काकाकाका....आआआआ....3516351635163516((((अअअअ).).).).————कें (cid:12)ीय सरकार, भारतीय प्रतिभूति और विनिमय बोर्ड, अधिनियम, 1992 (1992 का 15) की धारा 29 द्वारा प्रदत्त शक्तियों का प्रयोग करते (ए, भारतीय प्रतिभूति और विनिमय बोर्ड (अध्यक्ष और सदस्यों की निबंधन और सेवा शत/) िनयमावली, 1992 में और संशोधन करने के लिए एत0ारा निम्नलिखित नियम बनाती है; अर्थात :-
1. (1) इन नियमों को भारतीय प्रतिभूति और विनिमय बोर्ड (अध्यक्ष और सदस्यों की निबंधन और सेवा शत/) संशोधन नियमावली, 2015 कहा जाएगा।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे।
2. भारतीय प्रतिभूति और विनिमय बोर्ड (अध्यक्ष और सदस्यों की निबंधन और सेवा शत/) नियमावली,1992 में, नियम 3 में, उप-िनयम (5) के स्थान पर निम्निलिखत उप-नियम प्रतिस्थापित किया जाएगा; अर्थात :-
''(5) कें (cid:12)ीय सरकार, अध्यक्ष और प्रत्येक पूर्णकालिक सदस्य की नियुक्ति जांच और चयन समिति की सिफारिश पर करेगी। इस समिति में निम्नलिखित शामिल होंगे, नामत :-
(क) मंत्रिमंडल सचिव – अध्यक्ष;
(ख) प्रधानमंत्री के अपर प्रधान सचिव – सदस्य;
(ग) सिचव, आIथक कार्य विभाग – सदस्य;
(घ) अध्यक्ष, भारतीय प्रतिभूति और विनिमय बोर्ड (पूर्णकालिक सदस्य के चयनार्थ) – सदस्य;
(ङ) तीन ख्यातिप्राप्त विशेषM (वित्त, अर्थशास्त्र, विधि, लोक प्रशासन, वित्तीय बाजार के क्षेत्रों और इसके द्वारा अनुरक्षित विषयों के विशेषMों के पेनल से कें (cid:12)ीय सरकार द्वारा नामांकित किए जाने वाले) – सदस्य।

NOTIFICATION
New Delhi, the 23rd December, 2015
S.O. 3516 (E).—In exercise of the powers conferred by section 29 of Securities and Exchange Board of India Act, 1992 (15 of 1992), the Central Government hereby makes the following rules further to amend the Securities and Exchange Board of India(Terms and Conditions of Service of Chairman and Members) Rules, 1992, namely:-
1. (1) These rules may be called the Securities and Exchange Board of India (Terms and Conditions of Service of Chairman and Members) Amendment Rules, 2015.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Securities and Exchange Board of India(Terms and Conditions of Service of Chairman and Members) Rules, 1992, in rule 3, for the sub-rule (5), the following sub-rule shall be substituted, namely:-
"(5) The Chairman and every whole time Member shall be appointed by the Central Government on the recommendation of a Search-cum-Selection Committee consisting of the following, namely:-
(a) Cabinet Secretary – Chairman;
(b) Additional Principal Secretary to the Prime Minister – Member;
(c) Secretary, Department of Economic Affairs – Member;
(d) Chairman, Securities and Exchange Board of India
(for selection of whole-time Member) – Member;
(e) Three experts of repute (to be nominated by the Central Government from a panel of experts in the fields of Finance, Economics, Law, Public Administration, Financial Markets and related subjects maintained by it) —Member".

Note: The principal rules were published in the Gazette of India, Extraordinary, vide notification number S.O. 146(E), dated the 21st February, 1992 and subsequently amended vide notification numbers S.O. 153(E), dated the 7th February, 1994, S.O. 732(E), dated the 18th May, 2006, S.O. 2037, dated the 23rd July, 2009, S.O. 2442(E), dated the 7th October, 2010 and S.O. 809(E), dated the 30th December, 2013.
