का.आ. का.आ. का.आ. का.आ. 66666666((((अअअअ).).).).———— निम्नलिखित प्रारूप अिधसूचना, िजसे के न्(cid:18)ीय सरकार, पर्यावरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते %ए, जारी करने का प्रस्ताव करती है, पर्यावरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) की अपेक्षानुसार, जनसाधारण की जानकारी के िलए प्रकाशित की जाती है; िजनके उससे प्रभावित होने की संभावना है ; और यह सूचना दी जाती है कि उक्त प्रारूप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत के राजपत्र की प्रतियां जनसाधारण को उपलब्ध करा दी जाती हैं, साठ दिन की अविध की समाप्ति पर या उसके प4ात् िवचार किया जाएगा ;

इरावीकु लम राष्ट्रीय उद्यान, चिन्नार वन्यजीव अभयारFय, अनामुडी शोला राष्ट्रीय उद्यान, पम्पपाडन शोला राष्ट्रीय उद्यान और Iिन्जीमाला अभयारFय, के रल राज्य में मन्नार वन्यजीव प्रभाग, इडुकी जिला में निकटस्थ संरक्षित है, जिनकी मुख्य संरक्षण और पर्यावरणीय महत्ता है ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और इरावीकु लम राष्ट्रीय उद्यान, विY में नीलगिरि ताहर ( नीलगिरीट्रग्स हइलोIिस) के चारों ओर बृहद जीवसंख्या में संभरण करती है और नीलगिरि माट\न, ]डी नेवला, छोटा कॉलड ओटर, डस्की, स्टीपटीज,गिलहरी आदि सभी महत्वपूर्ण जीवजंन्तु यहां आ'ित है।

और इरावीकु लम राष्ट्रीय उद्यान, प4िमी घाट में एकमात्र मोंटेन शोला- cासलैंड वनस्पति आसामान्य रूप से अधिकतम और न्यूनतक मात्रा में फै ली है और यह नीलाकु रंजी (स्ट्रोबिलैथेस कु णथेंनम) का प्राकृ तिक वास भी है जो 12 साल में एक बार खिलता है और राओरचेस्टस रेसपेलेडेन्स,प्रजाति का मेंढक सिर्फ इस राष्ट्रीय उद्यान, में मिलता है ।

और इरावीकु लम राष्ट्रीय उद्यान, में पूर्व से पामबार नदी और प4िम से परियार नदी और चालक्कु डी नदी बहती है और जलcहण करती है।

और यहाँ पर कई तरह कि शीतोष्ण प्रजातियों जैसे माहोनिया लेंसचनालुटी ,रहोडोडेनiोन अरबोरम, गोलथेरिया jगैनटिस्मा बेरबेरिस kटकटोरिया, रैर ऑरचिiस जैसे ब्राकोIोथीस विगथो, हेबेनारिया फलाबेलीफॉमीस, िविवध जंगली प्रजातियॉ जातियॉ के साथ साथ कृ षि पौधे जैसे पीपर स्कमीडती और इलाटेरियॉ कारडामोम इरवीकु लम राष्ट्रीय उद्यान में पाए जाते हैं ।

और चिन्नार वन्यजीव अभयारFय, के रल के दक्षिणी पश्चिमी घाटों में पूर्वी भाग के ऊं चे पहाड़ों में उत्तरी अक्षांशभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3 प्रजातियॉ है उनमें सें लगभग 20%(109 प्रजातियॉ) स्थानिक है जिसमें 16 स्थानिक पक्षी है, अनामुडी राष्ट्रीय उद्यान में के वल इसकी 9 प्रजातियॉ है

और अनामुडी राष्ट्रीय उद्यान, अक]इकिया पेडनकु लाटा, एक्टेनडाफे न मालाबारिक, सेटिस टेटंरान(cid:18)ा, डाफनिफाइलम नीलcहैस, इलोकारपस मुनरोनी, कीनामाँम मैIोIै म्प, फीक्स लेविस, गोमफं (cid:18)ा कोरियासिया, लेटिसी कोरियासिया,पेरिसी मैIथा,मस्टीसीया अरबोरिया,कु रकु लाग आँशचीडस, Iै क्स फनफोडियम अमब्रोसोसडिस, एरीडेस, रंनीगेन, ओबरियोनिया चं(cid:18)शेखरनी, iोसेरा पेल्टेट आदि वनस्पति सम्मिल्लित है ।

