काकाकाका.... आआआआ.... 3513351335133513(अ),(अ),(अ),(अ),—यतः, केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन जल भूतल परिवहन मंत्रालय (सड़क स्कन्ध) की अधिसूचना संख्या का.आ. 196 (अ), तारीख 6 मार्च, 2000 तथा सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1192 (अ), तारीख 3 दिसम्बर, 2001 और का.आ.सं 465 (अ), तारीख 26 अप्रैल, 2002 द्वारा आंध्र प्रदेष राज्य मेंं राष्ट्रीय राजमार्ग संख्या 7 के 447.000 कि.मी. से 464.000 कि.मी., 474.000 कि.मी., 175.640 कि.मी. से 447.000 कि.मी. और 474.000 कि.मी. से 480.000 कि.मी. (नागपुर से हैदराबाद सेक्शन) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् 'प्राधिकरण' संदर्भित किया गया है) को सौंपा था;
अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008 जो सा.का.नि. 838, (अ), तारीख 5 दिसम्बर, 2008 को प्रकाषित किए गए थे और जिनमें सा.का.नि. 950 (अ), तारीख 3 दिसम्बर, 2010, सा.का.नि. 15 (अ), तारीख 12 जनवरी, 2011, सा.का.नि. 756 (अ), तारीख 12 अक्तूबर, 2011, सा.का.नि. 778 (अ), तारीख 16 दिसम्बर, 2013, सा.का.नि. 26 (अ), तारीख 16 जनवरी, 2014, सा.का.नि. 831 (अ), तारीख 21 नवम्बर, 2014 एवं सा.का.नि. 220 (अ), तारीख 23 मार्च, 2015 द्वारा संषोधन किया गया था (जिन्हें इसमें इसके पश्चात् "उक्त नियम" संदर्भित किया गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और तारीख 26.03.2014 की शुल्क अधिसूचना संख्या का.आ. 896 (अ) की सारणी 1 के क्रम संख्या 15 द्वारा यथासंषोधित अधिसूचना संख्या का. आ. 2171 (अ), तारीख 12.09.2012 का अधिक्रमण करते हुए एतद्द्वारा यह अधिसूचित करती है कि आंध्र प्रदेष राज्य मेंं राष्ट्रीय राजमार्ग संख्या 44 (पुराना रा.रा-7) के 368.255 कि.मी. से 419.793 कि.मी. तक (अड्लूर येल्लारेड्डी चेंगुटा सेक्षन) और 419.793 कि.मी. से 481.331 कि.मी., तक (चेंगुटा से बेवनपल्ली सेक्षन) (जिसे इसमें इसके पश्चात् ''उक्त खण्ड" संदर्भित किया गया है) चार या अधिक लेन के उपयोग हेतु नीचे सारणी 1 के स्तम्भ (1) में विनिर्दिष्ट प्रकार के यांत्रिक वाहनों पर सारणी 1 के स्तम्भ (2) में विनिर्दिष्ट आधार दरों के (जिसे इसमें इसके पश्चात् ''आधार दर" संदर्भित किया गया है) निम्नलिखित के लिए शुल्क उद्ग्रहीत एवं संग्रहीत किया जाएगाः

4. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजी—त हुआ हो और वह टोल प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके लिए वर्ष 2015-16 के लिए मासिक पास की दर 230.00/- रुपए (दो सौ तीस रुपए मात्र) होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा ।
5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्ः

