काकाकाका.... आआआआ.... 145145145145((((अअअअ))))....———— के न्(cid:12)ीय सरकार ने पैट्रोलियम पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन) अिधिनयम, 1962 (1962 का 50) (जिसे इसमें इसके प)ात उक्त अधिनियम कहा गया है) की धारा 3 की उप- धारा (1) के अधीन जारी की गई, भारत सरकार के पैट्रोलियम और प्राकृ तिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 2177(अ) तारीख 3 अगस्त, 2015 जिसका प्रकाशन भारत के राजपत्र संख्या 1683 भाग II, खंड 3, उपखंड (ii) तारीख 10 अगस्त, 2015 में किया गया है । इस अधिसूचना से संल; अनुसूची में विनि>दष्ट हरियाणा राज्य की तहसील रेवाड़ी जिला रेवाड़ी की भूमि में, मुन्(cid:12)ा पानीपत पाइपलाइन प्रतिस्थापन परियोजना के संबंध में पाइपलाइन बिछाने की परियोजना के लिए उपयोग के अधिकार का अर्जन करने के लिए अपने आशय की घोषणा की थी;
और उक्त राजपत्र अधिसूचना की प्रतियाँ जनता को तारीख 11.9.2015 से 8.10.2015 तक उपलब्ध करा दी गयी थी;
और, उक्त अधिनियम की धारा 6 की उपधारा (1) के अनुरक्षण में सक्षम प्राधिकारी ने के न्(cid:12)ीय सरकार को अपनी रिपोर्ट दे दी है ।
और, के न्(cid:12)ीय सरकार ने उक्त रिपोर्ट पर विचार करने के प)ात और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइन बिछाने के लिए अपेक्षित है, उसमे उपयोग के अधिकार का अर्जन करने का विनि)य किया है;
अतः अब के न्(cid:12)ीय सरकार उक्त अधिनियम की धारा 6 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते Tए, यह घोषणा करती है कि इस अधिसूचना से संल; अनुसूची में विनि>दष्ट भूमि में पाइपलाइन बिछाने के उपयोग का अधिकार अUजत किया जाए;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, के न्(cid:12)ीय सरकार उक्त अधिनियम कि धारा 6 की उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते Tए, यह निदWश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से के न्(cid:12)ीय सरकार में निहित होने के बजाए, सभी विल्लंगमों से मुक्त होकर इंडियन ऑइल कापZरेशन लिमिटेड में निहित होगा ।
पैट्रोलियम और खनिज पाइपलाइन अधिनियम, 1962 कि धारा 10 के अधीन किसी भी क्षतिपूUत के लिए इंडियन ऑइल कापZरेशन लिमिटेड पूर्णतया उत्तरदायी होगी और पाइपलाइन से संबन्धित किसी भी मामले पर के न्(cid:12)ीय सरकार के वि[\ कोई वाद, दावा या कानूनी कार्यवाही नह] हो सके गी ।

NOTIFICATION
New Delhi, the 14th January, 2016
S.O. 145(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas, published in the Gazette of India no. 1683 Part II, section 3, sub-section (ii) dated August 10, 2015 vide S.O. number 2177(E) dated August 3, 2015 issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the right of user in the land situated in Tehsil Rewari, District Rewari in Haryana State, specified in Schedule appended to that notification for the purpose of laying pipeline in "Mundra-Panipat Pipeline Replacement Project" of Indian Oil Corporation Limited.
And whereas, the copies of the said Gazette notification were made available to the public from 11.9.2015 to 8.10.2015.
And whereas, the Competent Authority, under sub-section (1) of section 6 of the said Act, has submitted his report to the Central Government;
And whereas, the Central Government after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby declares that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to pipeline.