और, कु रंजीमाला वन्यजीव अभयारFय, इडुकी जिले के देवीकु लम ताल्लुक में को(cid:127)ाकोम्बुर और वाटावाडा cामों में4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) पारिस्थितिकी संवेदी जोन 73.59 वर्ग किलोमीटर क्षेत्र में फै ला %आ है, जिसमें के रल राज्य में इडुकी जिले में देवीकु लम तालुक में कानन देवी cाम का भाग शामिल है

(ख) पारिस्थितिकी संवेदी जोन का विस्तार राष्ट्रीय उद्यान की अधिसूचित सीमा से 1 किलोमीटर से 1.5 किलोमीटर तक में है ।

(क) पारिस्थितिकी संवेदी जोन 20.35 वर्ग किलोमीटर क्षेत्र में फै ला %आ है, जिसमें के रल राज्य में इडुकी जिले में देवीकु लम तालुक में मरायूर, कजेंतूर और को(cid:127)ाकम्पूर cाम का भाग शामिल है ।

(ख) पारिस्थितिकी संवेदी जोन का विस्तार राष्ट्रीय उद्यान की अधिसूचित सीमा से 1 किलोमीटर तक में है ।

(क) पारिस्थितिकी संवेदी जोन 33.97 वर्ग किलोमीटर क्षेत्र में फै ला %आ है, जिसमें के रल राज्य में इडुकी जिले में देवीकु लम तालुक में कं दालूर और को(cid:127)ामबूर cाम का भाग शामिल है ।

(ख) पारिस्थितिकी संवेदी जोन का विस्तार राष्ट्रीय उद्यान की अधिसूचित सीमा से 1 किलोमीटर तक में है ।

(क) पारिस्थितिकी संवेदी जोन 8.12 वर्ग किलोमीटर क्षेत्र में फै ला %आ है, जिसमें के रल राज्य में इडुकी जिले में देवीकु लम तालुक में को(cid:127)ामबूर और बा(cid:127)ाबाडा cाम का भाग शामिल है ।

(ख) पारिस्थितिकी संवेदी जोन का विस्तार राष्ट्रीय उद्यान की अधिसूचित सीमा से 1 किलोमीटर तक में है ।

(क) पारिस्थितिकी संवेदी जोन 5.64 वर्ग किलोमीटर क्षेत्र में फै ला %आ है, जिसमें के रल राज्य में इडुकी जिले में देवीकु लम तालुक में बा(cid:127)ाबाडा cाम का भाग शािमल है ।

(ख) पारिस्थितिकी संवेदी जोन का विस्तार राष्ट्रीय उद्यान की अधिसूचित सीमा से 1 किलोमीटर तक में है ।

(6) पारिस्थितिकी संवेदी जोन की सीमा का वर्णन उपाबंध उपाबंध उपाबंध उपाबंध IIII के रूप में उपाब(cid:130) है ।

(7) मुख्य बिन्दुओं के समन्वयकों के साथ पारिस्थितिकी संवेदी जोन का मानचित्र उपाबंध उपाबंध उपाबंध उपाबंध II II II II के रूप में उपाब(cid:130) है ।

(8) पारिस्थितिकी संवेदी जोन में आने वाले cामों की सूची तथा पारिस्थितिकी संवेदी जोन के भीतर आने वाले अधिसूचित आरक्षित/निहित वन की सूची उपाबंधउपाबंधउपाबंधउपाबंध----IIIIIIIIIIII के रूप में उपाब(cid:130) किए गए हैं ।

2222.... पारिस्थिपारिस्थिपारिस्थिपारिस्थितिकीतिकीतिकीतिकी संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना ––––(1) राज्य सरकार, पारिस्थितिकी संवेदी जोन के प्रयोजनों के िलए राजपत्र में इस अिधसूचना के अंितम प्रकाशन की तारीख से दो वर्ष की अविध के भीतर, इस अधिसूचना में दिए गए उपदश(cid:134) का अनुपालन करते %ए, स्थानीय 6क्तियों के परामर्श से आंचिलक महायोजना तैयार करेगी ।

(2) उक्त योजना को राज्य सरकार में सक्षम प्राधिकारी द्वारा अनुमोदित किया जाएगा ।

(3) पारिस्थितिकी संवेदी जोन के लिए आचंलिक महायोजना राज्य सरकार द्वारा इस अधिसूचना में यथाविनि?दष्ट रीति में और सुसंगत कें (cid:18)ीय और राज्य िविधयों और कें (cid:18)ीय सरकार द्वारा जारी मार्गदर्शक सि(cid:130)ांतों, यदि कोई हों, के सामंजस्य से तैयार की जाएगी ।

