1. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का र्न(cid:7021)तार और उसक(cid:7409) सीमाएं--(1) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन ने(cid:7016)लाप(cid:6999)टू प(cid:6979)ी अभयार(cid:7003)य क(cid:7409) सीमा से 2 (cid:7408)कलोमीटर तक के (cid:6979)े(cid:7074) म(cid:7286) ै ला (cid:7263)आ है और इसमे आं(cid:7077) (cid:7079)दे के ने(cid:7016)लौर नलिे के कु छ (cid:7061)ाम ानमल है ।
(2) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन क(cid:7409) सीमा का र्र्नरण उपाबंध – I के (cid:7271)प म(cid:7286) उपाब(cid:7373) है और (cid:7061)ाम(cid:7298) क(cid:7409) सूची उपाबंध-II म(cid:7286) दी गई है ।
(3) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का माननच(cid:7074) अ(cid:6979)ां और देा(cid:7008)तर के सा उपाबंध III के (cid:7272)प म(cid:7286) उपाब(cid:7373) है ।
2. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आंचनलक महायोनिा (1) रा(cid:6996)य सरकार, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए रापि(cid:7074) म(cid:7286) अंनतम अनधसूचना के (cid:7079)कान क(cid:7409) तारीख से दोर् ष(cid:6981) क(cid:7409) र्अनध के भीतर, (cid:7021)ानीय (cid:7390)न(cid:7334)य(cid:7298) के पराम(cid:6981) से और इस अनधसूचना म(cid:7286) संल(cid:6991)न अनुबंध(cid:7298) के सामं(िcid:7021)य से आंचनलक महायोनिा तैयार करेगी ।
(2) आचंनलक महायोनिा रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा अनुमो(cid:7408)दत होगी ।
(3) रा(cid:6996)य सरकार (cid:7367)ारा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आचंनलक महायोनिा इस तरह, इस अनधसूचना म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट (cid:7272)प ता सुसंगत क(cid:7286) (cid:7076)ीय और रा(cid:6996)य र्ननधय(cid:7298) के सामं(िcid:7021)य और क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा ािरी माग(cid:6981)ननद(cid:7287)(cid:7298), य(cid:7408)द कोई ह(cid:7298), (cid:7367)ारा तैयार होगी ।
(4)आंचनलक महायोनिा, पया(cid:6981र्)रणीय और पा(cid:7407)रन(cid:7021)नतक(cid:7409)य र्नचार(cid:7298) को समाकनलत करने के नलए रा(cid:6996)य सरकार के सभी संब(cid:7373) र्नभाग(cid:7298) के पराम(cid:6981) से तैयार होगी, अा(cid:6981)त्:--
(i) पया(cid:6981र्)रण;
(ii)र् न;
(iii) नगर र्नकास;
(iv) पय(cid:6981)टन;
(v) नगरपानलक;
(vi) रा(िcid:7021र्);
(vii) कृ नष;
(viii) रा(cid:6996)य (cid:7079)दूषण ननयं(cid:7074)ण बोड(cid:6981);
(ix) (cid:7410)सचाई; और
(x) लोक ननमा(cid:6981)ण र्नभाग,भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 3 (5) महायोनिा अनुमो(cid:7408)दत र्न(cid:7378)मान भू-उपयोग, र्असंरचना(cid:7004)मक और (cid:7408)(cid:7059)याकलाप(cid:7298) पर कोई ननब(cid:7304)धन अनधरोनपत नह(cid:7277) करेगी बि तक (cid:7408)क इस अनधसूचना म(cid:7286) र्ननन(cid:7416)द(cid:7397) न ह(cid:7298) और आचंनलक महायोनिा म(cid:7286) सभी र्असंरचना (cid:7408)(cid:7059)याकलाप(cid:7298) म(cid:7286) द(cid:6979)ता और पा(cid:7407)रन(cid:7021)नतक अनुकू लता का र्संध(cid:6981)न करेगी ।
(6) आंचनलक महायोनिा म(cid:7286) अना(cid:6994)छा(cid:7408)दत (cid:6979)े(cid:7074)(cid:7298) के ीिण(cid:7299)(cid:7373)ार, र्न(cid:7378)मान लि ननकाय(cid:7298) के संर(cid:6979)ण, र्आाह (cid:6979)े(cid:7074)(cid:7298) के (cid:7079)बंधन, लि-संभर(cid:7298) के (cid:7079)बंधन, भूतल लि के (cid:7079)बंधन, मृदा और नमी संर(cid:6979)ण, (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) र्आ(cid:7019)यकता(cid:7312) ता पा(cid:7407)रन(cid:7021)नतक और पया(cid:6981र्)रण से संबंनधत ऐसे अ(cid:7008)य पहलू(cid:7312), ननि पर (cid:7007)यान देना र्आ(cid:7019)यक है, के नलए उपबंध ह(cid:7298)गे ।
(7) आंचनलक महायोनिा सभी र्न(cid:7378)मान र्एं (cid:7079)(cid:7021)तार्नत पूाि (cid:7021)ल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोब(cid:7021)त(cid:7298),र् न(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021)म(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), ऊपािऊ भूनम, ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021)ान, उ(cid:7378)ान कृ नष (cid:6979)े(cid:7074), आ(cid:7416)कड(cid:7298), झील(cid:7298) और अ(cid:7008)य लि ननकाय(cid:7298) का अ(cid:7012)यकं न करेगी ।
