(4) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का माननच(cid:7074) सीमा के (cid:7011)यौरे और उसके अ(cid:6979)ां और देांतर के सा उपाबंध III के (cid:7272)प म(cid:7286) संल(cid:7336) है ।

2. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आंचनलक महायोनिा – (1) रा(cid:6996)य सरकार, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के (cid:7079)योनि के नलए रापि(cid:7074) म(cid:7286) अंनतम अनधसूचना के (cid:7079)कान क(cid:7409) तारीख से दोर् ष(cid:6981) क(cid:7409) र्अनध के भीतर, (cid:7021)ानीय (cid:7390)न(cid:7334)य(cid:7298) के पराम(cid:6981) से और इस अनधसूचना म(cid:7286) अनुबंध(cid:7298) का पालन करते (cid:7263)ए एक आंचनलक महायोनिा तैयार क(cid:7409) ािएगी।

(2) उ(cid:7334) योनिा का रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा अनुमोदन (cid:7408)कया ािएगा ।

(3) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का आंचनलक महायोनिा रा(cid:6996)य सरकार (cid:7367)ारा ऐसी रीनत से ोि इस अनधसूचना म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट (cid:7408)कया ािए और सुसंगत क(cid:7286) (cid:7076)ीय और रा(cid:6996)य र्ननधय(cid:7298) के और क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा ािरी माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के अनु (cid:7272)प तैयार (cid:7408)कया ािएगा ।

(4) आंचनलक महायोनिा, उसम(cid:7286) पया(cid:6981र्)रणीय और पा(cid:7407)रन(cid:7021)नतक(cid:7409) र्नचारण(cid:7298) को सन(cid:7013)मनलत करने के नलए सभी संबंनधत रा(cid:6996)य र्नभाग(cid:7298) के पराम(cid:6981) से तैयार (cid:7408)कया ािएगा, अा(cid:6981)त्:--

(i) पया(cid:6981र्)रण ;

(ii) र्न ;

(iii) हरी र्नकास ;

(iv) पय(cid:6981)टन ;

(v) नगरपानलक ;

(vi) रा(िcid:7021र्) ;

(vii) कृ नष ;

(viii) छ(cid:7275)ीसग रा(cid:6996)य (cid:7079)दूषण ननयं(cid:7074)ण बोड(cid:6981) ;

(ix) (cid:7410)सचाई; और

(x) लोक ननमा(cid:6981)ण र्नभाग ।

[भाग II—खण्ड 3 (ii)] भारत का राजपत्रा : असाधरण 3

(5) आंचनलक महायोनिा म(cid:7286) बि तक इस अनधसूचना म(cid:7286) ऐसा र्ननन(cid:7416)द(cid:7020)ट न हो तब तक अनुमो(cid:7408)दत र्न(cid:7378)मान भू-उपयोग, र्असंरचना और (cid:7408)(cid:7059)याकलाप(cid:7298) पर कोई ननब(cid:7304)धन अनधरोनपत नह(cid:7277) (cid:7408)कया ािएगा और आंचनलक महायोनिा सभी र्असंरचना के सुधार और अनधक द(cid:6979) ता पा(cid:7407)रन(cid:7021)नतक(cid:7409) अनुकू ल होनेर् ाले (cid:7408)(cid:7059)याकलाप इस (cid:7079)कार र्ननन(cid:7416)द(cid:7020)ट न हो।

(6) आंचनलक महायोनिा म(cid:7286) अना(cid:6994)छा(cid:7408)दत (cid:6979)े(cid:7074)(cid:7298) के ीिण(cid:7299)(cid:7373)ार, र्न(cid:7378)मान लि ननकाय(cid:7298) के संर(cid:6979)ण, र्आाह (cid:6979)े(cid:7074)(cid:7298) के (cid:7079)बंधन, लि-संभर(cid:7298) के (cid:7079)बंधन, भूतल लि के (cid:7079)बंधन, मृदा और नमी संर(cid:6979)ण, (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) र्आ(cid:7019)यकता(cid:7312) ता पा(cid:7407)रन(cid:7021)नतक(cid:7409) और पया(cid:6981र्)रण से संबंनधत ऐसे अ(cid:7008)य पहलु(cid:7312), ननि पर (cid:7007)यान देना र्आ(cid:7019)यक है, के नलए उपबंध ह(cid:7298)गे ।