(4) आचंलिक महायोजना उसमें पर्यावरणीय और पारिस्थितिकीय मुद्दों को सम्मििलत करने के िलए संबंिधत राज्य िवभागों के साथ परामर्श से तैयार की जाएगी, जिसके अंतर्गत निम्नलिखित हैं--

(i) पर्यावरण ; (ii) वन ; (iii) शहरी िवकास ;

(iv) पर्यटन ; (v) नगरपािलक ; (vi) राजस्व ; (vii) कृ िष; (viii) राज्य प्रदूषण नियंत्रण बोर्ड, (ix) सिचाई; (x) लोक िनर्माण विभाग।

(5) आंचलिक महायोजना अनुमोदित विद्यमान भू-उपयोग, अवसंरचना और Iियाकलापों पर कोई निब(cid:137)धन अधिरोपित नह(cid:138) करेगी जब तक कि इस अधिसूचना में विनि?दष्ट न हो और आचंिलक महायोजना सभी अवसंरचना और Iियाकलापों में और अधिक दक्षता और पारिस्थितिकीय अनुकू लता का संवर्धन करेगी ।

(6) आंचिलक महायोजना में अना=छादित क्षेत्रों के जीण}(cid:130)ार, विद्यमान जल िनकायों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायों की आवश्यकताओं तथा पारिस्थितिकी और पर्यावरण से संबंिधत ऐसे अन्य पहलूओं, िजन पर ध्यान देना आवश्यक है, के िलए उपबंध होंगे ।

(7) आंचिलक महायोजना सभी विद्यमान पूजा स्थलों, cामों और नगरीय बंदोबस्तों, वनों के प्रकार और किस्मों, कृ िष क्षेत्रों, ऊपजाऊ भूमि, हरित क्षेत्र जैसे उद्यान और उसी प्रकार के स्थान, उद्यान कृ िष क्षेत्र, फलोधान, झीलों और अन्य जल निकायों का अ(cid:140)यकं न करेगी ।

(8) आंचिलक महायोजना स्थानीय समुदायों की जीवकोपार्जन को सुनिश्चित करने के लिए, पारिस्थितिक संवेदी जोन में विकास को पारिस्थिक अनुकू ल विकास के लिए विनियमित करेगी ।

(9) आंचलिक महायोजना के उपबंधों को पर्याप्त प्रचार प्रदान किया जाएगा ।

3. राज्यराज्यराज्यराज्य सरकारसरकारसरकारसरकार द्वाराद्वाराद्वाराद्वारा किएकिएकिएकिए जाजाजाजानेनेनेने वालेवालेवालेवाले उपायउपायउपायउपाय-------- राज्य सरकार इस अिधसूचना के उपबंधों को प्रभावी करने के िलए निम्नलिखित उपाय करेगी, अर्थात् :--

(1) (1) (1) (1) भूभूभूभू----उपयोग उपयोग उपयोग उपयोग ---- पारिस्थिितक संवेदी जोन में वनों, उद्यान-कृ िष क्षेत्रों, कृ िष क्षेत्रों आमोद-प्रमोद के प्रयोजन के िलए चिन्हित किए गए पाक(cid:134) और खुले स्थानों का वाणिज्यिक और औद्योगिक संब(cid:130) िवकास Iियाकलापों के िलए उपयोग या संपरिवर्तन नह(cid:138) होगा :

परंतु पारिस्थितिकी संवेदी जोन के भीतर कृ िष भूिम का संपरिवर्तन, मानीटरी सिमित की सिफारिश पर और राज्य सरकार के पूर्व अनुमोदन से, स्थानीय निवासियों की आवासीय जरूरतों को पूरा करने के िलए और पैरा 4 की सारणी के स्तंभ (2) में Iम सं0 12, 17, 23, 29, और 32 के अधीन Iियाकलापों को पूरा करने के िलए अनु(cid:141)ात होगा, अर्थात् :-

(i) पारिस्थितिकी अनुकू ल पर्यटन Iियाकलापों के लिए पर्यटकों के अस्थायी आवासन के लिए पारिस्थिितकी अनुकू ल आरामगाह जैसे टेंट, लकड़ी के मकान आदि ; (ii) िवद्यमान सड़कों को चौड़ा करना और सुदृढ़ करना (iii) प्रदूषण उत्पन्न न करने वाले लघु उद्योग,

