1. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का र्न(cid:7021)तार और उसक(cid:7409) सीमाएं--(1) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का (cid:6979)े(cid:7074) कु (cid:7076)ेमुख रा(cid:7398)ीय उ(cid:7378)ान क(cid:7409) सीमा के चार(cid:7298) ओर 10 (cid:7408)कलोमीटर तक के र्न(cid:7021)तार तक 286.259र् ग(cid:6981) (cid:7408)कलोमीटर है ।

रा(cid:7398)ीय उ(cid:7378)ान क(cid:7409) उ(cid:7275)री तर सोमे(cid:7393)र र्(cid:7008)र्यीि अभयार(cid:7003)य नमलता है, प(cid:7407)रणाम(cid:7021र्)(cid:7271)प इस तर (cid:7408)कसी पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का (cid:7079)(cid:7021)तार्नत नह(cid:7277) (cid:7408)कया गया है । ऐसे ोिन क(cid:7409) सीमा(cid:7312) के (cid:7011)यौरे उपाबंध-I पर (cid:7408)दए गए ह(cid:7289) ।

(2) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर आनेर् ाले 51 (cid:7061)ाम(cid:7298) क(cid:7409) सूची उनके मु(cid:6990)य ननद(cid:7287)ांक नब(cid:7008)दु(cid:7312) सनहत उपाबंध-II के (cid:7272)प म(cid:7286) उपाब(cid:7373) है ।

(3) सीमा के (cid:7011)यौरे अ(cid:6979)ां और देांतर के (cid:7011)यौर(cid:7298) के सा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का माननच(cid:7074) उपाबंध-III के (cid:7272)प म(cid:7286) उपाब(cid:7373) है ।

(4) मु(cid:6990)य पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के मु(cid:6990)य न(cid:7021)नत (ीिपीएस) नब(cid:7008)दु उपाबंध-IV के (cid:7272)प म(cid:7286) उपाब(cid:7373) है ।

2. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आंचनलक महायोनिा –(1) रा(cid:6996)य सरकार, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के (cid:7079)योनि(cid:7298) के नलए रापि(cid:7074) म(cid:7286) इस अनधसूचना के अंनतम (cid:7079)कान क(cid:7409) तारीख से दोर् ष(cid:6981) क(cid:7409) र्अनध के भीतर, इस अनधसूचना म(cid:7286) (cid:7408)दए गए उपद(cid:7300) का अनुपालन करते (cid:7263)ए, (cid:7021)ानीय (cid:7390)न(cid:7334)य(cid:7298) के पराम(cid:6981) से आंचनलक महायोनिा तैयार करेगी ।

(2) उ(cid:6989)त योनिा को रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा अनुमो(cid:7408)दत (cid:7408)कया ािएगा ।

(3) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आचंनलक महायोनिा रा(cid:6996)य सरकार (cid:7367)ारा इस अनधसूचना म(cid:7286) यार्ननन(cid:7416)द(cid:7020)ट रीनत म(cid:7286) और सुसंगत क(cid:7286) (cid:7076)ीय और रा(cid:6996)य र्ननधय(cid:7298) और क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा ािरी माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298), य(cid:7408)द कोई ह(cid:7298), के सामं(िcid:7021)य से तैयार क(cid:7409) ािएगी ।

(4) आचंनलक महायोनिा उसम(cid:7286) पया(cid:6981र्)रणीय और पा(cid:7407)रन(cid:7021)नतक मु(cid:7374)(cid:7298) को सन(cid:7013)मनलत करने के नलए सभी संबंनधत रा(cid:6996)य र्नभाग(cid:7298) के सा पराम(cid:6981) से तैयार क(cid:7409) ािएगी, नसिके अंतग(cid:6981)त नन(cid:7013)ननलनखत ह(cid:7289), अा(cid:6981)त :--

(i) पया(cid:6981र्)रण ;

(ii) र्न ;

(iii) हरी र्नकास ;

(iv) पय(cid:6981)टन ;

(v) नगरपानलका ;

(vi) रा(िcid:7021र्) ;

(vii) कृ नष ;