(7) आंचनलक महायोनिा सभी र्न(cid:7378)मान पूाि (cid:7021)ल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोब(cid:7021)त(cid:7298), र्न(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021)म(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), ऊपािऊ भूनम, ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021)ान, उ(cid:7378)ान कृ नष (cid:6979)े(cid:7074), आ(cid:7416)कड(cid:7298), झील(cid:7298) और अ(cid:7008)य लि ननकाय(cid:7298) का अ(cid:7012)यकं न करेगी ।

(8) आंचनलक महायोनिा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) र्नकास को र्नननयनमत करेगी नसिसे पा(cid:7407)रन(cid:7021)नतक(cid:7409) अनुकू ल र्नकास (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409)र् ीिकोपा(िcid:6981)न सुर(cid:6979)ा के नलए सुननन(cid:7019)चत (cid:7408)कया ाि सके ।

3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए ािने र्ाले उपाय- रा(cid:6996)य सरकार इस अनधसूचना के उपबंध(cid:7298) को (cid:7079)र्भाी करने के नलए नन(cid:7388)नलनखत उपाय करेगी, अा(cid:6981)त् :--

(1) भू-उपयोग - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286)र् न(cid:7298), उ(cid:7378)ान-कृ नष (cid:6979)े(cid:7074)(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योनि के नलए नचन(cid:7008)हत (cid:7408)कए गए पाक(cid:7300) और खुले (cid:7021)ान(cid:7298) कार् ानणन(cid:6996)यक और औ(cid:7378)ोनगक संब(cid:7373) र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए उपयोग या संप(cid:7407)र्रत(cid:6981)न नह(cid:7277) होगा :

परंतु पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर कृ नष भूनम का संप(cid:7407)र्रत(cid:6981)न, मानीटरी सनमनत क(cid:7409) नसा(cid:7407)र पर और रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन से, (cid:7021)ानीय नर्नानसय(cid:7298) क(cid:7409) र्आासीय (िcid:7272)रत(cid:7298) को पूरा करने के नलए और पैरा 4 क(cid:7409) सारणी के (cid:7021)तंभ (2) के अधीन (cid:7059)म सं. 11, 17, 23, 28 और सं. 31 के सामने सूचीब(cid:7373) (cid:7408)(cid:7059)याकलाप(cid:7298) को पूरा करने के नलए अनु(cid:6980)ात ह(cid:7298)गे, अा(cid:6981)त् :-

(i) पा(cid:7407)रन(cid:7021)नतक(cid:7409)य अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए, पय(cid:6981)टक(cid:7298) के अ(cid:7021)ायी अनधभोग के नलए पा(cid:7407)रन(cid:7021)नतक(cid:7409) अनुकू ल कु टीर ैिसे टे(cid:7008)ट, का(cid:7397) गृह ;

(ii) र्न(cid:7378)मान सक(cid:7298) को चौा ता मबिूत करना ;

(iii) (cid:7079)दूषण उ(cid:7004)प(cid:7382) न करनेर् ाले लघु उ(cid:7378)ोग ;

(iv) र्षा(cid:6981) लि संचयन; और

(v) कु टीर उ(cid:7378)ोग, नसिके अंतग(cid:6981)त (cid:7061)ामीण उ(cid:7378)ोग, सुर्नधानिक भंडार और (cid:7021)ानीय सुख-सुर्नधाएं भी ह(cid:7289) ।

परंतु यह और (cid:7408)क रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन और संर्नधान के अनु(cid:6994)छेद 244 या त(cid:7004)समय (cid:7079र्)ृ(cid:7275) र्ननध के उपबंध(cid:7298) के अनुपालन के नबना, नसिके अंतग(cid:6981)त अनुसूनचत निािनत और अ(cid:7008)य परंपरागत र्न नर्नासी र्(न अनधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अनधननयम, 2006 (2007 का 2) भी है,र् ानणन(cid:6996)यक या उ(cid:7378)ोग र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए निाितीय भूनम का उपयोग अनु(cid:6980)ात नह(cid:7277) होगा :

परंतु यह और भी (cid:7408)क पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर भू-अनभलेख(cid:7298) म(cid:7286) (cid:7079)तीत होने र्ाली कोई (cid:7074)ु(cid:7407)ट, मानीटरी सनमनत के र्नचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)येक मामले म(cid:7286) एक बार संोनधत होगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संोधन क(cid:7409) क(cid:7286) (cid:7076) सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय को सूचना देनी होगी:

परंतु यह और भी (cid:7408)क उपयु (cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट के संोधन म(cid:7286) इस उप पैरा के अधीन या उपबंनधत के नर्साय (cid:7408)कसी भी दा म(cid:7286) भू-उपयोग का प(cid:7407)र्रत(cid:6981)न सन(cid:7013)मनलत नह(cid:7277) होगा:

परंतु यह और भी (cid:7408)क ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसेर् न (cid:6979)े(cid:7074), कृ नष (cid:6979)े(cid:7074) आ(cid:7408)द म(cid:7286) कोई पा(cid:7407)रणानमक कटौती नह(cid:7277) होगी और अ(cid:7079)यु(cid:6989)त या अनु(cid:7004)पादक कृ नष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) र्नर्गां नागीिरा टाइगर (cid:7407)र्र(िcid:6981) क(cid:7409) बर आंचनलक (cid:7079)बंधन योनिा के अनुसार पुन:र् नीकरण करने के (cid:7079)यास (cid:7408)कए ािएंगे ।

(2) (cid:7079)ाकृ नतक लि-(cid:7090)ोत -- आंचनलक महायोनिा म(cid:7286) सभी (cid:7079)ाकृ नतक (cid:7090)ोत(cid:7298) के र्आाह (cid:6979)े(cid:7074)(cid:7298) क(cid:7409) पहचान क(cid:7409) ािएगी और उनके संर(cid:6979)ण और र्नीकरण के नलए योनिा सन(cid:7013)मनलत होगी और रा(cid:6996)य सरकार (cid:7367)ारा इन (cid:6979)े(cid:7074)(cid:7298) पर या उनके ननकट र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298), ोि ऐसे (cid:6979)े(cid:7074)(cid:7298) के नलए हाननकारक ह(cid:7289), को (cid:7079)नतनष(cid:7373) करने के नलए ऐसी रीनत से माग(cid:6981)ननद(cid:7287) तैयार (cid:7408)कए ािएंगे ।

(3) पय(cid:6981)टन – (क) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप, के अनुसार ह(cid:7298)गे, ोि आंचनलक महायोनिा, आंचनलक महायोनिा का भाग ह(cid:7298)गे ।

(ख) पय(cid:6981)टन महायोनिा पय(cid:6981)टन र्नभाग, रा(cid:6996)य सरकार के र् न और पया(cid:6981र्)रण र्नभाग, के पराम(cid:6981) से तैयार होगी ।

(ग) पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप नन(cid:7013)ननलनखत के अधीन र्नननयनमत ह(cid:7298)गे, अा(cid:6981)त् :-

S. O. 252(E).— The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

Draft Notification

WHEREAS, Pamed Wildlife Sanctuary situated in District Bizapur, Chhattisgarh and spread over an area of 442.230 Sq. km. is known for its rich habitat of varieties of flora and fauna including Baison, Leopard, Nilgai, Sambhar, Kotari, Wildboar, Wild dog, Wild Cat, Peacock, Langur, Macaque Monkey, Chital, Bear with tropical moist mixed deciduous forest, tropical dry deciduous forest, mixed forest with and without Teak, dry evergreen forest, aquatic vegetation. The sanctuary also provides an extension of habitat to Indrawati Tiger Reserve.

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Pamed Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone.

NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of 1 km all around the boundary of Pamed Wildlife Sanctuary in the State of Chhattisgarh as the Pamed Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.

(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 11, 17, 23, 28 and 31 in column (2) of the Table in paragraph 4, namely:-

(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities;

(ii) widening and strengthening of existing roads;

(iii) small scale industries not causing pollution;

(iv) rainwater harvesting; and

(v) cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government.

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Pamed Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of final notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Chhattisgarh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.

