का.आ. 3571(अ).—केन्द्रीय सरकार ने रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 20क की उप-धारा (1) के अधीन भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ंii) में प्रकाशित भारत सरकार के रेल मंत्रालय की अधिसूचना संख्या का.आ. 2881(अ) तारीख 06 सितम्बर, 2016 (जिसे इसमें इसके पश्चात्‌ उक्त अधिसूचना कहा गया है), द्वारा उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को; उत्तर प्रदेश राज्य के इटावा जिले में ईस्टर्न डेडीकेटेड फ्रेट कॉरिडोर के विशेष रेल परियोजना के निष्पादन, रख-रखाव, प्रबंध और प्रचालन के लिए लोक प्रयोजन हेतु अर्जित करने के अपने आशय की घोषणा की थी;

उक्त अधिसूचना का सारांश उक्त अधिनियम की धारा 20क की उप-धारा (4) के अधीन तारीख 20 सितम्बर, 2016 के अमर उजाला और हिन्दुस्तान दोनो में प्रकाशित किया गया था;

और, सक्षम प्राधिकारी को कोई आक्षेप प्राप्त नहीं हुआ है;

और, उक्त अधिनियम की धारा 20ङ की उपधारा (1) के अनुसरण में, सक्षम प्राधिकारी ने अपनी रिपोर्ट केन्द्रीय सरकार को प्रस्तुत कर दी है;

अतः अब, केन्द्रीय सरकार, सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम की धारा 20ङ की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी;

और, यह कि केन्द्रीय सरकार, उक्त अधिनियम की धारा 20ङ की उप-धारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशित होने पर इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर अनन्य रूप से केन्द्रीय सरकार में निहित हो जाएगी। 5477 GI/2016 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अनुसूची उत्तर प्रदेश राज्य में प्रस्तावित विशेष रेलवे परियोजना ईस्टर्न डेडीकेटेड फ्रेट कॉरिडोर के लिये जनपद-इटावा के अन्दर संरचना या उसके बिना आने वाली भूमि का संक्षिप्त विवरण।

NOTIFICATION

New Delhi, the 24th November, 2016

S.O. 3571(E).—Whereas, by the notification of the Government of India in the Ministry of Railways (Railway Board), number, S.O. 2881(E) dated the 06th September 2016 published in Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (ii) (hereinafter referred to as the said notification) under sub-section (1) Section 20A of the Railways Act, 1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government, declared its intention to acquire the land specified in the schedule annexed to the said notification for execution, maintenance, management and operation of Special Railway Project Eastern Dedicated Freight Corridor, in the District of Etawah, in the State of Uttar Pradesh.

And whereas, the substance of the said notification was published in Amar Ujala and Hindustan, both dated the 20.09.2016 under sub-section (4) of section 20A of the said Act;

And whereas, no objection has been received by the competent authority;

And whereas, in pursuance of sub-section (1) of section 20E of the said Act, the competent authority has submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority, and in exercise of the powers conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the lands specified in the schedule annexed hereto shall be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
