का.आ. 197.—कोयला धारक (cid:6979)े(cid:7074) (अ(िcid:6981)न और र्नकास) अनधननयम, 1957 (1957 का 20) (नसिे इसम(cid:7286) इसके प(cid:7019)चात् उ(cid:6989)त अनधननयम कहा गया है) क(cid:7409) धारा 9 क(cid:7409) उप-धारा (1) के अधीन ािरी भारत के रापि(cid:7074), भाग II, खंड 3, उपखंड (ii), तारीख 11 ूिन, 2015 म(cid:7286) नसिे भारत सरकार के कोयला मं(cid:7074)ालय क(cid:7409) अनधसूचना (cid:7367)ारा का. आ. सं(cid:6990)यांक 1535(अ), तारीख 20 मई, 2015 म(cid:7286) (cid:7079)कानत क(cid:7409) गई ी, उ(cid:6989)त अनधसूचना के (cid:7079)कान पर अनधसूचना से उपाब(cid:7373) अनुसूची म(cid:7286) र्(cid:7414)णत 1020.492 हे(cid:6989)टर (लगभग) या 2521.63 एक (लगभग) माप र्ाली र्(cid:7414)णत भूनम (नसिे इसम(cid:7286) इसके प(cid:7019)चात् उ(cid:6989)त भूनम कहा गया है) और ऐसी भूनम म(cid:7286) या उस पर के सभी अनधकार, उ(cid:6989)त अनधननयम क(cid:7409) धारा 10 क(cid:7409) उप-धारा (1) के अधीन, सभी र्न(cid:7016)लंगम(cid:7298) से मु(cid:6989)त होकर, आ(cid:7004)यंनतक (cid:7272)प म(cid:7286) के (cid:7008)(cid:7076)ीय सरकार म(cid:7286) नननहत हो गए ह(cid:7289);

और, के (cid:7008)(cid:7076)ीय सरकार का यह समाधान हो गया है, (cid:7408)क साउ ई(cid:7021)टन(cid:6981) कोल(cid:7409)(cid:7016)(cid:7001)स नलनमटेड, सीपत रोड, पो(cid:7021)ट बा(cid:6989)स सं(cid:6990)या 60, नलिा नबलासपुर-495006 (नसिे इसम(cid:7286) इसके प(cid:7019)चात् सरकारी कं पनी कहा गया है), ऐसे ननबंधन(cid:7298) और त(cid:7300) का न(िcid:7008)ह(cid:7286) के (cid:7008)(cid:7076)ीय सरकार इस नननम(cid:7004)त अनधरोनपत करना उनचत समझे, अनुपालन करने के नलये रािमंद ह(cid:7289) ;

अत: अब, के (cid:7008)(cid:7076)ीय सरकार, उ(cid:6989)त अनधननयम क(cid:7409) धारा 11 क(cid:7409) उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए, यह ननदे देती है, (cid:7408)क 1020.492 हे(cid:6989)टर (लगभग) या 2521.63 एक (लगभग) उ(cid:6989)त भूनम म(cid:7286) या उस पर के सभी अनधकार के (cid:7008)(cid:7076)ीय सरकार म(cid:7286) इस (cid:7079)कार नननहत बने रहने के बािए, तारीख 11 ूिन, 2015 से नन(cid:7013)ननलनखत ननबंधन(cid:7298) और त(cid:7300) के अधीन रहते (cid:7263)ए, उ(cid:6989)त सरकारी कं पनी म(cid:7286) नननहत हो ािएंगे, अा(cid:6981)त् –

1. सरकारी कं पनी, उ(cid:6989)त अनधननयम के उपबंध(cid:7298) के अधीन या र्अधा(cid:7407)रत (cid:7079)नतकर, (cid:7011)या,ि नुकसाननय(cid:7298) और र्ैसी ही मद(cid:7298) क(cid:7409) बाबत् (cid:7408)कए गए संदाय(cid:7298) क(cid:7409) के (cid:7008)(cid:7076)ीय सरकार को (cid:7079)नतपू(cid:7414)त करेगी ;

