सा.का.नन. 1112(अ).—कनतपय ननयम(cid:7298) का नन(cid:7388)नलनखत (cid:7079)ा(cid:7272)प नसिम(cid:7286) क(cid:7286) (cid:7076)ीय सरकार, र्ायुयान अनधननयम, 1934 (1934 का 22) क(cid:7409) धारा-5 के (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)एर् ायुयान ननयम, 1937 म(cid:7286) और संोधन करने का (cid:7079)(cid:7021)र्ता करती है, नसिे उ(cid:7334) अनधननयम क(cid:7409) धारा-14 क(cid:7409) अपे(cid:6979)ानुसार ऐसे (cid:7390)न(cid:7334)य(cid:7298) क(cid:7409) ािनकारी के नलए, ननिके उनसे (cid:7079)भार्नत होने क(cid:7409) संर्भाना है, (cid:7079)कानत (cid:7408)कया ािता है और एत(cid:7375)ारा सूचना दी ािती है (cid:7408)क भारत के रापि(cid:7074) म(cid:7286) (cid:7079)कानत अनधसूचना क(cid:7409) (cid:7079)नतय(cid:7298) को र्सा(cid:6981)निनक (cid:7272)प से उपल(cid:7011)ध कराए ािने क(cid:7409) तारीख से तीस (cid:7408)दन क(cid:7409) र्अनध के प(cid:7391)ात उ(cid:7334) (cid:7079)ा(cid:7272)प पर र्नचार (cid:7408)कया ािएगा;

1. (1) इन ननयम(cid:7298) का संन(cid:6979)(cid:7385) नामर् ायुयान (.......संोधन) ननयम, 2016 है।
(2) ये सरकारी रापि(cid:7074) म(cid:7286) अंनतम (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7275) ह(cid:7298)गे।
2. र्ायुयान ननयम, 1937 क(cid:7409) अनुसूची XI म(cid:7286),-

(3) आरंनभक आ(cid:6979)ेप न होने का (cid:7079)माण प(cid:7074) (cid:7079)दान करने के नलए, क(cid:7286) (cid:7076)ीय सरकार र्आेदक क(cid:7409) ठोस र्न(cid:7275)ीय न(cid:7021)नत, उसक(cid:7409) (cid:7079)चालन योनिा, उसके ननदेक(cid:7298) सनहत र्आेदक संगठन क(cid:7409) दृन(cid:7397) से संर(cid:6979)ा से अनापन(cid:7275) ैिसे पहलु(cid:7312) और अ(cid:7008)य पहलू ोि नीनतगत दृन(cid:7397) से (cid:7079)(cid:7021)र्ता का नह(cid:7021)सा हो सकते ह(cid:7289), पर (cid:7007)यान देते (cid:7263)ए र्नचार करेगी।
(4) आरंनभक आ(cid:6979)ेप न होने का (cid:7079)माण प(cid:7074) नसि तारीख को ािरी (cid:7408)कया गया है उस तारीख से एकर् ष(cid:6981) छह मास क(cid:7409) र्अनध के नलए र्ननधमा(cid:7008)य होगा और इसे एक बार छह मास क(cid:7409) र्अनध के नलए र्न(cid:7021)ता(cid:7407)रत (cid:7408)कया ाि सके गा।

(iv) पैरा 6 और 7 का लोप (cid:7408)कया ािए;
(v) पैरा 8 म(cid:7286),-
(क) उप- पैरा (1) के नलए, नन(cid:7388)नलनखत उप-पैरा को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािए; अा(cid:6981)तः-
''(1) महाननदेक र्नमान (cid:7079)चालक (cid:7079)माण प(cid:7074) के र्आेदन पर या समय तेीि से र्नचार कर(cid:7286)गे और उनके इस बात से समाधान(cid:7079)द हो ािने पर (cid:7408)क र्आेदक ने र्ननहत अपे(cid:6979)ाएं पूरी कर दी है, र्नमान (cid:7079)चालक (cid:7079)माण प(cid:7074) ऐसी त(cid:7300) ोि उसम(cid:7286) र्ननन(cid:7416)द(cid:7397) क(cid:7409) ािएं, के अधीन (cid:7079)दान कर सक(cid:7286) गे;''
(ख) उप-पैरा (2) म(cid:7286), खंड (iii), (iv) और (v) का लोप (cid:7408)कया ािए;

''9. (1) र्नमान (cid:7079)चालक (cid:7079)माण प(cid:7074) पांच र्ष(cid:6981) से अनधक र्अनध ोि महाननदेक (cid:7367)ारा इसे (cid:7079)दान करते समय र्ननहत क(cid:7409) ािए, के नलए र्ननधमा(cid:7008)य नह(cid:7277) होगी और महाननदेक (cid:7367)ारा एक बार अनधकतम पांचर् ष(cid:6981) क(cid:7409) र्अनध के नलए इसका र्नीकरण इस बात का समाधान (cid:7079)द हो ािने पर (cid:7408)कया ाि सके गा (cid:7408)क धारक (cid:7079)माण प(cid:7074) के अधीन संतोष(cid:7079)द (cid:7272)प म(cid:7286) र्सेा(cid:7312) का नन(cid:7020)पादन कर रहा है औरर् ह र्सेाएं ािरी रखने म(cid:7286) स(cid:6979)म है।
(2) र्नमान (cid:7079)चालक (cid:7079)माण प(cid:7074) ािरी करने नलए बीस लाख (cid:7271)पये ता उसके र्नीकरण के नलए 10 लाख (cid:7271)पये क(cid:7409) (cid:7409)स संदेय होगी।
9क. इस अनुसूची के अधीन संदेय (cid:7409)स का भुगतान र्ेतन और लेखा काया(cid:6981)लय, महाननदेक नागर र्नमानन, नागर र्नमानन मं(cid:7074)ालय, नई (cid:7408)द(cid:7016)ली के प(cid:6979) म(cid:7286) ऑनलाइन या मांग देय (cid:7071)ा(cid:7010)ट के (cid:7367)ारा (cid:7408)कया ाि सके गा;''
(vii) पैरा 15 म(cid:7286), उप-पैरा (2) के खंड (ड.) के (cid:7021)ान पर, नन(cid:7388)नलनखत खंड(cid:7298) को (cid:7079)नत(cid:7021)ानपत (cid:7408)कया ािए, अा(cid:6981)त:-