(8) आंचनलक महायोनिा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) र्नकास को पा(cid:7407)रन(cid:7021)नतक अनुकू ल र्नकास और (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) ीिर्कोपा(िcid:6981)न को सुननन(cid:7019)चत करते (cid:7263)ए र्नननयनमत होगी ।
3. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए ािने र्ाले उपाय-- रा(cid:6996)य सरकार इस अनधसूचना के उपबंध(cid:7298) को (cid:7079)र्भाी करने के नलए नन(cid:7388)नलनखत उपाय करेगी, अा(cid:6981)त् :--
(1) भू-उपयोग - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286)र् न(cid:7298), उ(cid:7378)ान-कृ नष (cid:6979)े(cid:7074)(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योनि के नलए नचन(cid:7008)हत (cid:7408)कए गए पाक(cid:7300) और खुले (cid:7021)ान(cid:7298) कार् ानणन(cid:6996)यक और औ(cid:7378)ोनगक संब(cid:7373) र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए उपयोग या संप(cid:7407)र्रत(cid:6981)न नह(cid:7277) होगा :
परंतु पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर कृ नष भूनम का संप(cid:7407)र्रत(cid:6981)न, मानीटरी सनमनत क(cid:7409) नसा(cid:7407)र पर और रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन से, (cid:7021)ानीय नर्नानसय(cid:7298) क(cid:7409) र्आासीय (िcid:7272)रत(cid:7298) को पूरा करने के नलए और पैरा 4 क(cid:7409) सारणी के (cid:7021)तंभ (2) के अधीन मद सं 12, 18, 24, 30 और सं. 33 के सामने सूचीब(cid:7373) (cid:7408)(cid:7059)याकलाप(cid:7298) को पूरा करने के नलए अनु(cid:6980)ात ह(cid:7298)गे, अा(cid:6981)त् :-
(i) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) से संबंनधत पय(cid:6981)टक(cid:7298) के अ(cid:7021)ायी अनधभोग के नलए नलए पा(cid:7407)रन(cid:7021)नतक अनुकू ल कु टीर ैिसे ट(cid:7289)ट, लकी के मकान आ(cid:7408)द ।
(ii) र्न(cid:7378)मान सक(cid:7298) को चौा करना और उ(cid:7008)ह(cid:7286) सुदृढ करना,
(iii) (cid:7079)दूषण उ(cid:7004)प(cid:7382) न करनेर् ाले लघु उ(cid:7378)ोग,
(iv)र् षा(cid:6981) लि संचय, और
(v) कु टीर उ(cid:7378)ोग(cid:7298) म(cid:7286) (cid:7061)ाम उ(cid:7378)ोग, भंडारण क(cid:7409) सुर्नधा और (cid:7021)ानीय सुख-सुर्नधाएं सन(cid:7013)मनलत ह(cid:7289) ::
परंतु यह और भी (cid:7408)क रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन ता संर्नधान के अनु(cid:6994)छेद 244 और त(cid:7004)समय (cid:7079र्)ृ(cid:7275) र्ननध के उपबंध(cid:7298) के अनुपालन के नबना, नसिके अंतग(cid:6981)त अनुसूनचत निािनत और अ(cid:7008)य परंपरागत र्न नर्नासी र्(न अनधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अनधननयम, 2006 (2007 का 2) भी है,र् ानणन(cid:6996)यक या उ(cid:7378)ोग र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए निाितीय भूनम का उपयोग अनु(cid:6980)ात नह(cid:7277) होगा :
परंतु यह और भी (cid:7408)क पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर भू-अनभलेख(cid:7298) म(cid:7286) उपसंाित कोई (cid:7074)ु(cid:7407)ट मानीटरी सनमनत के र्नचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)येक मामले म(cid:7286) संोनधत होगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संोधन क(cid:7409) के (cid:7008)(cid:7076)ीय सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय को सूचना देनी होगी ।
परंतु यह और भी (cid:7408)क उपयु (cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संोधन म(cid:7286) इस उप पैरा के अधीन या उपबंनधत के नर्साय (cid:7408)कसी भी दा म(cid:7286) भू-उपयोग का प(cid:7407)र्रत(cid:6981)न सन(cid:7013)मनलत नह(cid:7277) होगा :
परंतु यह और भी (cid:7408)क नसिसे ह(cid:7407)रत (cid:6979)े(cid:7074) म(cid:7286) ैिसे र्न (cid:6979)े(cid:7074), कृ नष (cid:6979)े(cid:7074) म(cid:7286) कोई पा(cid:7407)रणानमक कटौती नह(cid:7277) होगी और अन(cid:7079)यु(cid:6989)त या अनु(cid:7004)पादक कृ नष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पुन:र् नीकरण करने के (cid:7079)यास (cid:7408)कए ािएंगे ।