6. जिस जिले में टोल प्लाजा पड़ता है उस जिले में पंजी—त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के लिए वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।
7. जो यांत्रिक वाहन नियमों के अधीन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसे राष्ट्रीय राजमार्ग का उपयोग करने अथवा टोल प्लाजा को पार करने की तब तक अनुमति नहीं होगी जब तक कि ऐसे वाहन से अधिक भार को हटा न दिया जाए। ऐसे अधिक भार से लदे हुए यांत्रिक वाहन के चालक अथवा मालिक या प्रभारी व्यक्ति को ऐसे अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग पर प्रवेष कराने के लिए नियमों के अधीन, टोल संग्रहण एजेंसी को ऐसी श्रेणी के यांत्रिक वाहन पर लागू शुल्क के दस गुना के बराबर शुल्क का भुगतान करना होगा।
8. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छूट-प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
10. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और छूट की गणना खण्डों की पूरी कर ली गई लम्बाई के आधार पर प्राधिकरण द्वारा की जाएगी और उक्त नियमों के नियम 5 के अनुसार उसमें वार्षिक तौर पर संशोधन किया जाएगा और तदनुसार, उसे अंग्रेजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाषित किया जाएगा।
11.. पूरी परियोजना अर्थात् 368.255 कि.मी. से 481.331 कि.मी. तक (अड्लूर येल्लारेड्डी से बेवनपल्ली सेक्शन) की पूंजीगत लागत 590.137 करोड़ रुपए है और 31.03.2015 तक एकत्रित छूट प्राप्त राजस्व 148.52 करोड़ रुपए है। वसूल की जाने वाली पूंजीगत लागत अभी 441.617 करोड़ रुपए है। प्राधिकरण द्वारा उपयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पूंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पूंजीगत लागत की वसूली हो जाने के बाद लगाए गए शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इसमें वार्षिक तौर पर संशोधन किया जाएगा।

S.O. 3513(E).—Whereas, vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) number S.O. 196(E) dated the 6th March, 2000 and Ministry of Road Transport and Highways number S.O. 1192(E) dated 3rd December, 2001 and S.O. 465(E) dated the 26th April, 2002, issued under section 11 of the National Highway Authority of India Act, 1988 (68 of 1988), the Central Government entrusted the stretch from Km 447.000 to Km 464.000, Km 464.000 to Km 474.000, Km 175.640 to Km 447.000 and Km 474.000 to Km 480.000 (Nagpur to Hyderabad Section) respectively of National Highway No. 7 in the State of Andhra Pradesh, to the National Highways Authority of India (hereinafter referred to as the "Authority");
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R 778(E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014, G.S.R. 831(E) dated 21st November, 2014 & G.S.R. 220 (E) dated 23rd March, 2015 (hereinafter referred to as the "said Rules"), and in supersession of the notification bearing No. S.O. 2171(E) dated 12.09.2012 as amended vide Sl. No. 15 of Table 1 of fee notification bearing S.O. No. 896 (E) dated 26.03.2014, the Central Government, hereby, notifies that there shall be levied and collected fees on mechanical vehicles for the use of four or more lane section from km 368.255 to km 419.793 (Adloor Yellareddy to Chegunta Section) and from km 419.793 to km 481.331 (Chegunta to Bewenpally Section) of National Highway No. 44 (Old NH-7) in the State of Andhra Pradesh (hereinafter referred to as the "said section"), at the base rates specified in column (2) of the Table 1 (hereinafter referred to as "base rate") for the following:—

2. In additional to above, the following fee shall also be due and payable for the use of the following bypasses costing Rs. 10 crore or more at the following Toll Plazas at one and half times the base rate of the length of bypasses specified for such Toll Plazas:

3. In addition, the following fee shall also be due and payable for the use of the following structures having length more than 60 m at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

4. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 230.00 (Rupees Two Hundred Thirty only) for the year 2015-16, and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.
5. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle.
7. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall not be permitted to use the National Highway or crossing the Toll Plaza until the excess load has been removed from such mechanical vehicle. The driver or owner or a person in charge of such overloaded mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to the Toll Collecting agency, equal to 10 times of the fee applicable to such category of mechanical vehicles under the rules.
8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules.
9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules.

Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.
11. The capital cost of the complete Projects i.e km 368.255 to km 481.331 (Adloor Yellareddy to Bewenpally Section) is Rs. 590.137 Crore and and discounted revenue collected till 31.03.2015 is Rs. 148.52 Crore. The capital cost yet to be recovered is Rs. 441.617 Cr. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