(viii) कना(cid:6981)टक रा(cid:6996)य (cid:7079)दूषण ननयं(cid:7074)ण बोड(cid:6981) ;

(ix) (cid:7410)सचाई ; और

(x) लोक ननमा(cid:6981)ण र्नभाग

(5) आंचनलक महायोनिा अनुमो(cid:7408)दत र्न(cid:7378)मान भू-उपयोग, र्असंरचना और (cid:7408)(cid:7059)याकलाप(cid:7298) पर कोई ननब(cid:7304)धन अनधरोनपत नह(cid:7277) करेगी बि तक (cid:7408)क इस अनधसूचना म(cid:7286) इस (cid:7079)कार र्ननन(cid:7416)द(cid:7020)ट न (cid:7408)कया ािए और उ(cid:6989)त आंचनलक महायोनिा सभी र्असंरचना और काय(cid:6981)कलाप(cid:7298) म(cid:7286) द(cid:6979)ता और पा(cid:7407)रन(cid:7021)नतक अनुकू लता का सुधार करेगी ।

(6) आंचनलक महायोनिा म(cid:7286) अना(cid:6994)छा(cid:7408)दत (cid:6979)े(cid:7074)(cid:7298) के ीिण(cid:7299)(cid:7373)ार, र्न(cid:7378)मान लि ननकाय(cid:7298) के संर(cid:6979)ण, र्आाह (cid:6979)े(cid:7074)(cid:7298) के (cid:7079)बंधन, लि-संभर(cid:7298) के (cid:7079)बंधन, भूतल लि के (cid:7079)बंधन, मृदा और नमी संर(cid:6979)ण, (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) र्आ(cid:7019)यकता(cid:7312) ता पा(cid:7407)रन(cid:7021)नतक और पया(cid:6981र्)रण से संबंनधत ऐसे अ(cid:7008)य पहलू(cid:7312), ननि पर (cid:7007)यान देना र्आ(cid:7019)यक है, के नलए उपबंध ह(cid:7298)गे ।

(7) आंचनलक महायोनिा सभी र्न(cid:7378)मान र्एं (cid:7079)(cid:7021)तार्नत पूाि (cid:7021)ल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोब(cid:7021)त(cid:7298),र् न(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021)म(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), ऊपािऊ भूनम, ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021)ान, उ(cid:7378)ान कृ नष (cid:6979)े(cid:7074), आ(cid:7416)कड(cid:7298), झील(cid:7298) और अ(cid:7008)य लि ननकाय(cid:7298) का अ(cid:7012)यकं न करेगी ।

(8) आंचनलक महायोनिा (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409)र् ीिकोपा(िcid:6981)न को सुननन(cid:7019)चत करने का सुनन(cid:7019)चय करेगी ।

3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए ािनेर् ाले उपाय-- रा(cid:6996)य सरकार इस अनधसूचना के उपबंध(cid:7298) को (cid:7079)र्भाी करने के नलए नन(cid:7388)नलनखत उपाय करेगी, अा(cid:6981)त् :--

(1) भू-उपयोग – पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) र्न(cid:7298), उ(cid:7378)ान-कृ नष (cid:6979)े(cid:7074)(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योनि के नलए नचन(cid:7008)हत (cid:7408)कए गए पाक(cid:7300) और खुले (cid:7021)ान(cid:7298) का र्ानणन(cid:6996)यक और औ(cid:7378)ोनगक संब(cid:7373) र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए उपयोग या संप(cid:7407)र्रत(cid:6981)न नह(cid:7277) होगा :

परंतु पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर कृ नष भूनम का संप(cid:7407)र्रत(cid:6981)न, मानीटरी सनमनत क(cid:7409) नसा(cid:7407)र पर और रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन से, (cid:7021)ानीय नर्नानसय(cid:7298) क(cid:7409) र्आासीय (िcid:7272)रत(cid:7298) को पूरा करने के नलए और पैरा 4 क(cid:7409) सारणी के (cid:7021)तंभ (2) म(cid:7286) (cid:7059)म सं. 12, 18, 24, 29 और 32 के अधीन (cid:7408)(cid:7059)याकलाप(cid:7298) को पूरा करने के नलए अनु(cid:6980)ात होगा, अा(cid:6981)त् :-

