काकाकाका....आआआआ.... 225(अ225(अ225(अ225(अ))))....--------यतः केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1937 (अ), तारीख 09.08.2010 द्वारा मेघालय राज्य में राष्ट्रीय राजमार्ग संख्या 40 (नया रारा-6) के 0.000 कि.मी. से 61.800 कि.मी. (जोरबाट-षिलांग(बारपानी) सेक्षन) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात्‌ "प्राधिकरण" संदर्भित किया गया है) को सौंपा है;

और यतः, केन्द्रीय सरकार न,े राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 9 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजमार्गों के खण्डों, स्थायी पुलों, बाइपासों और सुरंगों के उपयोग के लिए शुल्क संग्रहण हेतु तारीख 5 दिसम्बर, 2008 की अधिसूचना सं. सा.का.नि. 838, (अ), द्वारा राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 बनाए हैं तथा उनमें अधिसूचना सं. सा.का.नि. 950 (अ), तारीख 3 दिसम्बर, 2010, सा.का.नि. 15 (अ), तारीख 12 जनवरी, 2011, सा.का.नि. 756 (अ), तारीख 12 अक्तूबर, 2011 तथा सा.का.नि. 778 (अ), तारीख 16 दिसम्बर, 2013, सा.का.नि. 26 (अ), तारीख 16 जनवरी, 2014, सा.का. नि. 831 (अ), तारीख 21 नवम्बर, 2014 और सा.का.नि. 220 (अ) 23 मार्च, 2015 द्वारा संषोधन किए हैें;

अतः अब, केन्द्रीय सरकार, समय-समय पर यथासंषोधित राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 (जिसे इसमें इसके पश्चात्‌ "उक्त नियम" संदर्भित किया गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्‌द्वारा सड़क खण्ड की निबल लम्बाई 55.8184 कि.मी. [0.1616 कि.मी. की संरचना (जिसकी लम्बाई 60 मीटर से अधिक) को छोड़कर और समकक्ष लम्बाई 1.616 कि.मी.] के लिए चार लेन के खण्डों के उपयोग हेतु नीचे सारणी 1 के स्तम्भ (1) में विनिर्दिष्ट प्रकार के वाहनों पर सारणी 1 के स्तम्भ (2) में विनिर्दिष्ट आधार दर का 100% पर (जिसे इसमें इसके पश्चात्‌ ''आधार दर" संदर्भित किया गया है) तथा 01 बाइपास जिसकी लम्बाई 5.86 कि.मी. है, नीचे सारणी 1 के स्तम्भ 2 में विनिर्दिष्ट आधार दर के 150% की दर पर असम और मेघालय राज्य में रारा-40 के 0.000 कि.मी. से 61.840* कि.मी. तक जोरबाट-षिलांग (बारापानी) सेक्षन के उपयोग के लिए, शुल्क उद्‌ग्रहीत करती है और प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकर के माध्यम से उक्त शुल्क को संग्रहीत करने हेतु प्राधिकृत करती है, अर्थात्‌ः-

*परियोजना का समापन चैनेज अर्थात्‌ 61.840 कि.मी. अधिसूचना कका.आ. 1937 (अ), तारीख 09.08.2010 द्वारा भाराराप्रा को सौंपे गए रारा का समापन चैनेज के वही अर्थात्‌ 61.800 कि.मी. है।

1. नीचे उद्‌ग्रहीत और संग्रहीत शुल्क निम्नलिखित टोल प्लाजा पर, ऐसे टोल प्लाजा के लिए विनिर्दिष्ट सड़क खण्ड की निवल लम्बाई हेतु, शोध्य और संदेय होगाः

2. उपर्युक्त के अतिरिक्त, 01 बाइपास जिसकी लागत 10 करोड़ रुपए अथवा इससे अधिक है, के उपयोग के लिए निम्नलिखित टोल प्लाजा पर ऐसे टोल प्लाजा के लिए विनिर्दिष्ट बाइपास की कुल लम्बाई हेतु, निम्नलिखित शुल्क भी शोध्य और संदेय होगा।

3. उपर्युक्त के अतिरिक्त, निम्नलिखित संरचनाओं जिनकी लम्बाई 60 मीटर से अधिक है, के उपयोग के लिए भी ऐसी संरचनाओं की लम्बाई को समकरण गुणक 10 से गुणा करके राजमार्ग की समकक्ष लम्बाई्र में परिवर्तित करते हुए, निम्नलिखित टोल प्लाजा (प्लाजाओं) पर निम्नलिखित शुल्क भी शोध्य और संदेय होगाः

