(2) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का माननच(cid:7074) उपाबंध I के (cid:7272)प म(cid:7286) उपाब(cid:7373) है |

(3) रा(cid:7398)ीय पाक(cid:6981) और इसका पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के अ(cid:6979)ां और देा(cid:7008)तर के सा सीमा (cid:7011)यौरा उपाबंध II के (cid:7272)प म(cid:7286) उपाब(cid:7373) है |

(4) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) आनेर् ाले 32 (cid:7061)ाम(cid:7298) क(cid:7409) सूची उपाबंध III के (cid:7272)प म(cid:7286) उपाब(cid:7373) है |

2. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आंचनलक महायोनिा – (1) रा(cid:6996)य सरकार, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के (cid:7079)योनि(cid:7298) के नलए रापि(cid:7074) म(cid:7286) इस अनधसूचना के अंनतम (cid:7079)कान क(cid:7409) तारीख से दोर् ष(cid:6981) क(cid:7409) र्अनध के भीतर, (cid:7021)ानीय (cid:7390)न(cid:7334)य(cid:7298) के पराम(cid:6981) से, और इस अनधसूचना म(cid:7286) (cid:7408)दए गए अनुबंध(cid:7298) का पालन करते (cid:7263)ए आंचनलक महायोनिा तैयार करेगी ।

(2) आचंनलक महायोनिा रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा अनुमो(cid:7408)दत होगी |

(3) पा(cid:7407)रन(cid:7021)नतक(cid:7409)य र्संेदी ोिन के नलए आंचनलक महायोनिा, रा(cid:6996)य सरकार (cid:7367)ारा इस अनधसूचना म(cid:7286) र्ननन(cid:7416)द(cid:7397) (cid:7272)प म(cid:7286) ऐसी रीनत म(cid:7286) ता सुसंगत के (cid:7008)(cid:7076)ीय और रा(cid:6996)य र्ननधय(cid:7298) के सामं(िcid:7021)य म(cid:7286) भी ता के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा ािरी माग(cid:6981)ननद(cid:7287), य(cid:7408)द कोई ह(cid:7298), (cid:7367)ारा तैयार होगी |

(4) आंचनलक महायोनिा उसम(cid:7286) पया(cid:6981र्)रणीय और पा(cid:7407)रन(cid:7021)नतक मु(cid:7374)(cid:7298) को सन(cid:7013)मनलत करने के नलए संबंनधत रा(cid:6996)य र्नभाग(cid:7298) के सा पराम(cid:6981) से तैयार क(cid:7409) ािएगी, अा(cid:6981)त्:--

(i) पया(cid:6981र्)रण ;

(ii) र्न ;

(iii) नगर र्नकास ;

(iv) पय(cid:6981)टन ;

(v) नगरपानलक ;

(vi) रा(िcid:7021र्) ;

(vii) कृ नष ;

(viii) गुरिात रा(cid:6996)य (cid:7079)दूषण ननयं(cid:7074)ण बोड(cid:6981),

(ix) (cid:7410)सचाई; औरभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3 (x) लोक ननमा(cid:6981)ण र्नभाग,

(5) आंचनलक महायोनिा अनुमो(cid:7408)दत र्न(cid:7378)मान भू-उपयोग, र्असंरचना और (cid:7408)(cid:7059)याकलाप(cid:7298) पर कोई ननब(cid:7304)धन अनधरोनपत नह(cid:7277) करेगी बि तक (cid:7408)क इस अनधसूचना म(cid:7286) और आंचनलक महायोनिा म(cid:7286) सभी र्असंरचना और अनधक (cid:7079)र्भाी और पा(cid:7407)रन(cid:7021)नतक अनुकू ल (cid:7408)(cid:7059)याकलाप कारक इस (cid:7079)कार र्ननन(cid:7416)द(cid:7397) न हो ।

