और बि(cid:7408)क, क(cid:7286) (cid:7076)ीय सरकार ने रा(cid:7020)(cid:7069)ीय रामिाग(cid:6981) अनधननयम, 1956 (1956 का 48) क(cid:7409) धारा 9 (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करत (cid:7263)ए रा(cid:7020)(cid:7069)ीय रामिाग(cid:7300) के खंड(cid:7298), (cid:7021)ायी पुल(cid:7298), बाइपास(cid:7298) और सुरंग(cid:7298) के उपयोग के नलए (cid:7409)स सं(cid:7061)हण हेतु सा.का.नन. 838(अ), (cid:7408)दनां(cid:7408)कत 05 (cid:7408)दसंबर, 2008 के तहत रा(cid:7020)(cid:7069)ीय रामिाग(cid:6981) (cid:7409)स (दर(cid:7298) का ननधा(cid:6981)रण र्एं सं(cid:7061)हण) ननयर्माली, 2008 तैयार क(cid:7409) है ता सा.का.नन. 950(अ), (cid:7408)दनां(cid:7408)कत 03 (cid:7408)दस(cid:7013)बर, 2010, सा.का.नन. 15(अ), (cid:7408)दनां(cid:7408)कत 12 र्निरी, 2011, सा.का.नन. 756(अ), (cid:7408)दनां(cid:7408)कत 12 अ(cid:6989)तूबर, 2011 और सा.का.नन. 778(अ), (cid:7408)दनां(cid:7408)कत 16 (cid:7408)दसंबर, 2013, सा.का.नन. 26(अ), (cid:7408)दनां(cid:7408)कत 16 र्निरी, 2014, सा.का.नन. 831(अ), (cid:7408)दनां(cid:7408)कत 21 र्नंबर, 2014 और सा.का.नन. 220(अ), (cid:7408)दनां(cid:7408)कत 23 माच(cid:6981), 2015 के तहत संोनधत क(cid:7409) है ।

अत: अब, रा(cid:7020)(cid:7069)ीय रामिाग(cid:6981) (cid:7409)स (दर(cid:7298) का ननधा(cid:6981)रण और सं(cid:7061)हण) ननयम, 2008 के ननयम 3 के सा प(cid:7407)ठत और समय-समय पर संोनधत (ोि इसके आगे ''ननयम'' के (cid:7272)प म(cid:7286) उन(cid:7016)लनखत है) रा(cid:7398)ीय रामिाग(cid:6981) अनधननयम, 1956 (1956 का 48) क(cid:7409) धारा 7 (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, के (cid:7008)(cid:7076)ीय सरकार, एतद् (cid:7367)ारा (cid:7079)ानधकारी को रा(cid:7020)(cid:7069)ीय रामिाग(cid:6981) 5625 GI/2016

1. इसके अंतग(cid:6981)त उदगृहीत और संगृहीत (cid:7409)स पकर (cid:7009)लााि(cid:7312) के नलए र्ननन(cid:7416)द(cid:7020)ट नर्नल दूरी हेतु नन(cid:7013)ननलनखत पकर (cid:7009)लााि(cid:7312) म(cid:7286) देय और भुगतान-यो(cid:6991)य होगी:-

2. उपयु (cid:6981)(cid:6989)त के अनत(cid:7407)र(cid:6989)त, टोल (cid:7009)लााि के नलए र्ननन(cid:7416)द(cid:7020)ट बाइपास क(cid:7409) नर्नल लंबाई के नलए नन(cid:7013)ननलनखत टोल (cid:7009)लााि पर 10 करो र्अा अनधक लागतर् ाले दो बाइपास(cid:7298) के (cid:7079)योग हेतु (cid:7409)स भी देय और भुगतान-यो(cid:6991)य होगी :-

3. उपयु (cid:6981)(cid:6989)त के अनत(cid:7407)र(cid:6989)त, टोल (cid:7009)लााि के नलए नन(cid:7013)ननलनखत टोल (cid:7009)लााि ((cid:7009)लााि(cid:7312)) पर 60 मीटर से अनधक लंबाई र्ाली नन(cid:7013)ननलनखत र्असंरचना(cid:7312) के उपयोग के नलए 10 के समतु(cid:7016)य कारक (cid:7367)ारा ऐसी र्असंरचना(cid:7312) क(cid:7409) लंबाई को गुणा करके रामिाग(cid:6981) क(cid:7409) समतु(cid:7016)य लंबाई म(cid:7286) र्असंरचना(cid:7312) क(cid:7409) लंबाई को प(cid:7407)र्र(cid:7414)तत करके नन(cid:7013)ननलनखत (cid:7409)स भी देय और भुगतान- यो(cid:6991)य होगी:-