(i) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए पय(cid:6981)टक(cid:7298) के अ(cid:7021)ायी र्आासन के नलए पा(cid:7407)रन(cid:7021)नतक अनुकू ल आरामगाह ैिसे ट(cid:7286)ट, लकी के मकान आ(cid:7408)द;

(ii) र्न(cid:7378)मान सक(cid:7298) को चौा करना और सुदृ करना;

(iii) (cid:7079)दूषण उ(cid:7004)प(cid:7382) न करनेर् ाले लघु उ(cid:7378)ोग;

(iv) र्षा(cid:6981) लि संचय; और

(v) कु टीर उ(cid:7378)ोग, नसिके अंतग(cid:6981)त (cid:7061)ामीण उ(cid:7378)ोग, सुर्नधानिक भंडार और (cid:7021)ानीय सुर्नधाएं भी ह(cid:7289), :

परंतु यह और (cid:7408)क रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन और संर्नधान के अनु(cid:6994)छेद 244 ता त(cid:7004)समय (cid:7079र्)ृ(cid:7275) र्ननध के उपबंध(cid:7298) के अनुपालन के नबना, नसिके अंतग(cid:6981)त अनुसूनचत निािनत और अ(cid:7008)य परंपरागत र्न नर्नासी र्(न अनधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अनधननयम, 2006 (2007 का 2) भी है,र् ानणन(cid:6996)यक या उ(cid:7378)ोग र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए निाितीय भूनम का उपयोग अनु(cid:6980)ात नह(cid:7277) होगा :

परंतु यह और भी (cid:7408)क पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर भू-अनभलेख(cid:7298) म(cid:7286) उपसंाित कोई (cid:7074)ु(cid:7407)ट, मानीटरी सनमनत के र्नचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)येक मामले म(cid:7286) एक बार संोनधत होगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संोधन क(cid:7409) भारत सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय को सूचना देनी होगी ।

परंतु यह और भी (cid:7408)क उपयु (cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संोधन म(cid:7286) इस उप पैरा के अधीन या उपबंनधत के नर्साय (cid:7408)कसी भी दा म(cid:7286) भू-उपयोग का प(cid:7407)र्रत(cid:6981)न सन(cid:7013)मनलत नह(cid:7277) होगा ।

परंतु यह और भी (cid:7408)क नसिसे ह(cid:7407)रत (cid:6979)े(cid:7074) म(cid:7286) ैिसेर् न (cid:6979)े(cid:7074), कृ नष (cid:6979)े(cid:7074) आ(cid:7408)द म(cid:7286) कोई पा(cid:7407)रणानमक कटौती नह(cid:7277) होगी और अन(cid:7079)यु(cid:6989)त या अनु(cid:7004)पादक कृ नष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पुन:र् नीकरण करने के (cid:7079)यास (cid:7408)कए ािएंगे ।

(2) (cid:7079)ाकृ नतक लि (cid:7090)ोत - आचंनलक महायोनिा म(cid:7286) सभी (cid:7079)ाकृ नतक लि (cid:7090)ोत(cid:7298) क(cid:7409) पहचान क(cid:7409) ािएगी और उनके संर(cid:6979)ण और पुन(cid:7271)(cid:7006)भूतकरण के नलए योनिा सन(cid:7013)मनलत होगी और रा(cid:6996)य सरकार (cid:7367)ारा ऐसे (cid:6979)े(cid:7074)(cid:7298) पर या उनके ननकट र्नकास (cid:7408)(cid:7059)याकलाप (cid:7079)नतनष(cid:7373) करने के नलए ऐसी रीनत से माग(cid:6981)ननद(cid:7287) तैयार (cid:7408)कए ािएंगे ।

(3) पय(cid:6981)टन - (क) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप, पय(cid:6981)टक महायोनिा के अनुसार ह(cid:7298)गे, ोि आंचनलक महायोनिा का एक भाग बन(cid:7286)गे ।