(6) आंचनलक महायोनिा म(cid:7286) अना(cid:6994)छा(cid:7408)दत (cid:6979)े(cid:7074)(cid:7298) के ीिण(cid:7299)(cid:7373)ार, र्न(cid:7378)मान लि ननकाय(cid:7298) के संर(cid:6979)ण, र्आाह (cid:6979)े(cid:7074)(cid:7298) के (cid:7079)बंधन, लि-संभर(cid:7298) के (cid:7079)बंधन, भूतल लि के (cid:7079)बंधन, मृदा और नमी संर(cid:6979)ण, (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) र्आ(cid:7019)यकता(cid:7312) ता पा(cid:7407)रन(cid:7021)नतक(cid:7409) और पया(cid:6981र्)रण से संबंनधत ऐसे अ(cid:7008)य पहलू(cid:7312), ननि पर (cid:7007)यान देना र्आ(cid:7019)यक है, के नलए उपबंध ह(cid:7298)गे ।

(7) आंचनलक महायोनिा सभी र्न(cid:7378)मान, र्एं (cid:7079)(cid:7021)तार्नत पूाि (cid:7021)ल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोब(cid:7021)त(cid:7298),र् न(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021)म(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), ऊपािऊ भूनम, ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021)ान, उ(cid:7378)ान कृ नष (cid:6979)े(cid:7074), आ(cid:7416)कड(cid:7298), झील(cid:7298) और अ(cid:7008)य लि ननकाय(cid:7298) का अ(cid:7012)यकं न करेगी ।

(8) आंचनलक महायोनिा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) र्नकास को र्नननयनमत करेगी नसिसे (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) ीिर्कोपा(िcid:6981)न को सुरन(cid:6979)त करने के नलए पा(cid:7407)रन(cid:7021)नतक अनुकू ल र्नकास को सुननन(cid:7391)त (cid:7408)कया ाि सके ।

3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए ािने र्ाले उपाय-- रा(cid:6996)य सरकार इस अनधसूचना के उपबंध(cid:7298) को (cid:7079)र्भाी करने के नलए नन(cid:7388)नलनखत उपाय करेगी, अा(cid:6981)त् :-

(1) भू-उपयोग - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286)र् न(cid:7298), उ(cid:7378)ान-कृ नष (cid:6979)े(cid:7074)(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योनि के नलए नचन(cid:7008)हत (cid:7408)कए गए पाक(cid:7300) और खुले (cid:7021)ान(cid:7298) का र्ानणन(cid:6996)यक और औ(cid:7378)ोनगक संब(cid:7373) र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए उपयोग या संप(cid:7407)र्रत(cid:6981)न नह(cid:7277) होगा:

परंतु पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर कृ नष भूनम का संप(cid:7407)र्रत(cid:6981)न, मानीटरी सनमनत क(cid:7409) नसा(cid:7407)र पर और रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन से, (cid:7021)ानीय नर्नानसय(cid:7298) क(cid:7409) र्आासीय (िcid:7272)रत(cid:7298) को पूरा करने के नलए और पैरा 4 क(cid:7409) सारणी के (cid:7021)तंभ (2) के अधीन मद सं. 10, 20, 22, 26 और 27 के सामने सूचीब(cid:7373) (cid:7408)(cid:7059)याकलाप(cid:7298) को पूरा करने के नलए अनु(cid:6980)ात ह(cid:7298)गे, अा(cid:6981)त्:—

(i) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए पय(cid:6981)टक(cid:7298) के अ(cid:7021)ायी र्आासन के नलए पा(cid:7407)रन(cid:7021)नतक अनुकू ल आरामगाह ैिसे ट(cid:7286)ट, लकी के मकान आ(cid:7408)द;

(ii) र्न(cid:7378)मान सक(cid:7298) को चौा और सुदृ करना ;

(iii) (cid:7079)दूषण का(cid:7407)रत न करनेर् ाले लघु उ(cid:7378)ोग |

(iv)र् षा(cid:6981) लि संचय; और

(v) कु टीर उ(cid:7378)ोग, नसिके अंतग(cid:6981)त (cid:7061)ामीण उ(cid:7378)ोग, सुर्नधा भंडार और (cid:7021)ानीय सुख- सुर्नधाएं ह(cid:7289);