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)](2) (cid:7079)ाकृ नतक लि (cid:7090)ोत -- आचंनलक महायोनिा म(cid:7286) सभी (cid:7079)ाकृ नतक लि (cid:7090)ोत(cid:7298) क(cid:7409) पहचान क(cid:7409) ािएगी और उनके संर(cid:6979)ण और पुनन(cid:6981र्)ीकरण के नलए योनिा को सन(cid:7013)मनलत (cid:7408)कया ािएगा और रा(cid:6996)य सरकार (cid:7367)ारा ऐसी रीनत से माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत बनाए ािएंगे नसिसे (cid:7408)क उन (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) या इसके समीप र्नकास (cid:7408)(cid:7059)याकलाप को रोका ाि सके ोि ऐसे (cid:6979)े(cid:7074) के नलए हाननकारक ह(cid:7289) ।
(3) पय(cid:6981)टन – (क) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप, ोि पय(cid:6981)टन महायोनिा के अनुसार ह(cid:7298)गे, आंचनलक महायोनिा का भाग (cid:7272)प म(cid:7286) ह(cid:7298)गे ।
(ख) पय(cid:6981)टन महायोनिा पय(cid:6981)टन र्नभाग, (cid:7367)ारा आ(cid:7008)(cid:7077) (cid:7079)दे रा(cid:6996)य सरकार के र्न और पया(cid:6981र्)रण र्नभाग के पराम(cid:6981) से तैयार होगी ।
(ग) पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप नन(cid:7013)ननलनखत के अधीन र्नननयनमत ह(cid:7298)गे, अा(cid:6981)त् :-
(i) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर सभी नए पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) या र्न(cid:7378)मान पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) का र्न(cid:7021)तार के (cid:7008)(cid:7076)ीय सरकार के पया(cid:6981र्)रण,र् न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय के माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के (cid:7367)ारा ता रा(cid:7020)(cid:7069)ीय (cid:7018)या(cid:7062) संर(cid:6979)ण (cid:7079)ानधकरण के पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन माग(cid:6981)द(cid:6981)क (cid:7367)ारा ािरी (समय-समय पर या संोनधत) नस(cid:7373)ांत(cid:7298) के अनुसार, पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन, पा(cid:7407)रन(cid:7021)नतक न(cid:6979)ा और पा(cid:7407)रन(cid:7021)नतक र्नकास को मह(cid:7004र्) देते (cid:7263)ए पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन क(cid:7409)र् हन (cid:6979)मता के अ(cid:7007)ययन पर आधा(cid:7407)रत होगा;
(ii) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टक (cid:7408)(cid:7059)याकलाप(cid:7298) के संबंध म(cid:7286) अ(cid:7021)ायी अनधभोग के नलए र्ास सुर्नधा के नर्साय नेलाप(cid:6999)टू प(cid:6979)ी अभयार(cid:7003)य क(cid:7409) सीमा से एक (cid:7408)कलोमीटर भीतर होटल और (cid:7407)रसोट(cid:7300) का नया संननमा(cid:6981)ण अनु(cid:6980)ात नह(cid:7277) होगा;

S.O.250(E).— The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

Draft Notification
WHEREAS, Nelapattu Bird Sanctuary is situated in Nelapattu Villlage of Doravarisatram Mandal in Nellore District of Andhra Pradesh and has an area of about 458.92 hectare and it is situated between Latitude 13°51' to 13°59' North, longitude 79° 57' to 79° 59' East;
AND WHEREAS, the said Sanctuary is a heaven for a wide variety of bird species for both breeding and roosting purpose and it is one of the largest Pelicanry in South – East Asia;
AND WHEREAS, many winter migratory birds visit this sanctuary and it is a breeding ground for some of the rare and endangered species like Grey Pelican, Open Bill Stork, Little Cormorant, Spoon bill, White ibis, Night heron etc;
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification up to two kilometers from the boundary of the Protected area of Nelapattu Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or and their operations and processes in the said Eco-sensitive Zone;
Now therefore, in exercise of the powers conferred by sub-section (1) and with clauses (v) and (xiv) of sub– section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of upto two kilometer from the boundary of Nelapattu Bird Sanctuary in the State of Andhra Pradesh as the Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundary of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies up to two kilometers from the boundary of Nelapattu Bird Sanctuary and includes certain villages in Nellore District of Andhra Pradesh.