(ख) पय(cid:6981)टन महायोनिा पय(cid:6981)टन र्नभाग (cid:7367)ारा रा(cid:6996)य सरकार के र्न और पया(cid:6981र्)रण र्नभाग के पराम(cid:6981) से तैयार क(cid:7409) ािएगी ।

(ग) पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप नन(cid:7013)ननलनखत के अधीन र्नननयनमत ह(cid:7298)गे, अा(cid:6981)त् :-

(i) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर सभी नए पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) या र्न(cid:7378)मान पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298)

का र्न(cid:7021)तार भारत सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय के माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के (cid:7367)ारा ता रा(cid:7020)(cid:7069)ीय (cid:7018)या(cid:7062) संर(cid:6979)ण (cid:7079)ानधकरण, (cid:7367)ारा ािरी पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन (समय-समय पर या संोनधत) माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के अनुसार, पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन, पा(cid:7407)रन(cid:7021)नतक न(cid:6979)ा और पा(cid:7407)रन(cid:7021)नतक र्नकास को मह(cid:7004र्) देते (cid:7263)ए पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन क(cid:7409)र् हन (cid:6979)मता के अ(cid:7007)ययन पर आधा(cid:7407)रत होगा;

(ii) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) के संबंनधत पय(cid:6981)टक(cid:7298) के अ(cid:7021)ायी नर्नास के नलए र्आासन के नर्साय पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर होटल और (cid:7407)रसोट(cid:6981) के नए संननमा(cid:6981)ण कु (cid:7076)ेमुख रा(cid:7398)ीय उ(cid:7378)ाम क(cid:7409) सीमा के 1 (cid:7408)कलोमीटर के भीतर अनु(cid:6980)ात नह(cid:7277) ह(cid:7298)गे ।

परंतु संरन(cid:6979)त (cid:6979)े(cid:7074)(cid:7298) क(cid:7409) सीमा से एक (cid:7408)कलोमीटर क(cid:7409) दूरी से परे पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन क(cid:7409) सीमा तक नए होटल और (cid:7407)रसाट(cid:6981) के (cid:7021)ापन पय(cid:6981)टन महायोनिा के अनुसार पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन सुर्नधा के नलए र्पू(cid:6981) प(cid:7407)रभानषत और र्ननन(cid:7416)द(cid:7397) (cid:7021)ान म(cid:7286) ही अनु(cid:6980)ात (cid:7408)कया ािएगा ।

S.O. 63(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

AND, WHERAS, apart from the floral value of Kudremukh National Park, the faunal values of Kudremukh National Park is of critical and reason behind our intention of protection and conservation of forest area of this landscape. Kudremukh becomes largest remaining home/habitat for the single largest remaining population of the Lion tailed macaques (a flagship species of Kudremukh National Park) in India and world. The National Park is also home for King Cobra, the longest venomous snake in the world and Malabar Slender Loris (Loris lydekkerianus malabaricus), a rare primate endemic to Kudremukh. The National Park is a representative of Tropical wet evergreen forest holding the assemblage of three top carnivores like Tiger, Leopard and Wild dogs. Kudremukh National Park holds high degree of endemism for faunal groups like reptiles, amphibians and fishes. Insects represent the most diverse faunal species followed by birds inside the National Park area. Avifauna's like Hornbills are found in the old growth forests and Flying squirrels are seen on tall trees in the valleys or on the fruit trees. Other faunal species occur in this National Park includes, Asiatic elephant, Indian Gaur, Sambar Deer, Barking Deer/Muntjac, Spotted deer, Mouse deer, Sloth Bear, Striped Hyena, Chevrotain, Wild Pig, Hanuman Langur, Bonnet Macaque, Malabar Giant Squirrel, Peacock, Python and Malabar Civet Cat etc. Kudremukh National Park area is considered as hottest spot among the hot spots for orchids in central Western Ghats.