परंतु यह और (cid:7408)क रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन और संर्नधान के अनु(cid:6994)छेद 244 ता त(cid:7004)समय (cid:7079र्)ृ(cid:7275) र्ननध के उपबंध(cid:7298) के अनुपालन के नबना, नसिके अंतग(cid:6981)त अनुसूनचत निािनत और अ(cid:7008)य परंपरागत र्न नर्नासी र्(न अनधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अनधननयम, 2006 (2007 का 2) भी है,र् ानणन(cid:6996)यक या उ(cid:7378)ोग र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए निाितीय भूनम का उपयोग अनु(cid:6980)ात नह(cid:7277) होगा :

परंतु यह और भी (cid:7408)क पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर भू-अनभलेख(cid:7298) म(cid:7286) उपसंाित कोई (cid:7074)ु(cid:7407)ट मानीटरी सनमनत के र्नचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)येक मामले म(cid:7286) एक बार संोनधत होगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संोधन क(cid:7409) के (cid:7008)(cid:7076)ीय सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय को सूचना देनी होगी ।

परंतु यह और भी (cid:7408)क उपयु (cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संोधन म(cid:7286) इस उप पैरा के अधीन या उपबंनधत के नर्साय (cid:7408)कसी भी दा म(cid:7286) भू- उपयोग का प(cid:7407)र्रत(cid:6981)न सन(cid:7013)मनलत नह(cid:7277) होगा ।

परंतु यह और भी (cid:7408)क नसिसे ह(cid:7407)रत (cid:6979)े(cid:7074) म(cid:7286) ैिसेर् न (cid:6979)े(cid:7074), कृ नष (cid:6979)े(cid:7074) आ(cid:7408)द म(cid:7286) कोई पा(cid:7407)रणानमक कटौती नह(cid:7277) होगी और अन(cid:7079)यु(cid:6989)त या अनु(cid:7004)पादक कृ नष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पुन:र् नीकरण करने के (cid:7079)यास (cid:7408)कए ािएंगे ।

(2) (cid:7079)ाकृ नतक लि-(cid:7090)ोत – आंचनलक महायोनिा म(cid:7286) सभी (cid:7079)ाकृ नतक लि (cid:7090)ोत(cid:7298) क(cid:7409) पहचान क(cid:7409) ािएगी और उनके संर(cid:6979)ण और पुनन(cid:6981र्)ीकरण के नलए योनिा सन(cid:7013)मनलत होगी और रा(cid:6996)य सरकार (cid:7367)ारा ऐसे (cid:6979)े(cid:7074)(cid:7298) पर या उनके ननकट र्नकास (cid:7408)(cid:7059)याकलाप (cid:7079)नतनष(cid:7373) करने के नलए ऐसी रीनत से माग(cid:6981)ननद(cid:7287) तैयार (cid:7408)कए ािएंगे |

(3) पय(cid:6981)टन – (क) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप, पय(cid:6981)टन महायोनिा के अनुसार ह(cid:7298)गे, ोि आंचनलक महायोनिा का भाग (cid:7272)प ह(cid:7298)गे ।

(ख) पय(cid:6981)टन महायोनिा, पय(cid:6981)टन र्नभाग (cid:7367)ारार् न और पया(cid:6981र्)रण र्नभाग, रा(cid:6996)य सरकार के पराम(cid:6981) से तैयार होगी ।

(ग) पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप नन(cid:7013)ननलनखत के अधीन र्नननयनमत ह(cid:7298)गे, अा(cid:6981)त् :-

परंतु संरन(cid:6979)त (cid:6979)े(cid:7074)(cid:7298) क(cid:7409) सीमा से एक (cid:7408)कलोमीटर क(cid:7409) दूरी से परे पा(cid:7407)रन(cid:7021)नतक(cid:7409)य र्संेदी ोिन क(cid:7409) सीमा तक नए होटल और (cid:7407)रसोट(cid:6981) क(cid:7409) (cid:7021)ापना पय(cid:6981)टन महायोनिा के अनुसार पा(cid:7407)रन(cid:7021)नतक(cid:7409)य पय(cid:6981)टन सुर्नधा के नलए र्पू(cid:6981) प(cid:7407)रभानषत और र्ननन(cid:7416)द(cid:7397) (cid:7021)ान म(cid:7286) ही अनु(cid:6980)ात होगी।

