(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः, अब, के (cid:7008)(cid:7076)ीय सरकार, पया(cid:6981र्)रण (संर(cid:6979)ण) ननयम, 1986 के ननयम 5 के उपननयम (3) और पया(cid:6981र्)रण (संर(cid:6979)ण) अनधननयम, 1986 (1986 का 29) क(cid:7409) धारा 3 क(cid:7409) उपधारा (2) के खंड (v) और खंड (xiv) के सा प(cid:7407)ठत उपधारा (1) (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए, म(cid:7007)य (cid:7079)दे रा(cid:6996)य म(cid:7286) घाटीर्गां (cid:7263)कनार् (cid:7008)र्यीि अभयार(cid:7003)य पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन (नसिे इसम(cid:7286) इसके प(cid:7391)ात् पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन कहा गया है) घाटीर्गां (cid:7263)कना अभयार(cid:7003)य क(cid:7409) सीमा 100 मीटर से 2 (cid:7408)कलोमीटर सीमा (cid:6979)े(cid:7074) को अनधसूनचत करती है, नसिका र्र्नरण नन(cid:7388)ानुसार है, अा(cid:6981)त् :-
1. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का र्न(cid:7021)तार और उसक(cid:7409) सीमाएं--(1) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का र्न(cid:7021)तार घाटीर्गां (cid:7263)कनार् (cid:7008)र्यीि अभयार(cid:7003)य क(cid:7409) सीमा से 100 मीटर से 2 (cid:7408)कलोमीटर र्न(cid:7021)तार के सा 1100.4601र् ग(cid:6981) (cid:7408)कलोमीटर (cid:6979)े(cid:7074) पर ै ला (cid:7263)आ है और ीिपीएस ननद(cid:7287)ांक के सा सीमा कार् ण(cid:6981)न उपाबंध Iक म(cid:7286) (cid:7408)दया गया है ।
(2) अ(cid:6979)ां, देांतर और सीमा (cid:7011)यौरे के सा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन का माननच(cid:7074) (cid:7059)मः उपाबंध Iख और III के (cid:7272)प म(cid:7286) उपाब(cid:7373) है ।
(3) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन नलिा र्नपुरी, म(cid:7007)य (cid:7079)दे के अंतग(cid:6981)त आनेर् ाले 13 (cid:7061)ाम(cid:7298) तक ै ला (cid:7263)आ है और पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के 100 मीटर और 2 (cid:7408)कलोमीटर के भीतर आनेर् ाले (cid:7061)ाम(cid:7298) क(cid:7409) सूची उपाबंध II के (cid:7272)प म(cid:7286) उपाब(cid:7373) है ।
2. पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आंचनलक महायोनिा – (1) रा(cid:6996)य सरकार, पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए रापि(cid:7074) म(cid:7286) अंनतम अनधसूचना के (cid:7079)कान क(cid:7409) तारीख से दोर् ष(cid:6981) क(cid:7409) र्अनध के भीतर, (cid:7021)ानीय (cid:7390)न(cid:7334)य(cid:7298) के पराम(cid:6981) से और इस अनधसूचना म(cid:7286) संल(cid:6991)न अनुबंध(cid:7298) के सामं(िcid:7021)य से आंचनलक महायोनिा तैयार करेगी ।
(2) आचंनलक महायोनिा रा(cid:6996)य सरकार म(cid:7286) स(cid:6979)म (cid:7079)ानधकारी (cid:7367)ारा अनुमो(cid:7408)दत होगी ।
(3) रा(cid:6996)य सरकार (cid:7367)ारा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के नलए आचंनलक महायोनिा इस तरह, इस अनधसूचना म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट (cid:7272)प ता सुसंगत क(cid:7286) (cid:7076)ीय और रा(cid:6996)य र्ननधय(cid:7298) के सामं(िcid:7021)य और क(cid:7286) (cid:7076)ीय सरकार (cid:7367)ारा ािरी माग(cid:6981)ननद(cid:7287)(cid:7298), य(cid:7408)द कोई ह(cid:7298), (cid:7367)ारा तैयार होगी ।
(4) आंचनलक महायोनिा, पया(cid:6981र्)रणीय और पा(cid:7407)रन(cid:7021)नतक र्नचार(cid:7298) को समाकनलत करने के नलए रा(cid:6996)य सरकार के सभी संब(cid:7373) र्नभाग(cid:7298) के पराम(cid:6981) से तैयार होगी, अा(cid:6981)त्:--
(i) पया(cid:6981र्)रण ;
(ii)र् न ;
(iii) नगर र्नकास ;
(iv) पय(cid:6981)टन ;
(v) नगरपानलका ;
(vi) रा(िcid:7021र्) ;
(vii) कृ नष ;
(viii) म(cid:7007)य (cid:7079)दे रा(cid:6996)य (cid:7079)दूषण ननयं(cid:7074)ण बोड(cid:6981) ;
(ix) (cid:7410)सचाई ; और
(x) लोक ननमा(cid:6981)ण र्नभाग।
(5) आंचनलक महायोनिा अनुमो(cid:7408)दत र्न(cid:7378)मान भू-उपयोग, र्असंरचना(cid:7004)मक और (cid:7408)(cid:7059)याकलाप(cid:7298) पर कोई ननब(cid:7304)धन अनधरोनपत नह(cid:7277) करेगी बि तक (cid:7408)क इस अनधसूचना म(cid:7286) इस (cid:7079)कार से र्ननन(cid:7416)द(cid:7020)ट न हो और आचंनलक महायोनिा म(cid:7286) सभी र्असंरचना के र्नकास ता (cid:7408)(cid:7059)याकलाप(cid:7298) को और अनधक द(cid:6979) और पा(cid:7407)रन(cid:7021)नतक अनुकू ल (cid:7271)प म(cid:7286) (cid:7059)मगनणत ह(cid:7298)गे ।
(6) आंचनलक महायोनिा म(cid:7286) अना(cid:6994)छा(cid:7408)दत (cid:6979)े(cid:7074)(cid:7298) के ीिण(cid:7299)(cid:7373)ार, र्न(cid:7378)मान लि ननकाय(cid:7298) के संर(cid:6979)ण, र्आाह (cid:6979)े(cid:7074)(cid:7298) के (cid:7079)बंधन, लि-संभर(cid:7298) के (cid:7079)बंधन, भूतल लि के (cid:7079)बंधन, मृदा और नमी संर(cid:6979)ण, (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) र्आ(cid:7019)यकता(cid:7312) ता पा(cid:7407)रन(cid:7021)नतक और पया(cid:6981र्)रण से संबंनधत ऐसे अ(cid:7008)य पहलू(cid:7312), ननि पर (cid:7007)यान देना र्आ(cid:7019)यक है, के नलए उपबंध ह(cid:7298)गे ।
(7) आंचनलक महायोनिा सभी र्न(cid:7378)मान उपासना (cid:7021)ल(cid:7298), (cid:7061)ाम(cid:7298) और नगरीय बंदोब(cid:7021)त(cid:7298), र्न(cid:7298) के (cid:7079)कार और (cid:7408)क(cid:7021)म(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), ऊपािऊ भूनम, ह(cid:7407)रत (cid:6979)े(cid:7074) ैिसे उ(cid:7378)ान और उसी (cid:7079)कार के (cid:7021)ान, उ(cid:7378)ान कृ नष (cid:6979)े(cid:7074), लो(cid:7378)ान, झील(cid:7298) और अ(cid:7008)य लि ननकाय(cid:7298) का अ(cid:7012)यकं न करेगी ।
(8) आंचनलक महायोनिा पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286) र्नकास को पा(cid:7407)रन(cid:7021)नतक अनुकू ल र्नकास और (cid:7021)ानीय समुदाय(cid:7298) क(cid:7409) ीिर्कोपा(िcid:6981)न को सुननन(cid:7019)चत करते (cid:7263)ए र्नननयनमत होगी ।
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 33. रा(cid:6996)य सरकार (cid:7367)ारा (cid:7408)कए ािनेर् ाले उपाय-- रा(cid:6996)य सरकार इस अनधसूचना के उपबंध(cid:7298) को (cid:7079)र्भाी करने के नलए नन(cid:7388)नलनखत उपाय करेगी, अा(cid:6981)त् :--
(1) भू-उपयोग - पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन म(cid:7286)र् न(cid:7298), उ(cid:7378)ान-कृ नष (cid:6979)े(cid:7074)(cid:7298), कृ नष (cid:6979)े(cid:7074)(cid:7298), आमोद-(cid:7079)मोद के (cid:7079)योनि के नलए नचन(cid:7008)हत (cid:7408)कए गए पाक(cid:7300) और खुले (cid:7021)ान(cid:7298) कार् ानणन(cid:6996)यक और औ(cid:7378)ोनगक संब(cid:7373) र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए उपयोग या संप(cid:7407)र्रत(cid:6981)न नह(cid:7277) होगा:
परंतु पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर कृ नष भूनम का संप(cid:7407)र्रत(cid:6981)न, मानीटरी सनमनत क(cid:7409) नसा(cid:7407)र पर और रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन से, (cid:7021)ानीय नर्नानसय(cid:7298) क(cid:7409) र्आासीय (िcid:7272)रत(cid:7298) को पूरा करने के नलए और पैरा 4 क(cid:7409) सारणी के (cid:7021)तंभ (2) के अधीन मद सं012, 20, 25,33 और सं. 36 के सामने सूचीब(cid:7373) (cid:7408)(cid:7059)याकलाप(cid:7298) को पूरा करने के नलए अनु(cid:6980)ात ह(cid:7298)गे, अा(cid:6981)त् :-
(i) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) से संबंनधत पय(cid:6981)टक(cid:7298) के अ(cid:7021)ायी अनधभोग के नलए नलए पा(cid:7407)रन(cid:7021)नतक अनुकू ल कु टीर ैिसे ट(cid:7289)ट, लकी के मकान आ(cid:7408)द;
(ii) र्न(cid:7378)मान सक(cid:7298) को चौा करना और उ(cid:7008)ह(cid:7286) सुदृढ करना ता नई सक(cid:7298) का संननमा(cid:6981)ण;
(iii) (cid:7079)दूषण उ(cid:7004)प(cid:7382) न करनेर् ाले लघु उ(cid:7378)ोग;
(iv)र् षा(cid:6981) लि संचय;
(v) कु टीर उ(cid:7378)ोग(cid:7298) म(cid:7286) (cid:7061)ाम उ(cid:7378)ोग, भंडारण क(cid:7409) सुर्नधा और (cid:7021)ानीय सुख-सुर्नधाएं सन(cid:7013)मनलत ह(cid:7289) :
परंतु यह और (cid:7408)क रा(cid:6996)य सरकार के र्पू(cid:6981) अनुमोदन और संर्नधान के अनु(cid:6994)छेद 244 या त(cid:7004)समय (cid:7079र्)ृ(cid:7275) र्ननध के उपबंध(cid:7298) के अनुपालन के नबना, नसिके अंतग(cid:6981)त अनुसूनचत निािनत और अ(cid:7008)य परंपरागतर् न नर्नासी र्(न अनधकार(cid:7298) क(cid:7409) मा(cid:7008)यता) अनधननयम, 2006 (2007 का 2) भी है,र् ानणन(cid:6996)यक या उ(cid:7378)ोग र्नकास (cid:7408)(cid:7059)याकलाप(cid:7298) के नलए निाितीय भूनम का उपयोग अनु(cid:6980)ात नह(cid:7277) होगा :
परंतु यह और भी (cid:7408)क पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर भू-अनभलेख(cid:7298) म(cid:7286) उपसंाित कोई (cid:7074)ु(cid:7407)ट, मानीटरी सनमनत के र्नचार (cid:7079)ा(cid:7385) करने के प(cid:7391)ात् रा(cid:6996)य सरकार (cid:7367)ारा (cid:7079)(cid:7004)येक मामले म(cid:7286) एक बार संोनधत होगी और उ(cid:7334) (cid:7074)ु(cid:7407)ट के संोधन क(cid:7409) क(cid:7286) (cid:7076)ीय सरकार के पया(cid:6981र्)रण, र्न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय को सूचना देनी होगी ।