AND, WHERAS, Among its all values, the ecosystem services value of Kudremukh are of great importance and vital to the protection and conservation of this area of forest land as National Park. Kudremukh National Park is the fountain head and catchment for major rivers like Tunga, Bhadra and Nethravathi and also catchments for other minor rivers like Swarna, Gurupura, Yennehole and Seethanadhi, thus became lifeline for local people and plays a vital role in the regional economy. Kudremukh receives one of the highest rainfalls in South India (average of 7000 milimetre per year). Further, the wet evergreen shola forest of Kudremukh act like a sponge, thus huge quantity of water is held as underground reserve and the same is released slowly into rivers throughout the year. Geographically, the National Park area holds a vast and enduring effect on the regional climate (by aiding the South West Monsoon). Further, Kudremukh National Park holds one of the highest standing biomass estimated at an average of 250-300 tons per hector and therefore acts as one of the great carbon sinks, an antidote to global warming and climate change phenomenon;

And, whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph1 of this notification around the protected area of Kudremukh National Park as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

Now, therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 10 kilometres around the boundary of Kudremukh National Park in the State of Karnataka as the Kudremukh National Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone- (1) The area of Eco-Sensitive Zone is 286.259 square kilometres with an extent upto 10 kilometres around the boundary of Kudremukh National Park. Someshwara Wildlife Sanctuary adjoin the northern side of the National Park consequently, no Eco-sensitive Zone has been proposed on this side. The boundary details of such Zone are given in Annexure-I.

(2) The list of 51 villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure-II.

(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III.

(4) Key locations (GPS points) on the eco-sensitive zone boundary as well as on the sanctuary are appended as Annexure-IV.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.

(2) The said Plan shall be approved by the competent authority in the State Government.

(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Municipal;

(vi) Revenue;

(vii) Agriculture;

(viii) Karnataka State Pollution Control Board;

(ix) Irrigation; and

(x) Public Works Department.

for integrating environmental and ecological considerations into it.

(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, ground water management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.

(7) The Zonal Master Plan shall demarcate all the existing and proposed worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential need of local residents, and for the activities listed against serial numbers 12, 18, 24, 29 and 32 in column (2) of the Table in paragraph 4, namely:-

(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities,

(ii) Widening and strengthening of existing roads.

(iii) Small scale industries not causing pollution,

(iv) Rainwater harvesting, and

(v) Cottage industries including village industries, convenience stores and local amenities etc:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government.

(c) The activity of tourism shall be regulated as under, namely:-

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Kudremukh National Park except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of final notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under.

(7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into bio-degradable and non-bio- degradable components;

(iii) the bio-degradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone

(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco- sensitive Zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone falling in the State of Karnataka , which shall comprise of the following namely:-

(i) Regional Commissioner, Mysore – Chairman

(ii) Representative of the Department of Environment, Government of Karnataka - Member;

(iii) Representative of the Department of Urban Development, Government of Karnataka-Member;

(iv) Representative of Non-governmental Organizations working in the field of nature conservation (including heritage conservation) to be nominated by the Government of Karnataka - Member;

(v) Representative of Karnataka State Pollution Control Board - Member;

(vi) One expert in Ecology from reputed Institution or University of the State of Karnataka to be nominated by the Government of Karnataka – Member;

(vii) Deputy Commissioner or his representative, Chikmagalur – Member

(viii) Deputy Commissioner or his representative, Dakshina Kannada – Member

(ix) Deputy Commissioner or his representative, Udupi –Member

(x) Member of Legislative assembly from Karkala constituency –Member.

(xi) Member of Legislative assembly from Mudigere, constituency –Member.

(xii) Member of Legislative assembly from Shringeri, constituency –Member.

(xiii) Member of Legislative assembly from Belthangady constituency –Member.

(xiv) The Deputy Conservator of Forests, Kudremukh Wildlife Division, Karkala – Member-Secretary.

*(Subject to the State Government of Karnataka obtaining relevant approvals inter alia including permission from the Speaker of Legislative Assembly, Karnataka, if required)

6. Terms of Reference.-

(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.

(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(4) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park the Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-V.

(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal .

Boundary Description of Kudremukh Eco-Sensitive Zone

North: The boundary line of Kudremukh Eco-sensitive zone starts from Bacchappu of Mudradi village and Moves towards North East along Kudremukh National Park boundary and join the Someshwara Reserve Forest boundary through Kapoli stream. Further it moves along Someshwar Reserve Forest Boundary and Join Kudremukh National Park boundary line at Durga. Further It moves along the Kudremukh National Park boundary towards North East and North West and reaches the stream near Peak point 767. Further it join road near Hasanabalu along stream.

East: Further the line Travels towards North East along the peak point of 741 and 744 and reaches the stream near Betegeri and then it joins the Malathi stream. Further it moves along the Malathi stream and reaches the road near Kalavantikadage and then it reaches the stream of Magode along the ridges of rocky knob Further it moves along the stream and connects the peak point 862 and then moves along the ridges of 862 and join the stream at Hulgar bail and then it join the Nalini stream at Sindodi. Further it Travers towards North East along the Ridges and reaches the peak point near Elakkigudda through 872 point. Further it moves towards North east along Sunkadamakki stream and connect the peak point 704, 821, 797 and then to thr stream Near Bukkibail. Further it moves along the stream up to Volale and connects the peak point 857 and 1044 and then connects to the Taluk boundary and to stream near Hanchinakodige. Further it moves along stream and road and reaches the Ridges of 1116 and moves along the ridges and reaches the road at Bandehaklu. Further it moves towards Nort east along the road up to the ridges of 921 and moves along the Ridges and reaches road near stream Chowna stream and then to Chownahalla stream along road. Further it moves towards west and south and reach peak point 1385 and 1064. Later, it Moves along the ridges of 1064, 1330, 1018, 1049 and reaches the peak point 1157 then it traverses along the ridges and connect the peak point 1186 and 1108. Further it moves towards North East along the ridges and reaches the peak point 1119 and then to 1128. Further it moves along the ridges of 1178 and reaches the road at Hulikan CE and then moves along the ridges of Harikan CE and connects the peak point of 1506 at Ballalarayana durga. Then it moves along the contour of 1506 and reaches the Balur SF at Ballalarayana Durga Falls.

South: Then the line traverses along Balur SF Boundary towards east and then connects the Charmadi road and then moves along the Charmadi Ghat road towards South East and connect Charmadi Katpadi Reserved Forest boundary. Further it moves along Charmadi to Kadpadi Reserved Forest boundary and reaches the stream at Bandage. Further it moves along the stream and reaches road near Hosabettu. Then it moves towards North along road and reaches the Tri-junction at Keyur. And then it moves towards south west along road reaches trijunction at Mura. Further it moves along road towards North West and reaches the stream near Idiyala gudda. Further it moves along the stream towards South up to the ridges of Belamavigudda and moves along ridges and reaches the Kuddalka stream through foot path. Further it moves along the stream towards South west and reaches the road near Nartikal. Further it moves along road and reaches the power line near point no124. Further it moves along the power line up to Hokkala and then connects the peak point 198 of Sulkerimogru along footpath. Further it directly connects to the tri-junction of road and Kudige stream at Sukkeri. Further it moves along reaches Kuthlur stream. Further it moves along Kthlur stream and joins the Hundi stream near Naravi through foot path. Further it moves towards north along Hundi stream and connect the Bare stream near Bare. Further it moves along Bare stream through Bedekila, Mulikar and reaches the Hurabe Reserved Forest boundary.

West: Further the line traverses along the Hurabe Reserved Forest and reaches the Tri-junction of Machitte stream and Mala stream at Kodange and them traverse along the Mala stream and reaches the road near Mullur. Further it moves along the road and reaches the Tri-junction of road and NH at Koodabettu. Then it moves along road towards North West and reaches the cart road near Shettibettu and along the cart road it reaches the road near Banglegudde. Further it moves along road towards North West and reaches the stream near Guddeyangadi. Further it moves along the stream and reaches road near Andar. Further it moves along road and power line and Marne stream and then power line it30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] reaches the road at point BM460. Further the line traverse towards North along road and reaches the Mathebettu stream along sub-streams. Further the line traverse along Mathebettu stream and joins the ridges of Varanga gudda and traverse along the ridged and then reaches the stream near Adka. Further the stream joins the Bendugudde ridges and then along ridges and footpath it reaches the main road near Mudradi and the line further Travels along the main road and reaches the Bacchappu.