*60 मीटर से अधिक की लम्बाई वाली संरचना का ब्यौरा निम्न प्रकार हैः

4. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजी—त हुआ हो और वह टोल प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके लिए वर्ष 2015-16 के लिए मासिक पास की दर 230.00 रुपए (दो सौ तीस रुपए मात्र) होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के प्रावधानों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा।

5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्‌ः

6 जिस जिले में टोल प्लाजा पड़ता है उस जिले में पंजी—त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो।

7.. अधिक भार से लदे हुए यांत्रिक वाहन के चालक अथवा मालिक अथवा प्रभारी व्यक्ति को राष्ट्रीय राजमार्ग पर अधिक भार से लदे हुए ऐसे वाहन के प्रवेष कराने के लिए नियमों के अधीन टोल संग्रहण एजेंसी को यांत्रिक वाहनों की ऐसी श्रेणी के लिए लागू शुल्क के 10 गुना के बराबर शुल्क का भुगतान करना होगा और उसे राजमार्ग खण्ड के उपयोग की अनुमति तब तक नहीं होगी जब तक ऐसे यांत्रिक वाहन पर लदा हुआ अधिक भार हटा नहीं दिया जाता।

8. यांत्रिक वाहनों के श्रेणी, उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं उक्त नियम में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।

9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।

10. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जाने वाले वास्तविक शुल्क और छूट की गणना खण्ड की पूरी कर ली गई लम्बाई के आधार पर प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संषोधन किया जाएगा और तदनुसार उसे अंग्रजी और स्थानीय भाषा के कम-से-कम एक-एक समाचार पत्र में प्रकाषित करवाया जाएगा।

11. परियोजना की अनुमानित पूंजीगत लागत 1372.40 करोड़ रुपए है। (एक हजार तीन सौ बहत्तर करोड़ चालीस लाख रुपए मात्र) है। पूंजीगत लागत परिवर्तन के अध्यधीन है क्योंकि भूमि अधिग्रहण जन-उपयोगी सेवाओं का स्थानांतरण, पेड़ों की कटाई आदि जैसे कार्यकलापों को अभी पूरा किया जाना बाकी है। अंतिम पूंजीगत लागत को अलग-से अधिसूचित किया जाएगा। प्राधिकरण द्वारा उपयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पूंजीगत लागत भी वसूली का रिकार्ड रखा जाएगा और पूंजीगत लागत की वसूली हो जाने के पश्चात्‌, लगाए जाने वाले शुल्क की दरों को घटाकर 40%ः कर दिया जाएगा और उक्त नियमों के अनुसार उसमें वार्षिक तौर पर संषोधन किया जाएगा।

NOTIFICATION

S.O. 225(E).—Whereas by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways number S.O 1937 (E) dated 09.08.2010 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from km 0.000 to km 61.800 (Jorbat-Shillong (Barapani) Section) of National Highway No. 40 (Now NH-6) in the State of Meghalaya to the National Highways Authority of India (hereinafter referred to as the "Authority");

And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide Notification No. G.S.R. 838 (E) dated the 5th December, 2008, and amended vide Notification Nos. G.S.R. 950(E) dated 3rd December, 2010, G.S.R. 15(E) dated 12th January, 2011, G.S.R. 756(E) dated 12th October, 2011 and G.S.R. 778 (E) dated 16th December, 2013, G.S.R. 26(E) dated 16th January, 2014 G.S.R. 831(E) dated4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 21st November, 2014 and G.S.R 220(E) dated 23rd March, 2015 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the "said Rules"), the Central Government hereby levies the fee at 100% of the base rate specified in columns (2) in Table 1 for net road section length of 55.8184 km [excluding 0.1616 Km of structure (having length more than 60 m) with equivalent length of 1.616 km] (hereinafter referred to as "base rate") for use of the four lanning sections on the Type of Vehicles specified in column (1) of Table 1 below and 01 bypass having a length of 5.86 Km. at 150% of the base rates specified in column-2 of Table-1 below for the use of Jorbat-Shillong (Barapani) section of NH-40 from Km. 0.000 to Km. 61.840* in State of Assam and Meghalaya and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:-

*End chainage of the project i.e Km. 61.840 is same as end chainage of the NH entrusted to NHAI i.e Km. 61.800 vide notification S.O 1937(E) dated 09.08.2010.

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza:

2. In addition to above, the following fee shall also be due and payable for the use of the 01 bypass costing Rs 10 crore or more at the following Toll Plaza for net bypass length specified for such Toll Plaza:

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the toll plaza is Rs. 230.00 (Rupees Two Hundred Thirty only) for the year 2015-16 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

11. The estimated capital cost of the project is Rupees 1372.40 Crore (Rupees One thousand three hundred Seventy two crore and forty lakh only). The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
