1. संन(cid:6979)(cid:7009)त नाम और (cid:7079)ारंभ :(1)इन ननयम(cid:7298) का संन(cid:6979)(cid:7009)त नामर् (cid:7021)(cid:7074) मं(cid:7074)ालय, हकरघा र्नकास आयु(cid:6989)त का काया(cid:6981)लय, ((cid:7079र्)त(cid:6981)न प(cid:6979)) समूह-''ग'' आुनलनपक (cid:7088)ेणी-2, उ(cid:6994)च (cid:7088)ेणी नलनपक, र्अर (cid:7088)ेणी नलनपक और (cid:7021)टा कार (cid:7071)ार्इर भत(cid:7278) ननयम 2016 है ।
(2) ये रापि(cid:7074) म(cid:7286) (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7004)त ह(cid:7298)गे ।
2. लागू होना :- ये ननयम इनके सा संल(cid:6991)न अनुसूची के (cid:7021)तंभ (1) के र्ननन(cid:7416)द(cid:7020)ट पद(cid:7298) पर लागू ह(cid:7298)गे ।
3. पद सं(cid:6990)या,र् ग(cid:7278)करण,र् ेतन ब(cid:7289)ड और (cid:7061)ेडर् ेतन यार् ेतनमान -उ(cid:6989)त पद सं(cid:6990)या,उसकार् ग(cid:7278)करण और उसके र् ेतन ब(cid:7289)ड ता (cid:7061)ेडर् ेतन या र् ेतनमानर् ह होगा,ोि इन ननयम(cid:7298) से उपाब(cid:7373) अनुसूची के (cid:7021)त(cid:7013)भ (2) से (cid:7021)त(cid:7013)भ (4) म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट है।
4. भत(cid:7278) क(cid:7409) प(cid:7373)नत, आयु-सीमा और अ(cid:7008)य अह(cid:6981)ताएं, आ(cid:7408)द-उ(cid:6989)त पद पर भत(cid:7278) क(cid:7409) प(cid:7373)नत, आयु-सीमा, अह(cid:6981)ताएं और उससे संबंनधत अ(cid:7008)य बात(cid:7286)र् े ह(cid:7298)गी ोि उ(cid:6989)त अनुसूची के स्तंभ (5) से (cid:7021)तंभ(13) म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट ह(cid:7289) ।

(क) नसिने ऐसे (cid:7018)यन(cid:7334) से नसिका पनत या नसिक(cid:7409) प(cid:7004)नी ीिर्नत है, र्र्नाह (cid:7408)कया है, या
(ख) नसिने अपने पनत या अपनी प(cid:7004)नी के ीिर्नत रहते (cid:7263)ए (cid:7408)कसी (cid:7018)यन(cid:7334) से र्र्नाह (cid:7408)कया है,
उ(cid:6989)त पद पर ननयुन(cid:7334) का पा(cid:7074) नह(cid:7277) होगा :
पर(cid:7008)तु य(cid:7408)द के (cid:7008)(cid:7076) सरकार का यह समाधान हो ािता है (cid:7408)क ऐसा र्र्नाह ऐसे (cid:7018)यन(cid:7334) और र्र्नाह के अ(cid:7008)य प(cid:6979)कार को लागू (cid:7021र्)ीय र्ननध के अधीन अनु(cid:6980)ेय है और ऐसा करने के नलए अ(cid:7008)य आधार ह(cid:7289) तोर् ह (cid:7408)कसी (cid:7018)यन(cid:7334) को इस ननयम के (cid:7079र्)त(cid:6981)न से छू ट दे सके गी ।
6. ननल करने क(cid:7409) न(cid:7334) : हिां के (cid:7008)(cid:7076) सरकार क(cid:7409) यह राय है (cid:7408)क ऐसा करना र्आ(cid:7019)यक या समीचीन है,र् हांर् ह उसके नलए ोि कारण ह(cid:7289), उ(cid:7008)ह(cid:7286) लेखब(cid:7373) करके ,इन ननयम(cid:7298) के (cid:7408)कसी उपबंध को (cid:7408)कसीर् ग(cid:6981) या (cid:7079र्)ग(cid:6981) के (cid:7018)यन(cid:7334)य(cid:7298) क(cid:7409) र्बात, आदे (cid:7367)ारा ननल कर सके गी ।
7. (cid:7018)र्याृन(cid:7275) : इन ननयम(cid:7298) क(cid:7409) कोई बात ऐसे आर(cid:6979)ण(cid:7298), आयु-सीमा म(cid:7286) छू ट और अ(cid:7008)य (cid:7407)रयायत(cid:7298) पर (cid:7079)र्भा नह(cid:7277) डालेगी, ननिका के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय-समय पर ािरी (cid:7408)कए गए आदे(cid:7298) के अनुसार अनुसूनचत ािनतय(cid:7298), अनुसूनचत निािनतय(cid:7298), अ(cid:7008)य नपछार् ग(cid:6981),भूतर्पू(cid:6981) सैननक(cid:7298) और अ(cid:7008)य र्नेष (cid:7079र्)ग(cid:6981) के (cid:7018)यन(cid:7334)य(cid:7298) के नलए उपबंध करना अपेन(cid:6979)त है ।

G.S.R. 75(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Office of the Development Commissioner for Handlooms (Enforcement Wing) Group C and D posts Recruitment Rules,1995, in so far as they relate to the posts of Stenographer, Grade –II, Upper Division Clerk, Lower Division Clerk and Staff Car Driver, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Stenographer, Grade –II, Upper Division Clerk, Lower Division Clerk and Staff Car Driver in the Office of the Development Commissioner for Handlooms (Enforcement Wing), Ministry of Textiles, namely:-

Short title and commencement.-(1) These rules may be called the Ministry of Textiles, Office of the Development Commissioner for Handlooms (Enforcement Wing) Group 'C' Stenographer, Grade –II, Upper Division Clerk, Lower Division Clerk and Staff Car Driver Recruitment Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.- These rules shall apply to the post specified in column (1) of the schedule annexed to these rules.
3. Number of posts, classification, pay band and grade pay or pay scale.- The number of said post, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.
4. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the aforesaid Schedule.
5. Disqualification.-No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax .– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of person.
7. Saving .– Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

| Promotion: Lower Division Clerk in pay band 1 with grade pay of Rs. 1900 with eight years regular service in the grade. Note 1.- Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. Power to relax .– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of person.
7. Saving .– Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