	लि या र्ायु या मृदा या र् नन दूषण कारत करनेर् ाले उोग क ापना ।	पारननतक र्संेदी ोिन के भीतर नए और दूषण कारत करनेर् ाले र्नमान उोग का र्न तार अनुात नह होगा ।
	र् ृहत तापीय और लि र्नुत परयोनिा क ापना ।	लागू र्ननधय के अनुसार नतनष (अया उपबंनधत के नर्साय) ।
	पहाी ढाल और नदी तट का संरण ।	राय तर सनमनत ारा अनुात के नर्साए कोई सनमाण याकलाप 1 से 10 से अनधक ढर्ला र्ाली पहानय और कसी नदी, ाकृ नतक नाले, के कनारे से 100 मीटर तक नह कया ािएगा।

र्नननयनमत याकलाप
10.	होटल और र्नाम ल का ापना ।	स ंरनत े क सीमा से 1 कलोमीटर के भीतर कोई नया र्ानणनयक होटल और रसोट अनुात नह कया ािएगा नर्साय पारननतक अनुकू ल पयटन याकलाप के संबंध म पयटक के अायी नर्नास ान के । तानप, एक कलोमीटर से परे और पारनतकय र्संेदी ोिन के र्नतार तक, सभी पयटन याकलाप या र्नमान याकलाप का र्नतार पयटन महायोनिा और राीय ा संरण ानधकरण के माग-दक नसांत के अनुप कया ािएगा ।
11.	सनमाण याकलाप ।	(क) संरनत े क सीमा से 1 कलोमीटर के भीतर कसी भी कार क े नएर् ानणनयक सनमाण क अनुा नह दी ािएगी । परतु ानीय नर्नानसय को उनक घरेलू र्आयकता, नसिके अंतगत पैरा 3 के उप पैरा (1) म सूचीब याकलाप भी ह, क े नलए अनुात कया ािएगा । परंतु दूषण न कारत करनेर् ाले लघु उोग से संबंनधत सनमाण याकलाप या लागू और र्नननयम, यद कोई ह, के अनुसार सम ानधकारी क र्पू अनुमनत से र्नननयनमत हगे और यूनतम पर रखे ािएंगे । और 1 कलोमीटर के आगे पारननतक र्संेदी ोिन के र्नतार तक र्ातर्नक ानीय र्आयकता के नलए संननमाण अनुात कया ािएगा और अय संननमाण याकलाप आंचनलक महायोनिा क े अनुसार र्नननयनमत हगे ।
12.	खाई खोदने का मैदान ।	नये खाई खोदने के मैदान को ानपत करना नतनष है । पुराने खाई क े मैदान के लागू र्ननधय के अधीन र्नननयनमत कया ािए ।
13.	ाकृ नतक लि ननकाय या सतही े म उपचारत बनर्हा का ननसारण ।	लागू र्ननधय के अधीन र्नननयनमत हगे ।
14.	र्ायु और यानीय दूषण ।	लागू र्ननधय के अधीन र्नननयनमत हगे ।
15.	र्नन दूषण ।	लागू र्ननधय के अधीन र्नननयनमत हगे ।

20.	र्नमान सक को चौा और सुदृढ करना।	उनचत पर्यारणीय र्भा ननधारण और या लागू उपमन उपाय क े सा कया ािएगा ।
21.	होटल और लॉ ि के र्नमान परसर म बाड लगाना ।	लागू र्ननधय के अधीन र्नननयनमत हगे । र्र्यीि के मु संचरण को अनुात करने के नलए, पारननतक स ंर्ेदी ोिन के भीतर होटल या अयर् ानणनयक ापन क कटीली तार से उनक संपनय को नह घेरा ािएगा और कोई घेरा 1 मीटर स े ऊं चा नह होगा \| इस अनुबंध का पालन न करने र्ाले कसी र्नमान घेरे को आंचनलक महायोनिा म समय-सीमा के उपातरत कया ािएगा ।
22.	दूषण उप न करनेर् ाले लघु उोग।	पारन नतक र्संेदी ोिन म देीय माल से उपाद का उपादन करने र्ाले गैर दूषण, गैर परसंकटमय, लघु और र्सेा उोग, कृ नष उान, कृ नष या कृ नष आधारत ऐसे उोग ोि पर्यारण पर कोई र्नपरीत र्भा नह डालते ह, अनुात कए ािएंगे ।