परंतु यह और भी (cid:7408)क उपयु (cid:6981)(cid:7334) (cid:7074)ु(cid:7407)ट का संोधन म(cid:7286) इस उप पैरा के अधीन या उपबंनधत के नर्साय (cid:7408)कसी भी दा म(cid:7286) भू-उपयोग का प(cid:7407)र्रत(cid:6981)न सन(cid:7013)मनलत नह(cid:7277) होगा ।
परंतु यह और भी (cid:7408)क नसिसे ह(cid:7407)रत (cid:6979)े(cid:7074) म(cid:7286) ैिसेर् न (cid:6979)े(cid:7074), कृ नष (cid:6979)े(cid:7074) आ(cid:7408)द म(cid:7286) कोई पा(cid:7407)रणानमक कटौती नह(cid:7277) होगी और अन(cid:7079)यु(cid:6989)त या अनु(cid:7004)पादक कृ नष (cid:6979)े(cid:7074)(cid:7298) म(cid:7286) पुन:र् नीकरण करने के (cid:7079)यास (cid:7408)कए ािएंगे ।
(2) पय(cid:6981)टन – (क) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप, ोि पय(cid:6981)टन महायोनिा का भाग (cid:7272)प म(cid:7286) नन(cid:7388)नलनखत ह(cid:7298)गे।
(ख) पय(cid:6981)टन महायोनिा पय(cid:6981)टन र्नभाग, (cid:7367)ारा रा(िcid:7021र्) औरर् न र्नभाग और पया(cid:6981र्)रण र्नभाग के पराम(cid:6981) से तैयार होगी ।
(ग) पय(cid:6981)टन संबंधी (cid:7408)(cid:7059)याकलाप नन(cid:7013)ननलनखत के अधीन र्नननयनमत ह(cid:7298)गे, अा(cid:6981)त् :-
(i) पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन के भीतर सभी नए पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) या र्न(cid:7378)मान पय(cid:6981)टन (cid:7408)(cid:7059)याकलाप(cid:7298) का र्न(cid:7021)तार क(cid:7286) (cid:7076) सरकार के पया(cid:6981र्)रण, र्न और र्लिायु प(cid:7407)र्रत(cid:6981)न मं(cid:7074)ालय के माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के (cid:7367)ारा ता रा(cid:7020)(cid:7069)ीय (cid:7018)या(cid:7062) संर(cid:6979)ण (cid:7079)ानधकरण, (cid:7367)ारा ािरी पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन (समय-समय पर या संोनधत) माग(cid:6981)द(cid:6981)क नस(cid:7373)ांत(cid:7298) के अनुसार, पा(cid:7407)रन(cid:7021)नतक पय(cid:6981)टन, पा(cid:7407)रन(cid:7021)नतक न(cid:6979)ा और पा(cid:7407)रन(cid:7021)नतक र्नकास को मह(cid:7004र्) देते (cid:7263)ए पा(cid:7407)रन(cid:7021)नतक र्संेदी ोिन क(cid:7409)र् हन (cid:6979)मता के अ(cid:7007)ययन पर आधा(cid:7407)रत होगा;
(ii) पा(cid:7407)रन(cid:7021)नतक अनुकू ल पय(cid:6981)टक (cid:7408)(cid:7059)याकलाप(cid:7298) के संबंध म(cid:7286) अ(cid:7021)ायी अनधभोग के नलएर् ास सुर्नधा के नर्साय घाटीर्गां (cid:7263)कना र्(cid:7008)र्यीि अभयार(cid:7003)य क(cid:7409) सीमा से एक (cid:7408)कलोमीटर भीतर होटल और (cid:7407)रसोट(cid:7300) का नया संननमा(cid:6981)ण अनु(cid:6980)ात नह(cid:7277) होगा ;

NOTIFICATION
New Delhi, the 13th December, 2016
S.O. 4031(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O 2700 (E), dated the 5th October 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And WHERAS, the copies of the Gazette containing the said notification were made available to the public on the 5th October 2015.
And WHERAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification.