(iv) वर्षा जल संचय, और

(v) कु टीर उद्योग, िजसके अंतर्गत cामीण उद्योग, सुविधाजनक भंडार और स्थानीय सुिवधाएं भी हैं, :

परंतु यह और कि राज्य सरकार के पूर्व अनुमोदन और संिवधान के अनु=छेद 244 तथा तत्समय प्रवृत्त िविध के उपबंधों के अनुपालन के िबना, िजसके अंतर्गत अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अधिकारों की मान्यता)6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अिधिनयम, 2006 (2007 का 2) भी है, वाणिज्यिक या उद्योग िवकास Iियाकलापों के िलए जनजातीय भूिम का उपयोग अनु(cid:141)ात नह(cid:138) होगा :

परंतु यह और भी कि पारिस्थितिकी संवेदी जोन के भीतर भू-अभिलेखों में उपसंजात कोई त्रुटि, इसमें पैरा 3 में नि?दष्ट मानीटरी सिमित के िवचार प्राप्त करने के प4ात् राज्य सरकार द्वारा प्रत्येक मामले में एक बार संशोिधत होगी और उक्त त्रुटि के संशोधन की भारत सरकार के पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय को सूचना देनी होगी ।

परंतु यह और भी कि उपयु र्क्त त्रुटि का संशोधन में इस उप पैरा के अधीन यथा उपबंिधत के िसवाय किसी भी दशा में भू- उपयोग का परिवर्तन सम्मिलित नह(cid:138) होगा ।

परंतु यह और भी कि जिससे हरित क्षेत्र में जैसे वन क्षेत्र, कृ षि क्षेत्र आदि में कोई पारिणामिक कटौती नह(cid:138) होगी और अनप्रयुक्त या अनुउत्पादक कृ षि क्षेत्रों में पुन: वनीकरण करने के प्रयास किए जाएंगे ।

((((2222)))) प्राकृ तिक जल /ोतोंप्राकृ तिक जल /ोतोंप्राकृ तिक जल /ोतोंप्राकृ तिक जल /ोतों ---- आचंिलक महायोजना में सभी प्राकृ तिक जल (cid:144)ोतों की पहचान की जाएगी और उनके संरक्षण और पुन](cid:145)भूतकरण के लिए योजना सम्मिलित होगी और राज्य सरकार द्वारा ऐसे क्षेत्रों पर या उनके निकट विकास Iियाकलाप प्रतिषि(cid:130) करने के लिए ऐसी रीति से मार्गनिद\श तैयार किए जाएंगे ।

((((3333)))) पर्यटन पर्यटन पर्यटन पर्यटन ---- (क) पारिस्थितिकी संवेदी जोन के भीतर पर्यटन संबंधी Iियाकलाप, पर्यटक महायोजना के अनुसार होंगे, जो आंचिलक महायोजना का एक भाग बनेंगे ।

(ख) पर्यटन महायोजना पर्यटन विभाग द्वारा राज्य सरकार के वन और पर्यावरण विभाग के परामर्श से तैयार की जाएगी ।

(ग) पर्यटन संबंधी Iियाकलाप निम्नलिखित के अधीन विनियमित होंगे, अर्थात् :-

(i) पारिस्थितिक संवेदी जोन के भीतर सभी नए पर्यटन Iियाकलापों या विद्यमान पर्यटन Iियाकलापों का विस्तार भारत सरकार के पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय के मार्गदर्शक सि(cid:130)ांतों के द्वारा तथा राष्ट्रीय (cid:147)या(cid:148) संरक्षण प्राधिकरण, द्वारा जारी पारिस्थितिक पर्यटन (समय-समय पर यथा संशोिधत) मार्गदर्शक सि(cid:130)ांतों के अनुसार, पारिस्थितिक पर्यटन, पारिस्थितिक शिक्षा और पारिस्थितिक िवकास को महत्व देते %ए पारिस्थितिक संवेदी जोन की वहन क्षमता के अध्ययन पर आधारित होगा;

(ii) पारिस्थितिकी अनुकू ल पर्यटन Iियाकलापों के संबंधित पर्यटकों के अस्थायी िनवास के िलए आवासन के िसवाय पारिस्थितिकी संवेदी जोन के भीतर होटल और रिसोर्ट के नए संनिर्माण की सीमा के 1 किलोमीटर के भीतर अनु(cid:141)ात नह(cid:138) होंगे ।