NOTIFICATION

New Delhi, the 22nd December, 2015

S.O. 67(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

Draft Notification

WHEREAS, the Velavedar Black Buck National Park spread over an area of 34.52 sq. kms located in Bhavnagar District of Gujarat and notified with the prime aim of long-term protection and conservation of Black Buck and the rare and endangered biological diversity.

AND WHEREAS, Reserve Forest categorised as Coastal Grassland Ecosystem and Rajwada Bio-geographical Province supports rich biodiversity, and also a variety of mammals, reptiles, insects and avifauna;

AND WHEREAS, the extremely closed vicinity of the National Park to human habitation, ongoing developmental activities, industrialization and salt farming activities around the National Park, necessitate the requirement 'of proper safeguards and control over such activities in view of long term wildlife conservation.

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Velavedar Black Buck National Park as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1 km to 26 kms around the boundary of Velavedar Black Buck National Park in the State of Gujarat as the Velavedar Black Buck National Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone shall be with a peripheral area of 727.68 sq. kms with an extent varying from 1 km to 26 kms around the boundary of Velavedar Black Buck National Park.

(2) The map of the Eco-sensitive Zone along is appended as Annexure-I.

(3) The boundary details along with latitudes and longitudes of National Park and its eco-sensitive zone are given in Annexure-II.

(4) The list of 32 villages falling in Eco-sensitive Zone is appended as Annexure-III.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.

(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment,

(ii) Forest,

(iii) Urban Development,

(iv) Tourism,

(v) Municipal,

(vi) Revenue,

(vii) Agriculture

(viii) Gujarat State Pollution Control Board,

(ix) Irrigation

(x) Public Work Department

for integrating environmental and ecological considerations into it.

(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.

(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet theभारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 15 residential needs of local residents, and for the activities listed against serial numbers 10, 20, 22, 26 and 27 in column (2) of the Table in paragraph 4, namely:-

(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities,

(ii) Widening and strengthening of existing roads.

(iii) Small scale industries not causing pollution,

(iv) Rainwater harvesting, and

(v) Cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of Article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government.

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Velavedar Black Buck National Park except for accommodation for temporary occupation of tourists related to Eco- friendly tourism activities:

Provided that beyond the distance of the one kilometre from the boundary of the Protected Area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for the eco-tourism facilities as per Tourism Master Plan;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or GujaratState Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under.

(7) Air pollution.- The Environment Department of the State Government or Gujarat State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial Units

(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law.

(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco- sensitive zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco ;sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

6.		Protection of hill slopes and river banks	No construction activity unless otherwise permitted by State Level Committee shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah.	NaN

10.	Establishment of hotels and resorts		No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan.	NaN
11.	Construction activities		(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area:	NaN
			Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any. Further, beyond one kilometer upto the extent of Eco- Sensitive Zone construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per Zonal Master Plan. 12.	Trenching ground		Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws.	NaN

5. Monitoring Committee:-

The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone

falling in the State of Gujarat, which shall comprise of the following namely:-

(a)	Collector, Bhavnagar	Chairperson
(b)	Regional Officer, Gujarat State Pollution Control Board, Bhavnagar	Member
(c)	Senior Town Planner of the area	Member
(d)	A representative of the Department of Forests and Environment, Government of Gujarat	Member
(e)	One expert in the area of ecology and environment to be nominated by the Ministry of Environment and Forests, Government of India	Member
(g)	A representative of Non-governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of India	Member
(h)	Assistant Conservator of Forests (In Charge of the Black Buck National Park), Bhavnagar	Member Secretary

6. Terms of Reference:

(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.

(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification.

(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(4) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV.

(7) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.