4. गैरर्-ानणन(cid:6996)यक (cid:7079)योनि(cid:7298) के नलए पंीिकृ त यांन(cid:7074)क र्ाहन के (cid:7021र्)ामी और पकर (cid:7009)लााि से 20 (cid:7408)कमी क(cid:7409) दूरी के भीतर नर्नास करनेर् ाले (cid:7018)यन(cid:6989)त के नलए मानसक पास क(cid:7409) दरर् ष(cid:6981) 2016-17 के नलए 235.00 (cid:7271). (दो सौ प(cid:7289)तीस (cid:7271)पए मा(cid:7074)) है और यह रा(cid:7020)(cid:7069)ीय रामिाग(cid:6981) (cid:7409)स (दर(cid:7298) का ननधा(cid:6981)रण और सं(cid:7061)हण) ननयम, 2008 के उपबंध(cid:7298) के अनुसार (cid:7079)(cid:7004)येकर् ष(cid:6981) संोधन के अ(cid:7007)यधीन है ।

5. रामिाग(cid:6981) खंड पर ब(cid:7263)ल या(cid:7074)ा(cid:7312) के नलए नन(cid:7013)ननलनखत दर(cid:7298) पर पास ािरी (cid:7408)कए ािएंगे, अा(cid:6981)त्

(cid:7409)स (cid:7009)लााि न(cid:7021)त होनेर् ाले नलिे म(cid:7286) पंीिकृ तर् ानणन(cid:6996)यकर् ाहन(cid:7298) (रा(cid:7020)(cid:7069)ीय परनमट के अधीन (cid:7079)चानलत (cid:7408)कए ाि रहे र्ाहन(cid:7298) को छोकर) के नलए (cid:7409)स उस (cid:7088)ेणी के र् ाहन हेतु ननधा(cid:6981)(cid:7407)रत दर क(cid:7409) 50% होगी, बत(cid:7287) (cid:7408)क ऐसेर् ानणन(cid:6996)यकर् ाहन(cid:7298) के उपयोग के नलए कोई स(cid:7414र्)स रोड यार् ैकन(cid:7016)पक सक उपल(cid:7011)ध न ह(cid:7298) ।

7. ननयम(cid:7298) के अंतग(cid:6981)त संबंनधत (cid:7088)ेणी के र् ाहन(cid:7298) के नलए र्ननन(cid:7416)द(cid:7020)ट अनु(cid:6980)ेय भार से अनधक भार लदे यांन(cid:7074)कर् ाहन, उस दर पर (cid:7409)स का भुगतान करने का दानय(cid:7004र्) होगा ोि अगली उ(cid:6994)च (cid:7088)ेणी के र् ाहन(cid:7298) के नलए अनु(cid:7079)यो(cid:6996)य है औरर् ह रामिाग(cid:6981) खंड का उपयोग करने के नलए तब तक हदिार नह(cid:7277) होगा बि तक ऐसे यांन(cid:7074)कर् ाहन से लदा अनतभार हटाया नह(cid:7277) ािता ।

8. सभी प(cid:7407)रभाषाएं, यांन(cid:7074)कर् ाहन(cid:7298) क(cid:7409) (cid:7088)ेणी, इनके अनु(cid:6980)ेय भार, छू ट (cid:7079)ा(cid:7009)तर् ाहन(cid:7298) क(cid:7409) (cid:7088)ेणी, स(cid:7414र्)स रोड,र् ैकन(cid:7016)पक सक इ(cid:7004)या(cid:7408)द र्पू(cid:7299)(cid:6989)त ननयम(cid:7298) म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट प(cid:7407)रभाषा(cid:7312) के अनु(cid:7272)प ह(cid:7298)गी ।

9. (cid:7409)स क(cid:7409) दर(cid:7286) उ(cid:7334) ननयम के ननयम 12 के अनुसरण म(cid:7286) (cid:7079)यो(cid:6989)ता(cid:7312) के सूचना(cid:6981) (cid:7079)द(cid:7414)त करनी ह(cid:7298)गी ।