परंतु आंचिलक महायोजना के अनुसार विद्यमान प्रतिष्ठापनों के विस्तार को अनु(cid:141)ात किया जाएगा ।

(iii) परंतु संरक्षित क्षेत्रों की सीमा से एक किलोमीटर की दूरी से परे पारिस्थितिकीय संवेदी जोन की सीमा तक होटल और रिसोर्ट की स्थापना आंचिलक महायोजना के अनुसार किया जा सके गा ।

परंतु यह और कि इरावीकु लम राष्ट्रीय उद्यान के चारों ओर पारिस्थितिकी संवेदी जोन में 2 मंिजल और 5000 वर्ग फीट और अनामुडी शोला राष्ट्रीय उद्यान, कु रंजीमाला अभयारFय, पम्पपाडन शोला राष्ट्रीय उद्यान और चिन्नार वन्यजीव अभयारFय पारिस्थितिकी संवेदी जोन में 3 मंजिल और 7500 वर्ग फीट तक सीमित होंगे ।

परन्तु यह और कि भूमि स्तर के निर्माण के नीचे जैसे पा(cid:150)कग क्षेत्र आदि की अनुमति नह(cid:138) दी जायेगी।

(iv) आंचिलक महायोजना का अनुमोदन किए जाने तक, पर्यटन के िलए िवकास और विद्यमान पर्यटन Iियाकलापों के विस्तार को वास्तविक स्थल विनि?दष्ट संवीक्षा तथा मानीटरी सिमित की सिफारिश पर आधारित संबंिधत िविनयामक प्राधिकारियों द्वारा अनु(cid:141)ात किया जाएगा ।

(5) मानीटरी सिमित का सदस्य-सिचव या संब(cid:130) कलक्टर या संरक्षित क्षेत्र का प्रभारी ऐसे 6क्ति के विरू(cid:130), जो इस अिधसूचना के किसी उपबंध का उल्लंघन करता है, पर्यावरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन परिवाद फाइल करने के िलए सक्षम होगा।

(6) मानीटरी सिमित मुद्दों के आधार पर अपेक्षाओं पर निर्भर रहते %ए संब(cid:130) विभागों के प्रतिनिधियों या विशेष(cid:141)ों, औद्योगिक संगमों या संब(cid:130) पणधारियों के प्रतिनिधियों को अपने िवचार-विमर्श में सहायता के िलए आमंत्रित कर सके गी ।

S.O. 66(E).- The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

Draft Notification S.O…………… WHEREAS, the Eravikulam National Park, Chinnar Wildlife Sanctuary, Anamudi Shola National Park, Pampadum Shola National Park and Kurinjimala Sanctuary are contiguous Protected Areas located in the Western Ghats in the State of Kerala in Munnar Wildlife Division, Idukki district having key conservation and environmental values;

AND WHEREAS, the sanctuary is home to Elephant, Tiger, Leopard, Gaur, Bonnet Macaque, Hanuman Langur, Nilgiri Langur , Slender Loris, Rusty Spotted Cat, Nilgiri tahr, Wild Boar, Sambar, Spotted Deer, Barking Deer, Porcupine, Wild Dog, Sloth Bear, Jungle Cat, Malabar Giant Squirrel, Common Flying Squirrel etc.;

AND WHEREAS, the Anamudi Shola National Park is located on the north –eastern part of southern Western Ghats in the villages of Kanthaloor and Kottakamboor of Davikulam Taluk of Idukki District;

AND WHEREAS, the Anamudi Shola National Park has the Mannavan Shola forest which is the largest shola forest patch in South India and harbours the giant fern, Cyathia crinita and supports 543 species of Pteridophytes and Angiosperms of which nearly 20 % (109 species) are endemic of the 16 endemic birds of Western Ghats found in Kerala, 9 species are reported from the Anamudi National Park;

AND WHEREAS, the vegetation of the Anamudi National includes Acrunychia pedunculata, Actenodaphne

malabarica,Celtis tetrandra, Daphniphyllum neilgherense, Elaeocarpus munronii, Cinnamomun Macrocarpum, Ficus

levis, Gomphandra coriacea, Litsea coriacea, Persea macrantha, Mastixia arborea, Curculago orchioides, Carex

filicina,Celosia pulchella, Chenopodium ambrossoides, Aerides ringens Oberonia chandrasekharanii, Drosera peltata

etc.;

(b)The extent of the Eco-Sensitive Zones varies from 1 Kilometers to 1.5 Kilometers from the notified boundary of the National Park.

