काकाकाका....आआआआ. . . . 126126126126((((अअअअ).).).).————जबकि के न्(cid:14) सरकार, स्थायी सलाहकार सिमित की सिफारिशों पर िवचार करते (cid:27)ए, पटसन पैके जिग साम"ी (वस्तुओं की पै'कग में अनिवार्य प्रयोग) अिधिनयम, 1987 (1987 का 10) धारा 3 की उपधारा (1) के तहत ऐसी वस्तुओं अथवा वस्तुओं की -ेणी अथवा उसका कु छ प्रतिशत आदेश में विनि/दष्ट किए गए अनुसार उन पटसन पैके जिग साम"ी में आपू3त अथवा िवतरण किए जाने के प्रयोजन से पैक किए जाने के िलए विनि/दष्ट करने के िलए अिधकृ त है;

और जबकि के न्(cid:14) सरकार ने उक्त अिधिनयम की धारा 4 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:27)ए पटसन साम"ी में पैके जिग के मानदंडों की सिफारिश करने के िलए दिनांक 13 फरवरी, 2013 के का.आ. 360 (अ) द्वारा स्थायी सलाहकार सिमित का गठन कर दिया है;

और, जबकि कें (cid:14) सरकार स्थायी सलाहकार सिमित द्वारा की गई सिफारिशों पर िवचार करने के बाद इस बात से संतुष्ट है कि पटसन पै'कग साम"ी में पैक किए जाने के लिए आवश्यक वस्तुओं अथवा वस्तुओं की -ेणियों अथवा उसके कु छ प्रतिशत को विनि/दष्ट करना, क;े पटसन और पटसन पैके जिग साम"ी के उत्पादन और इनके उत्पादन में लगे (cid:27)ए =क्तियों के िहत में अनिवार्य है;

अत: अब पटसन पैके जिग साम"ी (वस्तुओं की पै'कग में अनिवार्य प्रयोग) अिधिनयम, 1987 की धारा 16 की उपधारा (1) के साथ पठित धारा 3 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:27)ए दिनांक 11 फरवरी, 2015

को भारत के राजपत्र, असाधारण भाग-II खंड-3, उप-खंड (ii) में प्रकाशित भारत सरकार, वस्त्र मंत्रालय के 13 फरवरी, 2013 के आदेश सं. का.आ. 527(अ) के अधिBमण से पहले किए गए अथवा किए जाने से रोके जाने वाली

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संबंधित चीजों को छोड़कर, उस आदेश का अधिBमण करते (cid:27)ए कें (cid:14) सरकार एतGारा यह िनदेश देती है कि इस अिधसूचना के सरकारी राजपत्र में प्रकाशन की तारीख से 30 जून, 2016 तक नीचे दी गई अनुसूची के कालम (2) में विनि/दष्ट वस्तुओं को इस अनुसूची के कालम (3) में तHनुरूपी प्रविष्टियों में विनि/दष्ट किए गए अनुसार न्यूनतम प्रतिशत में संिवतरण की आपू3त के िलए पटसन पैके जिग साम"ी में पैक किया जाएगा।

*नोटनोटनोटनोट:::: सर्वप्रथम सम" आवश्यकता के लिए पटसन बैगों की मांग की जाएगी और यदि पटसन मिले आवश्यकतानुसार पटसन बैग उपलब्ध कराने में समर्थ नहR होगी तो खाद्य और सार्वजनिक वितरण विभाग द्वारा दस प्रतिशत तक विलय किए जाने की अनुमति होगी ।

उपर्यक्त प्रावधान निम्नलिखित पर लागू नहR होंगे:

(क) विटामिनयुक्त परिपुष्ट चीनी।

(ख) वस्तुओं के निर्यात के लिए पै'कग।

(ग) खाद्यान्न के िलए दस कि."ा. और उससे कम के तथा चीनी के िलए पUचीस कि."ा. और उससे कम के उपभोक्ता पैक।

(घ) सौ कि."ा. से अधिक की बल्क पैके जिग।

(ड़) निर्यात के लिए पैक की गयी चीनी जिसका निर्यात नहR किया जा सका।

2. कें (cid:14) सरकार खाद्यान्न के लिए अधिकतम तीस प्रतिशत तक पटसन साम"ी में पै'कग के लिए ये प्रावधान रीिलज कर सकती है।

3. खाद्यान्न पै'कग के लिए भारत सरकार द्वारा प्रदान की जाने वाली सब्सिडी अथवा प्रतिपू3त को ध्यान में रखते (cid:27)ए राष्ट्रीय खाद्य सुरक्षा अधिनियम, 2013 (2013 का 20) के अंतर्गत वितरण के उद्देश्य से खाद्यान्न की पै'कग के लिए दस कि."ा. और उससे अधिक पUचीस कि."ा. तक के उपभोक्ता पैक इस शर्त के अध्यधीन पटसन बैगों में पैक किए जाएंगे कि ऐसे पटसन बैग उUच घनत्व वाले पोली एथीलीन अथवा पोली प्रोपीलीन बैगों की तुलना में लागत प्रतिस्पर्धी होंगे।

ORDER

New Delhi, the 14th January, 2016

S.O. 126(E).—Whereas the Central Government under sub-section(1) of section 3 of the Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987 (10 of 1987) is empowered to specify the commodities or class of commodities or such percentage thereof which shall be packed for the purpose of its supply or distribution in such jute packaging material as may be specified in the order, considering the recommendations of the Standing Advisory Committee;

And, whereas, the Central Government, in exercise of powers conferred under sub-section (1) of section 4 of the said Act, has constituted the Standing Advisory Committee vide number S.O. 360(E), dated the 13th February, 2013, to recommend the norms of packaging in jute material;

And, whereas the Central Government, after considering the recommendations made by the Standing Advisory Committee, is satisfied that it is necessary in the interest of production of raw jute and jute packaging material, and of persons engaged in the production thereof to specify the commodity or class of commodities and percentage thereof required to be packed in jute packaging material;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with sub- section (1) of section 16 of the Jute Packaging Materials (Compulsory Use in Packaging Commodities) Act, 1987 and in supersession of the Government of India in the Ministry of Textiles, order number S.O. 527(E), dated the 13th February, 2015, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (ii) dated the 11th February, 2015, except as respects things done or omitted to be done before such supersession, the Central Government hereby directs that the commodities specified in column (2) of the Schedule below, shall be packed in jute packaging material for supply or distribution, in such minimum percentage as specified in corresponding entries in column (3) of the said Schedule, with effect from the date of publication of this order in the Official Gazette, upto 30th June, 2016.

Schedule

* Note: In the first instance, the indents for the whole requirement would be placed for jute bags and in case jute mills would not be able to provide jute bags as per requisition, then a dilution upto ten per cent. would be permissible by the Department of Food and Public Distribution.

Provided that this shall not apply to the following, namely:—

(a) sugar fortified with vitamins;

(b) packaging for export of commodities;

(c) consumer packs of ten kilograms and below for food grains and twenty five kilograms and below for sugar; and

(d) bulk packing of more than one hundred kilograms.

(e) sugar packed for export but which could not be exported.

2. The Central Government may release these provisions for packing in jute material up to a maximum of thirty per cent. for food grains.

3. Consumer packs of ten kilograms and above up to twenty-five kilograms for packing of foodgrains meant for distribution under the National Food Security Act, 2013 (20 of 2013) shall be packed in jute bags, subject to the condition that such jute bags shall be cost competitive as compared to high density poly ethylene or poly propylene bags factoring in the subsidy or re-imbursement provided by the Government of India for packing of foodgrains.
