1. संन(cid:6979)(cid:7385) ीष(cid:6981)क और (cid:7079)ारंभण:—

इन र्नननयम(cid:7298) को पे(cid:7069)ोनलयम और (cid:7079)ाकृ नतक गैस र्नननयामक बोड(cid:6981) ((cid:7079)ाकृ नतक गैस पाइपलाइन ु(cid:7016)क का ननधा(cid:6981)रण) संोधन र्नननयम, 2016 कहा ािएगा।

(2) ये सरकारी रापि(cid:7074) म(cid:7286) उनके (cid:7079)कान क(cid:7409) तारीख से (cid:7079र्)ृत ह(cid:7298)गे।

2. पे(cid:7069)ोनलयम और (cid:7079)ाकृ नतक गैस र्नननयामक बोड(cid:6981) ((cid:7079)ाकृ नतक गैस पाइपलाइन ु(cid:7016)क का ननधा(cid:6981)रण) र्नननयम, 2008, म(cid:7286),- (क) अनुसूची क म(cid:7286),-

(i) ख(cid:7003)ड 5 के उप-ख(cid:7003)ड (7) का लोप हो ािएगा।

(ii) ख(cid:7003)ड 6 के उप-ख(cid:7003)ड (1) म(cid:7286) नन(cid:7388)नलनखत से (cid:7079)नत(cid:7021)ानपत होगा, नामत :—

"(1) प(cid:7407)रयोनिा क(cid:7409) नमत(cid:7390)यी कार्लानध पर यूननट (cid:7079)ाकृ नतक गैस पाइपलाइन ु(cid:7016)क के ननधा(cid:6981)रण म(cid:7286) गुणक के (cid:7271)प म(cid:7286) मानी गई (cid:7079)ाकृ नतक गैस क(cid:7409) मा(cid:7074)ा का ननधा(cid:6981)रण मानक(cid:7409)य र्अार् ा(cid:7021)तर्नक आधार पर इनम(cid:7286) से ोि भी उ(cid:7340)तर होगा। मा(cid:7074)ा के मानक(cid:7409)य आधार क(cid:7409) गणना ैिसी (cid:7408)क नीचे इंनगत क(cid:7409) गई है :—

(ख) ैिसा (cid:7408)क पे(cid:7069)ोनलयम और (cid:7079)ाकृ नतक गैस र्नननयामक बोड(cid:6981) (पे(cid:7069)ोनलयम और पे(cid:7069)ोनलयम उ(cid:7004)पाद ता (cid:7079)ाकृ नतक गैस पाइपलाइन (cid:6979)मता का ननधा(cid:6981)रण) र्नननयम, 2010 के तहत घोनषत छठे र्ष(cid:6981) के नलए भाकि और (cid:7079)ाकृ नतक गैस पाइपलाइन के (cid:7079)चालन के बाद के र् ष(cid:7300) के नलए पुन(cid:7397) अनुबंध (cid:6979)मता के बराबर और बुक (cid:7408)कए गए सामा(cid:7008)यर् ाहक (cid:6979)मता या पचह(cid:7275)र (cid:7079)नतत ोि भी अनधक हो होगा।

(ग) य(cid:7408)द, (cid:6979)मता ननधा(cid:6981)रण र्नननयम(cid:7298) के अनुसार (cid:6979)मता घोनषत नह(cid:7277) क(cid:7409) गई है, (cid:7079)ानधकार म(cid:7286) उ(cid:7016)लेनखत (cid:6979)मता र्अा बोड(cid:6981) (cid:7367)ारा ािरी (cid:7021र्)ीकारोन(cid:7334) प(cid:7074) म(cid:7286) उ(cid:7016)लेनखत, (cid:6979)मता टै(cid:7407)र ननधा(cid:6981)रण के नलए (cid:7079)योग (cid:7408)कया ािएगा ता बाद म(cid:7286) बि (पे(cid:7069)ोनलयम और पे(cid:7069)ोनलयम उ(cid:7004)पाद ता (cid:7079)ाकृ नतक गैस पाइपलाइन (cid:6979)मता का ननधा(cid:6981)रण) र्नननयम, 2010 के अनुसार (cid:6979)मता उपल(cid:7011)ध होगी, आगामी टै(cid:7407)र समी(cid:6979)ा के समय (cid:6979)मता ननधा(cid:6981)रण र्नननयम(cid:7298) के अनुसार घोनषत (cid:6979)मता से यह (cid:6979)मता (cid:7079)नत(cid:7021)ानपत होगी।