(2) Extent of Eco-sensitive Zones around Chinnar Wildlife Sanctuary.-

(a)The Eco-Sensitive Zones covers a Geographical area of 20.35 Square Kilometers which includes part of Marayur, Kezanthur and Kottakkampur Villages in Devikulam Taluk of Idukki District of Kerala state and also the reserve forests of Marayur Sandal Division

(b)The extent of Eco Sensitive Zones is generally 1 Kilometers from the boundary of the Chinnar Wildlife Sanctuary.

(3) Extent of Eco-sensitive Zones around Anamudi Shola National Park.-

(a) The Eco-sensitive Zones covers a geographical area of 33.97 square kilometres which includes parts of Kandhaloor and Kottakamboor Village in Devikulam Taluk of Idukki District.

(b) The extent of Eco-sensitive Zones is 1 kilometer from the boundary of the National Park.

(4) Extent of Eco-sensitive Zones around Kurinjimala Sanctuary.-

(a)The Eco-sensitive Zones covers a geographical area on 8.12 square kilometres which includes party of Kottakombur and Vattavada villages in Devikulam Taluk of Idukki District of Kerala state.

(b)The range of extent of the Eco-sensitive Zones is 1 kilometre from the notified boundary of the sanctuary.

(5) Extent of Eco-sensitive Zones around Pampadum Shola National Park.-

(a)The Eco-Sensitive Zones covers a Geographical area of 5.64 Square Kilometers which includes part of Vattavada Village, in Devikulam Taluk of Idukki District of Kerala state.

(b) The range of extent of the Eco-Sensitive Zones is 1 Km from the notified boundary of the National Park.

(6) The detailed boundary description of the Eco-sensitive Zones is appended as Annexure-I. (7) The map of the Eco-sensitive Zoness along with co-ordinates of prominent points is appended as Annexure II (8) The list of villages covered by the Eco-sensitive Zoness and the notified reserved/vested forests falling within the Eco-sensitive Zoness are appended as Annexure III. 2. Zonal Master Plan for the Eco-sensitive Zones.- (1) The State Government shall, for the purpose of the Eco- sensitive Zones prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zones shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism, and ; (v) Municipal ; (vi) Revenue ; (vii) Agriculture; (viii) State Pollution Control Board; (ix) Irrigation and; (x) Public Works Department; for integrating environmental and ecological considerations into it; (5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zoness as to ensure Eco-friendly development for livelihood security of local communities. (9) Adequate publicity shall be given to the provisions of the Zonal Master Plan.

3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zoness shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zoness may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 17, 23, 29 and 32 in column (2) of the Table in paragraph 4, namely:-

(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Ecofriendly tourism activities,,

(ii) Widening and strengthening of existing roads, (iii) Small scale industries not causing pollution, (iv) Rainwater harvesting, and (v) Cottage industries including village artisans:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zoness shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zones shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Kerala in consultation with Department of Revenue and Forests, Government of Kerala. (c) The activity of tourism shall be regulated as under, namely:- (i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zoness shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco- sensitive Zoness; (ii) no new commercial hotels and resorts shall be permitted within the one kilometre from the boundary Protected Area except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:

Provided that extension of existing establishments may be allowed in accordance with the Zonal Master Plan.

(iii) However, beyond one kilometre from the boundary of the Protected Area up to the extent of the Eco-sensitive Zones establishment of hotels and resorts may be done subject to the Zonal Master Plan:

Provided further that buildings shall to be limited to 2 storeys and 5000 sq.ft. in Eco-sensitive Zones around Eravikulam National Park and to 3 storeys and 7500 sq.ft. in Eco-sensitive Zoness around Anamudi Shola National Park, Kurinjimala Sanctuary Pampadum Shola National Park and Chinnar Wildlife Sanctuary Eco Sensitive Zoness:

Provided further that construction of below ground level like parking area etc shall not be allowed.

(iv) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zoness, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zoness and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zones in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zones in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zones shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:- (i) the solid waste disposal in Eco-sensitive Zones shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zones and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zones. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zones shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Competent Authority in the State government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial Units (a) No establishment of new wood based Industries within the proposed Eco-sensitive Zones shall be permitted except the existing wood based Industries set up as per the Law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zones shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zones.- All activities in the Eco sensitive Zones shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eravikulam National Park (2) Chinnar Wildlife Sancutary , (3) Anamudi Shola National Park, (4) Pampadum shola national park , (5) Kurinjimala Sancutary Eco-sensitive Zones, which shall comprise of the following namely:-

(i) The District Collector, Idukki.

Chairman

(ii) The Member of Legislative Assembly, Devikolam - Member

(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Kerala, if required).

(iii) President, District Panchayat, Idukki –

Member

(iv) One representative of Non Governmental Organisation working in

the field of environment to be nominated by the Government of Kerala for a term of one year in each case – Member

(v) one expert in the area of ecology and environment from a reputed institution of University in the State to be nominated by the Government of Kerala for a term of one year in each case – Member

(vi) Kerala Pollution Control Board, District Officer, Idukki -Member

(vii) Concerned Divisional Forest Officer (Territorial) –Member

(viii) The Wildlife Warden, Munnar Wildlife Divsion -Member-Secretary

Terms of Reference: (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zones, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zones, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Central Government in the Ministry of Environment, Forest and Climate Change as per proforma given in Annexure IV.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.

BOUNDARY DESCRIPTION OF THE ECO-SENSITIVE ZONES

1. Boundary Description of the Eco-Sensitive Zones around Eravikulam National Park :

North Northern part of the Eravikulam National Park is being Tamilnadu no Eco- Sensitive Zones is proposed.

East Starting from the P 37 Continuing in a Eastern direction the boundary moves through P 38 (77.051895 E 10.133534 N) , 39 (77.059066 E 10.134159 N ) and 40 (77.066028 E 10.139471 N) . From P40 on the Munnar – Udumalpet road the boundary moves in a north Eastern direction through P 41 (77.072936 E 10.146418 N), 42 (77.078366 E 10.151109 N) and 43 (77.087327 E 10.155909 N), then across the peak with elevation 2086 mtrs it moves in a North – North Eastern direction to P 44 (77.093453 E 10.160524 N), 45 (77.100398 E 10.164968" N), 46 (77.104821 E 10.170673 N) and 47 (77.112572 E 10.174577 N). From P47 it goes on a North Eastern direction to P48 (77.114156 E 10.176429 N), 49 (77.122378 E 10.180912 N) and 50 (77.124302 E 10.184494 N) , then it moves on a North – North Eastern direction to P51 (77.125855 E 10.189540 N) and 52 (77.133037 E 10.194501 N), then the boundary proceeds in a North – North Eastern direction across P52, 53 (77.134446 E 10.198476 N), 54 (77.136915 E 10.201865 N) and 55 (77.139465 E 10.208588 N) till it reaches P56 (77.13889 E 10.21359 N). From P56 the boundary proceeds west till it reaches the point P57 (77.12962 E 10.21354 N). From this point to the point P58 (77.13283 E 10.2286 N) eco snesitive Zones is practically nil. Then from the point P58 (77.142845 E 10.232199 N) to 59 (77.138628 E 10.236005 N). From P59 the boundary proceeds in a North Western direction to P60 (77.131035 E 10.239485 N), 61 (77.120453 E 10.245917 N), 62 (77.111209 E 10.248947 N) and 63 (77.116027 E 10.257125 N). At P63 the boundary turns in a North Eastern direction to P64 (77.121942 E 10.267514 N), 65 (77.126385 E 10.276064 N), 66 (77.130196 E 10.283943 N), 67 (77.131662 E 10.291963 N) and 68 (77.12023 E 10.299832 N). From P68 the Eco - Sensitive Zones boundary ends at P69 (77.131058 E 10.292876 N) which is the tri junction of Chinnar Wildlife Sanctuary, Kudakkad Reserve of Marayoor Sandal Division and Eravikulam National Park .

South From the P36 (77.038948 E 10.133534 N) in a South Eastern direction the boundary reaches to P37 (77.046148 E 10.133524 N) near the Munnar – Udumalpet road in a Eastern direction continuing in a Eastern direction the boundary moves to P38 (77.051895 E 10.133534 N).

