काकाकाका....िनिनिनिन....आआआआ.... 12 12 12 12 ((((अअअअ).).).).---- के न्(cid:13)ीय सरकार, छावनी अिधिनयम, 2006 ( 2006 का 41) की धारा 340 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:26)ए, इस उपधारा के प्रयोजन के िलए उक्त अिधिनयम की पांचवी अनुसूची में निम्नलिखित संशोधन करती है, अर्थात्:—

छावनी अिधिनयम, 2006 की पांचव) अनुसूची में –

(i) *म सं. 12 पर स्तंभ 3 के खंड (ख) के सामने स्तंभ 4 की प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:—

"(क) कमान का मुख्य महा समादेशक अिधकारी;

(ख) अिधिनयम के प्रख्यापन की तारीख को लम्बित मामलों की सुनवाई करने के िलए अपर अपीलीय प्राधिकारी के रूप में मेजर जनरल परिचालन संभार-तंत्र, मुख्यालय कमान का पद धारण करने वाला सैिनक अिधकारी । यदि मुख्यालय कमान में मेजर जनरल परिचालन संभार-तंत्र प्राधिकृ त नह) है, उस दशा में मेजर जनरल प्रभारी प्रशासन अिधिनयम के प्रख्यापन की तारीख को लम्बित मामलों की सुनवाई करने के िलए अपर अपीलीय प्राधिकारी के रूप में कार्य करेगा "।

(ii) *म सं. 14 पर स्तंभ 3 के खंड (ख) के सामने स्तंभ 4 की प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात् :-

"(क) कमान का मुख्य महा समादेशक अिधकारी;

NOTIFICATION

New Delhi, the 31st December, 2015

S.R.O. 12(E).—In exercise of the powers conferred by sub-section (2) of section 340 of the Cantonment Act, 2006 (41 of 2006), the Central Government hereby makes the following amendments in Schedule V to said Act for the purpose of that sub-section, namely:—

In the Cantonment Act, 2006, in Schedule V,—

(i) at serial number 12, against clause (b) of column 3, for the entry in column 4, the following entries shall be substituted, namely:—

"(a) General Officer Commanding-in-Chief, the Command;

(b) Military Officer holding the appointment of Major General Operational Logistics, Headquarters Command as additional Appellate Authority to hear the pending appeals as on date of promulgation of the Act. If Major General Operational Logistics is not authorised in Headquarter Command, in that condition Major General-Incharge- Administration act as additional Appellate Authority to hear the pending appeals as on date of promulgation of the Act".

(ii) at serial number 14, against clause (b) of column 3, for the entry in column 4, the following entries shall be substituted, namely:—

"(a) General Officer Commanding-in-Chief, the Command;

(b) Military Officer holding the appointment of Major General Operational Logistics, Headquarters Command as additional Appellate Authority to hear the pending appeals as on date of promulgation of the Act. If Major General Operational Logistics is not authorised in Headquarter Command, in that condition Major General-Incharge- Administration act as additional Appellate Authority to hear the pending appeals as on date of promulgation of the Act".
