काकाकाका....आआआआ.... 153153153153(अ)(अ)(अ)(अ)....----केन्द्रीय सरकार ने रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 20क की उप-धारा (1) के अधीन भारत के राजपत्र, असाधारण, भाग II, खण्ड 3, उपखण्ड (ii) में प्रकाशित भारत सरकार के रेल मंत्रालय (रेलवे बोर्ड) की अधिसूचना संख्यांक का.आ. 128(अ), तारीख 09 जनवरी 2015 (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) द्वारा उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिंष्ट भूमि को गुजरात राज्य के खेडा जिले में विशेष रेल परियोजना, अर्थात्, वेस्टर्न डेडीकेटेड फ्रेट कोरीडोर के निष्पादन, अनुरक्षण, प्रबंधन, और प्रचालन के लिए अर्जित करने के अपने आशय की घेाषणा की थी;
और उक्त अधिसूचना का सार उक्त अधिनियम की धारा 20क की उप-धारा (4) के अधीन दैनिक समाचार पत्र ''द् टाईम्स ऑफ इण्डिया'' और ''संदेश'' में तारीख 06 मार्च, 2015 को प्रकाशित किया गया था;
और, सक्षम प्राधिकारी द्वारा केाई आक्षेप प्राप्त नहीं किया गया है;
अतः, अब, केन्द्रीय सरकार, सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर और रेल अधिनियम, 1989 की धारा 20 (ङ) की उपधारा (1) द्वारा प्रद्त्त शक्तियों का प्रयोग करते हुए, यह धोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वाेक्त प्रयोजन के लिए अर्जित की जाएगी;
और केन्द्रीय सरकार उक्त अधिनियम की धारा 20(ङ) की उपधारा (2) के अनुसरण में यह और घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशित होने पर इससे उपाबद्व अनुसूची में विनिद्रिष्ट भूमि सभी विल्लंगमों से मुक्त होकर अनन्य रूप से केन्द्रीय सरकार में निहित होगी।

NOTIFICATION
New Delhi, the 18th January, 2016
S.O. 153(E).—Whereas, by the notification of the Government of India, in the Ministry of Railways (Railway Board), number S.O. 128(E), dated the 09th January, 2015 published in Gazette of India Extraordinary. Part II, Section-3, Sub-Section (ii) (hereinafter referred to as the said notification) under sub-section (1) of section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government, has declared its intention to acquire the land specified in the schedule annexed to the said notification for execution, maintenance, management and operation of the Special Railway Project, namely, Western Dedicated Freight Corridor, in the District Kheda in the State of Gujarat;
And whereas, the substance of the said notification was published in daily "The Times of India" and "Sandesh" dated the 06th March, 2015 under sub-section (4) of section 20A of the said Act;
And whereas, no objection has been received by the Competent Authority;
And, whereas, in pursuance of sub-section (1) of section 20E of the said Act, the Competent Authority has submitted its report to the Central Government;
Now, therefore, upon receipt of the said report of the Competent Authority, and in exercise of the power conferred by sub- section (1) of section 20E of the said Act, the Central Government hereby declares that the lands specified in the schedule annexed hereto shall be acquired for the aforesaid purpose;
And further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