(7) Air pollution.- The Environment Department of the State Government or Chhattisgarh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forest vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Competent Authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial units.-

(a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the Law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco- sensitive Zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:—

1.	Commercial mining, stone quarrying and crushing units.	(a) All new and existing mining (minor and major minerals), stone quarrying and crushing units are prohibited except for the domestic needs of bona fide local residents with reference to digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing for personal use. (b) The mining operations shall strictly be in accordance with the orders of the Hon'ble Supreme Court dated 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No. 202 of 1995 and order of the Hon'ble Supreme Court dated 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.
2.	Setting up of saw mills.	No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3.	Setting up of industries causing water or air or soil or noise pollution.	No new or expansion of polluting industries in the Eco- sensitive Zone shall be permitted.
4.	Commercial use of firewood.	Prohibited (except as otherwise provided) as per applicable laws.
5.	Establishment of new major hydroelectric projects and irrigation projects.	Prohibited (except as otherwise provided) as per applicable laws.
6.	Use or production of any hazardous substances including pesticides and insecticides.	Prohibited (except as otherwise provided) as per applicable laws.
7.	Discharge of untreated effluents and solid waste in natural water bodies or land area.	Prohibited (except as otherwise provided) as per applicable laws.
8.	Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons.	Prohibited (except as otherwise provided) as per applicable laws.
9	New wood based industry.	No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone: Provided the existing wood-based industry may continue as per law: Provided further that renewal of licenses of existing saw mills shall not be done on their expiry period.
Regulated activities
10.	Use of plastic carry bags, laminates and tetra packs.
11.	Establishment of hotels and resorts.	No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities.
12.	Construction activities.	(a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the protected area: Provided that, local people shall be permitted to undertake construction in land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3; (b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any; (c) Construction activity in the Eco-sensitive Zone shall be as per Zonal Master Plan.
13.	Felling of trees.	(a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government; (b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed.
14.	Commercial water resources including ground water harvesting.	(a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land; (b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority; (c) no sale of surface water or ground water shall be permitted; (d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture.
15.	Erection of electrical cables, transmission lines and telecommunication towers.	(i) The existing overhead electric cables shall be insulated within a specified period as per the Zonal Master Plan. In future, underground cabling shall be promoted.
16.	Fencing of existing premises of hotels and lodges.	Regulated under applicable laws.
17.	Widening and strengthening of existing roads.	Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.
18.	Movement of vehicular traffic at night.	Regulated for commercial purpose, under applicable laws.
19.	Introduction of exotic species.	Regulated under applicable laws.
20.	Protection of hill slopes and river banks.	Regulated under applicable laws.
21.	Discharge of treated effluents in natural water bodies or land area and disposal of solid waste.	Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
22.	Commercial sign boards and hoardings.	Regulated under applicable laws.
23.	Small scale industries not causing pollution.	Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods
		from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
24.	Collection of Forest produce or Non- Timber Forest Produce (NTFP).	Regulated under applicable laws.
25.	Air and vehicular pollution.	Regulated under applicable laws.
26.	Drastic change of agriculture systems.	Regulated under applicable laws.
Promoted activities
27.	Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.	Permitted under applicable laws.
28.	Rain water harvesting.	Shall be actively promoted.
29.	Organic farming.	Shall be actively promoted.
30.	Adoption of green technology for all activities.	Shall be actively promoted.
31.	Cottage industries including village artisans.	Shall be actively promoted.
32.	Use of renewable energy sources.	Bio gas, solar light etc to be promoted.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone falling in the State of Chhattisgarh, which shall comprise of the following namely:—

a           Divisional Commissioner, Jagdalpur                             —Chairman
b          Collector, District Bijapur                                     —Member
c          Deputy. Director, Indravati National Park, Bijapur              —Member
d          Chief Executive Officer, District Panchayat, Bijapur            —Member
e          Superintendent  Engineer Public Works Department, Jagdalpur     —Member
f          Superintendent  Engineer Public Health Engineering, Jagdalpur   —Member
g          One expert in the area of ecology and environment to be         —Member
           nominated by the Government of Chhattisgarh for a period of one
           year in each case.
h          Representative of Non-Governmental Organisation working in      —Member
           the field of natural conservation (including heritage conservation)
           to be nominated by the Government of Chhattisgarh for a period
           of one year in each case.
i          Representative of the Town and Country Planning Department      —Member
j          Representative of Chhattisgarh Pollution Control Board          —Member
k          Chief Conservator of Forest (Wildlife) and Project Director,    —Member -Secretary
           Indrawati National Park,  Jagdalpur

6. Terms of Reference:

(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(4) The Member-Secretary of the Monitoring Committee or the concerned collector or the concerned Park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV.

(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal
