का.आ. का.आ. का.आ. का.आ. 3379337933793379(अ)(अ)(अ)(अ)....————यत:, मै. अदानी पो(cid:16)र्स और स्पेशल इकोनोमिक जोन िलिमटेड (ए.पी.एस.ई.जेड.एल), ने गुजरात राज्य के मुन् ा-तालुका, िजला-क!छ में ब$उत्पाद विशेष आ*थक जोन की स्थापना हेतु विशेष आ*थक जोन अिधिनयम, 2005 (2005 का 28) (जिसे एत1प2ात उक्त अधिनियम कहा गया है) की धारा 3 के अंतर्गत प्रस्ताव किया है;
और यत:, के न् सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप-धारा (8) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपयु र्क्त विशेष आ*थक जोन के विकास, प्रचालन एवं रखराव हेतु उक्त अधिनियम की धारा 3 की उप-धारा (10) के अंतर्गत दिनांक 24 अप्रैल, 2015 को अनुमोदन पत्र प्रदान कर दिया है;
अत:, अब, विशेष आ*थक जोन अधिनियम, 2005 की धारा 4 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते $ए और विशेष आ*थक जोन अधिनियम, 2006 के नियम 8 के अनुसरण में के न् सरकार, एतNारा उपयु र्क्त स्थान के 1856.53.35 हेक्टेयर के नीचे दी गई तालिका में दिए गए पॉके ट नंबर्स के क्षेत्र को विशेष आ*थक जोन के रूप में अधिसूचित करती है, अर्थात:—

और यत:, िवशेष आ*थक जोन अधिनियम, 2005 (2005 का 28) की धारा 13 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते $ए, के न् सरकार एतदद्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ उपयु र्क्त विशेष आ*थक जोन के िलए एक सिमित, िजसे अनुमोदन सिमित कहा जाएगा, गठित करती है, जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थात:—

| 2. | िनदेशक अथवा उप-सचिव, भारत सरकार, वाणिज्य एवं उद्योग मंत्रालय, वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव, भारत सरकार से कम नह\ होगा | सदस्य, पदेन |
| 3. | विशेष आ*थक जोन पर भू-भागीय क्षेत्राधिकार रखने वाले क्षेत्रीय संयुक्त विदेश ]ापार महािनदेशक | सदस्य, पदेन |
| 4. | विशेष आ*थक जोन पर भू-भागीय क्षेत्राधिकार रखने वाले सीमा शुल्क आयुक्त या क े न् ीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नह\ होगा | सदस्य, पदेन |

और यत:, विशेष आ*थक जोन अधिनियम, 2005 (2005 का 28) की धारा 53 की उप-धारा (2) द्वारा प्रदत्त
शक्तियों का प्रयोग करते $ए के न् सरकार एतNारा दिनांक 11 दिसंबर, 2015 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उपयु र्क्त विशेष आ*थक जोन को सीमा-शुल्क अधिनियम, 1962 (1962 का 52) की धारा 77 के अंतर्गत अंतदTशीय कं टेनर डिपो माना जाएगा ।

NOTIFICATION
New Delhi, the 11th December, 2015
S.O. 3379(E).Whereas, M/s Adani Ports and Special Economic Zone Ltd. (APSEZL) has proposed under section 3 of the Special Economic Zones Act, 2005 (28 of 2005), (hereinafter referred to as the said Act), to set up a Multi Product Special Economic Zone at Mundra Taluka, District Kutch, in the State of Gujarat;
And, whereas, the Central Government is satisfied that requirements under sub-section (8) of section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub- section (10) of section 3 of the said Act for development, operation and maintenance of the above sector specific Special Economic Zone on 24th April, 2015;
Now, therefore, the Central Government, in exercise of the powers conferred by sub-section (1) of section 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Rules, 2006, hereby notifies the 1856.53.35 hectares area at above location with pocket numbers given in the table below as a Special Economic Zone, namely:—

And, therefore, the Central Government, in exercise of the powers conferred by sub-section (1) of section 13 of the Special Economic Zones Act, 2005 (28 of 2005), hereby constitutes a Committee to be called the Approval Committee for the above Special Economic Zone for the purposes of section 14 of the said Act consisting of the following Chairperson and Members, namely:—
| 1. | Development Commissioner of the Special Economic Zone | Chairperson, ex officio; |
| 2. | Director or Deputy Secretary to the Government of India, Ministry of Commerce and Industry, Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India | Member, ex officio; |
| 3. | Zonal Joint Director General of Foreign Trade having territorial jurisdiction over the Special Economic Zone | Member, ex officio; |
| 4. | Commissioner of Customs or Central Excise having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner | Member, ex officio; |
| 5. | Commissioner of Income Tax having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner | Member, ex officio; |
| 6. | Director (Banking) in the Ministry of Finance, Banking Division, Government of India | Member, ex officio; |
| 7. | Two officers, not below the rank of Joint Secretary, to be nominated by the State Government | Member, ex officio; |
| 8. | Representative of the Developer of the zone | Special invitee |
And, therefore, the Central Government, in exercise of the powers conferred by sub-section (2) of section 53 of the Special Economic Zones Act, 2005 (28 of 2005), hereby appoints the 11th day of December, 2015 as the date from which the above Special Economic Zone shall be deemed to be Inland Container Depot under section 7 of the Customs Act, 1962 (52 of 1962).