(cid:7407)ट(cid:7009)पणः मूल ननयम तारीख 23 माच(cid:6981), 1937 क(cid:7409) अनधसूचना सं. र्ी-26 (cid:7367)ारा (cid:7079)कानत (cid:7408)कए गए और अंनतम संोधन तारीख 21 अ(cid:6989)तूबर, 2016 क(cid:7409) सा.का.नन अनधसूचना सं. 994(अ) (cid:7367)ारा (cid:7408)कए गए।

NOTIFICATION
New Delhi, the 28th November, 2016
G.S.R. 1112(E).—The following draft of certain rules further to amend the Aircraft Rules, 1937, which the Central Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act, 1934 (22 of 1934), is hereby published as required by section 14 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration after a period of thirty days from the date on which copies of the Gazette of India, in which this notification is published, are made available to the public;
Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite Safdarjung Airport, New Delhi-110003;
Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period specified above will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called the Aircraft(.....Amendment) Rules, 2016.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In Schedule XI to the Aircraft Rules, 1937,—
(i) in clause (ii) of paragraph 1,
(a) after sub-clause (a), the following Explanation shall be inserted, namely:-
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]"Explanation.- For the purposes of this sub-clause, the expression "principal place of business within India" means that the company or body corporate satisfies the following conditions, namely:-
(i) it has its headquarters in India where the senior management personnel like the Managing Director, Chief Executive Officer, Chief Financial Officer, etc., have their offices and operate from there on a regular basis;
(ii) it holds the meetings of its Board of Directors in India; and
(iii) it has its books of accounts at its headquarters in India.";
(b) for sub-clause (b), the following sub-clause shall be substituted, namely:-
"(b) at least one-third of its Directors are citizens of India and at least one of the posts of Chairman or Managing Director or Chief Executive Officer is held by an Indian citizen.";
(c) sub-clause (c) shall be omitted;
(ii) paragraphs 3 and 4 shall be omitted;
(iii) for paragraph 5, the following paragraph shall be substituted, namely:-
"5. (1) An application for Air Operator Certificate shall be made to the Director-General in such form and manner as may be specified by the Director-General which shall be signed by the applicant or by a person duly authorised in that behalf by the applicant and the application shall be made at least six months before the date on which it is planned to commence the scheduled air transport services.
(2) Before making the application to the Director-General, the applicant shall obtain an initial No Objection Certificate for his proposal from the Central Government by making an application to the Ministry of Civil Aviation in such form and manner as may be specified by the Director- General.
(3) For granting the initial no objection certificate, the Central Government shall consider the proposal taking into account factors such as the financial soundness of the applicant, his operational plan, the clearance from security angle of the applicant organisation including its Directors, and any other factor that may have a bearing on the proposal from policy angle.
(4) The initial no objection certificate shall be valid for a period of one and a half years from the date of issue and may be renewed for a further period of six months at a time.
(5) A fee of rupees fifty thousand shall be payable for making the application for initial no objection certificate and for each renewal thereof.";
(iv) paragraphs 6 and 7 shall be omitted;
(v) in paragraph 8,-
(a) for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:-
"(1) The Director-General shall consider the application for the Air Operator Certificate as speedily as possible and upon being satisfied that the applicant has met the laid down requirements, shall grant the Air Operator Certificate subject to such conditions as may be specified therein.";
(b) in sub-paragraph (2), clauses (iii), (iv) and (v) shall be omitted;
(vi) for paragraph 9, the following paragraphs shall be substituted, namely:-
"9. (1) The Air Operator Certificate shall be valid for a period not exceeding five years as may be fixed by the Director-General at the time it is granted and may be renewed by the Director- General for a maximum period of five years at a time upon being satisfied that the holder has been performing the services under the Certificate satisfactorily and has the capability to continue the services.
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(i)] 5(2) A fee of rupees twenty lakhs shall be payable for the issuance of an Air Operator Certificate and rupees ten lakhs for renewal thereof.
9A. The fees payable under this Schedule shall be paid by online or by Demand Draft drawn in favour of the Pay and Accounts Office, Director General of Civil Aviation, Ministry of Civil Aviation, New Delhi.";
(vii) in paragraph 15, for clause (e) of sub-paragraph (2), the following clauses shall be substituted, namely:-
"(e) that the permit was obtained by fraud; or
(f) that the security clearance of the company or the body corporate has been withdrawn or denied by the Central Government, Ministry of Home Affairs.".