10. यांन(cid:7074)क र्ाहन(cid:7298) से (cid:7409)स क(cid:7409) र्ा(cid:7021)तर्नक रान तानलका-1 म(cid:7286) या-उन(cid:7016)लनखत आधार र्ष(cid:6981) 2007-08 के नलए (cid:7079)नत

(cid:7408)कमी (cid:7409)स क(cid:7409) आधार दर के आधार पर (cid:7079)भा(cid:7407)रत होगी और छू ट(cid:7298) क(cid:7409) गणना (cid:7079)ानधकरण (cid:7367)ारा खंड क(cid:7409) पूरी हो गई लंबाई के

आधार पर क(cid:7409) ािएगी और उसे उ(cid:6989)त ननयम(cid:7298) के ननयम 5 के अनुसार (cid:7079)नतर् ष(cid:6981) संोनधत (cid:7408)कया ािएगा ता तदनुसार उसे

अं(cid:7061)ेीि और (cid:6979)े(cid:7074)ीय भाषा के कम से कम एक-एक समाचार प(cid:7074) म(cid:7286) (cid:7079)कानत (cid:7408)कया ािएगा ।

11. प(cid:7407)रयोनिा क(cid:7409) अनुमाननत पू ंीिगत लागत 383.40 करो (cid:7271). है । चू ं(cid:7408)क भूनम अनध(cid:7061)हण, र्सा(cid:6981)निनक सुर्नधा(cid:7312) के

(cid:7021)ानांतरण, पे(cid:7298) को काटने आ(cid:7408)द काय(cid:6981)कलाप(cid:7298) को अभी पूरा (cid:7408)कया ािना है, इसनलए पू ंीिगत लागत प(cid:7407)र्रत(cid:6981)न के अ(cid:7007)यधीन है ।

अंनतम पू ंीिगत लागत को पृक (cid:7272)प से अनधसूनचत (cid:7408)कया ािएगा । (cid:7079)ा(cid:7009)त होनेर् ाली (cid:7079)यो(cid:6989)ता (cid:7409)स के मा(cid:7007)यम सेर् सूल क(cid:7409)

गई पू ंीिगत लागत का (cid:7079)ानधकरण (cid:7367)ारा (cid:7407)रकॉड(cid:6981) रखा ािएगा ता पू ंीिगत लागत क(cid:7409) र्सूली के प(cid:7019)चात् उद(cid:7061)ा(cid:7405) (cid:7409)स

NOTIFICATION

New Delhi, the 6th December, 2016

S.O. 3661(E).—Whereas by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways number S.O 1396(E) dated 28th May, 2014 issued under section 5 of the National Highways Act, 1956 (48 of 1956), the Central Government has entrusted the Suratgarh-Sriganaganar-Rajasthan/Punjab Border section of National Highway No. 15 [New National Highway No. 62] from existing km 173.000 [design km 173.000] to existing km 249.200 [design km 251.100] in the State of Rajasthan to the State Government of Rajasthan acting through the Chief Engineer [National Highways], Public Works Department, Government of Rajasthan (hereinafter referred to as the "Authority");

And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide G.S.R. 838(E) dated the 5th Dec, 2008, and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011 and G.S.R 778(E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014, G.S.R 831(E) dated 21st November, 2014 and G.S.R 220(E) dated 23rd March, 2015 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels;

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the "said Rules"), the Central Government hereby levies the fee at the base rate specified in column (2) of the Table 1 for net road section length of 59.7988 km [excluding 0.2512 km of structure (having length more than 60 m) with equivalent length of 2.512 km] for use of the Two Lane with paved shoulders section (hereinafter referred to as "base rate") and at 90% of the base rate for the bypasses having design length of 17.9006 km. [excluding 0.1494 km of structure (having length more than 60 m) with equivalent length of 1.494 km] on the Type of Vehicles specified in column (1) of the Table 1 below, for the use of the Suratgarh-Sriganaganar- Rajasthan/Punjab Border section of National Highway No. 15 [New National Highway No. 62] from existing km. 173.000 [design km. 173.000] to existing km. 249.200 [design km. 251.100] and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza:

2. In addition to above, the following fee shall also be due and payable for the use of the bypass(es) costing Rs 10 crore or more at the following Toll Plaza(s) for net bypass(es) length specified for such Toll Plaza:

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the toll plaza is Rs. 235.00 (Rupees Two Hundred Thirty Five only) for the year 2016-17 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles.

7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules.

9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules.

10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly.

11. The estimated capital cost of the project is Rupees 383.40 Crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