3. सरकारी कं पनी, के (cid:7008)(cid:7076)ीय सरकार या उसके पदधा(cid:7407)रय(cid:7298) क(cid:7409), ऐसे (cid:7408)कसी अ(cid:7008)य (cid:7018)यय के संबंध म(cid:7286) (cid:6979)नतपू(cid:7414)त करेगी, ोि इस

(cid:7079)कार नननहत उ(cid:6989)त भूनम म(cid:7286) या उस पर के अनधकार(cid:7298) के बारे म(cid:7286), के (cid:7008)(cid:7076)ीय सरकार या उसके पदधा(cid:7407)रय(cid:7298) (cid:7367)ारा या उनके र्नरु(cid:7373)

(cid:7408)क(cid:7008)ह(cid:7277) काय(cid:6981र्)ानहय(cid:7298) के संबंध म(cid:7286) र्आ(cid:7019)यक हो ;

4. सरकारी कं पनी को के (cid:7008)(cid:7076)ीय सरकार के र्पू(cid:6981) अनुमोदन के नबना उ(cid:6989)त भूनम और इस (cid:7079)कार नननहत उ(cid:6989)त भूनम म(cid:7286) या

उस पर के अनधकार(cid:7298) को (cid:7408)कसी अ(cid:7008)य (cid:7018)यन(cid:6989)त को अंत(cid:7407)रत करने क(cid:7409) न(cid:6989)त नह(cid:7277) होगी ; और

5. सरकारी कं पनी, ऐसे ननदे(cid:7298) और त(cid:7300) का पालन करेगी, ोि के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा, बि कभी र्आ(cid:7019)यक हो, उ(cid:6989)त

भूनम के र्नन(cid:7020)ट (cid:6979)े(cid:7074)(cid:7298) के नलए (cid:7408)दए ािएं या अनधरोनपत (cid:7408)कए ािएं ।

NOTIFICATION

New Delhi, the 18th August, 2015

S.O. 197(E).—Whereas on the publication of the notification of the Government of India in the Ministry of Coal, number S. O. 1535(E), dated the 20th May, 2015, published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 11th June, 2015, issued under sub-section (1) of section 9 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the land measuring 1020.492 hectares (approximately) or 2521.63 acres (approximately) and the all rights in or over the land described in the Schedule appended to the said notification (hereinafter referred to as the said land) are vested absolutely in the Central Government free from all encumbrances under sub-section (1) of section 10 of the said Act;

And whereas the Central Government is satisfied that the South Eastern Coalfields Limited, Seepat Road, Post Box No. 60, District-Bilaspur-495006, (hereinafter referred to as the Government Company) is willing to comply with such terms and conditions as the Central Government thinks fit to impose in this behalf;

Now, therefore, in exercise of the power conferred by sub-section (1) of section 11 of the said Act, the Central Government hereby direct that the 1020.492 hectares (approximately) or 2521.63 acres (approximately) and all rights in or over the said land so vested shall with effect from the 11th June, 2015 instead of continuing to so vest in the Central Government shall vest in the Government Company subject to the following terms and conditions, namely:—

1. The Government Company shall reimburse to the Central Government all payments made in respect of compensation, interest, damages and the like as determined under the provisions of the said Act;

2. A Tribunal shall be constituted under section 14 for the purpose of determining the amounts payable to the Central Government by the Government Company under conditions (1) and all expenditure incurred in connection with any such Tribunal and persons appointed to assist the tribunal shall be borne by the Government Company and similarly, all expenditure incurred in respect of all legal proceedings including appeals for or in connection with the rights in or over the said lands so vesting shall also be borne by the Government Company;

3. The Government Company shall indemnify the Central Government or its officials against any other expenditure that may be necessary in connection with any proceedings by or against the Central Government or its officials regarding the rights in or over the said lands so vested;

4. The Government Company shall have no power to transfer the said lands to any other persons without the prior approval of the Central Government; and

5. The Government Company shall abide by such direction and conditions as may be given or imposed by the Central Government for particular areas of the said lands as and when necessary.