And WHERAS, the Ghatigaon Hukna Wildlife Sanctuary situated near village Ghatigaon, in Gwalior District and lying between 26o to 26o15' north latitude and 77o50'to 78o12 east longitude notified vide Government of Madhya Pradesh notification No. 15-16-75 Das-2, dated the Ist May, 1981 is spread over an area of 512 square kilometres ;
AND WHEREAS, the Ghatigaon Hukna Wildlife Sanctuary is an ideal habitat of Great Indian Bustard (Ardeotis nigriceps) and the other main fauna of the sanctuary are Cheetal (Axis axix), Chinkara (Gazella sp.), Nelgai (Boselephus sp.), Hyena (Hyaena sp.), Bear (Ursus sp.), crocodile (Crocodylus sp.), Kingfisher (Alcedo sp.);
AND WHEREAS, the main flora of the sanctuary are Khair (Acacia sp.), Gurjan (Dipterocarpus turbinatus), Tendu (Diospyros melanoxylon), Palas (Butea monosperma) and Reonjha (Acasia sp.) etc. and open medos are at places covered with low bushes of Zizyphus sp. Bhuy bhushi (Eragrostis tenelle) Lapurse (Aristida by sterix) and Bhanjura (Apluda mutica) are some of the grasses present in the area;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification, around the protected area of Ghatigaon Hukna Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1), clauses (V) and (xiv) of sub section (2) and sub section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area varying from 100 meters to 2 kilometers around the boundary of the Ghatigaon Hukna Wildlife Sanctuary in the State of Madhya Pradesh as Ghatigaon Hukna Wildlife Sanctuary Eco- sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are on under, namely :-

Extent and boundaries of Eco-sensitive Zone.- (1)The Eco-Sensitive Zone is spread over an area of 1100.4601 square kilometers with an extent varying from 100 meters to 2 kilometers around the boundary of Ghatigaon Hukna Wildlife Sanctuary and the boundary description along with Geographical Positioning System coordinates is given in Annexure-IA.
(2) The maps of the Eco-sensitive Zone along with latitudes, longitudes and boundary details are appended as Annexures I-B and III respectively.
(3) The Eco-sensitive Zone is spread over 13 villages falling in Shivpuri District of Madhya Pradesh and the list of villages falling within 100 meter and 2 kilometers of the Eco-sensitive Zone is appended as Annexure-II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Madhya Pradesh State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(5) The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 20, 25, 33 and 36 in column (2) of the Table in paragraph 4, namely:-
भारत का राजपत्रा : असाधरण [भाग II—खण्ड 3(ii)] 13(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) small scale industries not causing pollution;
(iv) rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Tourism.- (a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Ghatigaon Hukna Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities :
Provided that beyond the distance of one kilometer from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.
(3) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(4) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(5) Noise pollution.- The Environment Department of the State Government or Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.
(6) Air pollution.- The Environment Department of the State Government or Madhya Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)](7) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time.
(10) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(11) Industrial units
(a) No establishment of new wood based Industries within the Eco-sensitive Zone shall be permitted except the existing wood based Industries set up as per the law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco -sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) Divisional Commissioner, Gwalior -Chairman;
(b) Chief Conservator of Forest, Lion Project, Gwalior-Member;
(c) District Collector, district Gwalior-Member;
(d) Superintending Engineer Public Work Department,Gwalior-Member;
(e) Superintending Engineer Public Health Department,Gwalior- Member;
(f) Chief Executive Officer of Jila Panchayat Secretary-Member;
(g) One representative of None Governmental Organisation working in the field of environment to be nominated by the Government of Madhya Pradesh for a period of three years-Member;
(h) An expert in the area of ecology and environment to be nominated by the Government of Madhya Pradesh for a period of three years-Member;
(i) District Officer of the Town and Country Planning Department-Member;
(j) Regional Officer Madhya PradeshPollution Control Board, Gwalior-Member;
(k) Member of Biodiversity Board- Member ;
(l) Wildlife Warden of the Ghatigaon Wildlife Sanctuary, Gwalior-Member -Secretary.
6. Terms of reference.- 1. The tenure of the Monitoring Committee shall be three years.
2. The Monitoring Committee shall monitor the compliance of the provisions of this notification.
3. The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.
4. The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.
5. The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
6. The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.
7. The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV.
8. The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court of India or the High Court or National Green Tribunal .
