया गया था तथा जिनमें बाद में संशोधन किए गए थे (''उक्त नियम''), के नियम (3) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्या का.आ. 2645(अ), तारीख 28 सितम्बर, 2015 द्वारा यह अधिसूचित किया है कि आन्ध्रप्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 5 (नया रारा-16) के 901.753 कि.मी.(पुराना चैनेज 200.00 कि.मी.) से 1022.494 कि.मी. (पुराना चैनेज 81.600 कि.मी.) (दीवनाचेरूवु से गुंडुगोलानू सेक्शन) तक चार या अधिक लेन के खण्ड (''उक्त खण्ड'') के उपयोग हेतु यांत्रिक वाहनों पर शुल्क उद्‌ग्रहीत एवं संग्रहीत किया जाएगा और उसने प्राधिकरण को अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क को संग्रहीत करने हेतु प्राधिकृत किया हैः

राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार, अधिसूचना संख्या का.आ. 2645(अ), तारीख 28 सितम्बर, 2015 में निम्नलिखित संशोधन करती है, अर्थात्‌ः-

4. उक्त अधिसूचना में, विद्यमान पैरा 11ः-

उक्त नियमों के अनुसार परियोजना की पूंजीगत लागत को निम्नप्रकार प्रतिस्थापित किया जाएगाः-को निम्नप्रकार प्रतिस्थापित किया जाएगाः-को निम्नप्रकार प्रतिस्थापित किया जाएगाः-को निम्नप्रकार प्रतिस्थापित किया जाएगाः-

901.753 कि.मी. से 1022.494 कि.मी. तक की पूरी परियोजना की पूंजीगत लागत 773.46 करोड़ रुपए है और 31.03.2015 तक छूट सहित संग्रहीत राजस्व 195.52 करोड़ रुपए है। अभी तक वसूल किए जाने वाली पूंजीगत लागत 577.94 करोड़ रुपए है। प्राधिकरण द्वारा उपयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पूंजीगत लागत की वसूली कर रिकार्ड रखा जाएगा और पूंजीगत लागत की वसूली हो जाने के पश्चात्‌ लगाए जाने वाले शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इसमें वार्षिक तौर पर संशोधन किया जाएगा।

NOTIFICATION

New Delhi, the 9th December, 2015

S.O. 3323(E).—In exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and subsequent amendments (the "said Rules"), the Central Government, vide notification S.O. 2645(E), dated 28th September, 2015 has notified that there shall be levied and collected fees on mechanical vehicles for the use of four or more lane section from km 901.753 (old chainage km. 200.00) to km. 1022.494 (old chainage km 81.600) (Divancheruvu to Gundugolanu Section) of National Highway No. 5 (new NH-16) in the State of Andhra Pradesh (the "said section"), and has authorized the Authority to collect, either through its officials or through a contractor, the said fee.

In exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government hereby makes the following amendment in the notification S.O. 2645(E), dated 28th September, 2015, namely:-

between two Toll Plazas for tolling purpose.

4. In the said notification, the existing para 11:—

The capital cost of the Project ………………………………………………………… accordance with the said rules.

The capital cost of the complete project for km 901.753 to km 1022.494 is Rs. 773.46 Crore and discounted revenue collected till 31.03.2015 is Rs. 195.52 Crore. The capital cost yet to be recovered is Rs. 577.94 Crore. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