(घ) 01.04.2015 से 31.03.2020 के दौरान गैस पाइपलाइन के संबंध म(cid:7286) य(cid:7408)द, कोई (cid:7090)ोत ुिता है, तो पाइपलाइन क(cid:7409) नडािइन (cid:6979)मता म(cid:7286) (cid:7408)कसी (cid:7079)कार क(cid:7409) र्ृन(cid:7007)द होने पर 01.04.2015 से 31.03.2020 तक क(cid:7409) र्अनध के नलए उ(cid:7334) र्नीन (cid:7090)ोत का टै(cid:7407)र ननधा(cid:6981)रण म(cid:7286) र्नचार नही (cid:7408)कया ािएगा।";

(iii) ख(cid:7003)ड 9 के उप-ख(cid:7003)ड (4) के नलए नन(cid:7388)नलनखत (cid:7079)नत(cid:7021)ानपत होगा, नामत :—

" )4( अनंनतम (cid:7079)ारन(cid:7013)भक इकाई (cid:7079)ाकृ नतक गैस पाइपलाइन टै(cid:7407)र और अंनतम (cid:7079)ाकृ नतक गैस पाइपलाइन टै(cid:7407)र म(cid:7286) नभ(cid:7382)ता के कारण का समायोनि डीसीए गणना म(cid:7286) बनाना होगा और (cid:7390)ू(cid:7004)पन टै(cid:7407)र अगली समी(cid:6979)ा तक र्भाी आधार पर (cid:7061)ाहक(cid:7298) सेर् सूला ािएगा, इस मामले म(cid:7286) य(cid:7408)द, टै(cid:7407)र आदे 30 नसत(cid:7013)बर से र्पू(cid:6981) ािरी (cid:7408)कया ािता है तो टै(cid:7407)र उस र्न(cid:7275)ीयर् ष(cid:6981) नसि म(cid:7286) (cid:7408)क टै(cid:7407)र आदे ािरी (cid:7263)आ है क(cid:7409) 1 अ(cid:7079)ैल से लागू होगा अ(cid:7008)या आगामी र्न(cid:7275)ीयर् ष(cid:6981) के 1 अ(cid:7079)ैल से लागू होगा।";

PETROLEUM AND NATURAL GAS REGULATORY BOARD

NOTIFICATION

New Delhi, the 8th January 2016

F. No. PNGRB/M(C)/110.—In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, namely:—

1. Short title and commencement.

(i) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Amendment Regulations, 2016.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. In the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Regulations, 2008,—

(a) in Schedule A,—

(i) sub-clause (7) of clause 5 shall be omitted;

(ii) for sub-clause (1) of clause 6, the following shall be substituted, namely:-

"(1) " The volumes of natural gas to be considered as divisor in the determination of the unit natural gas pipeline tariff over the economic life of the project shall be computed on a normative or actual basis, whichever is higher. Volume on normative basis shall be calculated as indicated below:-

(a) The divisor for each of the first five years of operations of the natural gas pipeline shall be arrived by multiplying the applicable percentage utilization for the year, as per the basis indicated below, with seventy five per cent of the capacity of natural gas pipeline as declared under the Petroleum and Natural Gas Regulatory Board (Determining Capacity of Petroleum, Petroleum Products and Natural Gas Pipeline) Regulations, 2010:-

(b) The divisor for the sixth and the subsequent years of operation of the natural gas pipeline shall be equal to the firmed up contract capacity and booked common carrier capacity or seventy five per cent. of the capacity of natural gas pipeline as declared under the Petroleum and Natural Gas Regulatory Board (Determining Capacity of Petroleum, Petroleum Products and Natural Gas Pipeline) Regulations, 2010, whichever is higher.

(c) In case, capacity has not been declared as per capacity determination regulations, capacity as mentioned in the authorization or acceptance letter issued by the Board shall be used for tariff determination and subsequently when the capacity as per Petroleum and Natural Gas Regulatory Board (Determining Capacity of Petroleum, Petroleum Products and Natural Gas Pipeline) Regulations, 2010 is available, this capacity shall be replaced with the capacity declared as per capacity determination regulations at the time of next tariff review.

(d) In case of addition of any new source to a natural gas pipeline that comes during 01.04.2015 to 31.03.2020, any increase in the design capacity of the pipeline because of this new source shall not be considered in the tariff determination for a period from 01.04.2015 to 31.03.2020." ;

(iii) for sub-clause (4) of clause 9, the following shall be substituted, namely:-

"(4) Adjustment on account of variation in the provisional initial unit natural gas pipeline tariff and final initial unit natural gas pipeline tariff shall be made in the DCF calculations and the derived tariff shall be charged from the customers on prospective basis till next review, that is, in case tariff order is issued before 30th September, tariff shall be applicable from 1st April of the financial year in which Tariff Order is issued, otherwise tariff shall be applicable from 1st April of the next financial year.";

(b) clause (4) of Attachment 2 to Schedule A shall be omitted.