West Starting from the tri junction of Anamudy Reserve, Eravikulam National Park and Anamalai Reserve in Tamilnadu the boundary of Eco Sensitive Zones proceeds in a South Western direction to P1 (77.044159 E 10.255505 N), then it proceeds on South Eastern direction to P2 (77.048014 E 10.250477 N) and then it again proceeds on the South Eastern direction to P3 (77.054393 E 10.242576 N), then it proceeds to Southern direction to P4 (77.054334 E 10.241177 N). From P4 it proceeds on a South Southwestern direction to P5 (77.053793 E 10.241177N) then on a South western direction on P6 (77.052146 E 10.239341 N). Then the boundary proceeds along the ridge up to P7 (77.035809 E 10.237017 N). In a western direction and continuous to P8 (77.029475 E 10.236203 N) and P9 (77.024404 E 10.236484 N) in Western direction then to P10 (77.019489 E 10.23509 N) in a South Western direction and continuous to P11 (77.011525 E 10.230449 N) and P12 (77.007579 E 10.225785 N) in a South Western direction. 2. Boundary Description of the Eco-Sensitive Zones around Chinnar Wildlife Sanctuary Eco- Sensitive

Zones :

North Northern part of Chinnar Wildlife Sanctuary being Anamalai Tiger Reserve of Tamilnadu no Eco -Sensitive Zones is proposed.

East

Eastern part of Chinnar Wildlife Sanctuary being Anamalai Tiger Reserve of Tamilnadu no Eco- Sensitive Zones proposed Southern part of Chinnar Wildlife Sanctuary being habited ares no Eco Sensitive Zones is proposed.

South

West The boundary starts from the tri junction of Eravikulam National park, Chinnar Wildlife Sanctuary and Marayur Sandal Division, the boundary of Eco -sensitive Zones starts from the point 69 nearby poovar ( 77.131058 E 10.292876 N ) and proceeds south east to point 70 nearby Kappakizhangu vaikkal ( 77.152089 E 10.302172 N and then it proceeds to North east direction to the point 71 nearby Vettakkaran malai ( 77.157965 E 10297401 N ) From this point it again proceeds to South east direction to the point 72 nearby Puravayal ( 77.158614 E 10.289835 N). From Puravayal it proceeds North-East till it reaches the boundary of Chinnar Wildlife sanctuary at point P73 (77.16674 E 10.2937 N).

3. Boundary Description of the Eco-Sensitive Zones around Anamudi Shola National Park:

North Northern part of Anamudi Shola National Park being Chinnar Wildlife sanctuary no Eco - Sensitive Zones is proposed.

East The eastern part includes habited areas and Kurinjimala Sanctuary no Eco -Sensitive Zones is proposed.

South The Southern part includes habited areas and hence no Eco -Sensitive Zones is proposed.

West The western part includes habited areas and hence no Eco- Sensitive Zones is proposed.

4. Boundary Description of the Eco-Sensitive Zones around Kurinjimala Wildlife Sanctuary:

North Northern part of the Kurunjimala Sanctuary being Chinnar Wildlife Sanctuary hence no Eco- sensitive Zones is proposed.

East Eastern part of the Kurunjimala Sanctuary being Kodaikanal Division of Tamilnadu hence no Eco- sensitive Zones is proposed.

South Southern part of the Kurunjimala Sanctuary being Pambadum Shola National Park hence no Eco- sensitive Zones is proposed.

West Western part of the Kurunjimala Sanctuary being habited no Eco- sensitive Zones is proposed.

5- Boundary Description of the Eco-Sensitive Zones around Pampadum Shola National Park :

North The boundary of the Eco -sensitive Zones from the boundary of Pambadumshola National Park at the point 74 (77.25668 E 10.16257 N) and then proceeds to point 75 (77.25453E 10.16964 N). Then it proceeds to the point point near O.C division area of Tata Tea Plantation at point 76 (77.247525 E 10.164625 N) Thence it moves in a South west direction touching point 77 (77.244815 E 10.163296 N), 78 (77.24066 E 10.160541 N) till it reaches Vattavada area at point 79 (77.237315 E 10.15725 N) .Then it moves more or less northwards touching point 80 (77.23609 E 10.152753 N).

East The eastern part of Pampadum Shola National Park is being Tamilnadu. Hence no Eco - Sensitive Zones is proposed.

South From point 84 (77.236977 E 10.127196 N) the point proceeds to North East direction and reaches point 85 (77.241559 E 10.128652 N) till it reaches point 86 (77.246169 E10.129011N ) near estate mala.

West The point starts from Oorkkad area in a south west direction and stretches to point 81 (77.236577 E 10.146113 N ) and point 82 ( 77.2367156 E 10.139601 N ) then takes an southern direction to reach point 83( 77.23642 E 10.131401 N ) and point 84 ( 77.236977 E 10.127196 N ) at Manathalam.
