सासासासा.... काकाकाका.... निनिनिनि.... 97979797(अ)(अ)(अ)(अ)....—नारकोटिक्स औषध एवं मन:प्रभावी पदार्थ नियमावली, 1985 के अनुसरण में, कें ' सरकार एततद्वारा भारत के राजपत्र, असाधारण, भाग-।।, खंड-3, उप-खंड (i) में (एतश्मिन पश्चात् जिसे उक्त अधिसूचना से संबोधित किया जाएगा) प्रकाशित भारत सरकार, वित्त मंत्रालय, राजस्व विभाग की अधिसूचना सं.
सा.का.िन. 757 (अ) दिनांक 5 अक्टूबर, 2015, में निम्निलिखत संशोधन करती है, नामत:-
उक्त अधिसूचना में, पैरा<ाफ 2 में, उप-पैरा<ाफ (vii) में निम्नलिखित को अंत@वष्ट किया जाएगा, यथा:-
''(viii) राजस्थान गांवों के उन किसानों के लिए, जिन्होंने अफीम पोस्त की खेती या तो फसल वर्ष 2013- 14 या फसल वर्ष 2014-15 में की है तथा जिनका आने वाले वर्ष में नामत: 2014-15 या 2015-16 में संगत वर्ष में निर्धारित औसत उपज से कम परिमाण में अफीम पैदा करने के कारण लाइसेंस समाप्त हो गया हो, जैसी-भी स्थिित हो, यदि:-
(क) जिला प्रशासन द्वारा प्राकृ तिक आपदा तथा परिणामी फसल क्षति की रिपोर्ट फसल वर्ष 2013-14 या फसल वर्ष 2014-15 जैसी भी स्थिित हो, की गई थी, तथा
(ख) फसल वर्ष 2013-14 तथा 2014-15 में उस गांव में अफीम की औसत उपज उस गांव में Nमश: फसल वर्ष 2012-13 तथा 2013-14 की औसत उपज से कम थी, तथा
(ग) उस गांव में 50 प्रतिशत से अधिक उन किसानों को जिन्होंने अफीम की खेती फसल वर्ष 2013-14 तथा 2014-15 में की थी Nमश: फसल वर्ष 2014-15 तथा 2015-16 में, लाइसेंस समाप्त हो गया:

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] बशतP कि उस गांव में जहां 10 किसानों से कम किसानों ने, फसल वर्ष 2013-14 या फसल वर्ष 2014-15, जैसी भी स्थिित हो, अफीम की खेती की थी, के उपरोक्त उल्लिखित 50 प्रतिशत के प्रतिशत मानदंड को 30 प्रतिशत के रूप में प्रतिस्थापित किया जाएगा;
उक्त अधिसूचना में, पैरा<ाफ 4 में, उप-पैरा<ाफ (iii) के पश्चात् निम्नलिखित को अंत@वष्ट किया जाएगा, यथा:-
''(iv) पैरा<ाफ 2 के , उप-पैरा<ाफ (vi), (vii) तथा (viii) के तहत सभी पात्र किसानों को 10 एअर के िलए लाइसेंस जारी किया जाएगा''
उक्त अधिसूचना में, पैरा<ाफ 7 में, उप-पैरा<ाफ (v) के पश्चात् निम्नलिखित को अंत@वष्ट किया जाएगा, यथा:-
''(iv) एक किसान, जो कि पैरा 2 के उप-पैरा<ाफ (viii) के तहत लाइसेंस के लिए पात्र बनता है, के पास फसल वर्ष 2015-16 या फसल वर्ष 2016-17 के लिए लाइसेंस लेने का विकल्प होना चािहए।''

NOTIFICATION
New Delhi, the 22nd January, 2016
No. 1/2016-NARCOTICS CONTROL -I
G.S.R. 97(E).— In pursuance of rule 8 of the Narcotic Drugs and Psychotropic Substances Rules, 1985, the Central Government hereby makes following amendment in the Government of India, Ministry of Finance, Department of Revenue, Notification No. G.S.R. 757(E) dated 5th October, 2015 published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) (hereinafter referred to as the said notification), namely:-
1. In the said notification, in paragraph 2, after sub-paragraph (vii), the following shall be inserted, namely:-
"(viii) Cultivators of all those villages in the State of Rajasthan,who cultivated opium poppy either in the crop year 2013-14 or in the crop year 2014-15 and got de-licensed in the subsequent crop year, namely 2014-15 or 2015-16, as the case may be, for tendering opium below the stipulated average yield of the relevant year, if:-
(a) natural calamity and resultant crop damage had been reported by the District Administration in that village in the crop year 2013-14 or in the crop year 2014-15 as the case may be ; and[भाग II—खण्ड 3 (i)] भारत का राजपत्रा : असाधरण 3 (b) the average yield of opium in that village in the crop year 2013-14 and 2014-15 had gone down when compared to the average yield of that village in the crop year 2012-13 and 2013-14 respectively, and
(c) more than 50% of the cultivators in that village who tendered opium in the crop year 2013-14 and 2014-15 got de-licenced in the crop year 2014-15 and 2015-16 respectively:
Provided that in a village where less than 10 cultivators tendered opium in the crop year 2013- 14 or in the crop year 2014-15 , as the case may be, the percentage criteria of 50% mentioned above shall be substituted as 30%.".
2. In the said notification, in paragraph 4, after sub-paragraph (iii), the following shall be inserted, namely:-
"(iv) All eligible cultivators under paragraph 2, sub-paragraphs (vi), (vii) and (viii), shall be issued licence for 10 Ares.".
3. In the said notification, in paragraph 7, after sub-paragraph (v), the following shall be inserted, namely:-
"(vi) A cultivator, who becomes eligible for a licence under sub-paragraph (viii) of para 2, shall have the option to seek licence either in the crop year 2015-16 or in the crop year 2016-17.".
