का.आ. 3692(अ).—भारत सरकार ने पे(cid:7069)ोनलयम और खनन िपाइपलाईन (भूनम म(cid:7286) उपयोग के अनधकार का अ(िcid:6981)न) अनधननयम, 1962 (1962 का 50) (नसिे इसम(cid:7286) इसके प(cid:7019)चात् उ(cid:6989)त अनधननयम कहा गया है) क(cid:7409) धारा 3 क(cid:7409) उपधारा (1) के अधीन ािरी भारत सरकार के पे(cid:7069)ोनलयम और (cid:7079)ाकृ नतक गैस मं(cid:7074)ालय क(cid:7409) अनधसूचना सं(cid:6990)या का.आ. 2904(अ) तारीख 05.09.2016 (cid:7367)ारा; उस अनधसूचना से संल(cid:6991)न अनुसूची म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट भूनम म(cid:7286) गेल (इन(cid:7003)डया) नलनमटेड (cid:7367)ारा उ(cid:7004)तर (cid:7079)दे रा(cid:6996)य म(cid:7286) र्नयिपुर-औरया-ू लपुर पाईप लाईन के मा(cid:7007)यम से (cid:7079)ाकृ नतक गैस के प(cid:7407)र्रहन के नलए पाइपलाईन नबछाने के (cid:7079)योनि के नलए उपयोग के अनधकार का अ(िcid:6981)न करने के अपने आय क(cid:7409) घोषणा क(cid:7409) ी;

और उ(cid:6989)त रापिन(cid:7074)त अनधसूचना क(cid:7409) (cid:7079)नतयां निता को उपल(cid:7011)ध करा दी गई ी;

और स(cid:6979)म (cid:7079)ानधकारी ने निता से (cid:7079)ा(cid:7009)त आ(cid:6979)ेप(cid:7298) को परी(cid:6979)ण के उपरांत अ(cid:7021र्)ीकृ त कर (cid:7408)दया है;

और स(cid:6979)म (cid:7079)ानधकारी ने, उ(cid:6989)त अनधननयम क(cid:7409) धारा 6 क(cid:7409) उपधारा (1) के अधीन भारत सरकार को अपनी (cid:7407)रपोट(cid:6981) दे दी है;

और भारत सरकार ने, उ(cid:6989)त (cid:7407)रपोट(cid:6981) पर र्नचार करने के प(cid:7019)चात् और यह संतु(cid:7397) हो ािने पर (cid:7408)क उ(cid:6989)त भूनम पाइपलाइन(cid:7286) नबछाने के नलए अपेन(cid:6979)त है, उस म(cid:7286) उपयोग के अनधकार का अ(िcid:6981)न करने का र्ननन(cid:7019)चय (cid:7408)कया है;

अत: अब, भारत सरकार, उ(cid:6989)त अनधननयम क(cid:7409) धारा 6 क(cid:7409) उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए, यह घोषणा करती है (cid:7408)क इस अनधसूचना से संल(cid:6991)न अनुसूची म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट भूनम म(cid:7286) पाइपलाइन(cid:7286) नबछाने के नलए उपयोग के अनधकार का अ(िcid:6981)न (cid:7408)कया ािता है;

और, भारत सरकार, उ(cid:6989)त अनधननयम क(cid:7409) धारा 6 क(cid:7409) उपधारा (4) (cid:7367)ारा (cid:7079)द(cid:7004)त न(cid:6989)तय(cid:7298) का (cid:7079)योग करते (cid:7263)ए, ननद(cid:7287) देती है (cid:7408)क पाइपलाइन(cid:7286) नबछाने के नलए भूनम म(cid:7286) उपयोग का अनधकार, इस घोषणा के (cid:7079)कान क(cid:7409) तारीख को, भारत सरकार म(cid:7286) नननहत होने के बािए, पाइपलाइन(cid:7286) नबछाने का (cid:7079)(cid:7021)र्ता करनेर् ाली गेल (इन(cid:7003)डया) नलनमटेड म(cid:7286) नननहत होगा और तदुप(cid:7407)र, भूनम म(cid:7286) ऐसे उपयोग का अनधकार, इस (cid:7079)कार अनधरोनपत ननबंधन(cid:7298) और त(cid:7299) के अधीन रहते (cid:7263)ए, सभी र्न(cid:7016)लंगम(cid:7298) से मु(cid:6989)त, गेल (इन(cid:7003)डया) नलनमटेड म(cid:7286) नननहत होगा।

NOTIFICATION

New Delhi, the 29th November, 2016

S.O. 3692(E).—Whereas by notification of Government of India in Ministry of Petroleum and Natural Gas numbers S.O. 2904(E) dated 05.09.2016; issued under sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of Users in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act), Government of India declared its intention to acquire the Right of User in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transportation of natural gas through Vijaipur-Auraiya-Phulpur pipeline in the State of Uttar Pradesh by GAIL (India) Limited;

And whereas copies of the said Gazette notification were made available to the public;

And whereas the objections received from the public to the laying of the pipeline have been considered and disallowed by the competent authority;

And whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted its report to Government of India;

And whereas Government of India after considering the said report and on being satisfied that the said land is required for laying the pipelines, has decided to acquire the Right of User therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, Government of India hereby declares that the Right of User in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;

And, further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the land for laying the pipeline shall, instead of vesting in Government of India, vest, on this date of the publication of the declaration, in the GAIL (India) Limited, free from all encumbrances.