(2) The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II.
(3) The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended as Annexure III;
2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 13(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments for integrating environmental and ecological considerations into it, including the following State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department;
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification; and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 18, 24, 30 and 33 in column (2) of the Table in paragraph 4, namely:-
(i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities;
(ii) Widening and strengthening of existing roads;
(iii) Small scale industries not causing pollution;
(iv) Rainwater harvesting; and
(v) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, including forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan;
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment, Government of Government of Andhra Pradesh.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority from time to time, with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Nelapattu Bird Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities;
Provided that, beyond the distance of one kilometer from the boundary of the protected areas upto the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre- defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of final notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.
(7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 15(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time.
(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial units.- (a) no establishment of new wood based industries within the proposed Eco-sensitive Zone, this shall be apply to the existing legal wood based industries;
(b) no establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for
effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-
(a) District Collector, Nellore – Chairman
(b) One representative of Non Governmental Organisation working in the field of environment to be
nominated by the Government of Andhra Pradesh for a term of one year in each case – Member
(c) One expert in the area of ecology and environment to be nominated by the Government of Andhra
Pradesh for a term of one year in each case – Member
(d) Regional Officer, State Pollution Control Board – Member.
(e) Representative of Revenue Divisional Officer, Gudur. – Member.
(f) Divisional Forest Officer, Wildlife Management Division,
Sullurpet. – Member.
(g) Deputy Conservator of Forests (Territorial), Nellore – Member-Secretary.
6. Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
(3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the concerned collector or the concerned Park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 19(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per proforma appended at Annexure IV.
(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal.

Boundary description of Eco-Sensitive Zone:
North: - Eco- Sensitive Zone boundary around 2 Kilometre of Nelapattu Bird Sanctuary boundary starts at 101 Kilometre stone of Railway line which is station 1 and proceeds towards North east direction and touches at station No.2. Thence the line runs towards easterly direction and crosses the Northern point of Nelaballi RF and joins at station No.3. Thence the line runs towards easterly direction and joins at station No. 4. Thence the line runs towards easterly direction and joins at western boundary of pudur RF which is station No.5.
East: - Thence the line proceeds towards South East direction and crosses the Pudur RF and joins at Western boundary of Kallur RF which is Station No 6. Then the line proceeds towards southern direction with in the Western boundary of Kalluru RF and joins at Station No 7. Then the line runs towards southern direction along the Western boundary of Kalluru RF and joins at station No 8. Then the line runs towards South west direction crosses. The Kalluru RF and joins at Blacktop Road which is station No.9. From there the line proceeds towards southern direction and touches at station No.10
South: Thence Line precedes towards Western direction crosses the Railway line at 94.3 Kilometre and joins at station No.11.Then the line proceeds towards western direction and joins at station No12 near NH5. Then the line runs towards North West direction crosses the NH 5 at 91.7 Kilometre and joins at Irrigation tank of Kuppareddy Palem Village which is Station No.13.
West:- Thence the line proceeds towards North west direction and joins at station No 14. From there the line proceeds towards North West direction and joins at station No 15 in Ekollu RF. Then the line proceeds towards northerly direction and joins at station No.16 in the Rosanur protected Forest. From there, the line proceeds towards North East direction and crosses the Railway line at 101 km. stone and joins at station 1, which is closed station.
